ACTION PROGRAM OF THE GOVERNMENT FOR IMPLEMENTATION OF RESOLUTION NO. 28-NQ/TW DATED MAY 23, 2018 OF THE 7TH MEETING OF THE 12TH CENTRAL EXECUTIVE COMMITTEE ON REFORM OF SOCIAL INSURANCE POLICIES

THE GOVERNMENT

Pursuant to Law on Government Organization dated June 19, 2015;

Pursuant to Resolution No. 28-NQ/TW dated May 23, 2018 of 7th meeting of the 12th Central Executive Committee on reform of social insurance policies;

At request of Minister of Labor – War Invalids and Social Affairs,

HEREBY RESOLVES:

Article 1. Attached to this Resolution is action program of the Government for implementation of Resolution No. 28-NQ/TW dated May 23, 2018 of the 7th meeting of the 12th Central Executive Committee on reform of social insurance policies.

Article 2. This Resolution comes into effect from the date of signing.

Article 3. Related ministers, heads of ministerial agencies, heads of Governmental agencies, Chairman of the Provincial People’s Committee, organizations and individuals are responsible for the implementation of this Resolution./.

ACTION PROGRAM OF THE GOVERNMENT

IMPLEMENTATING RESOLUTION NO. 28-NQ/TW DATED MAY 23, 2018 OF THE 7TH MEETING OF THE 12TH CENTRAL EXECUTIVE COMMITTEE ON REFORM OF SOCIAL INSURANCE POLICIES
(Attached to Resolution No. 125/NQ-CP dated October 9, 2018 of the Government)

The 7th meeting of the 12th Central Executive Committee has approved Resolution No. 28-NQ/TW dated May 23, 2018 on social insurance reform (hereinafter referred to as “Resolution No. 28-NQ/TW”) with general objectives of “Reforming social insurance to turn social insurance into the core structure of social security system, firmly expand coverage of social insurance step-by-step in order to achieve nationwide social insurance. Develop social insurance system in a flexible, diversified, multilayered, modern and internationally integrated manner following the principles of paying – benefiting, equality, sharing and sustaining. Enhance capacity and effectiveness of state management and implement social insurance policies concisely, professionally, modernly, effectively, reliably and transparently”.

Based on objectives, reform categories, tasks and solutions under Resolution No. 28-NQ/TW, the Government promulgates the Action program with following main points:

I. OBJECTIVES AND REQUIREMENTS

1. Conduct research, comprehend thoroughly and stringently, effectively implement Resolution No. 28-NQ/TW, create noticeable shifts in awareness and actions of leaders of different sectors, levels, employees and employers.

2. Generally identify primary, specific and feasible tasks, utilize roles and responsibilities of sectors and fields to enable the Government, ministries, ministerial agencies, Governmental agencies, People’s Committees of provinces or central-affiliated cities (hereinafter referred to as local authorities) to focus on successfully directing and organizing implementation of general and specific tasks of Resolution No. 28-NQ/TW.

3. Based on functions, tasks and practical conditions, ministers, heads of ministerial agencies, heads of Governmental agencies, Chairpersons of People’s Committees of provinces and central-affiliated cities and heads of national administrative agencies are responsible for actively organizing implementation of tasks and solutions in a synchronized, complete, weighted and consistent manner, satisfactory to appropriate roadmap with high determination, great efforts and thorough, effective actions.

4. Strive to achieve specific objectives:

a) Until 2021:

Endeavor to ensure approximately 35% of workforce within appropriate age participate in social insurance, in which number of farmers and employees in informal economic sectors participating in voluntary social insurance account for 1% of workforce within appropriate age; approximately 28% of workforce within appropriate age participate in unemployment insurance; approximately 45% of individuals within retirement age receive pensions, monthly social insurance and social retirement benefits; rate of electronic transactions reaches 100%; implement level 4 public online services; reduce transaction hours between social insurance agencies with ASEAN 4 enterprises; satisfaction rating of social insurance participants reaches 80%.

b) Until 2025:

Endeavor to ensure approximately 45% of workforce within appropriate age participate in social insurance, in which number of farmers and employees in informal economic sectors participating in voluntary social insurance account for 2% of workforce within appropriate age; approximately 35% of workforce within appropriate age participate in unemployment insurance; approximately 55% of individuals within retirement age receive pensions, monthly social insurance and social retirement benefits; satisfaction rating of social insurance participants reaches 85%.

c) Until 2030:

Endeavor to ensure approximately 60% of workforce within appropriate age participate in social insurance, in which number of farmers and employees in informal economic sectors participating in voluntary social insurance account for 5% of workforce within appropriate age; approximately 45% of workforce within appropriate age participate in unemployment insurance; approximately 60% of individuals within retirement age receive pensions, monthly social insurance and social retirement benefits; satisfaction rating of social insurance participants reaches 90%.

II. PRIMARY TASKS AND MEASURES

1. Enhance communicating, publicizing and raising awareness on social insurance policies, unemployment insurance and create consensus in reforming social insurance policies.

a) Ministries and local governments shall cooperate closely with organizations affiliated to the Communist Party and committees of the Communist Party of the same levels in organizing research, thoroughly comprehending Resolution No. 28-NQ/TW, focusing on objectives, orientation, reforms, tasks and solutions for reformation of social insurance, unemployment insurance for the entire employees, public employees and workers under management; cooperate with Vietnam Fatherland Front, trade unions and socio-economic organizations in selecting practical contents of social insurance policies and reformation to publicize and distribute to employees and the general public.

b) Ministry of Labor – War Invalids and Social Affairs shall take charge and cooperate with Vietnam Social Security and relevant ministries in conducting research on complete renovation of contents, form and methods of publicizing satisfactory to properties and characteristics of each group of recipients and regions to ensure publicizing effectiveness together with development of social insurance participants, attract positive participation of farmers and employees in informal economic sectors; focus and utilize roles of reputable organizations and individuals in the community to mobilize the general public to participate in voluntary social insurance.

c) Ministry of Information and Communications shall direct and instruct press, radio and television agencies to publicize and distribute far and wide and spend appropriate runtime on publicizing Resolution No. 28-NQ/TW to create consensus among society, ministries and enterprises in implementing reformation of social insurance policies.

d) Vietnam Television and Voice of Vietnam shall take charge and cooperate with Ministry of Labor – War Invalids and Social Affairs and Vietnam Social Security in developing contents, categories and spending appropriate periodic runtime to publicize, popularize and explain policies, regulations and law related to social insurance.

2. Continue development of legal systems on labor, employment, social insurance, unemployment insurance and relevant law provisions to institutionalize reforms of social insurance policies

a) Thoroughly inspect applicable legal systems on social insurance, unemployment insurance and relevant law provisions to serve as the basis for proposing legislative document development program in order to institutionalize reforms of social insurance policies.

Ministry of Labor – War Invalids and Social Affairs shall take charge and cooperate with relevant ministries and agencies in inspecting legal systems on social insurance, unemployment insurance and relevant law provisions on labor, salaries, employment, social protection, persons having rendered meritorious services, social policies, civil laws, criminal laws, administrative laws, etc., and submitting to Prime Minister to hand over to competent agencies capable of developing and requesting competent authorities in issuing appropriate documents on amendments or annulment.

b) Implement pilot flexible short-termed voluntary social insurance package; issue policies when eligible.

Ministry of Labor – War Invalids and Social Affairs shall take charge and cooperate with relevant ministries in conducting research and requesting Prime Minister to implement pilot flexible short-termed voluntary social insurance package to enable employees to have multiple options and benefits; monitor, conclude and assess pilot implementation and report to the Government for presentation to the National Assembly for consideration and decision upon amendments of the Law on Social Insurance.

c) Amend relatively independent pensions in relationship with salaries of active employees.

Ministry of Labor – War Invalids and Social Affairs shall take charge and cooperate with relevant ministries in developing schemes for amending relatively independent pensions in relationship with salaries of active employees, changing methods of amending pensions to sharing and reporting to the Government for consideration and decision.

d) Conduct research and develop roadmap for increasing retirement age; amend regulations on salaries to facilitate identification of payment basis of social insurance of enterprises during amendment progress of the Labor Code.

Ministry of Labor – War Invalids and Social Affairs shall take charge and cooperate with relevant ministries in conducting research, requesting the Government to consider and requesting the National Assembly to amend the Labor Code to increase retirement in order to match the roadmap from 2021; amend regulations on salaries to enable identification of payment basis of social insurance of enterprises to equal to at least 70% of total salaries and other equivalent incomes of employees; amend regulations on employment management and employment relationships during the 4th industrial revolution in order to increase coverage of social insurance.

dd) Amend Law on Vietnamese guest workers.

Ministry of Labor – War Invalids and Social Affairs shall take charge and cooperate with relevant ministries in conducting research and proposing amendments to Law on Vietnamese guest workers to prescribe participation in compulsory social insurance of Vietnamese guest workers, benefiting of social insurance after concluding period of working abroad; simultaneously promote negotiating and entering into bilateral agreements on social insurance.

e) Conclude and assess implementation of financial assistance policies for social insurance of employees participating in voluntary social insurance.

Ministry of Labor – War Invalids and Social Affairs shall take charge and cooperate with Ministry of Finance, Vietnam Social Security and local governments in concluding and assessing implementation of financial assistance policies for social insurance of employees participating in voluntary social insurance to develop voluntary social insurance policies with appropriate assistance from state budget for farmers, poor people, low earners and employees in informal economic sectors to expand coverage of social insurance; increase awareness and responsibilities of employees for ensuring self-security in order to achieve effective multilayered social insurance systems.

g) Amend unemployment insurance policies and employment policies.

Ministry of Labor – War Invalids and Social Affairs shall take charge and cooperate with relevant ministries in conducting research and amending Law on employment, unemployment insurance and employment insurance by focusing on not only rectifying measures for unemployed persons via paying unemployment benefit, providing vocational training and education, skill improvement to satisfy requirements of new occupations and job placement but also development of measures to prevent and minimize unemployment via assisting enterprises and employees in maintaining jobs, assuring reasonable rights of enterprises and employees in maintaining jobs, assuring reasonable rights of enterprises and employees to boost connection and support among social insurance policies and flexibility of policies to expand the coverage.

h) Amend Law on Social Insurance.

Ministry of Labor – War Invalids and Social Affairs shall take charge and cooperate with relevant ministries and organizations in assessing 5 years of implementing Law on Social Insurance dated 2014, Resolution No. 93/2015/QH13 dated June 22, 2015 of National Assembly on implementing lump-sum payment of social insurance benefits to employees, Law on Occupation safety and hygiene on occupational hazard insurance, occupational diseases together with conducting research and assessing impact of new policies in order to report to the Government for presentation to the National Assembly for consideration and amendments to Law on Social Insurance in form of reducing minimum participation in social insurance required for retirement benefits; adjusting methods of calculating pensions following the principles of paying – benefiting, equality, sharing and sustaining; including beneficiaries of other insurance to beneficiaries of compulsory social insurance; boosting benefits if remaining period of social insurance is reserved for retirement regimes, reducing benefits if taking lump-sum payment of social insurance; amending regulations on social insurance amounts and basis to increase coverage of social insurance; adjusting accumulating rate to achieve maximum pension benefit rate satisfactory to international practices; developing and taking actions against violations against regulations and law on social insurance, especially evading payment, owing payment or abusing social insurance. 

3. Increase capacity and effectiveness of state management regarding social insurance

a) Develop and implement effectively scheme for assignment of developing participants of social insurance in provinces.

Ministry of Labor – War Invalids and Social Affairs shall take charge and cooperate with Ministry of Finance, Ministry of Planning and Investment and Vietnam Social Security in developing scheme for assignment of developing participants of social insurance in provinces; organize training and thoroughly publicize to initiate implementation from 2019.

b) Develop scheme for renovating and improving capacity and effectiveness of state management and quality, effectiveness of social insurance implementation.

Ministry of Labor – War Invalids and Social Affairs shall take charge and cooperate with Ministry of Home Affairs and Vietnam Social Security in renovating and increasing capacity and effectiveness of state management and quality, effectiveness of social insurance, in which criteria for assessing results of task execution and quality of service provision of social insurance agencies, satisfaction ratings of participants and beneficiaries of social insurance policies.

c) Stringently manage investment in social insurance fund, ensure safety, sustainability and effectiveness.

Ministry of Finance shall take charge and cooperate with Vietnam Social Security and relevant ministries in developing scheme for improving efficiency of social insurance fund management and investment by diversifying categories, ensuring safety, sustainability and effectiveness of investment and proposing to the Government; prioritize investment in government bonds, especially long-term government bonds; conduct research on expanding into highly profitable sectors, develop roadmap for investing part of the idle money of the fund via domestic and international investment trust while ensuring safety and sustainability.

d) Enhance connection of data on medical examination and treatment.

Ministry of Health shall take charge and cooperate with ministries in developing and introducing to Prime Minister scheme for enhancing connection of database on medical examination and treatment; data on issuance of documents and instrument serving as the basis for implementing social insurance policies, processing and paying social insurance to prevent abuse or exploitation of social insurance payment.

dd) Cooperate, share and connect information and data among regulatory agencies specialized in investment, financial, tax, labor and social insurance.

Ministry of Labor – War Invalids and Social Affairs shall take charge and cooperate with Ministry of Finance, Ministry of Planning and Investment, Vietnam Social Security and relevant agencies in developing documents providing guidelines for improving cooperation, share and connection of information and data among regulatory agencies specialized in investment, tax and labor and proposing the Prime Minister to issue in order to improve effectiveness of managing participants of social insurance and implementing social insurance.

e) Enhance inspection and monitoring of compliance with regulations and law on social insurance and unemployment insurance.

Ministry of Labor – War Invalids and Social Affairs shall take charge and cooperate with Vietnam Social Security and relevant agencies in enhancing inspection and monitoring of compliance with regulation and law on social insurance and unemployment insurance; promptly detect and take serious actions against violations, especially evading payment, owing payment, committing fraud or abusing social insurance and unemployment insurance.

4. Improve administration capacity and effectiveness of implementing social insurance and unemployment insurance policies

a) Develop organizational structures implementing social insurance policies.

Vietnam Social Security shall take charge and cooperate with ministries in developing scheme for research for organizing structure of Vietnam Social Security in an ordered, capable and effective manner according to Resolution No. 10/NQ-CP dated February 3, 2018 of the Government on Action program of the Government in implementation of Resolution No. 18-NQ/TW dated October 25, 2017 of the 6th Meeting of the 12th Central Executive Committee on difficulties in reforming and organizing structures of political systems in a concise, capable and effective manner; Plan No. 07-KH/TW dated November 27, 2017 of Politburo implementing Resolution 18-NQ/TW and Resolution No. 56/2017/QH14 dated November 24, 2017 of National Assembly on reforming and organizing structures of political systems in a concise, capable and effective manner.

b) Develop and improve operation capacity of Management Board of Vietnam Social Security.

The Management Board of Vietnam Social Security shall develop scheme for developing and improving operation capacity of the Management Board of Vietnam Social Security and propose to the Prime Minister.

c) Conduct research on entrusting collection of social insurance.

Vietnam Social Security shall take charge, cooperate with relevant ministries in conducting research on difficulties in entrusting collection of social insurance and Prime Minister.

d) Promote administrative procedures reform and implement level 4 online public services.

Vietnam Social Security shall take charge and cooperate with ministries in developing scheme for reforming administrative procedures, implementing level 4 online public services, promoting development of national database on social insurance and ensuring data connection and share with relevant national databases.

dd) Complete construction and operation of electronic database on managing social insurance on a nationwide scale.

Vietnam Social Security shall take charge and cooperate with relevant ministries in ensuring completion of development and operation of electronic database on managing social insurance in a synchronized, unified and transparent manner on a nationwide scale, connecting with relevant national databases, serving and improving effectiveness of state management on social insurance.

e) Improve operation capacity and effectiveness of agencies and entities implementing unemployment insurance policies.

Ministry of Labor – War Invalids and Social Affairs shall take charge and cooperate with relevant ministries in developing scheme for improving operation capacity and effectiveness of agencies and entities implementing unemployment insurance policies, focusing on organizational structure, personnel and financial mechanism to ensure that unemployment insurance to be the tool for administering employment market.

5. Execute international integration in social insurance

a) Negotiate and sign bilateral agreements on social insurance

Ministry of Labor – War Invalids and Social Affairs shall take charge and cooperate with ministries in negotiating and signing bilateral agreements on social insurance; prioritize countries that receive the majority of Vietnamese guest workers and countries where many Vietnamese guest workers operate.

b) Developing plans to approve agreements and recommendations of International Labor Organization on social insurance

Ministry of Labor – War Invalids and Social Affairs shall take charge and cooperate with ministries and international organizations in developing plans to approve agreements and recommendations of International Labor Organization on social insurance.

III. IMPLEMENTATION

1. Ministers, heads of ministerial agencies, Chairpersons People’s Committees of provinces and central-affiliated cities, heads of Governmental agencies within their tasks, powers and functions shall be assigned to direct, develop and issue plans for implementing Resolution No. 28-NQ/TW and this Resolution of the Government within the 3rd quarter of 2018; organize implementation of action plans of ministries; before November 30 every year, submit reports on implementing resolutions to Ministry of Labor – War Invalids and Social Affairs for consolidation and submission to the Government and Prime Minister.

2. Ministry of Labor - War Invalids and Social Affairs:

a) Monitor and expedite implementation of the Action program; in December each year, consolidate implementation progress, report and propose the Government and Prime Minister necessary measures to ensure synchronized and effective implementation of the Action plan; stringently comply with relevant categories in working regimes of the Central Executive Committee of Communist Party, Politburo, Secretariat, National Assembly and Standing Committee of National Assembly to submit reports as per the law.

b) Cooperate with relevant ministries affiliated to the Government and agencies authorized by the Communist Party, National Assembly, Vietnamese Fatherland Front and socio-political organizations in implementing objectives, reforms, tasks and solutions of the Action program of the Government in implementation of Resolution No. 28-NQ/TW in an effective and synchronized manner.

3. Assign Ministry of Finance and Ministry of Labor - War Invalids and Social Affairs to: conduct research and propose solutions for guaranteeing resources for implementing Action program of the Government for implementation of Resolution No. 28-NQ/TW; develop mechanisms for mobilizing private sector involvement, policies and funding sources from central government budget satisfactory to Law on state budget, Law on Social Insurance and documents providing guidelines, which particularly focuses on resources and mechanisms for implementing policies on social pension and assistance to enable farmers, poor people, low earners and employees in informal economic sectors to participate in voluntary social insurance.

4. Vietnam Social Security shall simultaneously implement objectives, reforms, tasks and solutions of the Action program of the Government in implementation of Resolution No. 28-NQ/TW and guidelines of competent agencies; submit periodic reports before the 5th of the first month of the quarter or when requested for implementation results of Resolution No. 28-NQ/TW to enable Ministry of Labor - War Invalids and Social Affairs and Ministry of Finance to consolidate and submit reports to the Government and competent authorities.

5. Request the Central Committee of Vietnam Fatherland Front, Central Vietnam Women's Union, Vietnam General Confederation of Labor, Central Vietnam Farmers' Union and other member organizations to cooperate with relevant agencies during implementation of this Action program; promote publicizing and educating to raise awareness of benefits and obligations for participating in social insurance for members of their organizations; monitor implementation of the Action program.

6. Difficulties that arise during the implementation should be reported to Ministry of Labor – War Invalids and Social Affairs for consolidation and report to the Government for consideration and solution./.
