Below is the response of Customs Department of Ho Chi Minh City to Official Dispatch No. 87/2022/3M dated 07/7/2022 of 3M Vietnam enquiring about difficulties in issuance of CAS numbers on the import declaration system:

After reviewing the system, the Sub-department of Customs for Investment does not have any import shipment that has not been granted customs clearance as mentioned in your Official Dispatch.

2. Regarding declaration of CAS numbers:

a. For non-chemical products:

- Pursuant to Article 1 of Decree No. 113/2017/ND-CP dated 09/10/2017, which is amended by Clause 1 Article 8 of Decree No. 17/2020/ND-CP dated 05/02/2022:

"Article 1. Scope

This Decree deals with and provides guidelines for implementation of certain articles of the Law on Chemicals with the following contents:

2. Conditional industrial chemicals; requirements, application and procedures for a certificate of eligibility for production or trade in conditional industrial chemicals.

3. Requirements for industrial precursor chemical production and trade; application and procedures for issuance of a license for industrial precursor chemical export/import.

4. Restricted industrial chemicals; requirements, application and procedures for issuance of a license for restricted industrial chemical production/trade.

5. Banned chemicals and toxic chemicals.

6. Plans and measures for prevention of and response to chemical emergencies.

7. Safety distance of hazardous chemical factories/stores.

8. Classification of chemicals and safety data sheets.

9. Declaration on chemicals and information about chemicals.

10. Training courses in chemical safety.

a) Pharmaceuticals; germicidal and insecticidal preparations; cosmetics;

b) Feeds; veterinary drugs; agrochemicals; organic fertilizers, biofertilizers, chemical fertilizers that are mixed fertilizers, organic mineral fertilizers, bio-mineral fertilizers; products used for preservation and processing of agricultural products, forestry products, fishery products and foods;

c) Radioactive substances; building materials; paints, printing ink; household adhesives and cleaning products;

d) Gasoline, oil; condensate and naphta used for gasoline and oil processing.”

According to the regulations above, non-chemical products are not regulated entities specified in Article 1 of Decree No. 113/2017/ND-CP dated 09/10/2017, which is amended by Clause 1 Article 8 of Decree No. 17/2020/ND-CP dated 05/02/2022, except for the regulated products mentioned above.

b. For chemical products:

- Pursuant to Appendix V of Decree No. 113/2017/ND-CP dated 09/10/2017 elaborating some Articles of the Law on Chemicals, the list of declared chemicals shall have the following information: Vietnamese names, English names, HS codes, CAS numbers, chemical formulae.

- Pursuant to Point a Clause 1 Article 18 of Circular No. 38/2015/TT-BTC dated 25/03/2015, which is amended by Clause 7 Article 1 of Circular No. 39/2018/TT-BTC dated 20/04/2018 of the Minister of Finance on customs procedures; customs supervision and inspection; export and import duties and management thereof:

"The declarant must provide sufficient information on the customs declaration as instructed in form No. 01 or form No. 02 in Appendix II hereof and send documents of the customs dossier mentioned in Article 16 of this Circular according to instructions in form No. 03 in Appendix II hereof to the customs authority through the e-customs system. Documents of the customs dossier may be electronic data scans certified by digital signatures...."
