VERDICT OF LEADERS OF THE PEOPLE’S COMMITTEE OF HANOI REGARDING SYNCHRONOUS INVESTIGATION INTO HANDLING OF VIOLATIONS OF 03 CONSTRUCTION PROJECTS AT 8B LE TRUC, 302 CAU GIAY AND 102 TRUONG CHINH

On October 17, 2019 on the premises of the People’s Committee of Hanoi, the President of the People’s Committee of Hanoi Nguyen Duc Chung chaired a meeting with other leaders on the synchronous investigation into the process of handling of violations of 03 construction projects at 8B Le Truc, 302 Cau Giay and 102 Truong Chinh.

The meeting was participated by the Deputy Presidents of the People’s Committee of Hanoi: Nguyen Van Suu, Nguyen Quoc Hung, Nguyen The Hung; Deputy Director of Hanoi Police Department; Directors and Deputy Directors of Department of Construction, Department of Planning and Investment, Department of Planning and Architecture, Department of Natural Resources and Environment; Presidents and Deputy Presidents of the People’s Committees of Ba Dinh, Dong Da, Cau Giay districts; President of the Board of Directors of Le Truc Garment JSC.; President of the Board of Directors of Servico Caugiay JSC.; General Director of Capital Hotel CO. LTD .; heads of the Office of the People’s Committee of Hanoi.

After considering reports of Department of Construction (Document No. 332/BC-SXD(TTr) dated 30/9/2019, Document No. 350/BC-SXD(TTr) dated 17/10/2019), comments of Mr. Tran Duc Minh (representative of investors of the projects at 8B Le Truc, 302 Cau Giay and 102 Truong Chinh) and other participants, leaders of the People’s Committee of Hanoi has arrived at the following verdict:

1. There are serious and systematic violations at the construction projects at 8B Le Truc, 302 Cau Giay and 102 Truong Chinh. The Prime Minister, Communist Party Committee of Hanoi and the People’s Committee of Hanoi have issued multiple documents requesting inclusion of these projects into Hanoi’s list of projects under supervision (Document No. 2173-TB/TU dated 28/8/2019). However, the investors are still avoiding violations handling by the authorities, thus the violations have not been thoroughly eliminated.

2. While police authorities are investigating according to criminal laws, the People’s Committees of Ba Dinh, Dong Da and Cau Giay districts are hereby requested to keep taking strict and thorough actions against the violating projects within their jurisdiction, the People’s Committees of these districts shall regularly provide information about the process and outcomes for the Internal Affairs Board of Communist Party Committee, Police Department and Department of Construction of Hanoi for consideration and reporting; provide adequate and accurate documents at the request of the investigation police authority to facilitate the process of criminal investigation as per regulations.

3. Second stage of handling violations at 8B Le Truc:

- According to the investor’s comments given at the meeting, the investor is not capable of dismantling the violating part of the construction work. The investor is requested to send a document to the People’s Committee of Ba Dinh district within October 2019 requesting the People’s Committee of Ba Dinh district to organize the dismantlement the cost of which will be paid by the investor (a minimum deposit of 5 billion VND has to be paid by the investor).

- If such a document is not sent by the investor by the aforementioned deadline, the People’s Committee of Ba Dinh district will advance money from the district budget to cover the cost of dismantlement and the investor will reimburse this cost.

4. Regarding handling of violations at 302 Cau Giay and 102 Truong Chinh: The investors are requested to implement remedial measures specified by the competent authorities. The People’s Committees of Cau Giay and Dong Da districts shall:

- Publish the violations at these projects; implement necessary and lawful measures to enforce implementation of remedial measures by the investors and prevent these projects from being put into operation before they undergo commissioning;

- Inform organizations, individuals and household of the risks and dangers of trading, buying and selling violating projects before remedial measures are implemented;

- Take charge and cooperate with Department of Planning and Investment in implementing necessary and lawful measures for enforcing shutdown and relocation of businesses that are leasing and/or operating in the violating projects.

5. The head of Hanoi Police Department shall request the investigation police authority to promptly carry out investigation as prescribed by law; promptly inform the People’s Committee of Hanoi, Internal Affairs Board of Communist Party Committee, Department of Construction and the People’s Committees of relevant districts of the decisions to press or not to press charge or cancellation of the decision to press charge and transfer of the case to other competent authorities for further handling (if other measures are deemed to be necessary).

The Office of the People’s Committee of Hanoi shall supervise the process and submit reports on the implementation of this document to the People’s Committee of Hanoi./.
