DECISION
APPROVAL OF THE SCHEME FOR ASSISTING CHILDREN WITH DISABILITIES IN ACCESS TO PROTECTION, CARE AND EDUCATION SERVICES IN COMMUNITY IN THE 2018 – 2025 PERIOD
PRIME MINISTER
Pursuant to Law on Government Organization dated June 19, 2015;
Pursuant to Law on Persons with Disabilities dated June 17, 2010;
Pursuant to Law on Child dated April 5, 2016;
Pursuant to Government's Resolution No. 63 / NQ-CP dated July 22, 2016, promulgating the Government's Program of Action for implementation of the National Assembly's Resolution on the socio-economic development plan in the 2016-2020 period;
Pursuant to Prime Minister's Decision No. 535 / QD-TTg dated April 14, 2014, approving the Plan for implementation of the Recommendation of the Commission on Children's Rights of United Nations;
At the request of the Minister of Labor, War Invalids and Social Affairs,
DECISION
Article 1. Approval of the Scheme for assisting children with disabilities in access to protection, care and education services in the 2018 - 2025 period (hereinafter referred to as the “Scheme”) with the following main contents:
I. THE OBJECTIVE OF THE SCHEME
1. General objective:
It is expected that by 2025, children with disabilities can access to the protection, care and education services in the community and have the opportunity to fully exercise their rights.
2. Specific objectives in the 2018 – 2020 period:
a) 70% of children with disabilities have access to protection, care and education services in the community.
b) 50% of children with disabilities are provided with appropriate knowledge and skills of community integration; 60% of parents or caregivers of children with disabilities are provided with knowledge and skills relevant to assist children with disabilities in access to protection, care and education services in the community.
c) 70% of officials at the establishments providing services related to child protection, care and education and social organizations related to children with disabilities, officials and collaborators providing support for children with disabilities are provided with knowledge and skills of protection, care and education for children with disabilities.
d) 50% of provinces and cities have a network of protection, care and education services for children with disabilities in the community and pilot some services to assist children with disabilities.
3. Objectives in the 2021 – 2025 period:
a) 90% of children with disabilities can access protection, care and education services in the community.
b) 70% of children with disabilities are provided with appropriate knowledge and skills of community integration; 80% of parents or caregivers of children with disabilities are provided with knowledge and skills relevant to assist children with disabilities in access to protection, care and education services in the community.
c) 90% of officials at the establishments providing services related to child protection, care and education; social organizations related to children with disabilities, officials and collaborators providing support for children with disabilities are provided with knowledge and skills of protection, care and education for children with disabilities.
d) 90% of provinces and cities have a network of protection, care and education services for children with disabilities in the community and pilot some services to assist children with disabilities.
II. SUBJECTS AND SCOPE
- Children with disabilities nationwide.
- Relevant agencies, organizations and individuals.
III. MAIN TASKS AND SOLUTIONS OF THE SCHEME
1. Propagate and disseminate the Government's views, policies and laws; raise awareness and responsibilities of families and society for assisting children with disabilities in access to protection, care and education services in the community.
2. Complete the legal system and policies to assist children with disabilities in access to protection, care and education services in the community.
3. Improve the capacity and responsibility of officials at all levels and sectors and disabled children-related service providers for assisting children with disabilities in access to protection, care and education services in the community.
4. Assist children with disabilities in access to protection, care and education services in the community.
- Complete a network of protection, care and education services for children with disabilities in the community and have a network to connect child protection, care and education services.
- Assist children with disabilities in access to protection, care and education services in the community such as healthcare, nutrition, education, rehabilitation, career education and psychological counseling, child protection and community integration.
- Pilot the implementation of models to assist children with disabilities in access to protection, care and education services in the community.
5. Strengthen the government's management on assist children with disabilities in access to protection, care and education services in the community.
- Strengthen the coordination among sectors in providing comprehensive services of protection, care and education for children with disabilities.
- Regular inspection of the conformity with laws and policies on provision of assistance for children with disabilities in access to services in the community.
Build and operate a supervision and evaluation system to assist children with disabilities in access to protection, care and education services in the community.
6. Promote international cooperation, take advantage of the assistance and funding resources and experience of domestic and foreign organizations and individuals to implement the Scheme.
IV. BUDGET FOR THE SCHEME
Funding for the Scheme includes:
1. A part of the annual state budget expenditure estimates of ministries and local government based on the current state budget decentralization. Budget of the relevant programs and schemes approved by competent authorities.
2. Funding from domestic and foreign organizations and individuals as well as other lawful sources.
3. Pursuant to the assigned tasks in this Scheme, Ministries and central and local authorities shall prepare their own annual expenditure estimates and submit them to competent agencies for approval.
Article 2. Implementation
1. The Ministry of Labor, War Invalids and Social Affairs shall preside over the implementation of the Scheme and cooperate with the concerned ministries in:
a) Providing guidelines on implementation of the Scheme nationwide.
b) Organizing communication activities, improve capacity on assisting children with disabilities in access to the services in the community.
c) Making or proposing amendments to the policies and laws on assistance for children with disabilities in accessing protection, care and education services in the community.
d) Building a network to connect services of protection, care and education for children with disabilities.
dd) Organizing the provision of assistance for children with disabilities in accessing protection, care and social welfare services in the community.
e) Organizing the pilot of models to assist children with disabilities in access to protection, care and education services in accordance within its management.
g) Mobilizing financial, technical assistance and cooperation as well as international experience during the implementation of the Scheme.
h) Supervising and evaluating the implementation of the Scheme; periodically organize the review and evaluation of the implementation of the Scheme.
2. The Ministry of Education and Training shall preside over the provision of appropriate educational services for children with disabilities; provides guidance on appropriate educational services for children with disabilities; pilot model of educating children with disabilities in the community according to the function of the industry.
3. The Ministry of Health shall preside over the provision of assisting children with disabilities in access to healthcare and rehabilitation services in the community; provides guidance on healthcare counseling services as well as early detection and early intervention for children with disabilities; pilots the healthcare model for children with disabilities according to the function of the industry.
4. The Ministry of Culture, Sports and Tourism shall preside over the implementation of cultural, sports and tourism activities for children with disabilities; provide guidance on the implementation of cultural, sports and tourism activities in order to ensure social integration for children with disabilities; integrate the accessibility of protection, care and education services to children with disabilities into building a prosperous and happy family.
5. The Ministry of Planning and Investment shall cooperate with the concerned ministries and branches in mobilizing official development assistance (ODA) for programs and projects on the protection, care and education for children with disabilities.
6. The Ministry of Finance shall provide adequate funding for implementation of the annual Scheme in accordance with the provisions of the Law on State Budget and the law guidance documents; cooperate with the Ministry of Labor, War Invalids and Social Affairs in inspecting the use of budget for the implementation of the Scheme.
7. The concerned ministries and branches shall implement the Scheme within their functions, tasks and powers.
8. The Central Committee of the Vietnam Fatherland Front, the Vietnam Women's Union, the Central Committee of Ho Chi Minh Communist Youth Union, Central Committee of Vietnam Red Cross Society and its member organizations of the Front, the Vietnam Association for Protection of Children's Rights, the Vietnam Relief Association for Handicapped Children, the Vietnam Association for the Support of People with Disabilities and Orphans shall participate in the implementation of the Scheme within their functions and duties.
9. The People's Committees of provinces and central-affiliated cities (hereinafter referred to as “provinces”) have the responsibility to:
a) Organize the implementation of the Scheme in their provinces.
b) Develop plans to implement the Scheme, focusing on promoting inter-sectoral coordination in assisting children with disabilities in access to protection, care and education services in the community; implementing models to assist children with disabilities in access to child protection, care and education services in the community; assessing and replicating the models in the provinces; integrate the effective implementation of this Scheme with other relevant programs and schemes in their provinces.
c) Allocate budget to implement the Scheme in accordance with the law on the state budget; mobilize resources to implement the Scheme in their provinces.
d) Regularly inspect, supervise and evaluate and make periodical report to the Ministry of Labor, War Invalids and Social Affairs on the implementation of the Scheme in their provinces to send report to the Government.
Article 3. This Decision takes effect from the date of signing.
Article 4. Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Presidents of People's Committees of provinces and central-affiliated cities as well as relevant agencies and organizations shall be in charge of the execution of this Decision. /.
