DECREE

GUIDELINES FOR SOME ARTICLES OF THE LAW ON NATURAL DISASTER PREPAREDNESS AND RECOVERY

Pursuant to the Law on Government Organization dated June 19, 2015;

Pursuant to the Law on Natural Disaster Preparedness and Recovery dated June 19, 2013;

At the request of the Minister of Agriculture and Rural Development;

The Government hereby promulgates a Decree on guidelines for some Articles of the Law on Natural Disaster Preparedness and Recovery.

Chapter I

GENERAL PROVISIONS

Article 1. Scope

This Decree provides guidelines for some Articles of the Law on Preparedness and Recovery covering responsibilities for news broadcasting, news broadcasting frequency and duration, communication networks and equipment serving command over natural disaster response; allocation of responsibility and cooperation in natural disaster response; mobilization, fundraising and allocation of resources for natural disaster relief and recovery; rights and obligations of foreign organizations and individuals and international organizations participating in natural disaster response and recovery in Vietnam; and organizational structures and tasks of natural disaster management agencies and the mechanism for cooperation between the Central Center for Natural Disaster Management and the National Committee for Natural Disaster Management and Response.

Article 2. Regulated entities

This Decree applies to Vietnamese organizations, households and individuals; foreign organizations and individuals and international organizations living, operating or participating in natural disaster preparedness and recovery in Vietnam.

Chapter II

SPECIFIC PROVISIONS

Section 1. RESPONSIBILITIES FOR NEWS BROADCASTING; NEWS BROADCASTING FREQUENCY AND DURATION; COMMUNICATION NETWORKS AND EQUIPMENT SERVING COMMAND OVER NATURAL DISASTER RESPONSE

Article 3. Agencies in charge of news broadcasting

1. Vietnam Television, Voice of Vietnam, Vietnam News Agency, coastal communication stations, radio and television stations of provinces and central-affiliated cities and press agencies shall broadcast news about instructional documents about natural disaster response (hereinafter referred to as “instructional documents”) promulgated by the Prime Minister, Central Command Center for Natural Disaster Management and National Committee for Natural Disaster Management and Response.

2. People’s Committees at all levels shall direct and organize the prompt and accurate provision of disaster forecasts and warnings and broadcast news about instructional documents promulgated by the Prime Minister, Central Command Center for Natural Disaster Management, National Committee for Natural Disaster Management and Response, superior Command Center for Natural Disaster Management and Command Center for Natural Disaster Management at the same level within the area that receives warnings.

3. Ministries, ministerial agencies and Governmental agencies shall direct their specialized information systems to broadcast news about natural disaster preparedness and recovery in the fields under their management.

4. The Ministry of Information and Communications shall provide guidelines or propose the promulgation of documents providing guidelines for transmitting disaster messages.

Article 4. Frequency and duration of broadcasting news about commands over natural disaster response

1. Vietnam Television, Voice of Vietnam, Vietnam News Agency, coastal communication stations, radio and television stations of provinces and central-affiliated cities, press agencies and relevant special-purpose information systems shall broadcast news about the document about natural disaster response promulgated by the Prime Minister, Central Command Center for Natural Disaster Management and National Committee for Natural Disaster Management and Response immediately after receiving such news and re-broadcast it at least every 3 hours regarding the level 3 disaster and at least every 01 hour regarding the disaster exceeding level 3 until a new instructional document is available or natural disaster response activities have been carried out or natural disaster developments have changed and do not exert any effect.

2. The duration of news about commands over natural disaster response must be adequate to cover all information specified in an instructional document promulgated by a competent authority, disaster forecast and warning and clearly stating changes to the instructional document, updating information about natural disaster developments and natural disaster response activities.

3. Radio and Television stations at all levels shall broadcast news about instructional documents promulgated by the Command Center for Natural Disaster Management at the same level and instructional documents of the supervisory authority immediately after receiving such news and re-broadcast it at the request of the Command Center for Natural Disaster Management at the same level in conformity with natural disaster developments and local response activities.

When a level-2, level-3 or level-4 disaster occurs, the Command Center for Natural Disaster Management at the same level or the superior Command Center for Natural Disaster Management shall decide on the frequency of broadcasting news.

4. The Command Centers for Natural Disaster Management at all levels shall provide guidelines for frequency and duration of broadcasting news about commands over natural disaster response on information systems within their areas. The areas where radio and television stations are not available, local conventional equipment or commands shall be used to inform disaster-prone households.

Article 5. Communication networks and equipment serving command over natural disaster response

1. Public communication networks serving command over natural disaster response, including:

a) Fixed ground and satellite telecommunications network;

b) Ground and satellite telecommunications network;

c) Radio and television transmission and broadcasting network;

d) Public postal network.

2. Special-purpose information networks, including:

a) Hotlines directly serving command over natural disaster preparedness and recovery;

b) Dedicated telecommunications network serving authorities of the Communist Party and the State, and national defense and security purposes;

c) Postal network serving authorities of the Communist Party and the State, and national defense and security purposes;

d) Dedicated telecommunications network and postal network of other organizations and enterprises;

dd) Communication network serving warning of tsunami and other natural disasters;

e) Network of warning information transmitted from special-purpose monitoring system.

3. Communication equipment serving command over natural disaster response, including:

a) Telephones;

b) Computers;

c) Facsimile machines;

d) Radio equipment;

dd) Television equipment;

e) Automatic monitoring equipment;

g) Public communication network, automatic special-purpose monitoring equipment; early warning system;

h) Other equipment.

4. Ministries, ministerial agencies, Governmental agencies and People’s Committees at all levels shall, within their jurisdiction, prepare a plan for procurement of communication equipment and submit it to a competent authority for approval, and organize the procurement, management and use thereof as prescribed by law.

Section 2. ALLOCATION OF RESPONSIBILITY AND COOPERATION IN NATURAL DISASTER RESPONSE

Article 6. Natural disaster risk levels

Natural disaster risk is classified into 05 levels depending on the severity of the natural disaster. These five levels are level 1, level 2, level 3, level 4 and level 5 (emergency). The Prime Minister shall elaborate natural disaster risk levels.

Article 7. Allocation of responsibility and cooperation in level 1 natural disaster response

1. The President of the People’s Committee of the commune shall directly command and mobilize resources to promptly respond to a natural disaster upon its occurrence; submit reports and carry out commands given by the superior natural disaster management agency.

2. The President of the People’s Committee of the commune is entitled to mobilize the following resources to respond to natural disasters:

a) Militia and self-defense forces, adolescents, local organizations and individuals and voluntary organizations and individuals;

b) Reserve supplies prepared by the people, and supplies, equipment and vehicles of the commune and local organizations and individuals.

3. The forces participating in natural disaster response within the commune shall closely cooperate with each other under the command of the President of the People’s Committee of the commune or the authorized person.

4. In case it is beyond the capacity of the commune, the President of the People’s Committee of the commune shall request the People’s Committee and Command Center for Natural Disaster Management of the district to provide assistance.

5. The President of the People’s Committee of the province shall directly command and mobilize resources within his/her power to respond to the natural disaster if the level 1 natural disaster hits at least two communes or when receiving the request for assistance from the President of the People’s Committee of the commune, and carry out commands given by the superior natural disaster management agency.

6. The President of the People’s Committee of the district is entitled to mobilize the following resources to respond to natural disasters:

a) Militia and self-defense forces, adolescents, local organizations and individuals and voluntary organizations and individuals;

b) Supplies, equipment and vehicles of the district and local organizations and individuals.

Article 8. Allocation of responsibility and cooperation in level 2 natural disaster response

1. The President of the People’s Committee of the province shall command local authorities, agencies and units within the province to respond to natural disasters; mobilize resources within his/her power to promptly respond to natural disasters in conformity with natural disaster developments, and submit reports and carry out commands given by the Prime Minister, Central Command Center for Natural Disaster Management and National Committee for Natural Disaster Management and Response.

2. The President of the People’s Committee of the province is entitled to mobilize the following resources to respond to natural disasters:

a) Army forces, militia and self-defense forces, adolescents, organizations and individuals, search and rescue forces, fisheries surveillance forces and voluntary organizations and individuals;

b) Supplies, equipment and vehicles of the province, and local organizations and individuals’ reserve supplies serving natural disaster preparedness and recovery.

3. The President of the People’s Committee of the district and the commune shall assume the responsibilities specified in Article 7, obey commands of the superior agency, instruct and evacuate people to safe places. The President of the People’s Committee of the district shall decide to carry out coercive evacuation in the case where an organization or individual fails to voluntarily obey commands and guidance for natural disaster preparedness and recovery for the sake of safety of people.

4. In case it is beyond the capacity of the province, the President of the People’s Committee of the province shall notify and request the Central Command Center for Natural Disaster Management and National Committee for Natural Disaster Management and Response to provide assistance.

5. The Central Command Center for Natural Disaster Management shall take charge and cooperate with the National Committee for Natural Disaster Management and Response in directly commanding, managing or mobilizing resources for natural disaster response upon occurrence of the disaster whose developments may result in serious consequences or upon receiving the request for assistance from the President of the People’s Committee of the province and head of the Command Center for Natural Disaster Management of the province. The forces participating in natural disaster response within the province shall closely cooperate with each other under the command of the President of the People’s Committee of the province or the authorized person.

Article 9. Allocation of responsibility and cooperation in level 3 natural disaster response

1. The Central Command Center for Natural Disaster Management shall direct local authorities, Ministries, ministerial agencies and Governmental agencies shall take disaster response measures, and decide to take urgent measures and mobilize resources within their power to provide assistance in natural disaster response upon request.

2. The National Committee for Natural Disaster Management and Response shall, according to current situation, take charge and cooperate with ministries and local authorities in directing and setting up forces, providing vehicles for search and rescue, and participating in coordinating disaster response activities.

3. Command Centers for Natural Disaster Management of Ministries, ministerial agencies and Governmental agencies shall take disaster response measures under their management, and participate in disaster response under the direction of the Central Command Center for Natural Disaster Management and the National Committee for Natural Disaster Management and Response.

4. The President of the People’s Committee of the province shall command and mobilize resources within his/her power and take disaster response measures within the province.

5. The President of the People’s Committee of the district and the commune shall, according to local situation, assume the responsibilities specified in Clause 3 Article 8 of this Decree and obey commands of the superior agency.

6. In case the disaster exceeds level 3 or it has developments that may result in serious consequences, the Central Command Center for Natural Disaster Management shall notify the Prime Minister thereof.

Article 10. Allocation of responsibility and cooperation in level 4 natural disaster response

1. The Prime Minister shall direct Ministries, ministerial agencies, Governmental agencies and relevant local authorities to take disaster response measures.

2. The Central Command Center for Natural Disaster Management shall provide counseling on disaster response measures to the Government and the Prime Minister.

3. The National Committee for Natural Disaster Management and Response shall take charge and cooperate with ministries and local authorities in directing and setting up forces, providing vehicles for search and rescue, and participating in coordinating disaster response activities.

4. Ministers, heads of ministerial agencies and Governmental agencies shall take disaster response measures under their management, and participate in disaster response under the direction of the Prime Minister, Central Command Center for Natural Disaster Management and National Committee for Natural Disaster Management and Response.

5. The President of the People’s Committee of the province shall command and mobilize resources within his/her power to promptly respond to natural disasters within the province and follow the direction of the Prime Minister, Central Command Center for Natural Disaster Management and National Committee for Natural Disaster Management and Response.

6. The President of the People’s Committee of the district and the commune, according to local situation, shall assume the responsibilities specified in Clause 3 Article 8 of this Decree and obey commands of the superior agency.

Article 11. Allocation of responsibility and cooperation in emergency response

1. In case the disaster exceeds level 4, the Central Command Center for Natural Disaster Management shall request the President of the Socialist Republic of Vietnam to declare a state of emergency.

2. The allocation of responsibility and cooperation in disaster response shall comply with regulations of law on state of emergency.

Section 3. MOBILIZATION, FUNDRAISING AND ALLOCATION OF RESOURCES FOR DISASTER RELIEF AND RECOVERY

Article 12. Mobilization and allocation of resources for disaster recovery

1. People’s Committees at all levels shall decide to use local government budget reserve and other local resources to promptly take remedial actions against natural disasters.

2. The President of the People’s Committee of the province shall use natural disaster preparedness and recovery fund in accordance with regulations on natural disaster preparedness and recovery fund.

3. Ministers, heads of ministerial agencies and Governmental agencies shall, within their jurisdiction, provide resources to take remedial actions against natural disasters under their management and assist local authorities in taking remedial actions against natural disasters.

4. The Central Command Center for Natural Disaster Management shall consolidate consequences and relief and recovery demands and propose central government budget reserve, national reserve and other legal sources to the Government and the Prime Minister with a view to assisting local authorities, Ministries, ministerial agencies and Governmental agencies in taking measures against natural disasters.

5. The Central Command Center for Natural Disaster Management shall consolidate consequences and relief and recovery demands and request the Government and the Prime Minister to use central government budget reserve, national reserve and other legal sources with a view to assisting local authorities, Ministries, ministerial agencies and Governmental agencies in taking measures against natural disasters.

6. After resources are provided by the State, People’s Committees at all levels shall allocate them in a prompt and proper manner and direct remedial actions against natural disasters within their areas.

7. Within 30 days from the date on which disaster relief and recovery resources are provided, People's Committees of provinces, Ministries, ministerial agencies and Governmental agencies shall submit a report on receipt, allocation and use of disaster relief and recovery resources to the Central Command Center for Natural Disaster Management, Ministry of Finance, Ministry of Planning and Investment and Ministry of Labor, War Invalids and Social Affairs.

Article 13. Mobilization, fundraising and distribution of resources from the community

The mobilization, fundraising and distribution of resources from the community shall comply with regulations on mobilization, fundraising, distribution and use of voluntary contributions for disaster recovery and regulations of law on operation of Vietnamese Fatherland Front and Vietnam Red Cross Society.

Section 4. RIGHTS AND OBLIGATIONS OF FOREIGN ORGANIZATIONS AND INDIVIDUALS AND INTERNATIONAL ORGANIZATIONS PARTICIPATING IN DISASTER RESPONSE AND RECOVERY IN VIETNAM

Article 14. Duty and charges for import and export of vehicles, equipment and goods serving emergency relief, search and rescue and disaster relief and recovery

Foreign organizations and individuals and international organizations participating in disaster response and recovery in Vietnam shall be exempt from duty and charges for import and export upon import and export of vehicles, equipment and goods serving emergency relief, search and rescue and disaster relief and recovery. Such vehicles, equipment and goods shall be liable to duty in accordance with Vietnamese law if they are used for other purposes in Vietnam.

Article 15. Applying for registration of disaster response and recovery in Vietnam

1. Before entering Vietnam to engage in disaster response and recovery, the foreign individual or international organization shall submit an application to the Ministry of Agriculture and Rural Development. An application includes:

a) An application form, specifying: name of the organization/individual; purposes; date and place of disaster response and recovery;

b) A list of goods, materials and equipment;

c) A list of participants.

2. Within 02 days from the receipt of the application, the Ministry of Agriculture and Rural Development shall notify application processing result to the applicant and relevant authorities.

Article 16. Entry and exit; procedures for import and export of vehicles, equipment and goods serving emergency response, search and rescue and disaster relief and recovery

1. A person allowed to enter Vietnam to engage in disaster response and recovery is entitled to follow prioritized entry or exit procedures at the border checkpoint. In case of emergency response, if such person has no visa, he/she will be granted at the border checkpoint.

2. After having served search and rescue and disaster relief and recovery, vehicles, equipment and goods qualified for import or re-export shall be prioritized to follow customs clearance procedures at border checkpoints.

Article 17. Residence regulations applicable to foreigners engaging in disaster response and recovery in Vietnam

1. A person allowed to enter Vietnam to engage in disaster response and recovery shall be provided with guidance on accommodation, workplace and temporary residence procedures relevant to specific conditions.

2. Agencies and local authorities receiving assistance shall provide guidance on procedures for registration of temporary residence, accommodation and workplace for individuals and organizations entering Vietnam to engage in disaster response and recovery.

Section 5. ORGANIZATIONAL STRUCTURES AND TASKS OF NATURAL DISASTER MANAGEMENT AGENCIES AND MECHANISM FOR COOPERATION BETWEEN THE CENTRAL COMMAND CENTER FOR NATURAL DISASTER MANAGEMENT AND THE NATIONAL COMMITTEE FOR NATURAL DISASTER MANAGEMENT AND RESPONSE

Article 18. Organizational structure and tasks of the Central Command Center for Natural Disaster Management

1. The Central Command Center for Natural Disaster Management is established by the Prime Minister and acts as an inter-sectoral coordinator assisting the Government and the Prime Minister in organizing, directing and administering the disaster preparedness, response and recovery nationwide. The Central Command Center for Natural Disaster Management is entitled to use the seal bearing national emblem to perform its tasks. Members of the Center work on a part-time basis

2. The Central Command Center for Natural Disaster Management includes:

a) The Deputy Prime Minister, the head of the Center;

b) Deputy heads, including: Standing deputy head - the Minister of Agriculture and Rural Development, 01 leader of the Ministry of National Defense, and the General Director of Vietnam Disaster Management Authority;

c) Members, including: Ministers of the Ministry of Industry and Trade, Ministry of Transport, Ministry of Information and Communications, Ministry of Construction, Ministry of Labor, War Invalids and Social Affairs, Ministry of Finance and Ministry of Planning and Investment and leaders of some Ministries, ministerial agencies and Governmental agencies; the General Director of Viet Nam Television, General Director of Voice of Viet Nam, General Director of Viet Nam News Agency; the General Director of Vietnam Disaster Management Authority, Chief of Office of National Committee for Natural Disaster Management and Response;

d) According to work requirement, the head of the Central Command Center for Natural Disaster Management shall decide to invite leaders of relevant organizations: Vietnamese Fatherland Front Central Committee, Central Vietnam Women's Union, Central Ho Chi Minh Communist Youth Union, Central Vietnam Red Cross Society and other relevant organizations to join the Central Command Center for Natural Disaster Management.

3. The Ministry of Agriculture and Rural Development shall act as a standing body of the Central Command Center for Natural Disaster Management and utilize leader of the Vietnam Disaster Management Authority to perform the task of a Standing Office of the Central Command Center for Natural Disaster Management (hereinafter referred to as “the Standing Office of the Command Center”).

The Standing Office of the Command Center has its own seal, is granted funding for operation and opens accounts at the State Treasury. The head of the Central Command Center for Natural Disaster Management shall define functions, tasks and working regulations of the Standing Office of the Command Center.

4. Tasks of the Central Command Center for Natural Disaster Management:

a) Provide guidelines for preparing and expediting the implementation of national strategies and plans, and policies and lawsoft on natural disaster preparedness and recovery;

b) Take charge of preparing disaster response plans;

c) Direct and coordinate disaster response and recovery nationwide: direct response to level 3 disaster; assist in directing response to level 4 and 5 natural disasters; coordinate and assist or direct local authorities to respond to level 1 and 2 natural disasters if such disasters have unanticipated developments which may result in serious consequences.

d) According to natural disaster developments and actual situation, decide to take urgent measures and mobilize resources of Ministries, ministerial agencies, Governmental agencies, organizations and individuals to respond to and take remedial actions against natural disasters in accordance with regulations of the Law on Natural Disaster Preparedness and Recovery and this Decree.

dd) Direct the consolidation of consequences and local authorities and ministries’ demands for emergency assistance, recovery and reconstruction and propose central government budget reserve, national reserve and other legal sources to the Government and the Prime Minister with a view to serving emergency response and disaster recover nationwide;

e) Inspect, expedite and instruct ministries and local authorities to engage in natural disaster preparedness and recovery as prescribed by law;

g) Direct, organize rehearsals and provide training for forces involved in natural disaster preparedness and recovery; direct, implement and organize the implementation of measures to gradually increase civil capacity for natural disaster response;

h) Direct and organize the provision of infrastructure, equipment, materials and special-purpose vehicles; establish database to serve issuance of decision on command over disaster preparedness and recovery;

i) Call for, receive and provide domestic and foreign assistance in case of emergency due to natural disasters; take charge of directing and coordinating the receipt and provision of assistance in disaster relief and recovery;

k) Provide guidelines, inspect, expedite and consolidate result of exploitation of resources and notify the Prime Minister thereof;

l) Direct and prepare documents, provide training, disseminate and raise community awareness of natural disaster preparedness and recovery on an annual basis;

m) Provide guidelines for natural disaster preparedness and recovery to internal voluntary forces in charge of natural disaster preparedness and recovery (hereinafter referred to as “the voluntary forces”).

Article 19. Organizational structure and tasks of the Command Center for Natural Disaster Management of a Ministry, ministerial agency and Governmental agency

1. The Ministry of National Defense, Ministry of Public Security, Ministry of Agriculture and Rural Development, Ministry of Transport, Ministry of Construction, Ministry of Industry and Trade, Ministry of Natural Resources and Environment, Ministry of Information and Communications, Ministry of Health, Ministry of Education and Training, Ministry of Labor, War Invalids and Social Affairs and Ministry of Culture, Sports and Tourism shall establish a ministerial Command Center for Natural Disaster Management.

2. Ministries, ministerial agencies and Governmental agencies (except the Ministries specified in Clause 1 of this Article) shall, within their jurisdiction, decide to establish a ministerial Command Center for Natural Disaster Management or assign an affiliated departmental agency to assist the Ministers or heads of agencies in natural disaster preparedness and recovery and search and rescue under their management.

3. Ministers and heads of ministerial agencies and Governmental agencies shall, within their jurisdiction, decide to establish ministerial command centers for natural disaster management of their affiliates.

4. Organizational structure of a ministerial Command Center for Natural Disaster Management:

a) The head of the Command Center for Natural Disaster Management of the Ministry of Agriculture and Rural Development, Ministry of Transport, Ministry of Construction, Ministry of Industry and Trade, Ministry of Information and Communications, Ministry of Health, Ministry of Education and Training or Ministry of Labor, War Invalids and Social Affairs shall be the Minister.

b) The head of the Command Center for Natural Disaster Management of a Ministry, ministerial agency or Governmental agency specified in Clauses 1 and 2 of this Article (except the Ministries specified in Point a of this Clause) shall be the leader at ministerial level.

c) Ministers, heads of ministerial agencies and Governmental agencies shall, within their jurisdiction, shall assign a specialized agency to assist Ministers and heads of agencies in natural disaster management under their management and act as the Standing Office of the Command Center for Natural Disaster Management;

d) The ministerial Command Center for Natural Disaster Management may use the Ministry’s seal or its own seal. The Standing Office has its own seal, is granted funding for operation and opens accounts.

5. Tasks of a ministerial Command Center for Natural Disaster Management:

a) Assist the Minister in natural disaster management under its management;

b) Cooperate with relevant Ministries, ministerial agencies and local authorities in natural disaster management nationwide under the direction of the Prime Minister, Central Command Center for Natural Disaster Management and National Committee for Natural Disaster Management and Response;

c) Decide to adopt urgent measures and mobilize resources of the Ministry for prompt natural disaster response and recovery and search and rescue under the management of the Ministry and local authorities.

Article 20. Organizational structure and task of Command Centers for Natural Disaster Management of provinces

1. The Command Center for Natural Disaster Management of a provinceshall be established by the President of the People’s Committee of the province and assist the People’s Committee of the province in commanding natural disaster preparedness and recovery, search and rescue within the province. The Command Center for Natural Disaster Management has its own seal, is granted funding for operation and opens accounts.

2. The Command Center for Natural Disaster Management of a province includes:

a) President of the People’s Committee of the province, the head of the Command Center;

b) A Deputy President of the People’s Committee of the province, the standing deputy head of the Command Center;

c) Director of the Provincial Department of Agriculture and Rural Development, the deputy head in charge of natural disaster management;

d) According to condition of each area, the Commanding Officer of the Military Command of the province shall act as a deputy head in charge of mainland search and rescue; the Commanding Officer of the Border Guard Command of the province shall act as a deputy head in charge of maritime and border search and rescue;

dd) Members, including Directors or leaders of departments related to natural disaster preparedness and recovery, search and rescue, Fatherland Front, Women's Union, Red Cross Society, Ho Chi Minh Communist Youth Union and social organizations of the province joining the Command Center for Natural Disaster Management of the province.

3. The Department of Agriculture and Rural Development of the province shall act as a standing natural disaster management agency. The Military Command or Border Guard Command shall act as a standing search and rescue agency of the Command Center for Natural Disaster Management of the province.

According to actual condition, the President of the People's Committee of the province shall decide to establish a specialized department affiliated to the Department of Agriculture and Rural Development of the province to act as a Standing Office of the Command Center for Natural Disaster Management.

4. Tasks of a Command Center for Natural Disaster Management of the province:

a) Assist the People’s Committee of the province in natural disaster management as prescribed in Clause 1 Article 43 of the Law on Natural Disaster Preparedness and Recovery;

b) Direct and expedite the preparation and submission of natural disaster response plans for approval;

c) Command natural disaster response, search and rescue during natural disasters within the province;

d) Inspect and expedite the natural disaster preparedness and recovery by local departments and agencies;

dd) Assist the People’s Committee of the province in directing, inspecting, expediting and consolidating reports on consequence assessment, determination of assistance demands and natural disaster recovery;

e) Comply with regulations on the natural disaster preparedness and recovery fund;

g) Organize rehearsals and provide training for forces involved in natural disaster preparedness and recovery, search and rescue;

h) Disseminate information about and raise community awareness of natural disaster preparedness and recovery;

i) Direct, implement and organize the implementation of measures to gradually increase civil capacity for natural disaster response;

k) Provide human resources, equipment and combat gears for the Standing Office of the Command Center for Natural Disaster Management of the province; electronically connect with central natural disaster management agencies and natural disaster management agencies at all levels to serve command over natural disaster preparedness and recovery.

Article 21. Organizational structure and task of Command Centers for Natural Disaster Management of districts

1. The Command Center for Natural Disaster Management of a district shall be established by the President of the People’s Committee of the district and assist the People’s Committee of the district in inspecting, expediting and commanding natural disaster preparedness and recovery, search and rescue within the district. The Command Center for Natural Disaster Management of the district has its own seal and account, and is granted funding for operation.

2. The Command Center for Natural Disaster Management of a district includes:

a) The President of the People’s Committee of the district, the head of the Command Center;

b) A Deputy President of the People’s Committee of the district, the standing deputy head of the Command Center;

c) The head of division or head of the agency assigned to perform state management of natural disaster preparedness and recovery; the chief of the police authority of the district and Commanding Officer of Military Command of the district, deputy head of the Command Center;

d) Members, including heads or leaders of divisions, agencies and units related to natural disaster preparedness and recovery, search and rescue; leaders of Fatherland Front, Women's Union, Red Cross Society, Ho Chi Minh Communist Youth Union and social organizations of the province join the Command Center for Natural Disaster Management.

3. According to actual condition, the President of the People's Committee of the district shall decide to assign a specialized division affiliated to the People’s Committee of the district to act as a Standing Office of the Command Center for Natural Disaster Management.

4. Tasks of a Command Center for Natural Disaster Management of a district:

a) Assist the People’s Committee of the district in natural disaster management as prescribed in Clause 1 Article 43 of the Law on Natural Disaster Preparedness and Recovery;

b) Direct and expedite the preparation and submission of natural disaster response plans for approval;

c) Command and organize the response to natural disaster response, search and rescue during natural disasters within the district;

d) Inspect and expedite the natural disaster preparedness and recovery by local agencies and agencies;

dd) Assist the People’s Committee of the district in directing, inspecting and consolidating reports on consequence assessment and natural disaster recovery;

e) Provide training for forces involved in natural disaster preparedness and recovery, search and rescue;

g) Disseminate information about and carry out activities aimed at raising community awareness of natural disaster preparedness and recovery;

h) Comply with regulations on the natural disaster preparedness and recovery fund.

Article 22. Organizational structure and task of Command Centers for Natural Disaster Management of communes

1. The Command Center for Natural Disaster Management of a commune shall be established by the President of the People’s Committee of the commune and assist the People’s Committee of the commune in inspecting, expediting and commanding natural disaster preparedness and recovery, search and rescue within the commune.

2. The Command Center for Natural Disaster Management of a commune includes:

a) President of the People’s Committee of the commune, the head of the Command Center;

b) A Deputy President of the People’s Committee of the commune, the standing deputy head of the Command Center;

c) Chief of the police authority of the commune, the deputy head of the Command Center, and chief of military unit of the commune, the deputy head in charge of voluntary forces of the commune;

d) Members, including officials in charge of irrigation and agriculture and heads of political organizations of the commune.

dd) Commune officials performing state management of natural disaster preparedness and recovery and acting as a standing member of the Command Centers for Natural Disaster Management.

3. The Command Center for Natural Disaster Management of the commune is located in the People’s Committee of the commune. The Command Center is entitled to use the seal of the People’s Committee of the commune and assign its officials to act as standing members and is granted funding for operation.

4. Tasks of the Command Center for Natural Disaster Management of a commune:

a) Assist the People’s Committee of the commune in natural disaster management as prescribed in Clause 2 Article 43 of the Law on Natural Disaster Preparedness and Recovery;

b) Broadcast news about commands over natural disaster response given by all levels to the community;

c) Command natural disaster response, search and rescue during natural disasters within the commune;

d) Direct and expedite the preparation and approval for natural disaster response plans;

dd) Inspect and expedite the natural disaster preparedness and recovery by organizations and individuals within the commune;

e) Take charge of assisting the People’s Committee of the commune in establishing, training and maintaining voluntary forces of the commune, especially militia and self-defense forces, Red Cross Society, Ho Chi Minh Communist Youth Union and other organizations within the commune;

g) Comply with regulations on the natural disaster preparedness and recovery fund;

h) Disseminate information about and raise community awareness of natural disaster preparedness and recovery on an annual basis.

Article 23. Command Centers for Natural Disaster Management of groups,corporations and enterprises

According to specific condition, the head of an organization shall decide to establish a Command Center for Natural Disaster Management to perform the tasks related to natural disaster preparedness and recovery as prescribed by law.

Article 24. Mechanism for cooperation between the Central Command Center for Natural Disaster Management and the National Committee for Natural Disaster Management and Response

1. The Central Command Center for Natural Disaster Management shall take charge and cooperate with the National Committee for Natural Disaster Management and Response in promulgating instructional documents to respond to each natural disaster.

2. The Central Command Center for Natural Disaster Management and the National Committee for Natural Disaster Management and Response shall proactively notify and cooperate with each other immediately after being informed of incidents occurring during a natural disaster, and reach an agreement on remedial measures, mobilize forces and prepare vehicles, materials and equipment for natural disaster response.

3. The Central Command Center for Natural Disaster Management shall take charge of mobilizing resources and directing natural disaster response and recovery, and cooperate with the National Committee for Natural Disaster Management and Response in mobilizing and coordinating search and rescue forces to carry out search and rescue.

4. The Central Command Center for Natural Disaster Management shall agree with the National Committee for Natural Disaster Management and Response about the request for assistance to be submitted to countries in terms of search and rescue forces in case of serious natural disaster before notifying the Prime Minister for decision.

Chapter III

IMPLEMENTATION CLAUSE

Article 25. Effect

1. This Decree comes into force from January 01, 2019.

2. This Decree replaces the Decree No. 66/2014/ND-CP dated July 04, 2014.

Article 26. Responsibility for implementation

Ministers, heads of ministerial agencies, heads of Governmental agencies and Presidents of People’s Committees at all levels and relevant organizations and individuals are responsible for the implementation of this Decree./.

NGHỊ ĐỊNH

QUY ĐỊNH CHI TIẾT THI HÀNH MỘT SỐ ĐIỀU CỦA LUẬT PHÒNG, CHỐNG THIÊN TAI

Căn cứ Luật tổ chức Chính phủ ngày 19 tháng 6 năm 2015 ;

Căn cứ Luật phòng, chống thiên tai ngày 19 tháng 6 năm 2013;

Theo đề nghị của Bộ trưởng Bộ Nông nghiệp và Phát triển nông thôn;

Chính phủ ban hành Nghị định quy định chi tiết, hướng dẫn thi hành một số điều của Luật phòng, chống thiên tai.

Chương I

QUY ĐỊNH CHUNG

Điều 1. Phạm vi điều chỉnh

Nghị định này quy định chi tiết, hướng dẫn thi hành một số điều của Luật phòng, chống thiên tai, bao gồm: Trách nhiệm truyền tin, tần suất, thời lượng phát tin, mạng lưới, thiết bị thông tin phục vụ hoạt động chỉ đạo, chỉ huy ứng phó thiên tai; phân công, phân cấp trách nhiệm và phối hợp trong ứng phó thiên tai; huy động, quyên góp và phân bổ nguồn lực cứu trợ, hỗ trợ khắc phục hậu quả thiên tai; quyền và nghĩa vụ của tổ chức, cá nhân nước ngoài, tổ chức quốc tế tham gia hoạt động ứng phó và khắc phục hậu quả thiên tai tại Việt Nam; cơ cấu tổ chức, nhiệm vụ của cơ quan chỉ đạo, chỉ huy về phòng, chống thiên tai và cơ chế phối hợp giữa Ban Chỉ đạo Trung ương về phòng, chống thiên tai và Ủy ban Quốc gia Ứng phó sự cố, thiên tai và Tìm kiếm cứu nạn.

Điều 2. Đối tượng áp dụng

Nghị định này áp dụng đối với cơ quan, tổ chức, hộ gia đình, cá nhân Việt Nam; tổ chức, cá nhân nước ngoài, tổ chức quốc tế đang sinh sống, hoạt động hoặc tham gia phòng, chống thiên tai tại Việt Nam.

Chương II

QUY ĐỊNH CỤ THỂ

Mục 1. TRÁCH NHIỆM TRUYỀN TIN; TẦN SUẤT, THỜI LƯỢNG PHÁT TIN; MẠNG LƯỚI THÔNG TIN, TRANG THIẾT BỊ PHỤC VỤ HOẠT ĐỘNG CHỈ ĐẠO, CHỈ HUY ỨNG PHÓ THIÊN TAI

Điều 3. Cơ quan có trách nhiệm truyền tin

1. Đài Truyền hình Việt Nam, Đài Tiếng nói Việt Nam, Thông tấn xã Việt Nam, hệ thống đài thông tin duyên hải, đài phát thanh, truyền hình các tỉnh, thành phố trực thuộc trung ương và các cơ quan thông tấn, báo chí có trách nhiệm phát các văn bản chỉ đạo ứng phó thiên tai của Thủ tướng Chính phủ, Ban Chỉ đạo Trung ương về phòng, chống thiên tai và Ủy ban Quốc gia ứng phó sự cố, thiên tai và Tìm kiếm cứu nạn.

2. Ủy ban nhân dân các cấp chịu trách nhiệm chỉ đạo, tổ chức phổ biến kịp thời và chính xác các bản tin dự báo, cảnh báo thiên tai, văn bản chỉ đạo, chỉ huy ứng phó thiên tai của Thủ tướng Chính phủ, Ban Chỉ đạo Trung ương về phòng, chống thiên tai, Ủy ban Quốc gia Ứng phó sự cố, thiên tai và Tìm kiếm cứu nạn, Ban Chỉ huy phòng, chống thiên tai và tìm kiếm cứu nạn cấp trên và cùng cấp trên địa bàn được cảnh báo.

3. Các bộ, cơ quan ngang bộ, cơ quan thuộc Chính phủ có trách nhiệm chỉ đạo hệ thống thông tin chuyên ngành để phát thông tin có liên quan đến phòng, chống thiên tai trong lĩnh vực quản lý.

4. Bộ Thông tin và Truyền thông hướng dẫn hoặc trình cơ quan có thẩm quyền ban hành văn bản hướng dẫn việc tổ chức nhắn tin dự báo, cảnh báo thiên tai.

Điều 4. Tần suất, thời lượng phát tin chỉ đạo, chỉ huy ứng phó thiên tai

1. Đài Truyền hình Việt Nam, Đài Tiếng nói Việt Nam, Thông tấn xã Việt Nam, hệ thống đài thông tin duyên hải, đài phát thanh, truyền hình các tỉnh, thành phố trực thuộc trung ương và các cơ quan thông tấn, báo chí và các hệ thống thông tin chuyên dùng liên quan phát, đưa tin đầy đủ nội dung chỉ đạo trong các văn bản chỉ đạo ứng phó thiên tai của Thủ tướng Chính phủ, Ban Chỉ đạo Trung ương về phòng, chống thiên tai và Ủy ban Quốc gia Ứng phó sự cố, thiên tai và Tìm kiếm cứu nạn ngay sau khi nhận được và phát lại với tần suất tối thiểu 3 giờ/lần đối với thiên tai đến cấp độ 3, tối thiểu 01 giờ/lần đối với thiên tai trên cấp độ 3 cho đến khi có văn bản chỉ đạo mới hoặc hoạt động ứng phó thiên tai đã được thực hiện hoặc diễn biến thiên tai đã thay đổi không còn ảnh hưởng.

2. Thời lượng phát tin chỉ đạo, chỉ huy ứng phó thiên tai bao gồm thời gian phát đầy đủ nội dung văn bản chỉ đạo, chỉ huy ứng phó thiên tai của cơ quan có thẩm quyền, bản tin dự báo, cảnh báo thiên tai, nêu rõ sự thay đổi của nội dung văn bản chỉ đạo, chỉ huy, cập nhật tình hình diễn biến thiên tai, các hoạt động ứng phó thiên tai.

3. Đài Phát thanh, truyền hình các cấp phát văn bản chỉ huy ứng phó thiên tai của Ban Chỉ huy phòng, chống thiên tai và tìm kiếm cứu nạn cùng cấp, văn bản chỉ đạo, chỉ huy của cơ quan cấp trên ngay sau khi nhận được và phát lại theo yêu cầu của Ban Chỉ huy phòng, chống thiên tai và tìm kiếm cứu nạn cùng cấp, phù hợp với diễn biến thiên tai và ứng phó của địa phương.

Khi xảy ra thiên tai cấp độ 2, 3, 4 trên địa bàn, tần suất phát tin theo yêu cầu của Ban Chỉ huy phòng, chống thiên tai và tìm kiếm cứu nạn cùng cấp hoặc cấp trên.

4. Ban Chỉ huy phòng, chống thiên tai và tìm kiếm cứu nạn các cấp hướng dẫn cụ thể nội dung và tần suất, thời lượng phát tin chỉ huy ứng phó thiên tai trên các hệ thống thông tin trên địa bàn. Những nơi không có phát thanh, truyền thanh, truyền hình sử dụng các phương tiện, dụng cụ, hiệu lệnh truyền thống theo quy ước của địa phương để thông báo tới các hộ gia đình thuộc diện bị ảnh hưởng bởi thiên tai.

Điều 5. Mạng lưới thông tin, trang thiết bị phục vụ hoạt động chỉ đạo, chỉ huy ứng phó thiên tai

1. Mạng thông tin công cộng phục vụ hoạt động chỉ đạo, chỉ huy phòng chống thiên tai, bao gồm:

a) Mạng viễn thông cố định mặt đất, vệ tinh;

b) Mạng viễn thông di động mặt đất, vệ tinh;

c) Mạng truyền dẫn, phát sóng phát thanh, truyền hình;

d) Mạng bưu chính công cộng.

2. Mạng thông tin chuyên dùng, bao gồm:

a) Đường dây nóng phục vụ trực tiếp công tác chỉ đạo, chỉ huy phòng, chống thiên tai;

b) Mạng viễn thông dùng riêng phục vụ cơ quan Đảng, Nhà nước, quốc phòng, an ninh;

c) Mạng bưu chính phục vụ cơ quan Đảng, Nhà nước, quốc phòng, an ninh;

d) Mạng viễn thông dùng riêng, mạng bưu chính của cơ quan, tổ chức, doanh nghiệp khác;

đ) Mạng thông tin cảnh báo sóng thần, kết hợp cảnh báo thiên tai khác;

e) Mạng lưới thông tin cảnh báo từ hệ thống quan trắc chuyên dùng.

3. Thiết bị thông tin phục vụ hoạt động chỉ đạo, chỉ huy phòng, chống thiên tai bao gồm:

a) Điện thoại;

b) Máy tính;

c) Máy fax;

d) Thiết bị phát thanh;

đ) Thiết bị truyền hình;

e) Thiết bị quan trắc tự động truyền tin;

g) Mạng thông tin công cộng, thiết bị quan trắc giám sát chuyên dùng tự động truyền tin; hệ thống thông tin cảnh báo sớm;

h) Phương tiện, dụng cụ thông tin khác.

4. Căn cứ yêu cầu, nhiệm vụ phòng chống thiên tai, các bộ, cơ quan ngang bộ, cơ quan trực thuộc Chính phủ và Ủy ban nhân dân các cấp lập kế hoạch xây dựng và mua sắm trang thiết bị thông tin; trình cấp có thẩm quyền phê duyệt; tổ chức xây dựng, mua sắm, quản lý và sử dụng theo quy định của pháp luật.

Mục 2. PHÂN CÔNG, PHÂN CẤP TRÁCH NHIỆM VÀ PHỐI HỢP TRONG ỨNG PHÓ THIÊN TAI

Điều 6. Cấp độ rủi ro thiên tai

Rủi ro thiên tai được phân thành 05 cấp tăng dần về mức độ rủi ro, bao gồm: Cấp độ 1, cấp độ 2, cấp độ 3, cấp độ 4 và cấp độ 5 (tình trạng khẩn cấp về thiên tai). Thủ tướng Chính phủ quy định chi tiết về cấp độ rủi ro thiên tai.

Điều 7. Phân công, phân cấp trách nhiệm và phối hợp trong ứng phó rủi ro thiên tai cấp độ 1

1. Chủ tịch Ủy ban nhân dân cấp xã có trách nhiệm trực tiếp chỉ huy, huy động nguồn lực tại chỗ để ứng phó kịp thời ngay khi thiên tai xảy ra; báo cáo và chịu trách nhiệm thực hiện chỉ đạo, chỉ huy của các cơ quan phòng chống thiên tai cấp trên.

2. Chủ tịch Ủy ban nhân dân cấp xã được quyền huy động các nguồn lực sau để ứng phó thiên tai:

a) Dân quân tự vệ, thanh niên, các tổ chức, cá nhân trên địa bàn và các tổ chức, cá nhân tình nguyện;

b) Vật tư dự trữ do nhân dân chuẩn bị, vật tư, trang thiết bị, phương tiện của cấp xã và tổ chức, cá nhân hoạt động trên địa bàn.

3. Các lực lượng tham gia ứng phó thiên tai trên địa bàn cấp xã phải phối hợp chặt chẽ theo sự chỉ huy của Chủ tịch Ủy ban nhân dân cấp xã hoặc người được ủy quyền.

4. Trong trường hợp vượt quá khả năng ứng phó của cấp xã, Chủ tịch Ủy ban nhân dân cấp xã đề nghị Ủy ban nhân dân, Ban Chỉ huy phòng, chống thiên tai và tìm kiếm cứu nạn cấp huyện hỗ trợ.

5. Chủ tịch Ủy ban nhân dân cấp huyện có trách nhiệm trực tiếp chỉ huy và huy động nguồn lực theo thẩm quyền để ứng phó thiên tai trong trường hợp thiên tai cấp độ 1 xảy ra trong phạm vi từ hai xã trở lên hoặc khi nhận được yêu cầu trợ giúp của Chủ tịch Ủy ban nhân dân cấp xã; chịu trách nhiệm thực hiện chỉ huy, chỉ đạo của các cơ quan chỉ đạo phòng chống thiên tai cấp trên.

6. Chủ tịch Ủy ban nhân dân cấp huyện được quyền huy động các nguồn lực sau để ứng phó thiên tai:

a) Dân quân tự vệ, thanh niên, các tổ chức, cá nhân trên địa bàn và các tổ chức, cá nhân tình nguyện;

b) Vật tư, trang thiết bị, phương tiện của cấp huyện và các tổ chức, cá nhân hoạt động trên địa bàn.

Điều 8. Phân công, phân cấp trách nhiệm và phối hợp trong ứng phó rủi ro thiên tai cấp độ 2

1. Chủ tịch Ủy ban nhân dân cấp tỉnh chỉ huy các địa phương, cơ quan, đơn vị trên địa bàn triển khai ứng phó thiên tai; huy động nguồn lực theo thẩm quyền để ứng phó kịp thời, phù hợp với diễn biến thiên tai tại địa phương; báo cáo và chịu trách nhiệm thực hiện chỉ đạo của Thủ tướng Chính phủ, Ban Chỉ đạo Trung ương về phòng, chống thiên tai và Ủy ban Quốc gia Ứng phó sự cố, thiên tai và Tìm kiếm cứu nạn.

2. Chủ tịch Ủy ban nhân dân cấp tỉnh được quyền huy động các nguồn lực sau để ứng phó thiên tai:

a) Lực lượng quân đội, công an, dân quân tự vệ, thanh niên, các tổ chức, cá nhân, lực lượng tìm kiếm cứu nạn, lực lượng kiểm ngư và các tổ chức, cá nhân tình nguyện;

b) Vật tư, trang thiết bị, phương tiện của cấp tỉnh, vật tư dự trữ phòng, chống thiên tai và của tổ chức, cá nhân hoạt động trên địa bàn.

3. Chủ tịch Ủy ban nhân dân cấp huyện, cấp xã tổ chức thực hiện nhiệm vụ quy định tại Điều 7; tuân thủ sự chỉ huy của cơ quan cấp trên; hướng dẫn và tổ chức sơ tán người đến nơi an toàn; Chủ tịch Ủy ban nhân dân cấp huyện quyết định tổ chức cưỡng chế sơ tán trường hợp tổ chức, cá nhân không tự giác chấp hành chỉ đạo, chỉ huy, hướng dẫn sơ tán phòng, tránh thiên tai vì mục đích an toàn cho người.

4. Trong trường hợp vượt quá khả năng ứng phó của cấp tỉnh, Chủ tịch Ủy ban nhân dân cấp tỉnh báo cáo, đề nghị Ban Chỉ đạo Trung ương về phòng, chống thiên tai và Ủy ban Quốc gia Ứng phó sự cố, thiên tai và Tìm kiếm cứu nạn hỗ trợ.

5. Ban Chỉ đạo Trung ương về phòng, chống thiên tai chủ trì, phối hợp với Ủy ban Quốc gia ứng phó sự cố, thiên tai và Tìm kiếm cứu nạn có trách nhiệm trực tiếp chỉ đạo, điều hành hoặc huy động các nguồn lực hỗ trợ ứng phó khi xuất hiện các tình huống thiên tai có diễn biến phức tạp, nguy cơ gây hậu quả lớn hoặc khi nhận được yêu cầu hỗ trợ của Chủ tịch Ủy ban nhân dân, Trưởng ban Ban Chỉ huy phòng, chống thiên tai và tìm kiếm cứu nạn cấp tỉnh. Các lực lượng tham gia hỗ trợ phòng, chống thiên tai tại địa phương phải phối hợp chặt chẽ và theo sự chỉ huy thống nhất của Chủ tịch Ủy ban nhân dân cấp tỉnh hoặc người được ủy quyền.

Điều 9. Phân công, phân cấp trách nhiệm và phối hợp trong ứng phó rủi ro thiên tai cấp độ 3

1. Ban Chỉ đạo Trung ương về phòng, chống thiên tai chỉ đạo các địa phương, các bộ, cơ quan ngang bộ, cơ quan thuộc Chính phủ triển khai các biện pháp ứng phó thiên tai; quyết định các biện pháp cấp bách và huy động nguồn lực theo thẩm quyền để hỗ trợ các địa phương ứng phó thiên tai khi có yêu cầu.

2. Ủy ban Quốc gia ứng phó sự cố, thiên tai và Tìm kiếm cứu nạn căn cứ tình huống cụ thể chủ trì, phối hợp với các bộ ngành, địa phương chỉ đạo, bố trí sẵn sàng lực lượng, phương tiện triển khai công tác tìm kiếm cứu nạn và tham gia điều phối các hoạt động ứng phó thiên tai.

3. Ban Chỉ huy phòng, chống thiên tai và tìm kiếm cứu nạn các bộ, cơ quan ngang bộ, cơ quan thuộc Chính phủ chịu trách nhiệm triển khai các biện pháp ứng phó thiên tai trong phạm vi quản lý, đồng thời tham gia ứng phó thiên tai theo sự chỉ đạo và huy động của Ban Chỉ đạo Trung ương về phòng, chống thiên tai và Ủy ban Quốc gia Ứng phó sự cố, thiên tai và Tìm kiếm cứu nạn.

4. Chủ tịch Ủy ban nhân dân cấp tỉnh chịu trách nhiệm chỉ huy, huy động nguồn lực theo thẩm quyền, triển khai các biện pháp ứng phó thiên tai trên địa bàn.

5. Chủ tịch Ủy ban nhân dân cấp huyện, cấp xã thực hiện nhiệm vụ theo quy định tại khoản 3 Điều 8 Nghị định này phù hợp với tình huống cụ thể tại địa phương; tuân thủ sự chỉ đạo, chỉ huy của cơ quan cấp trên.

6. Trường hợp rủi ro thiên tai trên cấp độ 3 hoặc thiên tai có diễn biến phức tạp nguy cơ cao gây hậu quả nghiêm trọng, Ban Chỉ đạo Trung ương về phòng, chống thiên tai báo cáo Thủ tướng Chính phủ trực tiếp chỉ đạo.

Điều 10. Phân công, phân cấp trách nhiệm và phối hợp trong ứng phó rủi ro thiên tai cấp độ 4

1. Thủ tướng Chính phủ chỉ đạo các bộ, cơ quan ngang bộ, cơ quan thuộc Chính phủ và các địa phương liên quan triển khai các biện pháp ứng phó thiên tai.

2. Ban Chỉ đạo Trung ương về phòng, chống thiên tai chịu trách nhiệm tham mưu cho Chính phủ, Thủ tướng Chính phủ các biện pháp ứng phó thiên tai.

3. Ủy ban Quốc gia Ứng phó sự cố, thiên tai và Tìm kiếm cứu nạn chủ trì, phối hợp với các bộ ngành, địa phương chỉ đạo, bố trí, sẵn sàng lực lượng, phương tiện triển khai công tác tìm kiếm cứu nạn và tham gia điều phối các hoạt động ứng phó thiên tai.

4. Bộ trưởng, Thủ trưởng cơ quan ngang bộ, cơ quan thuộc Chính phủ chịu trách nhiệm triển khai các biện pháp ứng phó thiên tai trong phạm vi quản lý, đồng thời tham gia ứng phó thiên tai theo sự chỉ đạo và huy động của Thủ tướng Chính phủ, Ban Chỉ đạo Trung ương về phòng, chống thiên tai và Ủy ban Quốc gia Ứng phó sự cố, thiên tai và Tìm kiếm cứu nạn.

5. Chủ tịch Ủy ban nhân dân cấp tỉnh có trách nhiệm chỉ huy, huy động nguồn lực theo thẩm quyền triển khai các biện pháp ứng phó thiên tai trên địa bàn, tuân thủ sự chỉ đạo của Thủ tướng Chính phủ, Ban Chỉ đạo Trung ương về phòng, chống thiên tai và Ủy ban Quốc gia Ứng phó sự cố, thiên tai và Tìm kiếm cứu nạn.

6. Chủ tịch Ủy ban nhân dân cấp huyện và cấp xã thực hiện nhiệm vụ theo quy định tại khoản 3 Điều 8 Nghị định này phù hợp với tình huống cụ thể tại địa phương; tuân thủ sự chỉ đạo, chỉ huy của cơ quan cấp trên.

Điều 11. Phân công, phân cấp trách nhiệm và phối hợp trong ứng phó tình trạng khẩn cấp về thiên tai

1. Trường hợp thiên tai vượt cấp độ 4, Ban Chỉ đạo Trung ương về phòng, chống thiên tai báo cáo Thủ tướng Chính phủ đề nghị Chủ tịch nước ban bố tình trạng khẩn cấp về thiên tai.

2. Việc phân công, phân cấp trách nhiệm và phối hợp trong ứng phó tình trạng khẩn cấp về thiên tai thực hiện theo quy định của pháp luật về tình trạng khẩn cấp.

Mục 3. HUY ĐỘNG, QUYÊN GÓP VÀ PHÂN BỔ NGUỒN LỰC CỨU TRỢ, HỖ TRỢ KHẮC PHỤC HẬU QUẢ THIÊN TAI

Điều 12. Huy động và phân bổ nguồn lực hỗ trợ khắc phục hậu quả thiên tai

1. Ủy ban nhân dân các cấp quyết định sử dụng dự phòng ngân sách địa phương và các nguồn lực khác của địa phương để khắc phục kịp thời hậu quả thiên tai trên địa bàn.

2. Chủ tịch Ủy ban nhân dân cấp tỉnh quyết định sử dụng Quỹ phòng, chống thiên tai để khắc phục hậu quả thiên tai theo quy định về Quỹ phòng, chống thiên tai.

3. Bộ trưởng, Thủ trưởng cơ quan ngang bộ, cơ quan thuộc Chính phủ trong phạm vi chức năng, quyền hạn của mình có trách nhiệm bố trí nguồn lực để khắc phục hậu quả thiên tai thuộc phạm vi quản lý và hỗ trợ các địa phương khắc phục hậu quả thiên tai.

4. Ban Chỉ đạo Trung ương về phòng chống thiên tai tổng hợp thiệt hại, nhu cầu cứu trợ, hỗ trợ khẩn cấp, đề xuất Chính phủ, Thủ tướng Chính phủ quyết định sử dụng dự phòng ngân sách trung ương, dự trữ quốc gia, các nguồn lực hợp pháp khác để hỗ trợ các địa phương, các bộ, cơ quan ngang bộ, cơ quan thuộc Chính phủ khắc phục hậu quả thiên tai.

5. Thủ tướng Chính phủ quyết định sử dụng nguồn dự phòng ngân sách trung ương, xuất hàng dự trữ quốc gia và các nguồn lực hợp pháp khác để hỗ trợ các địa phương, các bộ, cơ quan ngang bộ, cơ quan thuộc Chính phủ khắc phục hậu quả thiên tai theo quy định của pháp luật về ngân sách nhà nước, pháp luật về dự trữ quốc gia.

6. Ủy ban nhân dân các cấp ngay sau khi nhận được nguồn lực hỗ trợ của Nhà nước có trách nhiệm phân bổ kịp thời, đúng đối tượng và chỉ đạo thực hiện khắc phục hậu quả thiên tai tại địa phương.

7. Chậm nhất 30 ngày kể từ khi nhận được nguồn hỗ trợ, cứu trợ thiên tai, Ủy ban nhân dân cấp tỉnh, các bộ, cơ quan ngang bộ, cơ quan thuộc Chính phủ có trách nhiệm báo cáo bằng văn bản với Ban Chỉ đạo Trung ương về phòng, chống thiên tai, Bộ Tài chính, Bộ Kế hoạch và Đầu tư, Bộ Lao động - Thương binh và Xã hội về tiếp nhận, phân bổ, sử dụng nguồn hỗ trợ, cứu trợ.

Điều 13. Vận động, quyên góp và phân bổ nguồn lực từ cộng đồng

Việc vận động, quyên góp và phân bổ nguồn lực từ cộng đồng thực hiện theo quy định của pháp luật về vận động, tiếp nhận, phân phối và sử dụng các nguồn đóng góp tự nguyện hỗ trợ nhân dân khắc phục khó khăn do thiên tai và các quy định của pháp luật về hoạt động của Mặt trận Tổ quốc Việt Nam, Hội chữ thập đỏ Việt Nam.

Mục 4. QUYỀN VÀ NGHĨA VỤ CỦA TỔ CHỨC, CÁ NHÂN NƯỚC NGOÀI, TỔ CHỨC QUỐC TẾ THAM GIA HOẠT ĐỘNG ỨNG PHÓ VÀ KHẮC PHỤC HẬU QUẢ THIÊN TAI TẠI VIỆT NAM

Điều 14. Thuế, lệ phí nhập khẩu, xuất khẩu đối với phương tiện, trang thiết bị, hàng hóa phục vụ hoạt động cứu trợ khẩn cấp, tìm kiếm cứu nạn, cứu trợ, hỗ trợ thiên tai

Tổ chức, cá nhân nước ngoài, tổ chức quốc tế tham gia hoạt động ứng phó và khắc phục hậu quả thiên tai tại Việt Nam nhập khẩu, tái xuất khẩu phương tiện, trang thiết bị, hàng hóa để phục vụ công tác cứu trợ khẩn cấp, tìm kiếm cứu nạn, cứu trợ, hỗ trợ thiên tai được miễn thuế, lệ phí nhập khẩu, xuất khẩu theo quy định tại điểm a khoản 1 Điều 41 Luật phòng, chống thiên tai . Trường hợp để lại Việt Nam sử dụng vào mục đích khác phải chịu thuế theo quy định của pháp luật Việt Nam.

Điều 15. Đăng ký hoạt động ứng phó và khắc phục hậu quả thiên tai tại Việt Nam

1. Tổ chức cá nhân nước ngoài, tổ chức quốc tế trước khi vào Việt Nam thực hiện hoạt động ứng phó và khắc phục hậu quả thiên tai gửi hồ sơ đăng ký đến Bộ Nông nghiệp và Phát triển nông thôn. Hồ sơ đăng ký bao gồm:

a) Đơn (hoặc văn bản) đề nghị tham gia ứng phó và khắc phục hậu quả thiên tai tại Việt Nam, trong đó bao gồm các nội dung: Tên tổ chức, cá nhân; mục đích của hoạt động; thời gian, địa điểm dự kiến thực hiện;

b) Danh mục hàng hóa, vật tư, trang thiết bị hỗ trợ;

c) Danh sách người tham gia.

2. Trong thời gian 02 ngày kể từ ngày nhận được hồ sơ, Bộ Nông nghiệp và Phát triển nông thôn có trách nhiệm thông báo kết quả xử lý hồ sơ đến tổ chức, cá nhân nộp hồ sơ đăng ký và các cơ quan liên quan.

Điều 16. Nhập cảnh, xuất cảnh; thủ tục nhập khẩu, xuất khẩu đối với phương tiện, trang thiết bị, hàng hóa phục vụ hoạt động ứng phó khẩn cấp và tìm kiếm cứu nạn, cứu trợ, hỗ trợ khắc phục hậu quả thiên tai

1. Người được phép đến Việt Nam hoạt động ứng phó và khắc phục hậu quả thiên tai được làm thủ tục nhập cảnh, xuất cảnh ưu tiên tại các cửa khẩu; trường hợp ứng phó khẩn cấp, nếu chưa có thị thực, được cấp thị thực tại cửa khẩu.

2. Phương tiện, trang thiết bị, hàng hóa được phép nhập khẩu, tái xuất sau khi hoàn thành hoạt động tìm kiếm cứu nạn, cứu trợ, hỗ trợ thiên tai được ưu tiên làm thủ tục thông quan tại các cửa khẩu.

Điều 17. Lưu trú đối với người nước ngoài tham gia hoạt động ứng phó và khắc phục hậu quả thiên tai tại Việt Nam

1. Người được phép đến Việt Nam hoạt động ứng phó và khắc phục hậu quả thiên tai được hướng dẫn nơi ở, làm việc và thủ tục tạm trú phù hợp với điều kiện cụ thể.

2. Cơ quan, địa phương tiếp nhận hỗ trợ có trách nhiệm hướng dẫn thủ tục đăng ký tạm trú, nơi ở và làm việc cho các cá nhân, tổ chức đến Việt Nam hoạt động ứng phó và khắc phục hậu quả thiên tai.

Mục 5. CƠ CẤU TỔ CHỨC, NHIỆM VỤ CỦA CƠ QUAN CHỈ ĐẠO, CHỈ HUY VỀ PHÒNG, CHỐNG THIÊN TAI VÀ CƠ CHẾ PHỐI HỢP GIỮA BAN CHỈ ĐẠO TRUNG ƯƠNG VỀ PHÒNG, CHỐNG THIÊN TAI VÀ ỦY BAN QUỐC GIA ỨNG PHÓ SỰ CỐ, THIÊN TAI VÀ TÌM KIẾM CỨU NẠN

Điều 18. Cơ cấu tổ chức, nhiệm vụ của Ban Chỉ đạo Trung ương về phòng, chống thiên tai

1. Ban Chỉ đạo Trung ương về phòng, chống thiên tai do Thủ tướng Chính phủ thành lập, làm nhiệm vụ điều phối liên ngành giúp Chính phủ, Thủ tướng Chính phủ trong việc tổ chức, chỉ đạo, điều hành công tác phòng ngừa, ứng phó và khắc phục hậu quả thiên tai trên phạm vi cả nước. Ban Chỉ đạo Trung ương về phòng, chống thiên tai được sử dụng dấu quốc huy để thực hiện các nhiệm vụ của Ban. Các thành viên của Ban hoạt động theo chế độ kiêm nhiệm.

2. Ban Chỉ đạo Trung ương về phòng, chống thiên tai gồm các thành viên:

a) Phó Thủ tướng Chính phủ làm Trưởng ban;

b) Các Phó Trưởng ban, gồm: Phó Trưởng ban thường trực là Bộ trưởng Bộ Nông nghiệp và Phát triển nông thôn, 01 lãnh đạo Bộ Quốc phòng và Tổng Cục trưởng Tổng cục Phòng, chống thiên tai;

c) Các ủy viên gồm: Bộ trưởng các Bộ: Công Thương, Giao thông vận tải, Thông tin và Truyền thông, Xây dựng, Lao động - Thương binh và Xã hội, Tài chính, Kế hoạch và Đầu tư và đại diện lãnh đạo một số bộ, cơ quan ngang bộ, cơ quan thuộc Chính phủ; Tổng Giám đốc Đài Truyền hình Việt Nam, Tổng Giám đốc Đài Tiếng nói Việt Nam, Tổng Giám đốc Thông tấn xã Việt Nam; Tổng cục trưởng Tổng cục Phòng, chống thiên tai, Chánh văn phòng Ủy ban Quốc gia ứng phó sự cố, thiên tai và Tìm kiếm cứu nạn;

d) Căn cứ yêu cầu công tác, Trưởng ban Ban Chỉ đạo Trung ương về phòng, chống thiên tai quyết định mời đại diện lãnh đạo các cơ quan và tổ chức có liên quan: Ủy ban Trung ương Mặt trận Tổ quốc Việt Nam, Trung ương Hội Liên hiệp Phụ nữ Việt Nam, Trung ương Đoàn Thanh niên Cộng sản Hồ Chí Minh, Trung ương Hội Chữ thập đỏ Việt Nam và các cơ quan, tổ chức liên quan khác tham gia Ban Chỉ đạo Trung ương về phòng chống thiên tai.

3. Bộ Nông nghiệp và Phát triển nông thôn là cơ quan thường trực của Ban Chỉ đạo Trung ương về phòng, chống thiên tai; sử dụng bộ máy của Tổng cục Phòng chống thiên tai thực hiện nhiệm vụ Văn phòng thường trực của Ban Chỉ đạo Trung ương về phòng, chống thiên tai (sau đây gọi tắt là Văn phòng thường trực Ban Chỉ đạo).

Văn phòng thường trực Ban Chỉ đạo Trung ương về phòng, chống thiên tai có con dấu, được cấp kinh phí và mở tài khoản tại Kho bạc Nhà nước để hoạt động. Trưởng Ban Chỉ đạo Trung ương về phòng, chống thiên tai quy định về chức năng, nhiệm vụ và quy chế hoạt động của Văn phòng thường trực Ban Chỉ đạo.

4. Nhiệm vụ của Ban Chỉ đạo Trung ương về phòng, chống thiên tai:

a) Hướng dẫn việc xây dựng, đôn đốc thực hiện chiến lược, kế hoạch quốc gia, chính sách, pháp luật về phòng, chống thiên tai;

b) Chủ trì hướng dẫn xây dựng phương án ứng phó thiên tai;

c) Chỉ đạo, điều phối ứng phó và khắc phục hậu quả thiên tai trên phạm vi toàn quốc: Chỉ đạo ứng phó rủi ro thiên tai cấp độ 3; tham mưu chỉ đạo ứng phó rủi ro thiên tai cấp độ 4, 5; điều phối và hỗ trợ hoặc chỉ đạo các địa phương ứng phó rủi ro thiên tai cấp độ 1, 2 khi có diễn biến phức tạp, nguy cơ gây hậu quả lớn, nghiêm trọng;

d) Căn cứ diễn biến thiên tai và yêu cầu thực tế, quyết định các biện pháp cấp bách, huy động các nguồn lực của các bộ, cơ quan ngang bộ, cơ quan thuộc Chính phủ, của tổ chức, cá nhân để ứng phó và khắc phục hậu quả thiên tai theo quy định của Luật phòng, chống thiên tai và Nghị định này;

đ) Chỉ đạo công tác tổng hợp thiệt hại, nhu cầu hỗ trợ khẩn cấp và phục hồi, tái thiết của các địa phương, các bộ, ngành đề xuất với Chính phủ, Thủ tướng Chính phủ quyết định các biện pháp, sử dụng dự phòng ngân sách trung ương và các biện pháp, nguồn lực hợp khác phục vụ hoạt động ứng phó khẩn cấp và khắc phục hậu quả thiên tai trong phạm vi cả nước;

e) Kiểm tra, đôn đốc, hướng dẫn các bộ, ngành, địa phương thực hiện các hoạt động phòng, chống thiên tai theo quy định của pháp luật;

g) Chỉ đạo, tổ chức huấn luyện, đào tạo, diễn tập, tập huấn cho các lực lượng tham gia hoạt động phòng, chống thiên tai; Chỉ đạo, triển khai và tổ chức thực hiện các giải pháp nhằm từng bước nâng cao năng lực dân sự trong hoạt động ứng phó thiên tai;

h) Chỉ đạo, tổ chức thực hiện việc tăng cường cơ sở vật chất, trang thiết bị, vật tư, phương tiện chuyên dùng; xây dựng hệ thống cơ sở dữ liệu phục vụ hỗ trợ, tham mưu ra quyết định chỉ đạo điều hành phòng, chống thiên tai các cấp;

i) Tổ chức kêu gọi, tiếp nhận và triển khai các khoản hỗ trợ khẩn cấp trong và ngoài nước trong các tình huống khẩn cấp do thiên tai; là đầu mối chỉ đạo, điều phối chung công tác tiếp nhận, phân phối cứu trợ và khắc phục hậu quả thiên tai;

k) Tổ chức hướng dẫn, kiểm tra đôn đốc và tổng hợp kết quả triển khai thực hiện các nguồn lực hỗ trợ báo cáo Thủ tướng Chính phủ;

l) Chỉ đạo, tổ chức xây dựng tài liệu, hướng dẫn, tập huấn, phổ biến, truyền thông, nâng cao nhận thức cộng đồng về phòng, chống thiên tai hàng năm;

m) Hướng dẫn hoạt động của lực lượng xung kích phòng, chống thiên tai tại cơ sở.

Điều 19. Tổ chức, nhiệm vụ của Ban Chỉ huy phòng, chống thiên tai và tìm kiếm cứu nạn của bộ, cơ quan ngang bộ, cơ quan thuộc Chính phủ

1. Các Bộ: Quốc phòng, Công an, Nông nghiệp và Phát triển nông thôn, Giao thông vận tải, Xây dựng, Công Thương, Tài nguyên và Môi trường, Thông tin và Truyền thông, Y tế, Giáo dục và Đào tạo, Lao động - Thương binh và Xã hội, Văn hóa, Thể thao và Du lịch thành lập Ban Chỉ huy phòng, chống thiên tai và tìm kiếm cứu nạn cấp bộ.

2. Các bộ, cơ quan ngang bộ, cơ quan thuộc Chính phủ (trừ các bộ quy định tại khoản 1 Điều này) căn cứ nhiệm vụ được giao quyết định việc thành lập Ban Chỉ huy Phòng, chống thiên tai và tìm kiếm cứu nạn cấp bộ hoặc giao một cơ quan cấp Vụ trực thuộc kiêm nhiệm chức năng tham mưu cho Bộ trưởng, Thủ trưởng cơ quan về công tác phòng, chống thiên tai và tìm kiếm cứu nạn trong phạm vi quản lý.

3. Căn cứ yêu cầu, nhiệm vụ phòng, chống thiên tai và tìm kiếm cứu nạn, Bộ trưởng, Thủ trưởng cơ quan ngang bộ, cơ quan thuộc Chính phủ quyết định việc thành lập Ban Chỉ huy phòng, chống thiên tai và tìm kiếm cứu nạn của các đơn vị trực thuộc.

4. Tổ chức của Ban Chỉ huy Phòng, chống thiên tai và tìm kiếm cứu nạn cấp bộ:

a) Ban Chỉ huy Phòng, chống thiên tai và tìm kiếm cứu nạn các Bộ: Nông nghiệp và Phát triển nông thôn, Giao thông vận tải, Xây dựng, Công Thương, Thông tin và Truyền thông, Y tế, Giáo dục và Đào tạo, Lao động - Thương binh và Xã hội do Bộ trưởng làm Trưởng ban.

b) Ban Chỉ huy Phòng chống thiên tai và tìm kiếm cứu nạn các bộ, cơ quan ngang bộ, cơ quan thuộc Chính phủ quy định tại khoản 1 và 2 Điều này (trừ các bộ quy định tại điểm a khoản này) do 01 lãnh đạo cấp bộ làm Trưởng ban.

c) Căn cứ yêu cầu, nhiệm vụ, Bộ trưởng các bộ, Thủ trưởng cơ quan ngang bộ, cơ quan thuộc Chính phủ giao cơ quan chuyên môn tham mưu, giúp Bộ trưởng, Thủ trưởng cơ quan thực hiện nhiệm vụ quản lý về phòng, chống thiên tai thuộc phạm vi quản lý và kiêm nhiệm vụ Văn phòng thường trực Ban Chỉ huy Phòng, chống thiên tai và tìm kiếm cứu nạn;

d) Ban Chỉ huy phòng, chống thiên tai và tìm kiếm cứu nạn cấp bộ được sử dụng con dấu của bộ hoặc sử dụng con dấu riêng, Văn phòng thường trực có con dấu, được cấp kinh phí, mở tài khoản để hoạt động.

5. Nhiệm vụ của Ban Chỉ huy Phòng, chống thiên tai và tìm kiếm cứu nạn cấp bộ:

a) Tham mưu giúp Bộ trưởng thực hiện nhiệm vụ phòng, chống thiên tai và tìm kiếm cứu nạn trong phạm vi quản lý;

b) Phối hợp với các bộ, cơ quan ngang bộ và địa phương thực hiện nhiệm vụ phòng, chống thiên tai và tìm kiếm cứu nạn trong phạm vi cả nước theo chỉ đạo của Thủ tướng Chính phủ, Ban Chỉ đạo Trung ương về phòng, chống thiên tai, Ủy ban Quốc gia Ứng phó sự cố, thiên tai và Tìm kiếm cứu nạn;

c) Quyết định các biện pháp cấp bách, huy động theo thẩm quyền các nguồn lực của bộ để ứng phó và khắc phục kịp thời hậu quả thiên tai và tìm kiếm cứu nạn trong phạm vi quản lý của bộ và hỗ trợ các địa phương.

Điều 20. Tổ chức, nhiệm vụ của Ban Chỉ huy phòng, chống thiên tai và tìm kiếm cứu nạn cấp tỉnh

1. Ban Chỉ huy phòng, chống thiên tai và tìm kiếm cứu nạn cấp tỉnh do Chủ tịch Ủy ban nhân dân cấp tỉnh thành lập, giúp Ủy ban nhân dân cấp tỉnh chỉ huy, điều hành hoạt động phòng, chống thiên tai, tìm kiếm cứu nạn tại địa phương. Ban Chỉ huy phòng, chống thiên tai và tìm kiếm cứu nạn có con dấu, được cấp kinh phí, mở tài khoản để hoạt động.

2. Ban Chỉ huy phòng, chống thiên tai và tìm kiếm cứu nạn cấp tỉnh gồm các thành viên sau:

a) Chủ tịch Ủy ban nhân dân cấp tỉnh làm Trưởng ban;

b) Một Phó Chủ tịch Ủy ban nhân dân cấp tỉnh làm Phó Trưởng ban thường trực;

c) Giám đốc Sở Nông nghiệp và Phát triển nông thôn làm Phó Trưởng ban phụ trách công tác phòng, chống thiên tai;

d) Tùy theo điều kiện cụ thể từng địa phương, Chỉ huy Trưởng Bộ chỉ huy Quân sự tỉnh làm Phó Trưởng ban phụ trách công tác cứu hộ, cứu nạn trên đất liền; Chỉ huy trưởng Bộ chỉ huy Bộ đội Biên phòng tỉnh làm Phó Trưởng ban phụ trách công tác cứu hộ, cứu nạn trên biển và biên giới;

đ) Các ủy viên là Giám đốc hoặc đại diện lãnh đạo các sở, ngành có liên quan đến công tác phòng chống thiên tai và tìm kiếm cứu nạn, Mặt trận Tổ quốc, Hội Phụ nữ, Hội Chữ thập đỏ, Đoàn thanh niên Cộng sản Hồ Chí Minh và các tổ chức đoàn thể - xã hội cấp tỉnh tham gia thành viên Ban Chỉ huy phòng, chống thiên tai và tìm kiếm cứu nạn cấp tỉnh.

3. Sở Nông nghiệp và Phát triển nông thôn là cơ quan thường trực phòng, chống thiên tai; Bộ chỉ huy quân sự hoặc Bộ chỉ huy Bộ đội Biên phòng là cơ quan thường trực tìm kiếm cứu nạn của Ban Chỉ huy phòng, chống thiên tai và tìm kiếm cứu nạn cấp tỉnh.

Căn cứ điều kiện thực tế của địa phương, Chủ tịch Ủy ban nhân dân cấp tỉnh quyết định việc thành lập bộ phận chuyên trách thuộc Sở Nông nghiệp và Phát triển nông thôn làm nhiệm vụ Văn phòng thường trực của Ban Chỉ huy phòng chống thiên tai và tìm kiếm cứu nạn.

4. Nhiệm vụ của Ban Chỉ huy phòng, chống thiên tai và tìm kiếm cứu nạn cấp tỉnh:

a) Tham mưu giúp Ủy ban nhân dân cấp tỉnh thực hiện nhiệm vụ phòng, chống thiên tai theo quy định tại khoản 1 Điều 43 của Luật phòng, chống thiên tai ;

b) Chỉ đạo, đôn đốc việc xây dựng và trình phê duyệt kế hoạch, phương án ứng phó thiên tai;

c) Chỉ huy ứng phó thiên tai, tìm kiếm cứu nạn trong thiên tai trong phạm vi địa phương;

d) Kiểm tra, đôn đốc các sở, cơ quan tại địa phương thực hiện nhiệm vụ phòng, chống thiên tai;

đ) Giúp Ủy ban nhân dân tỉnh chỉ đạo, kiểm tra, đôn đốc và tổng hợp báo cáo việc thống kê đánh giá thiệt hại, xác định nhu cầu hỗ trợ, triển khai công tác khắc phục hậu quả và phục hồi tái thiết sau thiên tai;

e) Thực hiện các nội dung về Quỹ phòng, chống thiên tai theo quy định;

g) Tổ chức huấn luyện, đào tạo, diễn tập, tập huấn cho các lực lượng tham gia hoạt động phòng, chống thiên tai và tìm kiếm cứu nạn;

h) Tổ chức phổ biến, tuyên truyền nâng cao nhận thức cộng đồng về phòng, chống thiên tai;

i) Chỉ đạo, triển khai và tổ chức thực hiện các giải pháp nhằm từng bước nâng cao năng lực dân sự trong hoạt động ứng phó thiên tai;

k) Tập trung nguồn nhân lực, trang thiết bị, xây dựng công cụ hỗ trợ cho Văn phòng thường trực Ban Chỉ huy phòng, chống thiên tai và tìm kiếm cứu nạn cấp tỉnh; kết nối trực tuyến với cơ quan phòng, chống thiên tai Trung ương và các cấp ở địa phương phục vụ công tác chỉ đạo, chỉ huy điều hành phòng, chống thiên tai.

Điều 21. Tổ chức, nhiệm vụ của Ban Chỉ huy phòng, chống thiên tai và tìm kiếm cứu nạn cấp huyện

1. Ban Chỉ huy phòng, chống thiên tai và tìm kiếm cứu nạn cấp huyện do Chủ tịch Ủy ban nhân dân cấp huyện thành lập, có chức năng tham mưu giúp Ủy ban nhân dân cấp huyện trong việc kiểm tra, đôn đốc, chỉ huy điều hành công tác phòng, chống thiên tai và tìm kiếm cứu nạn trong phạm vi địa phương. Ban Chỉ huy phòng, chống thiên tai và tìm kiếm cứu nạn cấp huyện có con dấu, tài khoản và được cấp kinh phí để hoạt động.

2. Thành viên của Ban Chỉ huy phòng, chống thiên tai và tìm kiếm cứu nạn cấp huyện gồm:

a) Chủ tịch Ủy ban nhân dân cấp huyện làm Trưởng ban;

b) Một Phó Chủ tịch Ủy ban nhân dân cấp huyện làm Phó Trưởng ban thường trực;

c) Trưởng phòng hoặc thủ trưởng cơ quan được giao nhiệm vụ quản lý nhà nước về phòng, chống thiên tai; Trưởng Công an huyện và Chỉ huy trưởng Ban Chỉ huy Quân sự cấp huyện làm Phó Trưởng ban;

d) Các ủy viên là cấp trưởng hoặc đại diện lãnh đạo các phòng và cơ quan, đơn vị có liên quan đến công tác phòng, chống thiên tai và tìm kiếm cứu nạn của địa phương; lãnh đạo Mặt trận Tổ quốc, Hội Phụ nữ, Chữ thập đỏ, Đoàn Thanh niên Cộng sản Hồ Chí Minh và các tổ chức đoàn thể xã hội cấp huyện tham gia Ban Chỉ huy phòng, chống thiên tai và tìm kiếm cứu nạn.

3. Căn cứ điều kiện cụ thể của địa phương, Chủ tịch Ủy ban nhân dân cấp huyện quyết định giao trách nhiệm cho một phòng chức năng thuộc Ủy ban nhân dân cấp huyện làm nhiệm vụ Văn phòng thường trực Ban Chỉ huy phòng, chống thiên tai và tìm kiếm cứu nạn.

4. Nhiệm vụ của Ban Chỉ huy phòng, chống thiên tai và tìm kiếm cứu nạn cấp huyện:

a) Tham mưu giúp Ủy ban nhân dân cấp huyện thực hiện nhiệm vụ phòng, chống thiên tai theo quy định tại khoản 1 Điều 43 của Luật phòng, chống thiên tai ;

b) Chỉ đạo, đôn đốc việc xây dựng và trình phê duyệt kế hoạch, phương án ứng phó thiên tai của địa phương;

c) Chỉ huy và tổ chức ứng phó thiên tai, tìm kiếm cứu nạn trong thiên tai trong phạm vi cấp huyện;

d) Kiểm tra, đôn đốc các cơ quan, đơn vị tại địa phương thực hiện nhiệm vụ phòng, chống thiên tai;

đ) Giúp Ủy ban nhân dân huyện chỉ đạo, kiểm tra, tổng hợp báo cáo công tác thống kê đánh giá thiệt hại, khắc phục hậu quả và phục hồi tái thiết sau thiên tai;

e) Tổ chức tập huấn cho các lực lượng tham gia hoạt động phòng, chống thiên tai và tìm kiếm cứu nạn;

g) Tổ chức phổ biến, tuyên truyền các hoạt động nâng cao nhận thức cộng đồng về phòng, chống thiên tai;

h) Thực hiện các nội dung về Quỹ phòng, chống thiên tai theo quy định.

Điều 22. Tổ chức, nhiệm vụ của Ban Chỉ huy phòng, chống thiên tai và tìm kiếm cứu nạn cấp xã

1. Ban Chỉ huy phòng, chống thiên tai và tìm kiếm cứu nạn cấp xã do Chủ tịch Ủy ban nhân dân cấp xã thành lập, tham mưu giúp Ủy ban nhân dân cấp xã trong việc kiểm tra, đôn đốc, chỉ huy, điều hành công tác phòng, chống thiên tai và tìm kiếm cứu nạn trong phạm vi địa phương.

2. Thành viên của Ban Chỉ huy phòng, chống thiên tai và tìm kiếm cứu nạn cấp xã gồm:

a) Chủ tịch Ủy ban nhân dân cấp xã làm Trưởng ban;

b) Một Phó Chủ tịch Ủy ban nhân dân cấp xã làm Phó Trưởng ban thường trực;

c) Trưởng Công an xã làm Phó Trưởng ban và Xã đội trưởng làm Phó Trưởng ban phụ trách lực lượng xung kích phòng chống thiên tai cấp xã;

d) Các ủy viên là cán bộ thủy lợi, nông nghiệp, trưởng các tổ chức chính trị và đoàn thể của xã;

đ) Công chức xã làm nhiệm vụ quản lý nhà nước về phòng, chống thiên tai kiêm Ủy viên thường trực Ban chỉ huy phòng, chống thiên tai và tìm kiếm cứu nạn.

3. Ban Chỉ huy phòng, chống thiên tai và tìm kiếm cứu nạn cấp xã đặt tại trụ sở Ủy ban nhân dân cấp xã. Ban được sử dụng con dấu của Ủy ban nhân dân xã, sử dụng một số cán bộ chuyên môn của Ủy ban nhân dân cấp xã làm bộ phận thường trực và được cấp kinh phí để hoạt động.

4. Nhiệm vụ của Ban Chỉ huy phòng, chống thiên tai và tìm kiếm cứu nạn cấp xã:

a) Tham mưu giúp Ủy ban nhân dân cấp xã thực hiện nhiệm vụ phòng, chống thiên tai theo quy định tại khoản 2 Điều 43 của Luật phòng, chống thiên tai ;

b) Thực hiện việc truyền phát tin chỉ đạo, chỉ huy ứng phó thiên tai của các cấp đến cộng đồng;

c) Chỉ huy ứng phó thiên tai, tìm kiếm cứu nạn trong thiên tai trong phạm vi cấp xã;

d) Chỉ đạo, đôn đốc việc xây dựng và phê duyệt kế hoạch, phương án ứng phó thiên tai của địa phương;

đ) Kiểm tra, đôn đốc tổ chức, cá nhân tại địa phương thực hiện nhiệm vụ phòng, chống thiên tai;

e) Chủ trì tham mưu giúp Ủy ban nhân dân xã thành lập, tổ chức đào tạo, tập huấn và duy trì lực lượng xung kích phòng chống thiên tai cấp xã với nòng cốt là lực lượng dân quân tự vệ và sự tham gia của Hội Chữ thập đỏ, đoàn thanh niên và các tổ chức đoàn thể khác tại địa phương;

g) Thực hiện các nội dung về Quỹ phòng, chống thiên tai theo quy định;

h) Tổ chức phổ biến, tuyên truyền nâng cao nhận thức cộng đồng về phòng chống thiên tai hàng năm.

Điều 23. Ban Chỉ huy phòng, chống thiên tai và tìm kiếm cứu nạn các tập đoàn, tổng công ty, doanh nghiệp

Tùy theo điều kiện cụ thể, người đứng đầu cơ quan, tổ chức quyết định thành lập Ban Chỉ huy phòng, chống thiên tai và tìm kiếm cứu nạn để triển khai các nhiệm vụ về phòng, chống thiên tai theo quy định của pháp luật.

Điều 24. Cơ chế phối hợp giữa Ban Chỉ đạo Trung ương về phòng, chống thiên tai với Ủy ban Quốc gia Ứng phó sự cố, thiên tai và Tìm kiếm cứu nạn

1. Ban Chỉ đạo Trung ương về phòng, chống thiên tai chủ trì, phối hợp với Ủy ban Quốc gia ứng phó sự cố thiên tai và Tìm kiếm cứu nạn ban hành các văn bản chỉ đạo để ứng phó các tình huống thiên tai cụ thể.

2. Ban Chỉ đạo Trung ương về phòng, chống thiên tai và Ủy ban Quốc gia Ứng phó sự cố thiên tai và Tìm kiếm cứu nạn chủ động thông báo, phối hợp xử lý ngay khi nhận được thông tin về tai nạn, sự cố xảy ra trong thiên tai, thống nhất về biện pháp và huy động lực lượng, phương tiện, vật tư, trang thiết bị để ứng phó thiên tai.

3. Ban Chỉ đạo Trung ương về phòng, chống thiên tai chủ trì trong việc huy động các nguồn lực, tổ chức chỉ đạo, điều hành hoạt động ứng phó và khắc phục hậu quả thiên tai, phối hợp với Ủy ban Quốc gia Ứng phó sự cố thiên tai và Tìm kiếm cứu nạn huy động và điều phối các lực lượng tìm kiếm cứu nạn, thực hiện công tác tìm kiếm cứu nạn và cứu hộ thiên tai.

4. Ban Chỉ đạo Trung ương về phòng, chống thiên tai thống nhất với Ủy ban Quốc gia Ứng phó sự cố, thiên tai và Tìm kiếm cứu nạn về nội dung đề nghị các nước hỗ trợ về lực lượng tìm kiếm cứu nạn trong trường hợp thiên tai nghiêm trọng trước khi báo cáo Thủ tướng Chính phủ quyết định.

Chương III

ĐIỀU KHOẢN THI HÀNH

Điều 25. Hiệu lực thi hành

1. Nghị định này có hiệu lực thi hành từ ngày 01 tháng 01 năm 2019.

2. Nghị định này thay thế Nghị định số 66/2014/NĐ-CP ngày 04 tháng 7 năm 2014 quy định chi tiết, hướng dẫn thi hành một số điều của Luật phòng, chống thiên tai.

Điều 26. Trách nhiệm tổ chức thực hiện

Các Bộ trưởng, Thủ trưởng cơ quan ngang bộ, Thủ trưởng cơ quan thuộc Chính phủ, Chủ tịch Ủy ban nhân dân các cấp và các cơ quan, tổ chức, cá nhân có liên quan chịu trách nhiệm thi hành Nghị định này./.
