CIRCULAR
PROMULGATING NATIONAL TECHNICAL REGULATION AND REGULATIONS ON INSPECTION AND MONITORING OF DOMESTIC WATER QUALITY
Pursuant to the Government’s Decree No. 117/2007/ND-CP dated July 11, 2007 on clean water production, supply and consumption; Government's Decree No. 124/2011/ND-CP dated December 28, 2011 on amendments to some Articles of the Government’s Decree No. 117/2007/ND-CP dated July 11, 2007 on clean water production, supply and consumption;
Pursuant to the Decree No. 75/2017/ND-CP dated June 20, 2017 defining functions, tasks, entitlements and organizational structure of the Ministry of Health;
At the request of the Director of the Health Environment Management Agency;
The Minister of Health hereby promulgates a Circular on national technical regulation and regulations on inspection and monitoring of domestic water quality.
Article 1. Promulgation of Regulation
The National technical regulation on domestic water quality is promulgated together with this Circular;
Article 2. Regulations on inspection and monitoring of domestic water quality
1. The results of testing of domestic water quality parameters specified Clauses 2 and 3 Article 5 of the Regulation promulgated together with this Circular shall be made publicly available by the water supplier within 3 days from the date on which results are available on its website (if a website is not available, the water supplier shall be posted at its office. To be specific:
a) Total number of water samples and sampling locations.
b) Parameters and results of testing of each water sample.
c) Remedial measures taken if any parameter fails the Regulation, and time limit for implementation thereof.
2. The competent authority shall carry out an external inspection of implementation of regulations on assurance of domestic water quality by every water supplier as follows:
a) Inspect the testing of domestic water quality parameters specified Clauses 2 and 3 Article 5 of the Regulation promulgated together with this Circular; documents about monitoring and management of domestic water quality; publishing of information about domestic water quality according to Clause 1 Article 2 of this Circular;
b) Collect samples and test domestic quality parameters specified in Clauses 2 and 3 Article 5 of the Regulation promulgated together with this Circular.
c) Within 5 days from the date on which results of external inspection of domestic water quality are obtained, the external inspecting authority shall notify the inspected water supplier in writing thereof; publish the results on its website; notify the following information to the unit selecting the water supplier and supervisory authority of the inspected water supplier (if any):
- Name of the inspected water supplier.
- Results of inspection of contents specified in Clause 1 Article 2 of this Circular.
3. External inspection frequency:
a) Each water supplier shall undergo an external inspection once a year.
b) An unscheduled external inspection shall be conducted when:
- the water supplier’s periodic and ad hoc reports on water quality give rise to suspicions about finished water quality.
- there is an environmental emergency that may affect water quality.
- results of the water quality inspection or epidemiological investigation show that the water source is potentially polluted.
- any organization or individual complains about water quality.
- it is requested by a competent authority.
Article 3. Effect
1. This Circular comes into force from June 15, 2019.
2. The Circular No. 50/2015/TT-BYT dated December 11, 2015 of the Minister of Health is null and void from the effective date of this Circular.
3. The Circular No. 04/2009/TT-BYT and Circular No. 05/2009/TT-BYT dated June 17, 2009 of the Minister of Health shall remain effective to apply to the entities specified in Clause 2 Article 4 of this Circular until June 30, 2021 when a local technical regulation on domestic water quality is promulgated and comes into force.
Article 4. Transitional clauses
Regarding provinces and central-affiliated cities that have not yet promulgated a local technical regulation on domestic water quality within the time limit specified in Clause 3 Article 3 of this Circular, every water supplier may:
1. apply National technical regulation on domestic water quality promulgated together with this Circular but is required to test all domestic water quality parameters on the list specified in Article 4 of the Regulation; or
2. Continue to apply the National technical regulation on drinking water quality (QCVN 01:2009/BYT) and National technical regulation on domestic water quality (QCVN 02:2009/BYT) until June 30, 2021.
Article 5. Responsibility for implementation
1. The Health Environment Management Agency affiliated to the Ministry of Health shall disseminate, provide guidance and inspect the implementation of this Circular nationwide.
2. People’s Committees of provinces and central-affiliated cities shall:
a) organize and inspect the implementation of this Circular within provinces and cities.
b) promulgate a local technical regulation on domestic water quality, which comes into force before July 01, 2021.
c) allocate budget for and direct the unscheduled or periodic inspection and monitoring of domestic water quality; investment in and upgrading of laboratory equipment in relevant preventive health centers/ centers for disease control of provinces (Centers for disease control of provinces) to enable them to test domestic water quality parameters in accordance with regulations of this Circular.
3. Specialized institutes affiliated to the Ministry of Health shall:
a) carry out reviews, analyze and report domestic water quality within provinces under their management and formulate a plan to provide training and technical and professional assistance to local authorities in the implementation of the Regulation.
b) conduct external inspections of domestic water quality at the request of the Ministry of Health; prepare external inspection reports using the Form No. 01 in the Appendix hereof.
c) provide technical assistance to provinces and cities under their management for the purpose of making local technical regulation on domestic water quality.
d) submit mid-year and annual reports to the Health Environment Management Agency within 15 days from the ending dates of June and December; prepare reports using the Form No. 02 in the Appendix hereof.
4. Departments of Health of provinces and central-affiliated cities shall:
a) take charge and cooperate with relevant units in implementing this Circular within provinces and cities.
b) direct their affiliates to disseminate and provide guidance for implementation of this Circular, inspect and monitor domestic water quality as prescribed in this Circular within provinces and cities.
c) receive declarations of conformity submitted by water suppliers within provinces and cities.
d) prepare a plan and provide human resources, equipment and funding (provided by annual budget) for inspection and monitoring of domestic water quality within provinces and cities; inspect and monitor quality of water extracted by households themselves in areas prone to water pollution so as to take measures to ensure people’s health.
5. Centers for disease control of provinces shall:
a) conduct periodic and unscheduled external inspections of quality of water from all water suppliers that serve 500 households or more (or have a design capacity of at least 1,000 m3/ 24 hours in case of failure to determine the number of households); prepare external inspection reports using the Form No. 01 in the Appendix hereof.
b) cooperate with health centers of districts in conducting periodic and unscheduled external inspections of quality of water from all water suppliers that serve fewer than 500 households (or have a design capacity of less than 1,000 m3/ 24 hours in case of failure to determine the number of households);
c) make an annual plan and estimate of funding for organizing inspections of domestic water quality.
d) submit mid-year and annual reports to the Departments of Health of provinces and central-affiliated cities, specialized institutes affiliated to the Ministry of Health and Health Environment Management Agency affiliated to the Ministry of Health within 10 days from the ending dates of June and December; prepare reports using the Form No. 03 in the Appendix hereof.
6. Health centers for districts shall:
a) conduct periodic and unscheduled external inspections of quality of water from all water suppliers that serve fewer than 500 households (or have a design capacity of 1,000 m3/ 24 hours in case of failure to determine the number of households); prepare external inspection reports using the Form No. 01 in the Appendix hereof.
b) make an annual plan and estimate of funding for organizing inspections of domestic water quality, and submit them to a competent authority for approval.
c) submit quarterly, mid-year and annual reports to the Health Environment Management Agency within 5 days from the ending dates of March, June, September and December; prepare reports using the Form No. 04 in the Appendix hereof.
7. Water suppliers shall:
a) implement regulations of this Circular.
b) be responsible to the law for quality of domestic water they provide.
c) archive and manage domestic water quality monitoring documentation:
- Local technical regulations on domestic water quality, which are promulgated by People’s Committees of provinces and central-affiliated cities.
- Results of periodic and unscheduled testing of raw water quality.
- Results of periodic and unscheduled testing of domestic water quality parameters.
- Records on chemicals used during the process of producing domestic water.
- Water sampling logbooks (upon each sampling, specify the number of samples; sampling location; volume of samples; method for storing samples; time of sample collection and storage; sample collector).
- Report on remedial measures against emergencies related to domestic water quality.
- Information about domestic water quality.
- Documentary evidences for implementation of the water safety plan.
d) be subject to inspections and supervision by competent authorities.
dd) propose domestic water parameters in order to make local technical regulations on domestic water quality.
e) submit quarterly domestic water testing reports to health centers of districts and centers for disease control of provinces according to the Forms No. 05 and 06 in the Appendix hereof.
8. The Chief of the Ministry Office, Director of Administration of Science Technology and Training, Director of Health Environment Management Agency, Director of Department of Legal Affairs, relevant departments, heads of affiliates of the Ministry of Health, Directors of Departments of provinces and central-affiliated cities and relevant organizations and individuals are responsible for the implementation of this Circular.
Difficulties that arise during the implementation of this Circular should be reported to the Ministry of Health for consideration./.

NATIONAL TECHNICAL REGULATION ON DOMESTIC WATER QUALITY
Foreword
The National technical regulation on domestic water quality QCVN 01-1:2018/BYT is prepared by the Health Environment Management Agency, presented by the Department of Legal Affairs, appraised by the Ministry of Science and Technology and promulgated together with the Circular No. 41/2018/TT-BYT dated December 14, 2018 by the Ministry of Health.
The National technical regulation on drinking water quality QCVN 01-1:2018/BYT supersedes the National technical regulation on drinking water quality QCVN 01-1:2009/BYT and National technical regulation on domestic water quality QCVN 02:20Q9/BYT which are promulgated together with the Circular No. 04/2009/TT-BYT and Circular No. 05/2009/TT-BYT dated June 17, 2009 of the Minister of Health respectively.
NATIONAL TECHNICAL REGULATION
ON DOMESTIC WATER QUALITY
Chapter I
GENERAL
Article 1. Scope
This Regulation provides for permissible limits of domestic water quality parameters.
Article 2. Regulated entities
1. This Regulation applies to organizations and individuals partially or totally involved in extraction, production, transmission, wholesale and retail of domestic water according to a complete centralized system (hereinafter referred to as “water suppliers”); domestic water quality inspecting and monitoring authorities; testing laboratories and bodies certifying domestic water quality parameters.
2. This Regulation does not apply to tap water, bottled drinking water, bottled natural mineral water, water produced by water purifiers, water purification system and non-domestic water.
Article 3. Definitions
For the purposes of this Regulation, the terms below shall be construed as follows:
1. “domestic water” refers to water that has undergone treatment and satisfies given requirements of quality to serve human consumption and sanitation purposes.
2. “organoleptic parameters” refer to factors, including color and taste that can be experienced via human senses.
3. “AOAC” stands for Association of Official Analytical Chemists.
4. “CFU” stands for Colony Forming Unit.
5. “FCR” stands for Free Chlorine Residual.
6. “NTU” stands for Nephelometric Turbidity Unit.
7. “SMEWW” stands for Standard Methods for the Examination of Water and Waste Water.
8. “TCU” stands for True Color Unit.
9. “US EPA” stands for United States Environmental Protection Agency.

Notes:
- (*) is only applicable to water suppliers that extract groundwater.
- (**) is only applicable to water suppliers that use chlorine for disinfection.
- (**) is only applicable to coastal areas and islands.
- (***) means no unit.
- Both Nitrite and Nitrate can form methemoglobin. Therefore, if the two substances are present in domestic water, total concentration (C) of each substance compared to its maximum limit (ML) must not exceed 1 and be calculated according to the following formula:
Cnitrate/MLnitrate + Cnitrite/MLnitrite ≤ 1
Article 5. Testing of domestic water quality parameters
1. All domestic water quality parameters shall be tested at laboratories or certification bodies that have been accredited according to TCVN ISO/IEC 17025 and registered its their testing services as prescribed in the Government's Decree No. 107/2016/ND-CP dated July 01, 2016.
2. Group A parameters shall be tested by all water suppliers.
3. Group B parameters shall be tested in accordance with local technical regulations promulgated by People’s Committees of provinces and central-affiliated cities on the basis of parameters selected to suit local current conditions.
4. Water suppliers shall test all Group A and B parameters on the List of domestic water quality parameters specified in Article 4 of this Regulation in the following cases:
a) Before they are put into operation for the first time.
b) After they undergo a major upgrade or repair that affects the production system.
c) There is an environmental emergency that may affect water quality.
d) Risks incurred during production process may affect water quality or testing is requested by a competent authority.
dd) The testing is conducted every 03 years from the latest testing of all parameters.
5. Periodic testing:
a) Periodic testing of group A parameters shall be conducted at least once a month.
b) Periodic testing of group B parameters shall be conducted at least every 6 months.
c) Depending on local current conditions, People’s Committees of provinces and central-affiliated cities shall define a testing frequency that is higher than that specified in Points a and b of this Clause.
Article 6. Number of samples and sampling locations
1. The number of samples needed for each testing:
a) Regarding water suppliers that serve fewer than 100,000 people: take at least 03 domestic water samples.
b) Regarding water suppliers that serve at least 100,000 people: take at least 04 domestic water samples and one additional sample for every 100,000 people served.
2. Sampling locations: 01 sample taken from the water supplier’s tank containing water that has been treated before being put into a water distribution system, 01 sample taken from a random tap at the end of a water distribution system, the others taken from a random tap in a water distribution system (including water distribution vehicles, such as tankers or water-carrying boats).
3. Regarding authorities, units, apartments, collective living quarters, hospitals, schools, enterprises and areas that have shared water tanks: take at least 02 samples, one from the shared water tank and 01 from a random tap. If there are 02 shared water tanks or more, take at least 01 sample from each tank and 01 sample from a random tap.
4. In the event of any risk of water source pollution or diseases, increase the number of water samples taken at different sampling locations.
Article 7. Sampling and testing methods
Sampling and testing methods are provided in the Appendix 01 hereof.
Chapter III
MANAGEMENT REGULATIONS
Article 8. Declaration of conformity
Every water producer shall assess its conformity itself as prescribed in the Circular No. 28/2012/TT-BKHCN dated December 12, 2012 and Circular No. 02/2017/TT-BKHCN dated March 31, 2017 of the Minister of Science and Technology.
Every water producer shall assess its conformity according to the method set forth in Point a Clause 1 Article 5 of the Circular No. 28/2012/TT-BKHCN and submit the declaration of conformity to the Department of Health of the province or central-affiliated city where it is located according to the Form in the Appendix 02 hereof.
Chapter IV
IMPLEMENTATION
Article 9. Responsibility for implementation
The Health Environment Management Agency shall take charge and cooperate with relevant authorities in providing guidelines and organizing implementation of this Regulation and recommend the Ministry of Health to make amendments thereto in accordance with management regulations.
Article 10. Transitional clause
In the cases where any of the regulations on testing methods in the National regulation and legislative documents referred to in this Regulation is amended or replaced, the newest one shall apply.
