DECISION

LIST OF IMPORTS BANNED FROM STORAGE IN BONDED WAREHOUSES

Pursuant to the Law on Government Organization dated June 19, 2015;

Pursuant to the Law on Customs dated June 23, 2014;

Pursuant to the Government’s Decree No. 08/2015/NĐ-CP dated January 21, 2015 on implementation of regulations of the Law on Customs on customs procedures, customs inspection, supervision and control;

Pursuant to the Government’s Decree No. 59/2018/NĐ-CP dated April 20, 2018 on amendments to the Government’s Decree No. 08/2015/NĐ-CP;

At the request of the Minister of Finance;

The Prime Minister promulgates the List of imports banned from storage in bonded warehouses.

Article 1. Scope

The List of imports banned from storage in bonded warehouses is promulgated together with this Decision.

Article 2. Regulated entities

1. Organizations and individuals that follow customs procedures for import of goods included in the List specified in Article 3 of this Decision.

2. Customs authorities, customs officials and relevant authorities.

3. Other organizations and individuals involved in customs procedures for import of goods included in the List specified in Article 3 of this Decision.

Article 4. Implementation clauses

1. This Decision comes into force from November 15, 2020. Applicable laws on bonded warehouse storage period shall apply to shipments that have been moved into bonded warehouses before this date. If they cannot be exported upon expiration of the bonded warehouse storage period specified in Article 61 of the Law on Customs, they will have to be re-exported through the initial checkpoint of import.

2. The Ministry of Finance shall preside over and cooperate with relevant Ministries in proposing revisions to this List to the Prime Minister.

3. Ministers, heads of ministerial-level agencies, heads of governmental agencies, Presidents of the People’s Committees of provinces and the entities specified in Article 2 are responsible for the implementation of this Decision./.
