OUTCOMES OF REVIEW OF NEW EXPORTERS IN THE CASE OF IMPOSITION OF ANTI-DUMPING MEASURES ON PLASTICS AND ARTICLES THEREOF MADE OF POLYMERS OF PROPYLENE ORIGINATING FROM THE PEOPLE’S REPUBLIC OF CHINA, THE KINGDOM OF THAILAND AND MALAYSIA (CASE: NR01.AD07)

Pursuant to the Law No. 05/2017/QH14 on Foreign Trade Management dated June 12, 2017;

Pursuant to Government’s Decree No. 10/2018/ND-CP dated January 15, 2018 on guidelines for the Law on Foreign Trade Management on trade remedies;

Pursuant to Government’s Decree No. 96/2022/ND-CP dated November 29, 2022 on functions, tasks, powers and organizational structure of the Ministry of Industry and Trade;

Pursuant to Circular No. 37/2019/TT-BCT dated November 29, 2019 of the Minister of Industry and Trade on provision of detailed regulations on trade remedies;

Pursuant to Decision No. 2639/QD-BCT dated December 02, 2022 of the Minister of Industry and Trade on functions, tasks, powers and organizational structure of the Trade Remedies Authority of Vietnam;

Pursuant to Decision No. 2400/QD-BCT dated November 14, 2022 of the Minister of Industry and Trade on review of new exporters in the case of imposition of anti-dumping duty on plastics and articles thereof made of polymers of propylene originating from the People’s Republic of China, the Kingdom of Thailand and Malaysia (case: NR01.AD07);  

Pursuant to Decision No. 197/QD-BCT dated February 09, 2023 of the Minister of Industry and Trade on extension of the duration of review of new exporters in the case of imposition of anti-dumping measures on plastics and articles thereof made of polymers of propylene originating from the People’s Republic of China, the Kingdom of Thailand and Malaysia;

At the request of the Director of the Trade Remedies Authority of Vietnam.

HEREBY DECIDES:

Article 1. The anti-dumping duty shall be imposed on SRF Industries (Thailand) Limited on the basis of the outcomes of review of new exporters in the case of imposition of anti-dumping measures on plastics and articles thereof made of polymers of propylene originating from the People’s Republic of China, the Kingdom of Thailand and Malaysia (case: NR01 .AD07) at the following rate:

Article 2. Procedures for imposition of anti-dumping measures shall comply with law regulations on anti-dumping actions against imports into Vietnam, the law on import and export duties and relevant laws.

Article 3. Other contents shall be implemented in accordance with Decision No. 1403/QD-BCT dated July 15, 2022 of the Minister of Industry and Trade on outcomes of first review of imposition of anti-dumping measures on plastics and articles thereof made of polymers of propylene originating from the People’s Republic of China, the Kingdom of Thailand and Malaysia.

Article 4. This Decision comes into force 15 days after the date of its promulgation.
