IMPLEMENTATION OF AGRICULTURAL INSURANCE ASSISTANCE POLICIES
Pursuant to the Law on Government Organization dated June 19, 2015; Law on Amendments to some Articles of the Law on Amendments to some Articles of the Law on Government Organization and Law on Local Government Organization dated November 22, 2019;
Pursuant to the Law on Insurance Business dated December 09, 2000; Law on Amendments to some Articles of the Law on Insurance Business dated November 24, 2010;
Pursuant to the National Assembly’s Resolution No. 32/2016/QH14 dated November 23, 2016 on further raising capacity and the effectiveness in implementation of the national target programme on new rural construction associated with agricultural restructuring;
Pursuant to the Government’s Decree No. 58/2018/ND-CP dated April 18, 2018 on agricultural insurance;
At the request of the Minister of Finance and the Minister of Agriculture and Rural Development;
The Prime Minister hereby promulgates a Decision on implementation of agricultural insurance assistance policies.

This Decision provides for the implementation of agricultural insurance assistance policies in accordance with the Government’s Decree No. 58/2018/ND-CP dated April 18, 2018, including eligible agricultural producers, eligible plants, domestic animals and aquaculture species; subsidized coverage; levels of subsidies; eligibility period for subsidies; eligible areas; funding allocated by the central government budget to local government budgets for grant of agricultural insurance subsidies.
This Decision applies to:
1. Organizations and individuals engaging in planting of rice, rubber, pepper, cashew and coffee trees; breeding of buffaloes, cows and pigs and farming of giant tiger prawns, whiteleg shrimps and pangasius fish which are subject to clause 2 Article 22 of the Government’s Decree No. 58/2018/ND-CP dated April 18, 2018.
2. Non-life insurers, branches of foreign non-life insurers, and reinsurers that are established, organized and operate in accordance with the Law on Insurance Business and relevant law provisions.
3. Other authorities, organizations and individuals involved in the implementation of agricultural insurance assistance policies.

Article 3. Insured subjects eligible for premium subsidies
1. Plants: Rice, rubber, pepper, cashew and coffee trees.
2. Domestic animals: buffaloes, cows, pigs.
3. Aquaculture species: giant tiger prawns, whiteleg shrimps and pangasius fish.
Article 4. Levels of premium subsidies
1. Agricultural producers that are poor households or near-poor households as defined in the Government Decree’s Decision No. 07/2021/ND-CP dated January 27, 2021 on multidimensional poverty levels in the 2021 - 2025 period and its amending and/or superseding documents (if any): the maximum subsidy specified in clause 1 Article 19 of the Decree No. 58/2018/ND-CP and amending or replacing documents will be granted.
2. Agricultural producers other than poor households and near-poor households specified in clause 1 of this Article: the maximum subsidy specified in clause 2 Article 19 of the Decree No. 58/2018/ND-CP and its amending and/or superseding documents (if any) will be granted.
3. Agricultural producers: the maximum subsidy specified in clause 3 Article 19 of the Decree No. 58/2018/ND-CP and amending or replacing documents (if any) will be granted if the following regulations are satisfied:
a) Agricultural producers must be enterprises established in accordance with the Law on Enterprises or cooperatives established in accordance with the Law on Cooperatives.

c) Agricultural products which are eligible for agricultural insurance subsidies must be issued with foods quality and safety certificate by competent authorities or they are recognized as agricultural enterprises applying high technology according to regulations of law on criteria, power and procedures for recognizing enterprises applying high technology.
Article 5. Insured risks eligible for premium subsidies
1. Subsidized rice, rubber, pepper, cashew and coffee tree insurance coverage:
a) Natural disasters afflicting rice, including: storms, tropical depressions, whirlwinds, thunderlike, heavy rain, floods, flash floods, inundation, landslides or land subsidence caused by floods or runoffs, sea level rise, saltwater intrusion, extreme heat, drought, damaging cold, hail, frost, earthquake and tsunami. Such disaster events must be announced or confirmed by competent authorities.
Natural disasters afflicting rubber, pepper, cashew and coffee trees, including: storms, tropical depressions, whirlwinds, thunderlike, floods, flash floods, inundation, hail, frost. Such disaster events must be announced or confirmed by competent authorities.
b) Diseases affecting rice, including: rice grassy stunt virus, rice ragged stunt virus, southern rice black streaked dwarf virus, rice blast disease, bacterial leaf blight, bacterial leaf streak; brown planthopper and rice stem borer outbreaks; stem borers, leaf rollers, gall midges; rats. Such epidemics must be announced or confirmed by competent authorities. Such diseases must be announced or confirmed by competent authorities.
Insurance does not cover diseases affecting rubber, pepper, cashew and coffee tree.
2. Subsidized buffalo, cow and pig insurance coverage
a) Natural disasters, including: storms, tropical depressions, whirlwinds, thunderlike, heavy rain, floods, flash floods, inundation, landslides or land subsidence caused by floods or runoffs, extreme heat, drought, damaging cold, hail, frost, earthquake and tsunami. Such disaster events must be announced or confirmed by competent authorities.

3. Subsidized insurance coverage on giant tiger prawns, whiteleg shrimps and pangasius fish
a) Natural disasters, including: storms, tropical depressions, whirlwinds, thunderlike, heavy rain, floods, flash floods, inundation, landslides or land subsidence caused by floods or runoffs, sea level rise, saltwater intrusion, extreme heat, drought, damaging cold, hail, frost, earthquake and tsunami. Such disaster events must be announced or confirmed by competent authorities.
b) Diseases: Insurance does not cover diseases affecting giant tiger prawns, whiteleg shrimps and pangasius fish.
Article 6. Areas eligible for premium subsidies
1. With regard to plants:
a) With regard to rice, subsidies will be granted in the following provinces: Thai Binh, Nam Dinh, Nghe An, Ha Tinh, Binh Thuan, An Giang and Dong Thap.
b) With regard to rubber trees, subsidies will be granted in the following provinces: Kon Tum, Gia Lai, Dak Lak, Binh Thuan, Binh Phuoc, Tay Ninh, Binh Duong and Dong Nai.
c) With regard to coffee trees, subsidies will be granted in the following provinces: Son La, Kon Tum, Gia Lai, Dak Lak, Dak Nong, Lam Dong and Binh Phuoc.
d) With regard to pepper trees, subsidies will be granted in the following provinces: Gia Lai, Dak Lak, Dak Nong, Binh Phuoc, Dong Nai and Ba Ria - Vung Tau.

2. With regard to domestic animals:
a) With regard to buffaloes and cows, subsidies will be granted in the following provinces and central-affiliated cities: Ha Giang, Vinh Phuc, Hanoi, Thanh Hoa, Nghe An, Binh Dinh, Gia Lai, Dak Lak, Lam Dong, Dong Nai and Binh Duong.
b) With regard to pigs, subsidies will be granted in the following provinces and central-affiliated cities: Bac Giang, Hanoi, Thai Binh, Nam Dinh, Thanh Hoa, Nghe An, Binh Dinh, Dak Lak and Dong Nai.
3. With regard to giant tiger prawns, whiteleg shrimps and pangasius fish, subsidies will be granted in the following provinces: Ben Tre, Tra Vinh, Soc Trang, Bac Lieu and Ca Mau.
People's Committees of provinces and central-affiliated cities defined in clause 1, clause 2 and clause 3 of this Article shall organize selection of areas for grant of agricultural insurance subsidies according to clause 2 Article 21 of the Government’s Decree No. 58/2018/ND-CP dated April 18, 2018.
Article 7. Eligibility period for premium subsidies
Agricultural insurance premium subsidies shall be granted from the effective date of this Decision to December 31, 2025, inclusively.
The maximum subsidy shall be granted according to the Prime Minister’s Decision No. 127/QD-TTg dated January 24, 2022 and its amending and/or superseding documents (if any).

1. This Decision comes into force from June 24, 2022 to December 31, 2025, inclusively.
2. This Decision supersedes the Prime Minister’s No. 22/2019/QD-TTg dated June 26, 2019 and Decision No. 03/2021/QD-TTg dated January 25, 2021.
Article 10. Responsibility for implementation
1. The Ministry of Finance shall take charge and cooperate with relevant authorities in reviewing, evaluating and suggesting the draft Decision on agricultural insurance assistance policies for the period after 2025.
2. Minister of Finance, Minister of Agriculture and Rural Development, heads of ministerial agencies, heads of Governmental agencies and Chairmen/Chairwomen of People’s Committees of provinces and central-affiliated cities are responsible for the implementation of this Decision.
