CIRCULAR
AMENDING AND SUPPLEMENTING SEVERAL ARTICLES OF CIRCULAR NO. 01/2014/TT-NHNN DATED JANUARY 6, 2014 OF THE GOVERNOR OF THE STATE BANK OF VIETNAM ON HANDLING, STORAGE AND TRANSPORTATION OF CASH, PRECIOUS PROPERTY AND FINANCIAL INSTRUMENTS
Pursuant to the Law on State Bank of Vietnam dated June 16, 2010;
Pursuant to the Government’s Decree No. 40/2012/ND-CP dated May 2, 2012 on money issuance; storage and transportation of precious property and financial instruments within the State Bank’s system, credit institutions and foreign bank branches;
Pursuant to the Government's Decree No. 16/2017/ND-CP dated February 17, 2017, defining the functions, tasks, powers and organizational structure of the State Bank of Vietnam;
Upon the request of the Director of the Issue and Vault Department;
The Governor of the State Bank of Vietnam (SBV) herein promulgates the Circular on amendments and supplements to several Articles of the Circular No. 01/2014/TT-NHNN dated January 6, 2014 of the SBV’s Governor on handling, storage and transportation of cash, precious property and financial instruments.
Article 1. Amendments and supplements to several Articles of the Circular No. 01/2014/TT-NHNN dated January 6, 2014 of the SBV’s Governor on handling, storage and transportation of cash, precious property and financial instruments
1. Amending and supplementing clause 1 of Article 11 as follows:
“1. Delivery and receipt of banknotes in a 10-shief bundle on which the security seal remains intact, or in a money bag on which the security seal remains intact, in the following cases:
a) Delivering and receiving banknotes in circulation inside the Transaction Center, the SBV’s branches, except as provided in point c and g of clause 2 of this Article;
b) Delivering and receiving banknotes having the minimum face value of VND 50,000 according to the transfer orders between the central vaults and the Transaction Center or SBV branches; between central vaults; between SBV branches, except for the case specified at point dd of clause 2 of this Article;
c) Delivering and receiving banknotes between the Transaction Center, SBV branches and credit institutions or foreign bank branches; between credit institutions or foreign bank branches operating in the same province and city.”
2. Adding point d, dd, e and g to clause 2 of Article 11 as follows:
“d) Delivering and receiving banknotes having the maximum face value of VND 20,000 according to the transfer orders between the central vaults and the Transaction Center or SBV branches; between central vaults; between SBV branches;
dd) Delivering and receiving banknotes having the face value of VND 50,000 according to the transfer orders between the central vaults and SBV branches of Phu Tho, Nghe An, Binh Dinh and Vinh Long province; between central vaults; between SBV branches of Phu Tho, Nghe An, Binh Dinh and Vinh Long province;
e) Delivering and receiving banknotes intramurally inside the central vault;
g) Delivering and receiving banknotes intramurally inside the SBV branch of Phu Tho, Nghe An, Binh Dinh and Vinh Long province when executing the transfer orders.”
3. Amending and supplementing clause 1 of Article 12 as follows:
“1. Tally of banknotes in circulation delivered and received according to transfer orders issued by SBV:
a) Transaction Center, SBV branches (except SBV branches of Phu Tho, Nghe An, Binh Dinh and Vinh Long province which comply with the provisions of point b of this clause) in charge of keeping a tally of sheets (pieces) of banknotes received must set up a Tally Council according to the provisions of clause 3 of Article 62 of this Circular. The tally duration is 30 working days from receipt of banknotes. The sender designates its witnesses; In case of no witness, the sender must notify the receiver in writing.
The Director of the Issue and Vault Department shall consider and decide on extension of the banknote tallying and counting duration according to the transfer orders due to objective causes at the request of the Transaction Center or SBV branches;
b) SBV branches of Phu Tho, Nghe An, Binh Dinh and Vinh Long province shall be in charge of counting and tallying sheets (pieces) of banknotes transferred to credit institutions or foreign bank branches in a province or city. The tally council is set up according to clause 3 of Article 62 herein and responsible for supervising property safety;
c) For banknotes that has not been counted in sheets (pieces), the Transaction Center or the SBV branches may deliver them in a bundle (bag) with seals remaining intact to credit institutions, foreign bank branches in the same province or city, and must appoint witnesses when receiving credit institutions, foreign bank branches count or tally sheets (pieces) of banknotes.”
4. Amending and supplementing point b of clause 2 of Article 26 as follows:
“b) At other locations of Vault I, the Director of the Issue and Vault Department may authorize a Deputy Director or Head of Vault I in writing to perform the task of managing cash, precious property, financial instruments and vaults for a specified period of time. In case where the authorized person is absent, the Director of the Issue and Vault Department may authorize another Deputy Director or a Deputy Head of Vault I to act on his/her behalf in writing on an on-demand basis;”
5. Amending and supplementing clause 1 of Article 48 as follows:
“1. Issue and Vault Department shall be in charge of the transportation of cash, precious property and financial instruments from money printing and minting establishments, airports, seaports and railway stations to the central vaults; between central vaults; from the central vaults to the Transaction Center’s vault or the vaults of SBV branches; between vaults of SBV branches.
Where necessary, the Transaction Center and SBV branches can appoint an escort and deliver and receive cash, previous property and financial instruments at central vaults or other SBV branches.
SBV branches of Phu Tho, Nghe An, Binh Dinh and Vinh Long province shall be in charge of transporting banknotes, precious property and financial instruments between these branches and central vaults; between SBV branches of provinces and cities in the same area (under the decisions of SBV’s Governor over periods of time).”
Article 2. Implementation responsibilities
The Office’s Chief, the Director of the Issue and Vault Department, Heads of units controlled by SBV, Directors of SBV branches of provinces, cities, credit institutions and foreign bank branches shall be responsible for implementing this Circular.
Article 3. Entry into force
1. This Circular is entering into force as of January 8, 2022.
2. This Circular shall abolish clause 1 and 2 of Article 1 in the Circular No. 12/2017/TT-NHNN dated August 31, 2017 on amendments and supplements to several Articles of the Circular No. 01/2014/TT-NHNN dated January 6, 2014 of the SBV’s Governor on handling, storage and transportation of cash, precious property and financial instruments./.
