CIRCULAR
AMENDMENTS TO SOME ARTICLES PRESCRIBING VIETNAM'S NOMENCLATURE OF EXPORTS AND IMPORTS ISSUED TOGETHER WITH SOME CIRCULARS OF THE MINISTER OF INDUSTRY AND TRADE
Pursuant to Government’s Decree No. 96/2022/ND-CP dated November 29, 2022 on functions, tasks, powers and organizational structure of the Ministry of Industry and Trade of Vietnam;
Pursuant to Government’s Decree No. 69/2018/ND-CP dated May 15, 2018 on elaboration of some Articles of the Law on Foreign Trade Management;
At the request of the Director of Agency of Foreign Trade;
The Minister of Industry and Trade hereby promulgates a Circular on amendments to some Articles prescribing Vietnam's Nomenclature of exports and imports issued together with some Circulars of the Minister of Industry and Trade.
Article 1. Amendments to some Articles of Circular No. 12/2018/TT-BCT dated June 15, 2018 of the Minister of Industry and Trade on elaboration of some Articles of the Law on Foreign Trade Management and Government’s Decree No. 69/2018/ND-CP dated May 15, 2018 on elaboration of some Articles of the Law on Foreign Trade Management (hereinafter referred to as “Circular No. 12/2018/TT-BCT)
1. Appendix I - List of used consumer goods, medical devices and vehicles prohibited from import specified in Article 3 of Circular No. 12/2018/TT-BCT shall be replaced by Appendix I issued together with this Circular.

Article 2. Amendments to some Articles of Circular No. 41/2019/TT-BCT dated December 16, 2019 of the Minister of Industry and Trade on amendments to Vietnam's Nomenclature of exports and imports specified in some Circulars of the Ministry of Industry and Trade (Circular No. 41/2019/TT-BCT)
1. Appendix I - Detailed list of rice for export and their HS codes specified in Article 1 of Circular No. 41/2019/TT-BCT shall be replaced by Appendix III issued together with this Circular.
2. Appendix VI - Detailed list of tobacco raw materials and cigarette papers and their HS codes specified in Clause 1, Article 6 of Circular No. 41/2019/TT-BCT shall be replaced by Appendix IV issued together with this Circular.
3. Appendix VII - Detailed list of specialty machinery and equipment in tobacco industry and their HS codes specified in Clause 2, Article 6 of Circular No. 41/2019/TT-BCT shall be replaced by Appendix V issued together with this Circular.
Article 3. Entry into force
1. This Circular comes into force as of May 16, 2023.
2. Any difficulty or problem that arises during the implementation of this document should be reported to the Ministry of Industry and Trade for consideration and amendment.

APPLICATION PRINCIPLES
This List is made according to the Vietnam's Nomenclature of exports and imports. This List is used according to the following principles:
1. In case only goods with 2-digit codes are listed, all of the goods with 8-digit codes of the same Chapter shall be prohibited from import.
2. In case only goods with 4-digit codes are listed, all of the goods with 8-digit codes of the same 4-digit heading shall be prohibited from import as well.
3. In case only goods with 6-digit codes are listed, all of the goods with 8-digit codes of the same 6-digit sub-heading shall be prohibited from import as well.
