CIRCULAR
AMENDMENTS TO SOME REGULATIONS ON CRITERIA FOR TITLE OF HEALTHCARE PUBLIC EMPLOYEES
Pursuant to the Government’s Decree No. 89/2021/ND-CP dated October 18, 2021 on amendments to some articles of the Government’s Decree 101/2017/ND-CP dated September 01, 2017 on training and refresher training of officials and public employees;
Pursuant to the Government’s Decree No. 115/2020/ND-CP dated September 25, 2020 on recruitment, use and management of public employees;
Pursuant to Decree No. 75/2017/ND-CP dated June 20, 2017 of Government on functions, tasks, powers, and organizational structure of Ministry of Health of Vietnam;
Pursuant to Decision No. 01/2017/QD-TTg dated January 17, 2017 of the Prime Minister on promulgation of the List of education and training of the national education system;
After the Ministry of Home Affairs reaches a consensus in Official Dispatch No. 4932/BNV-CCVC dated October 02, 2021 on the promulgation of a Circular on amendments to some regulations on criteria for title of healthcare public employees;

Article 1. Amendments to some articles of Joint Circular No. 10/2015/TTLT-BYT-BNV dated May 27, 2015 of the Minister of Health, the Minister of Home Affairs on code and criteria for title of doctor, doctor of preventive medicine and physician
1. Clause 2 Article 4 shall be amended as follows:
“2. Criteria for training and refresher training level:
a) Being a doctor of specialist II or doctor of medicine (except for preventive medicine specialty); doctor of specialist II or doctor of Teeth-Jaw-Face
b) Having certificate of refresher training according to criteria for title of doctor or medical practice certificate (doctor titles).
2. Point e Clause 3 Article 4 shall be amended and point g Clause 3 Article 4 shall be added as follows:
“e) The public employee taking the test or applying for promotion from the title of primary doctor (grade II) to the title of senior doctor (grade I) must have the time to hold the title of primary doctor (grade II) or equivalent position for at least 06 years. If the applicant has held an equivalent position for at least 06 years, he/she has to hold the position of primary doctor (grade II) for at least 01 year (full 12 months) by the deadline for application.
g) Having competence in use of basic information technology, foreign languages or ethnic minority languages for public employees who work in ethnic minority areas according to requirements of working position.
3. Clause 2 Article 5 shall be amended as follows:

a) Being a doctor of specialist I or master of medicine or higher level (except for preventive medicine specialty); doctor of specialist I or master of Teeth-Jaw-Face or higher level
b) Having certificate of refresher training according to criteria for title of doctor or medical practice certificate (doctor).
4. Point g Clause 3 Article 5 shall be amended and point h Clause 3 Article 5 shall be added as follows
“g) The public employee taking the test or applying for promotion from the title of doctor (grade III) to the title of primary doctor (grade II) must have the time to hold the title of doctor (grade III) or equivalent position for at least 09 years for persons having doctor degree of specialist I or master of medicine (except for preventive medicine specialty); doctor of specialist I or master of Teeth-Jaw-Face; 06 years for persons having doctor degree of specialist II or doctor of medicine (except for preventive medicine specialty); doctor of specialist II or doctor of Teeth-Jaw-Face or resident degree. If the applicant has held an equivalent position, he/she has to hold the position of primary doctor (grade III) for at least 01 year (full 12 months) by the deadline for application.
h) Having competence in use of basic information technology, foreign languages or ethnic minority languages for public employees who work in ethnic minority areas according to requirements of working position.
5. Clause 2 Article 6 shall be amended as follows:
“2. Criteria for training and refresher training level:
a) Being a doctor of medicine (except for doctor of preventive medicine); doctor of Teeth-Jaw-Face.
b) Having certificate of refresher training according to criteria for title of doctor or medical practice certificate (doctor).

7. Clause 2 Article 7 shall be amended as follows:
a) Being a doctor of specialist II or doctor of medicine of preventive medicine specialty;
b) Having certificate of refresher training according to criteria for title of doctor of medicine of preventive medicine specialty (titles of doctors of medicine of preventive medicine specialty)
8. Point g Clause 3 Article 7 shall be amended and point h Clause 3 Article 7 shall be added as follows
“g) The public employee taking the test or applying for promotion from the title of primary doctor of preventive medicine (grade II) to the title of senior doctor of preventive medicine (grade I) must have the time to hold the title of primary doctor of preventive medicine (grade II) or equivalent position for at least 06 years. If the applicant has held an equivalent position for at least 06 years, he/she has to hold the position of primary doctor of preventive medicine (grade II) for at least 01 year (full 12 months) by the deadline for application.

10. Point i Clause 3 Article 8 shall be amended and point k Clause 3 Article 8 shall be added as follows:
“i) The public employee taking the test or applying for promotion from the title of doctor of preventive medicine (grade III) to the title of primary doctor of preventive medicine (grade II) must have the time to hold the title of doctor of preventive medicine (grade III) or equivalent position for at least 09 years for persons having doctor degree of specialist I or master of medicine; 06 years for persons having doctor degree of specialist II or doctor of medicine or resident degree. If the applicant has held an equivalent position for at least 09 years, he/she has to hold the position of doctor of preventive medicine (grade III) at least 01 year (full 12 months) by the deadline for application.
k) Having competence in use of basic information technology, foreign languages or ethnic minority languages for public employees who work in ethnic minority areas according to requirements of working position.
11. Clause 2 Article 9 shall be amended as follows:
“2. Criteria for training and refresher training level:
a) Being a doctor of medicine (except for doctor of traditional medicine).
b) Having certificate of refresher training according to criteria for title of doctor of medicine of preventive medicine specialty (titles of doctors of medicine of preventive medicine specialty)

Article 2. Amendments to some articles of Joint Circular No. 11/2015/TTLT-BYT-BNV dated May 27, 2015 of the Minister of Health, the Minister of Home Affairs on code and criteria for professional title of public health
1. Clause 2 Article 4 shall be amended as follows:
“2. Criteria for training and refresher training level:
a) Having finished the specialty of level II or being a doctor of public health specialty; having finished the specialty of level II or being a doctor of health management specialty; being a doctor of specialist II or doctor of medicine of preventive medicine specialty.
b) Having certificate of refresher training according to criteria for title of public health (titles of public health)
2. Point i Clause 3 Article 4 shall be amended and point k Clause 3 Article 8 shall be added as follows:
“i) The public employee taking the test or applying for promotion from the title of primary public health (grade II) to the title of senior public health (grade I) must have the time to hold the title of primary public health (grade II) or equivalent position for at least 06 years. 4. Point i Clause 3 Article 5 shall be amended and point k Clause 3 Article 5 shall be added as follows:
“i) The public employee taking the test or applying for promotion from the title of public health (grade III) to the title of primary public health (grade I) must have the time to hold the title of public health (grade III) or equivalent position for at least 09 years. If the applicant has held an equivalent position for at least 09 years, he/she has to hold the position of primary public health (grade II) for at least 01 year (full 12 months) by the deadline for application.
k) Having competence in use of basic information technology, foreign languages or ethnic minority languages for public employees who work in ethnic minority areas according to requirements of working position.
5. Clause 2 Article 6 shall be amended as follows:
“2. Criteria for training and refresher training level:
a) Having graduated from university of public health or health management specialty; or being a doctor of medicine (except for traditional medicine). Having postgraduate diploma of public health or health management specialty.
b) Having certificate of refresher training according to criteria for title of public health (titles of public health)

Article 3. Amendments to some articles of Joint Circular No. 26/2015/TTLT-BYT-BNV dated October 07, 2015 of the Minister of Health, the Minister of Home Affairs on code and criteria for title of nurse, midwife and biomedical engineering technician
1. Clause 2 Article 4 shall be amended as follows:
“2. Criteria for training and refresher training level:
a) Having finished the specialty of level I or being a master or higher level of Nursing.
b) Having certificate of refresher training according to criteria for title of nurse or medical practice certificate (nurse titles).
2. Point g Clause 3 Article 4 shall be amended and point h Clause 3 Article 7 shall be added as follows
“g) The public employee taking the test or applying for promotion from the title of nurse (grade III) to the title of nurse (grade II) must have the time to hold the title of nurse (grade III) or equivalent position for at least 09 years. If the applicant has held an equivalent position for at least 09 years, he/she has to hold the position of nurse (grade III) for at least 01 year (full 12 months) by the deadline for application.
h) Having competence in use of basic information technology, foreign languages or ethnic minority languages for officials who work in ethnic minority areas according to requirements of working position.

“e) The public employee taking the test or applying for promotion from the title of midwife (grade III) to the title of midwife (grade II) must have the time to hold the title of midwife (grade III) or equivalent of at least 09 years. If the applicant has held an equivalent position, he/she has to hold the position of midwife (grade III) for at least 01 year (full 12 months) by the deadline for application.

If the applicant has held an equivalent position for at least 03 years, he/she has to hold the title of midwife (grade IV) for at least 01 year (full 12 months) by the deadline for application.
e) Having competence in use of basic information technology, foreign languages or ethnic minority languages for public employees who work in ethnic minority areas according to requirements of working position.

“g) The public employee taking the test or applying for promotion from the title of biomedical engineering technician (grade III) to the title of biomedical engineering technician (grade II) must have the time to hold the title of biomedical engineering technician (grade III) or equivalent position for at least 09 years. If the applicant has held an equivalent position for at least 09 years, he/she has to hold the position of biomedical engineering technician (grade III) for at least 01 year (full 12 months) by the deadline for application.

Article 5. Amendments to some articles of Joint Circular No. 28/2015/TTLT-BYT-BNV dated October 07, 2015 of the Minister of Health, the Minister of Home Affairs on code and criteria for title of nutrition specialist
1. Clause 2 Article 4 shall be amended as follows:
“2. Criteria for training and refresher training level:
a) Having finished the specialty of level I or being a master or higher level who specializes in nutrition.
b) Having certificate of refresher training according to criteria for title of nutrition specialist (nutrition specialist titles).”
2. Point e Clause 3 Article 4 shall be amended and point g Clause 3 Article 4 shall be added as follows:
“e) The public employee taking the test or applying for promotion from the title of nutrition specialist (grade III) to the title of nutrition specialist (grade II) must have the time to hold the title of nutrition specialist (grade III) or equivalent position for at least 09 years. If the applicant has held an equivalent position for at least 09 years, he/she has to hold the position of nutrition specialist (grade III) for at least 01 year (full 12 months) by the deadline for application.

a) Having a university degree or higher, specialized in nutrition; being a doctor of medicine.
b) Having certificate of refresher training according to criteria for title of nutrition specialist (nutrition specialist titles).”
4. Point e Clause 3 Article 5 shall be amended and point g Clause 3 Article 5 shall be added as follows:
“e) The public employee taking the test or applying for promotion from the title of nutrition specialist (grade IV) to the title of nutrition specialist (grade III) must have the time to hold the title of nutrition specialist (grade IV) or equivalent position for 03 years and over. If the applicant has held an equivalent position for at least 03 years, he/she has to hold the position of nutrition specialist (grade IV) for at least 01 year (full 12 months) by the deadline for application.
g) Having competence in use of basic information technology, foreign languages or ethnic minority languages for public employees who work in ethnic minority areas according to requirements of working position.
Article 6. Amendments to some articles of Joint Circular No. 08/2016/TTLT-BYT-BNV dated April 15, 2016 of the Minister of Health, the Minister of Home Affairs on code and criteria for title of demographer.
1. Clause 2 Article 4 shall be amended as follows:

a) Having graduated from university or higher of public health; in case of graduation from university or higher of another discipline, it is required to have certificate of demographer.
b) Having certificate of refresher training according to criteria for title of demographer (demographer titles).”
2. Point h Clause 3 Article 4 shall be amended and point i Clause 3 Article 4 shall be added as follows:
“h) The public employee taking the test or applying for promotion from the title of demographer (grade III) to the title of demographer (grade II) must have the time to hold the title of demographer (grade III) or equivalent position for at least 09 years. If the applicant has held an equivalent position for at least 09 years, he/she has to hold the position of demographer (grade III) for at least 01 year (full 12 months) by the deadline for application.
i) Having competence in use of basic information technology, foreign languages or ethnic minority languages for public employees who work in ethnic minority areas according to requirements of working position.

a) Having graduated from university of public health; in case of graduation from university of another discipline, it is required to have certificate of demographer.
b) Having certificate of refresher training according to criteria for title of demographer (demographer titles).”

“g) The public employee taking the test or applying for promotion from the title of demographer (grade IV) to the title of demographer (grade III) must have the time to hold the title of demographer (grade IV) or equivalent position for 03 years and over. If the applicant has held an equivalent position for at least 03 years, he/she has to hold the position of demographer (grade IV) for at least 01 year (full 12 months) by the deadline for application.
i) Having competence in use of basic information technology, foreign languages or ethnic minority languages for public employees who work in ethnic minority areas according to requirements of working position.
Article 7. Salary changes for nurses, midwives, biomedical engineering technicians, pharmacists, nutrition specialists and demographers (grade IV) who have college degrees
1. The nurses, midwives, biomedical engineering technicians, pharmacists, nutrition specialists and demographers (grade IV) specified in this Circular shall be subject to application of salary schedules (public employees – type A) with coefficients from 2,10 to 4,89 in Table 3 (Salary schedule of officials, public employees in public service providers) issued together with Government’s Decree No. 204/2004/ND-CP dated December 14, 2004 on salary regime for officials, public employees and armed force personnel (hereinafter referred to as “Decree No. 204/2004/ND-CP”)
2. If the public employee who has college degree in conformity with the training major is appointed and entitled to the salary grade in accordance with the title of nurse, midwife, biomedical engineering technician, pharmacist, nutrition specialist and demographer (grade IV) according to regulations of the Law before the effective date of the Circular, he/she must be entitled to a newly-graded salary – type A0 specified in Decree No. 204/2004/ND-CP and the calculation of salary shall comply with Circular No. 02/2007/TT-BNV dated May 25, 2007 of the Minister of Home Affairs on guidelines for calculation of salaries, increment, reclassification of category, change of type of officials, public employees.
If the public employee who has intermediate degree have been recruited and appointed to work as nurse, midwife, biomedical engineering technician, pharmacist, nutrition specialist or demographer (grade IV) according to regulations of the Law before the effective date of the Circular, he/she must be standardized in order to achieve the college degree in conformity with training major as prescribed before January 1, 2025.
If the public employee is appointed to study in order to achieve college level but fails to complete the course or fails to achieve satisfactory results, his/ her employer shall report to the agency or unit that manage the public employee for reassignment or dismissal.
Article 8. Transitional clauses
1. If the public employee who has been appointed to the title of public employee in the health sector in accordance with the law before the effective date of this Circular with regulations on training and refresher training level of the title without certificate of refresher training according to the title, he/she shall not have a certificate of refresher training according to the title specified in this Circular. The public employee taking the test or applying for promotion shall have a certificate of refresher training according to the title specified in this Circular.

3. If the training courses grant certificates of refresher training according to titles of doctors, doctors of preventive medicine, public health, pharmacists, nurses, midwives, biomedical engineering technicians, nutrition specialists, demographers of the respective titles which are being deployed before the effective date of this Circular, the training and issuance of certificates may continue.
4. The public employee who has a bachelor's degree in nursing of gynecology & obstetrics before the effective date of this Circular shall be recognized that he/she fully satisfies the requirements for training level of the title of midwife (grade III) specified in Clause 8 Article 3 of this Circular.
Article 9. Implementation
1. This Circular comes into force as of June 10, 2022.
2. Points b and c, Clause 2, Article 10 of Joint Circular No. 10/2015/TTLT-BYT-BNV dated May 27, 2015 of the Minister of Health and the Minister of Home Affairs on code and criteria for title of doctor, doctor of preventive medicine and physician; Point b, Point c, Clause 2, Article 6 of Joint Circular No. 28/2015/TTLT-BYT-BNV dated October 7, 2015 of the Minister of Health and the Minister of Home Affairs code and criteria for title of nutrition specialist; Point b, Point c, Clause 2, Article 6 of Joint Circular No. 08/2016/TTLT-BYT-BNV dated April 15, 2016 of the Minister of Health and the Minister of Home Affairs code and criteria for title of demographer shall cease to be effective from the effective date of this Circular.
3. If any document that is cited in this Circular is amended or replaced, the latest one shall be applied.
Article 10. Responsibility for implementation
1. The Ministers, the Heads of the Ministerial-Level Agencies, the Heads of the Governmental Agencies, the Chairpersons of the People's Committees of provinces and relevant organizations and individuals shall be responsible for the implementation of this Circular.
