DECISION

PLAN FOR\r\nIMPLEMENTING UNITED NATIONS’ GLOBAL COMPACT FOR SAFE, ORDERLY AND REGULAR\r\nMIGRATION

PRIME MINISTER

Pursuant to the Law on Government Organization\r\ndated June 19, 2015;

Pursuant to Decision No. 1676/QD-TTg dated\r\nDecember 3, 2018 of the Prime Minister approving Global Compact for Safe,\r\nOrderly and Regular Migration (GCM) and Global Compact on Refugees (GCR) of the\r\nUnited Nations;

At request of Ministry of Foreign Affairs under\r\ndocuments No. 5165/TTr-BNG-LS dated December 31, 2019, 556/BNG-LS dated February\r\n24, 2020, and 898/BNG-LS dated March 16, 2020,

HEREBY DECIDES:

Article 1. The Plan for implementing United\r\nNations’ Global Compact for Safe, Orderly and Regular Migration (hereinafter\r\nreferred to as “Plan”) is promulgated as follows:

1. Objectives\r\n

a) Show Vietnam's resolution and responsibility for\r\nimplementing the United Nations’ Global Compact for Safe, Orderly and Regular\r\nMigration (GCM) in a manner satisfactory to Vietnam’s policies, regulations,\r\nand conditions in order to effectively manage migration for the goal of\r\nsustainable development.

b) Identify priority fields, objectives, contents,\r\nand roadmaps for implementing the GCM; extensively utilize available resources\r\nin Vietnam and call for support from international community.

c) Improve quality and effectiveness of\r\ninternational migration management via close and regular cooperation and\r\nparticipation of the entire political system and society in order to facilitate\r\na migration environment that is transparent, accessible, and respectful for\r\nmigrants’ dignity, and protecting migrants' legitimate rights and benefits,\r\nespecially certain groups, women and children.

2. Requirements\r\n

a) The implementation of the Plan must conform to\r\nregulations and law, National target programs, National strategies, and\r\nsocio-economic development programs and plans of Vietnam in addition to\r\nrelevant international commitments to which Vietnam is a signatory; adhere to\r\npractical situation, revolve around the human factor, and contain gender and\r\nsustainable development details.

b) Develop regulations on regular cooperation in\r\norder to ensure effectiveness in implementation of the Plan; increase\r\nleadership and coordination of authorities, cooperation between agencies during\r\nimplementation.

c) Popularization and guidance on implementation of\r\nthe GCM must be implemented on a regular, timely, and adequately basis and\r\naiming at ministries, departments, relevant agencies, organizations and\r\nindividuals.

II. CORE TASKS

a) Popularize, motivate, and raise awareness about\r\nthe GCM and international migration issues (legal, safe migration; illegal\r\nmigration; human trafficking; etc.), aim towards state authorities, law\r\nenforcement authorities relating to international migration, socio-political\r\norganizations, socio-professional organizations, relevant agencies,\r\norganizations, enterprises, and the general public. Dissemination must suit\r\ngender, age, ethnicity, education level, local characteristics, accessibility,\r\netc. and come in a variety of format.

b) Upload clear and transparent information on\r\nmigration (guidance, counseling, recommendation, warning relating to\r\ninternational migration; foreign labor market; visa issue policy; rights of\r\nmigrants, etc.) on website of Ministry of Foreign Affairs.

c) Improve capacity of officials of all levels\r\n(especially in grassroots level), departments, authorities, organizations\r\nengaging in the implementation of GCM in order to increase effectiveness in\r\nmanaging migration, assisting and protecting migrants, especially certain\r\ngroups, children, women, and ethnics.

2. Collect\r\ninformation and data on migration of Vietnamese nationals travelling abroad and\r\nforeigners entering Vietnam.

a) Monitor, review, update information and data\r\nregarding international migration (employment; study; marriage involving\r\nforeign factor; adoption involving foreign factor; illegal migration; human\r\ntrafficking; forced labor; returning migrants; etc.); continue to manage and\r\neffectively utilize relevant database.

b) Research and integrate details relating to\r\nmigration in population and housing census to additionally inspect migration\r\nsituation (causes of migration; latest date of entry, exit; country of\r\nresidence within 5 years prior to the population and housing census, etc.).

c) Apply information technology in registering and\r\nassisting Vietnamese nationals residing overseas and include basic information\r\non Vietnamese nationals migrating overseas for a variety of purposes.

b) Research, develop national database on migration\r\nbased on connection and integration with other relevant databases in order to\r\neffectively utilize and serve the making of policies and regulations on\r\nmigration.

3. Improve\r\npolicies, regulations, and organize implementation.

b) Continue to effectively implement approved\r\nprograms and plans relating to international migration.

c) Review, complete, and promulgate solutions,\r\nsocio-economic policies suitable with Vietnam’s situations (policies on poverty\r\nreduction, social security, sustainable occupation, gender equality,\r\nempowerment of women and girls, etc.) in order to minimize factors leading to\r\nillegal migration, help the general public make right decisions regarding\r\nmigration, contribute towards fulfillment of comprehensive and sustainable\r\ndevelopment and “no one left behind”.

d) Integrate migration issues in the National\r\naction plan for Parliamentary procedure of 2030 for sustainable development,\r\nreview, update, and promote implementation of this Plan.

4. Research\r\nand predict situations, policies of other countries and territories relating to\r\nmigration issues.

a) Research, analyze, and predict worldwide and\r\nregional situations, potentials that can affect migration and migrants\r\n(political unrest, natural disaster, epidemic, climate change, cross-border\r\npollution, etc.) to allow relevant individuals, agencies, and organizations to\r\nstay informed and develop response, warning measures in order to protect\r\nlegitimate rights and benefits of migrants.

b) Look into and assess regulations, policies of\r\ncountries and territories regarding international migration (visa, insurance,\r\noccupation, residence, nationality, civil registration, social security\r\npolicies for migrants and punitive regulations for violation of the laws of\r\nhost countries, etc.), especially prediction of newer trends to promptly propose\r\namendments to policies accordingly.

c) Continue to monitor overseas Vietnamese and\r\nforeigners in Vietnam in order to propose appropriate solutions for effectively\r\nmanaging and enabling migrants to reintegrate with community, gain equal\r\nchances in study, occupation, development, and exercise their role and\r\ncontribute to socio-economic development of the country.

5. Increase\r\ninternational cooperation in implementation of GCM.

a) Actively engage in international and regional\r\nforums regarding migration in order to affirm Vietnam’s responsibilities and\r\nefforts in resolving worldwide issues.

c) Organize effective implementation of international\r\ntreaties, agreements, and conventions regarding migration to which Vietnam is a\r\nsignatory while adhering to Vietnam’s laws and conditions; assess results and\r\npropose solutions.

d) Attract and utilize international resources in\r\nimplementation of the GCM to increase capacity of relevant Vietnamese\r\nauthorities and effectiveness of migration management.

III. ORGANIZING\r\nIMPLEMENTATION

1. Assign:\r\n

a) Ministry of Foreign Affairs to:

- Guide, supervise, assess,\r\nand consolidate information on implementation of the Plan, and report to the\r\nPrime Minister annually; organize assessment and conclusion of implementation\r\nof the Plan; develop national assessment report on implementation of the GCM.

- Advise the Government and\r\nPrime Minister to develop regulations and policies regarding international\r\nmigration that fit policies, regulations, conditions of Vietnam and\r\ninternational practices.

- Research and develop\r\nnational migration database and cooperate with Ministry of Planning and\r\nInvestment in integrating details relating to migration in population and\r\nhousing census.

- Develop regulations on\r\ncooperation in protecting legitimate rights and benefits of overseas Vietnamese\r\ndepending on migration situation of nationals.

b) Ministry of Public Security shall take charge\r\nand cooperate with ministries, departments, and local governments in advising\r\nthe Government and Prime Minister to improve policies and regulations on\r\nmanaging foreigners in Vietnam relating to the GCM.

c) Ministry of Justice shall take charge and\r\nresearch policies, regulations on nationality, civil registration of migrants\r\nand relevant international migration issues.

d) Ministry of National Defense shall take charge\r\nand cooperate with ministries, departments, and local governments in\r\nstrengthening border management, combating and preventing illegal migration,\r\nfacilitation of illegal migration, human trafficking.

e) Ministry of Labor - War Invalids and Social\r\nAffairs shall take charge and cooperate with ministries, departments, and local\r\ngovernments in advising the Government and Prime Minister to improve policies\r\nand regulations on migrant workers, increase solutions for managing the provision\r\nof guest worker service, and improve quality of workers engaging in guest\r\nworker service.

g) Ministry of Information and Communications shall\r\ntake charge and cooperate with Ministry of Foreign Affairs and relevant\r\nministries, departments, and local governments in publicizing, educating, and\r\nraising awareness of the general public and society about issues pertaining to\r\ninternational migration, migration and sustainable development, GCM, and\r\nimplementation of GCM.

h) People’s Committees of provinces or central-affiliated\r\ncities to:

- Integrate implementation of\r\nthe Plan with socio-economic development programs in their provinces in order\r\nto minimize factors that lead to illegal migration and human trafficking.

- Direct local authorities to\r\nstrengthen security and order relating to migration activities in provinces;\r\nacknowledge number of Vietnamese nationals migrating overseas, foreigners in\r\ntheir provinces, and returning migrants to devise appropriate management and\r\nsupport measures.

i) Ministries, departments, and local authorities\r\nshall implement tasks assigned under the Plan and Appendix attached hereto;\r\nprovide data relating to international migration to Ministry of Foreign Affairs\r\nevery 6 months and send report on implementation of the Plan to Ministry of\r\nForeign Affairs every year before November 15 for consolidation and report to\r\nthe Prime Minister.

3. Expenditure\r\non implementation of the Plan shall be guaranteed from state budget and\r\nmobilized from donations, support, and other legitimate financial sources as\r\nper the law.

- In case of state budget,\r\nbased on specific tasks, ministries, central departments, and local governments\r\nshall integrate with programs, projects, and schemes within annual state budget\r\nestimates.

- In case of new tasks that\r\nare not integrated with programs, projects, and schemes in implementation,\r\nministries, departments, and local authorities shall produce expenditure\r\nestimates and consolidate in annual state budget estimates of agencies,\r\nentities, and send to financial authorities of the same level and request\r\ncompetent authorities to allocate funding for implementation in accordance with\r\nthe Law on State Budget and guiding documents.

4. If\r\nspecific details need to be revised or added during implementation of the Plan,\r\nrelevant ministries, departments, local authorities, and organizations shall\r\nnotify and discuss in order to allow Ministry of Foreign Affairs to research\r\nand report to the Prime Minister.

Article 2. This Decision comes into effect\r\nfrom the day of signing.

Article 3. Ministers, heads of ministerial\r\nagencies, heads of Governmental agencies, Chairpersons of People’s Committees\r\nof provinces and central-affiliated cities and heads of relevant agencies are\r\nresponsible for implementation of this Decision./.
