Căn cứ Nghị định số 15/2017/NĐ-CP ngày 17 tháng 02 năm 2017 của Chính phủ quy định chức năng, nhiệm vụ, quyền hạn và cơ cấu tổ chức của Bộ Nông nghiệp và Phát triển nông thôn;
Căn cứ Nghị định số 187/2013/NĐ-CP ngày 20 tháng 11 năm 2013 của Chính phủ quy định chi tiết thi hành Luật Thương mại về hoạt động mua bán hàng hóa quốc tế và các hoạt động đại lý mua, bán, gia công và quá cảnh hàng hóa với nước ngoài;
Theo đề nghị của Vụ trưởng Vụ Pháp chế; Tổng cục trưởng các Tổng cục: Lâm nghiệp,Thủy sản; Cục trưởng các Cục: Bảo vệ thực vật, Trồng trọt, Thú y, Chăn nuôi, Quản lý chất lượng nông lâm sản và thủy sản, Kinh tế hợp tác và Phát triển nông thôn;
Bộ trưởng Bộ Nông nghiệp và Phát triển nông thôn ban hành Thông tư Bảng mã số HS đối với hàng hóa chuyên ngành xuất khẩu, nhập khẩu thuộc phạm vi quản lý của Bộ Nông nghiệp và Phát triển nông thôn.
Điều 1. Ban hành kèm theo Thông tư này các phụ lục sau đây:
1. Phụ lục 01: Bảng mã số HS đối với thuốc bảo vệ thực vật;
2. Phụ lục 02: Bảng mã số HS đối với thuốc bảo vệ thực vật cấm sử dụng tại Việt Nam;
3. Phụ lục 03: Bảng mã số HS đối với Danh mục vật thể thuộc diện kiểm dịch thực vật của Việt Nam;
4. Phụ lục 04: Bảng mã số HS đối với phân bón;
5. Phụ lục 05: Bảng mã số HS đối với Danh mục thực phẩm có nguồn gốc thực vật nhập khẩu phải kiểm tra an toàn thực phẩm thuộc phạm vi quản lý của Bộ Nông nghiệp và Phát triển nông thôn;
6. Phụ lục 06: Bảng mã số HS đối với Danh mục giống cây trồng được phép sản xuất, kinh doanh ở Việt Nam;
7. Phụ lục 07: Bảng mã số HS đối với hàng hóa cấm xuất khẩu là gỗ tròn, gỗ xẻ các loại từ gỗ rừng tự nhiên trong nước;
8. Phụ lục 08: Bảng mã số HS đối với hàng hóa thực phẩm (phối chế) có nguồn gốc nông, lâm, thủy sản nhập khẩu vào Việt Nam thuộc phạm vi quản lý của Bộ Nông nghiệp và Phát triển nông thôn;
9. Phụ lục 09: Bảng mã số HS đối với Danh mục muối (kể cả muối ăn và muối bị làm biến tính);
10. Phụ lục 10: Bảng mã số HS đối với Danh mục máy, thiết bị dùng trong nông nghiệp;
11. Phụ lục 11: Bảng mã số HS thức ăn, nguyên liệu sản xuất thức ăn thủy sản;
12. Phụ lục 12: Bảng mã số HS sản phẩm xử lý môi trường nuôi trồng thủy sản;
13. Phụ lục 13: Bảng mã số HS các loài thủy sản xuất khẩu có điều kiện;
14. Phụ lục 14: Bảng mã số HS các loài thủy sản sống được phép nhập khẩu làm thực phẩm;
15. Phụ lục 15: Bảng mã số HS các loài thủy sản cấm xuất khẩu;
16. Phụ lục 16: Bảng mã số HS về lĩnh vực khai thác thủy sản;
17. Phụ lục 17: Bảng mã số HS giống thủy sản nhập khẩu thông thường;
18. Phụ lục 18: Bảng mã số HS đối với giống vật nuôi được phép sản xuất, kinh doanh tại Việt Nam;
19. Phụ lục 19: Bảng mã số HS đối với giống vật nuôi quý hiếm cấm xuất khẩu;
20. Phụ lục 20: Bảng mã số HS Danh mục hóa chất, kháng sinh cấm nhập khẩu, sản xuất, kinh doanh và sử dụng trong thức ăn chăn nuôi gia súc, gia cầm tại Việt Nam;
21. Phụ lục 21. Bảng mã số HS các sản phẩm thức ăn chăn nuôi nhập khẩu được phép lưu hành tại Việt Nam;
22. Phụ lục 22: Bảng mã số HS đối với Danh mục động vật, sản phẩm động vật trên cạn thuộc diện phải kiểm dịch;
23. Phụ lục 23: Bảng mã số HS đối với Danh mục động vật, sản phẩm động vật thủy sản thuộc diện phải kiểm dịch;
24. Phụ lục 24: Bảng mã số HS đối với Danh mục thuốc thú y được phép nhập khẩu, lưu hành tại Việt Nam.
1. Thông tư này có hiệu lực thi hành kể từ ngày 01 tháng 01 năm 2018.
2. Thông tư này thay thế các văn bản và Phụ lục sau đây:
a) Quyết định số 38/2008/QĐ-BNN ngày 28 tháng 02 năm 2008 của Bộ trưởng Bộ Nông nghiệp và Phát triển nông thôn về việc ban hành danh mục áp mã số HS hàng hóa xuất khẩu, nhập khẩu chuyên ngành thủy sản;
b) Quyết định số 2515/QĐ-BNN-BVTV ngày 29 tháng 6 năm 2015 của Bộ trưởng Bộ Nông nghiệp và Phát triển nông thôn về việc ban hành bảng mã số HS của Danh mục vật thể thuộc diện kiểm dịch thực vật của Việt Nam;
c) Quyết định số 2766/QĐ-BNN-CN ngày 13 tháng 7 năm 2015 của Bộ trưởng Bộ Nông nghiệp và Phát triển nông thôn công bố mã HS đối với Danh mục giống vật nuôi được sản xuất, kinh doanh tại Việt Nam;
d) Quyết định số 5481/QĐ-BNN-CN ngày 30 tháng 12 năm 2005 của Bộ trưởng Bộ Nông nghiệp và Phát triển nông thôn công bố mã HS đối với Danh mục giống vật nuôi quý hiếm cấm xuất khẩu;
đ) Quyết định số 4069/QĐ-BNN-QLCL ngày 14 tháng 10 năm 2015 của Bộ trưởng Bộ Nông nghiệp và Phát triển nông thôn về việc công bố danh mục hàng hóa nhập khẩu phải kiểm tra an toàn thực phẩm trước khi thông quan thuộc trách nhiệm quản lý của Bộ Nông nghiệp và Phát triển nông thôn;
e) Quyết định số 13/QĐ-BNN-TCTS ngày 05 tháng 01 năm 2016 của Bộ trưởng Bộ Nông nghiệp và Phát triển nông thôn về việc Công bố mã HS đối với các Danh mục quản lý hàng hóa chuyên ngành thủy sản tại Việt Nam;
g) Quyết định số 4758/QĐ-BNN-TY ngày 18 tháng 11 năm 2015 của Bộ trưởng Bộ Nông nghiệp và Phát triển nông thôn về việc ban hành Bảng mã số HS của Danh mục động vật, sản phẩm động vật trên cạn thuộc diện phải kiểm dịch;
h) Quyết định số 2432/QĐ-BNN-TT ngày 13 tháng 6 năm 2017 của Bộ trưởng Bộ Nông nghiệp và Phát triển nông thôn ban hành bảng mã HS đối với Danh mục giống cây trồng được phép sản xuất, kinh doanh ở Việt Nam;
i) Thông tư số 24/2016/TT-BNNPTNT ngày 30 tháng 6 năm 2016 của Bộ trưởng Bộ Nông nghiệp và Phát triển nông thôn Ban hành danh mục và công bố mã HS đối với hàng hóa cấm xuất khẩu là gỗ tròn, gỗ xẻ các loại từ gỗ rừng tự nhiên trong nước và hàng hóa xuất khẩu theo giấy phép là củi, than làm từ gỗ hoặc củi có nguồn gốc từ gỗ rừng tự nhiên trong nước;
k) Phụ lục IB. Danh mục thuốc thú y được phép nhập khẩu lưu hành tại Việt Nam ban hành kèm theo Thông tư số 10/2016/TT-BNNPTNT ngày 01 tháng 6 năm 2016 của Bộ trưởng Bộ Nông nghiệp và Phát triển nông thôn;
l) Phần B, Phụ lục IC. Danh mục thuốc thú y thủy sản được phép lưu hành tại Việt Nam ban hành kèm theo Thông tư số 10/2016/TT-BNNPTNT ngày 01 tháng 6 năm 2016 của Bộ trưởng Bộ Nông nghiệp và Phát triển nông thôn;
m) Phụ lục III Thông tư số 03/2016/TT-BNNPTNT ngày 21 tháng 4 năm 2016 của Bộ trưởng Bộ Nông nghiệp và Phát triển nông thôn ban hành Danh mục thuốc bảo vệ thực vật được phép sử dụng, cấm sử dụng tại Việt Nam; công bố mã HS đối với thuốc bảo vệ thực vật được phép sử dụng, cấm sử dụng tại Việt Nam.
Chánh Văn phòng Bộ, Vụ trưởng Vụ Pháp chế, Thủ trưởng các đơn vị thuộc Bộ và các tổ chức, cá nhân có liên quan chịu trách nhiệm thi hành Thông tư này.
Trong quá trình thực hiện Thông tư, nếu có vướng mắc, đề nghị phản ánh kịp thời về Bộ Nông nghiệp và Phát triển nông thôn để hướng dẫn, bổ sung./.

CIRCULAR
PROMULGATING LIST OF HARMONIZED SYSTEM (HS) CODES FOR EXPORTS AND IMPORTS UNDER MANAGEMENT OF THE MINISTRY OF AGRICULTURE AND RURAL DEVELOPMENT
Pursuant to the Government's Decree No. 15/2017/ND-CP dated February 17, 2017 specifying functions, duties, entitlements and organizational structure of the Ministry of Agriculture and Rural Development;
Pursuant to the Government's Decree No. 187/2013/ND-CP dated November 20, 2013 on guidelines for the Law on Commerce in respect of international trade of goods and activities of agency for sale and purchase, processing and transit of goods involving foreign parties;
At the request of Director of the Legal Department; Directors of General Departments of: Forestry, Aquaculture; Directors of Departments of: Plant Protection, Farming, Veterinary, Animal Husbandry, Agro-Forestry-Fishery Quality Control, Cooperative Economy and Rural Development;
The Minister of Agriculture and Rural development promulgates a Circular on list of harmonized system (HS) codes for exports and imports under management of the ministry of agriculture and rural development
Article 1. Issue together with this Circular the following Appendices:
1. Appendix 01: List of HS codes for plant protection products;
2. Appendix 02: List of HS codes for plant protection products banned in Vietnam;
3. Appendix 03: List of HS codes for regulated articles subject to plant quarantine in Vietnam;
4. Appendix 04: List of HS codes for fertilizers;
5. Appendix 05: List of HS codes for food of imported vegetable original subject to food safety inspection under management of the Ministry of Agriculture and Rural Development;
6. Appendix 06: List of HS codes for plant varieties permissible for business in Vietnam;
7. Appendix 07: List of HS codes for round logs, saw logs of all kinds from natural forest timber in the country banned from export;
8. Appendix 08: List of HS codes for combined food of agricultural-forestry-aquatic origin imported to Vietnam under management of the Ministry of Agriculture and Rural Development;
9. Appendix 09: List of HS codes for salt (including table salt and denatured salt);
10. Appendix 10: List of HS codes for machinery and equipment used in agriculture;
11. Appendix 11: List of HS codes for foods and raw materials used in production of aquaculture feed;
12. Appendix 12: List of HS codes for aquaculture environmental remediation products;
13. Appendix 13: List of HS codes for conditional export aquatic species;
14. Appendix 14: List of HS codes for live aquatic species permissible for import as food;
15. Appendix 15: List of HS codes for aquatic species banned from export;
16. Appendix 16: List of HS codes for fisheries;
17. Appendix 17: List of HS codes for aquatic breeds in ordinary import;
18. Appendix 18: List of HS codes for domestic animals permissible for business in Vietnam;
19. Appendix 19: List of HS codes for precious domestic animals banned from export;
20. Appendix 20: List of HS codes for chemicals, antibiotics banned from import, business and use in livestock and poultry feed in Vietnam;
21. Appendix 21. List of HS codes for imported animal feed permitted to be circulated in Vietnam;
22. Appendix 22: List of HS codes for terrestrial animals and animal products subject to quarantine;
23. Appendix 23: List of HS codes for aquatic animals and animal products subject to quarantine;
24. Appendix 24: List of HS codes for veterinary medicine permissible for import and circulation in Vietnam.
Article 2. Entry in force
1. This Circular comes into force as of January 1, 2018.
2. This Circular supersedes documents and Appendices below:
a) Decision No. 38/2008/QD-BNN dated February 28, 2008 of the Minister of Agriculture and Rural Development promulgating the list of HS codes for aquatic exports and imports;
b) Decision No. 2515/QD-BNN-BVTV dated June 29, 2015 of the Minister of Agriculture and Rural development promulgating list of HS codes for articles subject to plant quarantine in Vietnam;
c) Decision No. 2766/QD-BNN-CN dated July 13, 2015 of the Minister of Agriculture and Rural development promulgating list of HS codes for domestic animals permissible for business in Vietnam;
d) Decision No. 5481/QD-BNN-CN dated December 30, 2005 of the Minister of Agriculture and Rural development promulgating list of HS codes for precious domestic animals banned from export;
dd) Decision No. 4069/QD-BNN-QLCL dated October 14, 2015 of the Minister of Agriculture and Rural development publishing the list of imports subject to food safety inspection before customs clearance under management of the Ministry of Agriculture and Rural Development;
e) Decision No. 13/QD-BNN-TCTS dated January 5, 2016 of the Minister of Agriculture and Rural Development promulgating the list of HS codes for list of aquaculture products in Vietnam;
g) Decision No. 4758/QD-BNN-TY dated November 18, 2015 of the Minister of Agriculture and Rural development promulgating list of HS codes of terrestrial animals and animal products subject to quarantine in Vietnam;
h) Decision No. 2432/QD-BNN-TT dated July 13, 2015 of the Minister of Agriculture and Rural development promulgating list of HS codes for plant varieties permissible for business in Vietnam;
i) Circular No. 24/2016/TT-BNNPTNT dated June 30, 2016 of the Minister of Agriculture and Rural development promulgating list of HS codes for round logs, saw logs of all kinds from natural forest timber in the country banned from export and exported goods subject to licenses being firewood, coal made of logs derived from natural forest timber in the country;
k) Appendix IB. List of veterinary medicine permission for import to circulate in Vietnam issued together with Circular No. 10/2016/TT-BNNPTNT dated June 1, 2016 of the Minister of Agriculture and Rural development;
l) Part B, Appendix IC. List of aquatic medicine permission permitted to circulated in Vietnam issued together with Circular No. 10/2016/TT-BNNPTNT dated June 1, 2016 of the Minister of Agriculture and Rural development;
m) Appendix III of Circular No. 03/2016/TT-BNNPTNT dated April 21, 2016 of the Minister of Agriculture and Rural development promulgating the list of plant protection products permissible for use or banned in Vietnam; publishing list of HS codes for plant protection products permissible for use or banned in Vietnam.
3. HS codes prescribed in Appendix II of Circular No. 03/2016/TT-BNNPTNT dated April 21, 2016 of the Minister of Agriculture and Rural development promulgating the list of plant protection products permissible for use or banned in Vietnam; publishing list of HS codes for plant protection products permissible for use or banned in Vietnam.
Article 3. Implementation
The Chief of the Ministry Office, Director of the Legal Department, Heads of units affiliated to Ministries and relevant entities shall implement this Circular.
Difficulties that arise during the implementation of this Circular should be reported to the Ministry of Agriculture and Rural Development for consideration./.
