DECREE
TUITION FEES OF EDUCATIONAL INSTITUTIONS AFFILIATED TO NATIONAL EDUCATION SYSTEM AND COLLECTION, MANAGEMENT THEREOF; POLICIES ON TUITION FEE EXEMPTION, REDUCTION, AND FINANCING FOR STUDYING COSTS; SERVICE PRICES IN EDUCATION AND TRAINING SECTORS
Decree No. 81/2021/ND-CP dated August 27, 2021 of the Government of Vietnam on tuition fees of educational institutions affiliated to national education system and collection, management thereof; policies on tuition fee exemption, reduction, and financing for studying costs; service prices in education and training sectors, effective as of October 15, 2021, is amended by:
Decree No. 104/2022/ND-CP dated December 21, 2022 of the Government of Vietnam on amendments to Decrees related to the submission and presentation of household registration books and temporary residence registration books upon carrying out administrative procedures or providing public services, effective as of January 1, 2023.

The Government of Vietnam hereby promulgates the Decree on tuition fees of educational institutions affiliated to national education system and collection, management thereof; policies on tuition fee exemption, reduction, and financing for studying costs; service prices in education and training sectors.[1]
Chapter I
GENERAL PROVISIONS
Article 1. Scope
This Decree provides for tuition fees of educational institutions affiliated to national education system and collection, management thereof; policies on tuition fee exemption, reduction, and financing for studying costs; service prices in education and training sectors.

This Decree applies to preschool children, students, learners, and researchers (hereinafter referred to as “learners”) studying in educational institutions affiliated to the national education system according to Law on Education, Law on Higher Education, and Law on Vocational Education; educational institutions affiliated to national education system according to Law on Education, Law on Higher Education, and Law on Vocational Education, and relevant organizations, individuals.
Article 3. Interpretation of terms
1. “Service prices in education and training sector” refers to the money paid by service users for each service in education, training, and vocational education sectors, including: tuition fees (depending on education and training level) and prices for other services in education and training sectors (prices for enrolment services, prices for education quality accreditation services; prices for issuance of degree, certificate templates; prices for education support and human resource supply services via researching and developing strategies, planning, schemes for human resource training; prices for human resource demand investigation, analysis, and estimation services via connecting training facilities with employers to extract resources for human resource training; prices for teacher and education personnel improvement services; prices for consulting services for organizations and individuals to develop plans and schemes for human resource development and development of necessary skills for learners; prices for education and training support services).
2. “Tuition fee” refers to the amount of money paid by the learners to cover the costs of education and training services in part or whole. Tuition fees shall be determined according to the roadmap for guaranteeing education and training services according to this Decree.
3. “Education quality accreditation” under this Decree consists of education quality accreditation for preschool, continuing education facilities, formal educational institutions, higher education institutions, education quality accreditation for education programs of higher education institutions as per domestic quality assessment criteria issued by Minister of Education and Training of Vietnam and education quality accreditation of vocational education institutions, education quality accreditation of training program of all levels of vocational education issued by Minister of Labor – War Invalids and Social Affairs of Vietnam (hereinafter referred to as “quality accreditation by domestic standards”) or by quality assessment criteria of foreign education quality accreditation bodies recognized for operation in Vietnam (hereinafter referred to as “quality accreditation by foreign standards”).
Article 4. State management regarding prices for education and training services
1. Ministry of Education and Training of Vietnam and the Ministry of Labor – War Invalids and Social Affairs of Vietnam shall take charge and cooperate with the Ministry of Finance of Vietnam and relevant ministries in implementing state management functions regarding tuition and prices for other services in education and training:
a) Provide guidelines and develop, appraise, and issue economic and technical norms, methods of determining tuition and prices for other services in education and training applied in education and training sector under their management;
b) Decide on methods of assigning tasks, placing orders, and bidding for provision of products and services in education and training sectors under lists of public services utilizing state budget from central government budget within their assigned sector; decide on price of order of service in education and training sectors under lists of public services utilizing central government budget within their assigned sector.

3. People’s Committees of provinces shall perform state management regarding other tuitions and prices for services in education and services; issue economic and technical norms and costs in education and training sectors for services with incomplete economic and technical norms under the management of local government; decide on methods of assigning tasks, placing orders, and bidding for product and service provision in education and training sector; decide on prices for service orders in education and training sectors under lists of public services utilizing budget under the management of local government, People’s Committees of provinces shall request People’s Councils of provinces to decide on tuition fees or tuition fee brackets of preschool education and public formal education; elaborate the list of fees, collection and expense policies for services assisting education and training activities in public educational institutions under their management for local application.
4. Heads of educational institutions affiliated to the national education system shall publicly and transparently provide society with explanations on the basis and methods for determining and calculating service prices in education and training sectors for services whose value is calculated and reported to competent authorities by the institutions as per regulation.
Article 5. Principles of determining service prices in education and training sectors
1. Prices for services in education and training sectors are determined according to laws on prices and regulations of the Government of Vietnam on financial autonomy of public service providers.
2. Prices for services in education and training sectors shall be revised according to the appropriate roadmap corresponding to the quality of education and training services with the rate of increasing service price does not exceed 15%/year.
Article 6. Methods of and entitlements to price determination for services in education and training sectors
Methods of price determination and authorities competent to determine prices for services in education and training sectors shall be identified according to the Law on Prices, Law on Education, Law on Higher Education, Law on Vocational Education, guiding documents, and regulations of the Government of Vietnam on financial autonomy of public service providers.
Article 7. Roadmap for calculating prices for services in education and training sectors
1. Roadmap for calculating price for services in education and training sectors shall comply with regulations of the Government of Vietnam on financial autonomy of public service providers.

3. People's Committees of provinces shall, based on education development policies of the Government of Vietnam and actual conditions of local administrative divisions, request People's Councils of provinces to consider allowing preschools and general education institutions in areas with high possibilities of private sector involvement and preschools and general education institutions in universities, colleges, and research institutes to proactively implement the roadmap for whole inclusion of costs in prices for services in education and training sectors corresponding to education and training quality while guaranteeing mandatory education objectives according to the Law on Education and guiding documents.
Chapter II
REGULATIONS ON TUITION FEES
Article 8. Principles of determining tuition fees
1. For preschools and public general education institutions.
Tuition fees shall be developed based on a sharing principle between the state and the learners in conformity with the socio-economic conditions of each residential area, contribution capacity of the people and the growth rate of consumer price index, annual economic growth rate, and roadmap for calculating prices for services in education and training sectors as prescribed by laws while guaranteeing education quality.
2. For public vocational education institutions.
a) Public vocational education institutions that have guaranteed recurrent expenditure partially and public vocational education institutions that have recurrent expenditure guaranteed by the government (hereinafter referred to as “public vocational education institutions that have not guaranteed recurrent expenditure entirely”) shall determine tuition fees without exceeding the top limit under Point a Clause 1 and Point a Clause 2 Article 10 hereof;
b) Public vocational education institutions that have guaranteed recurrent expenditure entirely shall determine tuition fees for each training major based on variables compared to the top limit applicable to vocational education institutions that have not guaranteed recurrent expenditure entirely according to Clause 2 Article 10 hereof;

3. Tuition fees for public higher education institutions.
a) Public higher education institutions that have guaranteed recurrent expenditure partially and public higher education institutions that have recurrent expenditure guaranteed by the government (hereinafter referred to as “public higher education institutions that have not guaranteed recurrent expenditure entirely”) shall determine tuition fees without exceeding the top limit under Point a Clause 1 and Point a Clause 2 Article 11 hereof;
b) Public higher education institutions that have guaranteed recurrent expenditure and investment expenditure entirely and public higher education institutions that have guaranteed recurrent expenditure shall determine tuition fees for each training major with variables compared to the top limit applicable to public higher education institutions that have not guaranteed recurrent expenditure entirely under Clause 2 Article 11 hereof;
c) For training programs of public higher education institutions that satisfy quality accreditation standards of the Ministry of Education and Training of Vietnam or quality accreditation standards of foreign countries or equivalences, higher education institutions may determine tuition fees of the training programs based on economic and technical norms issued by the higher education institutions while providing public explanations for learners and society.
4. For private educational institutions
a) Private education institutions may develop tuition fees and prices for other services in education and training sectors (except for services whose prices are determined by the State) while ensuring cost offsetting and reasonable accumulations and shall provide public explanations for tuition fees and prices for services that they have decided for the learners and society;
b) Private education institutions shall provide explanations for average education and training costs for a student, annual tuition fees, tuition fees for the entire education level in case of preschool education and general education, and tuition fees for the entire course in case of higher education institutions; provide explanation for roadmap and rate of increasing tuition fees in subsequent years (annual rate of increasing tuition fees must not exceed 15% for higher education; 10% for preschool education and general education), perform disclosure as prescribed by laws, and provide explanations for the learners and society;
c) Students eligible for tuition fee exemption, reduction, or financing in private educational institutions shall have their tuition fees covered by the state maximally equal to the tuition fees applicable to students in local public educational institutions that have not guaranteed recurrent expenditure entirely;
d) People's Committees of provinces shall, based on the socio-economic development conditions of local administrative divisions, requirements of the primary education program, the number of students at the primary education level, and the number of students per class at the primary education level as prescribed by law, develop criteria for identifying local administrative divisions without sufficient number of public schools, provide presentations for People's Councils of provinces for approval and decision on financing for tuition fees of primary students in private schools in areas without sufficient number of public schools in each academic year. The funding for tuition fee financing shall be granted by the state budget according to the Law on State Budget and guiding documents.

1. Tuition fee bracket for the 2021 - 2022 academic year
People's Council of provinces shall, based on local conditions, decide on the tuition fee bracket or specific tuition fees without exceeding the top limit or value issued by People's Councils of provinces for the academic year of 2020 – 2021, applicable to each education level and area under their management.
2. Tuition fee bracket for the 2022 - 2023 academic year
a) The tuition fee bracket (bottom limit – top limit) for preschools and general education institutions that have not guaranteed recurrent expenditure entirely:

People's Council of provinces shall, based on the regulations above, decide on the tuition fee bracket or specific tuition fees for preschools and general education institutions under their management and decide on the classification of local areas for educational institutions to apply tuition fees.
The tuition fee bracket for public primary education institutions under this Point shall serve as the basis for People's Councils of provinces to decide on the tuition fee financing for students in private primary education institutions in areas without a sufficient number of public primary education institutions and students in private primary education institutions eligible for the tuition fee reduction or exemption as per regulation.
b) The top limit of the tuition fee bracket applicable to preschools and public general education institutions that have guaranteed recurrent expenditure entirely: Up to 2 times the top limit under Point a of this Clause;

d) Preschools and public general education institutions that have guaranteed recurrent expenditure entirely or recurrent expenditure and investment expenditure entirely in a manner satisfactory to quality accreditation standards of the Ministry of Education and Training of Vietnam may determine tuition fees on the basis of economic, technical, and cost norms publicized by the educational institutions and shall submit reports to People’s Committees of provinces for presentation to People’s Councils of provinces for consideration and approval of the tuition fees.
3. Tuition fee bracket from the 2023 - 2024 academic year onwards
a) From the academic year of 2023 – 2024 onwards, the tuition fee bracket shall be revised according to local socio-economic conditions, growth rate of consumer price index, annual economic growth rate, and solvency of the people without exceeding 7.5%/year;
b) People’s Committees of provinces shall, based on the tuition fee bracket under Point a of this Clause, request People's Councils of provinces to decide on specific tuition fees without exceeding the top limit.
4. In areas with high potential for private sector involvement, People’s Committees of provinces shall, based on education development policies of the Government and local conditions, request People’s Councils of provinces to consider and decide on the tuition fee bracket or tuition fees applicable to public preschools and general education institutions (including preschools and general education institutions established by universities, colleges, or research institutes) on the basis of economic, technical, and cost norms issued by competent authority in a manner that guarantees correspondence between tuition fees and education quality while implementing mandatory education objectives according to the Law on Education and guiding documents.
5. In the case of online learning, People’s Committees of provinces shall request People’s Councils of provinces to stipulate specific tuition fees for public educational institutions under their management on the basis of reasonable actual costs without exceeding the disclosed tuition fees of education institutions.
6. Continuing education facilities and other training facilities providing general education programs may apply tuition fees equal to the tuition fees of public general education institutions providing the same education level in the same areas. For other forms of continuing education, People’s Committees of provinces shall request People’s Councils of provinces to stipulate specific tuition fees for each form of training based on specific conditions of each area.

2. The top tuition fee limit from the academic year of 2022 - 2023 to the academic year of 2025 - 2026 is as follows:
a) For public vocational education institutions that have not guaranteed recurrent expenditure entirely: Based on the list of level IV training majors at the college level and intermediate level issued by the Minister of Labor – War Invalids and Social Affairs of Vietnam, top tuition limit is determined by economic and technical norms and calculated according to roadmap until the academic year of 2025 – 2026. The top tuition limit is as follows:

b) For public vocational education institutions that have guaranteed recurrent expenditure entirely: Maximum tuition fee shall not exceed 2 times the tuition fee under Point a Clause 2 of this Article;
c) For public vocational education institutions that have guaranteed recurrent expenditure and investment expenditure entirely: May develop and decide on tuition fees according to the Law on Vocational Education and other relevant documents;

dd) For training programs satisfactory to quality accreditation standards in public vocational education institutions that have guaranteed recurrent expenditure entirely, vocational education institutions that have guaranteed recurrent expenditure partially, and vocational education institutions that have recurrent expenditure guaranteed by the government, top tuition limit shall not exceed 2,5 times the tuition fees under Point a Clause 2 of this Article.
3. Tuition fees for part-time training and distant education is determined on the basis of reasonable costs without exceeding 150% of the tuition fees of respective formal education program.
4. For tuition fees for training majors available in the form of online learning, vocational education institutions shall determine such tuition fees on the basis of reasonable costs without exceeding the tuition fees of majors available in the form of face-to-face learning.
5. Tuition fees for preliminary training, continuing training, and skill training programs shall be developed and stipulated by vocational education institutions according to agreements between learners and vocational education institutions, ensuring publicity, transparency, and accountability with the learners and society.
6. Tuition fees for vocational education shall be calculated by modules or credits:
a) The tuition fee for a credit or module is determined based on the total tuition fee for the entire course by training major and the total number of credits or modules of the entire course using the following formula:

The total tuition fee for a course = the tuition fee for 1 student/month x 10 months x the number of academic years, ensuring that the maximum total tuition fee by credits of the training program equals the total year-based tuition.
b) In case of studying for longer than the intended period of a training program, credit-based tuition fees applied from the point of exceeding the intended period shall be re-determined based on the actual studying period, ensuring cost offsetting, publicity, and transparency with learners;
c) In case of pursuing graduate degrees, only tuition fees for credits and modules actually taken are required.
7. Tuition fees for public vocational education institutions: Heads of public vocational education institutions shall, based on the top tuition fee limit above for each academic year, specific characteristics, training major development demands, training forms, and practical conditions, stipulate specific tuition fees for training majors under their management and publicize such fees for the entire course.
8. For vocational education institutions under the direct management of business entities or state enterprises: Heads of vocational education institutions shall stipulate tuition fees for each academic year and each training major without exceeding the top tuition fee limit under Point b Clause 1 and Point c Clause 2 of this Article.
The state budget shall reimburse tuition fees for learners who are eligible for tuition fee exemption or reduction and studying in vocational education institutions under the direct management of business entities or state enterprises according to the top tuition fee limit applicable to respective training major in public vocational education institutions that have not guaranteed recurrent expenditure entirely under Point a Clause 1 and Point a Clause 2 of this Article.
9. Public vocational education institutions may stipulate tuition fees for cases of repeating classes. The maximum tuition fee for repeating classes must not exceed the top limit under this Decree. In the case of organizing separate studying upon requests from learners, tuition fees shall be agreed upon by the learners and vocational education institutions on the basis of cost offsetting.
10. Foreign students participating in training courses in vocational education institutions shall pay tuition fees stipulated by the vocational education institutions or conventions or agreements on cooperation with foreign parties.

c) Public higher education institutions that have guaranteed recurrent expenditure and investment expenditure entirely: Tuition fees shall equal up to 2,5 times the top value under Point a of this Clause for each respective major and each academic year;
d) For training programs of public higher education institutions that satisfy quality accreditation standards of the Ministry of Education and Training of Vietnam or quality accreditation standards of foreign countries or equivalences, higher education institutions may determine tuition fees of the training programs based on economic and technical norms issued by the higher education institutions while providing public explanations for learners and society.
3. The top tuition fee limit for training for master’s degrees and doctorate degrees of public higher education institutions shall equal the top limit of higher education tuition fees under Clause 1 and Clause 2 of this Article multiplied by 1,5 for training for master’s degrees and 2,5 for training for doctorate degrees in each respective major of each academic year depending on each level of autonomy.
4. Tuition fees for part-time training and distant education is determined on the basis of reasonable costs without exceeding 150% of tuition of respective formal education program.
5. In the case of online learning, higher education institutions shall determine tuition fees on the basis of reasonable costs without exceeding the tuition fees of higher education institutions providing respective majors with respective level of autonomy.
6. Tuition fees for continuing education programs and short-term training services for certification in specific majors of each education institution as prescribed by law shall be calculated by education institutions and collected under agreements between the learners and the education institutions, ensuring publicity and transparency with the learners and society.
7. Tuition fees for other short-term training programs shall be agreed upon by education institutions and the learners.
8. Tuition fees for higher education shall be calculated by credits and modules:
a) The tuition fee for a credit or module is determined based on the total tuition fee for the entire course by training major and the total number of credits or modules of the entire course using the following formula:

The total tuition fee for a course = the tuition fee for 1 student/month x 10 months x the number of academic years, ensuring that the maximum total tuition fee by credits of the training program equals the total year-based tuition.
b) In case of studying for longer than the intended period of a training program, credit-based tuition fees applied from the point of exceeding the intended period shall be re-determined based on the actual studying period, ensuring cost offsetting, publicity, and provision of explanations for learners;
c) In case of training for the second university degree, learners shall pay tuition fees according to the actual number of credits in the training program.

Tuition fees for public higher education institutions: Directors of National Universities, regional universities, and heads of public higher education institutions shall, based on the top tuition fee limit in this Article for each academic year, characteristics of institutions, training major development requirements, forms of training, and practical conditions, stipulate specific tuition fees for entities and training programs under their management.
10. For higher education institutions under the direct management of business entities or state enterprises: Heads of higher education institutions shall stipulate tuition fees for each academic year and each training major without exceeding the top tuition fee limit under Point b Clause 1 and Point c Clause 2 of this Article.
The state budget shall reimburse tuition fees for learners who are eligible for a tuition fee exemption or reduction and studying in higher education institutions under the direct management of business entities or state enterprises according to the top tuition fee limit applicable to respective training major in public vocational education institutions that have not guaranteed recurrent expenditure entirely under Point a Clause 1 and Point a Clause 2 of this Article.

12. University students, students of higher education level, and researchers who are foreigners and studying in public higher education institutions shall pay tuition fees as stipulated by higher education institutions or according to conventions or agreements with foreign parties.
Chapter III
TUITION FEE COLLECTION, MANAGEMENT, AND USE
Article 12. Tuition fee collection
1. Tuition fees shall be collected monthly. If the students are voluntary, the school may collect lump-sum tuition fees for the whole semester or academic year. In the case of continuing education institutions, continuing training facilities, and short-term training courses, tuition fees shall be collected by each month of studying. For preschools and general education institutions, tuition shall be collected for up to 9 months per year. For higher education institutions and vocational education institutions, tuition shall be collected for up to 10 months per year.
2. In case of natural disasters, epidemics, or other force majeure events, tuition fees shall be collected by the specific number of months of studying (including the period of online studying or makeup class at the education institutions); tuition fees for periods when classes are not provided shall not be collected. Tuition fees must satisfy the number of months of studying and necessary costs for organizing teaching without exceeding the total tuition fee calculated by the maximum number of months of an academic year (up to 9 months/year for preschools and general education institutions and up to 10 months/year for higher education institutions and vocational education institutions) and must be disclosed from the beginning of the academic year in education institutions. People’s Committees of provinces shall request People’s Councils to decide on the tuition fees and the time of collection thereof for local public preschools and general education institutions; heads of higher education institutions and vocational education institutions shall stipulate the tuition fees and the time for collection thereof in case of natural disasters, epidemic, and other force majeure events.
3. In the case of studying and teaching by credits, education institutions may perform conversion to collect tuition fees by credits while keeping total credit-based tuition fees for the entire course from exceeding year-based tuition fees stipulated for the entire course.
4. Education institutions shall collect and transfer tuition fees to commercial banks or the State Treasury for management and use. In case of new tuition fees to be collected in cash periodically, education institutions shall perform procedures for submitting all tuition fees collected in cash to their account at the State Treasury or commercial banks for management as per regulation.

2. Private educational institutions shall utilize tuition fees to guarantee expenditure, and revenue, assume responsibilities for financial management for their activities, organize accounting works, pay taxes, and perform other financial obligations as prescribed by laws.
3. Educational institutions shall manage tuition fee revenues and expenditures within accounting, audit, tax, and financial disclosure policies as prescribed by laws; comply with inspection requirements of competent financial agencies and educational authorities and assume legal responsibilities for the accuracy and truthfulness of the provided information and data.
4. Prior to enrolment or admission, educational institutions shall disclose tuition fees and training costs for each academic year and education level for preschool education and general education, roadmaps for increasing tuition fees (if any) for each academic year, and estimated fees for the entire course in case of higher education.
5. Educational institutions shall disclose and explain training costs, tuition fees, and roadmaps for increasing tuition fees for each academic year and education level; disclose qualifying criteria as prescribed by laws; disclose tuition fee reduction, exemption policies, and the amount thereof in case of natural disasters, epidemics, and other force majeure events.
Chapter IV
POLICIES ON TUITION FEE EXEMPTION, REDUCTION, AND STUDYING COST FINANCING AND PAYMENT METHODS

1. Individuals prescribed by Ordinance on Benefits for Revolutionary Contributors when studying in educational institutions affiliated to the national education system.
2. Preschool students and students with disabilities.
3. Preschool students and students under 16 years old without nurturing sources and individuals from 16 to 22 years old studying in general education or higher education for the first degree eligible for monthly social allowances as prescribed in Clause 1 and Clause 2 Article 5 of Decree No. 20/2021/ND-CP dated March 15, 2021 of the Government of Vietnam. Learners at intermediate and/or college levels who are left without both parents and shelter according to the Law on Vocational Education.
4. Preschool students, general education students, and learners of continuing education facilities pursuing general education programs whose parent, parents, or grandparents (in case of living with grandparents) are poor households according to regulations of the Prime Minister of Vietnam.
5. 5-year-old preschool children in extremely disadvantaged hamlets or communes in category III areas of ethnic minority areas and mountainous areas or extremely disadvantaged communes in river islets, coastal regions, and islands according to regulations of competent authorities.
6. 5-year-old preschool children not specified under Clause 5 of this Article shall be exempted from tuition fees from the 2024-2025 academic year (starting from September 1, 2024).
7. Preschool children, general education students, and learners of continuing education facilities pursuing general education programs who are legal foster children or biological children of active non-commissioned officers and soldiers as prescribed in Clause 2 Article 6 of Decree No. 27/2016/ND-CP dated April 6, 2016 of the Government of Vietnam.
8. Lower secondary education students in extremely disadvantaged hamlets or communes in category III areas in ethnic minority areas and mountainous areas or extremely disadvantaged communes in river islets, coastal regions, and islands as prescribed by regulations of competent authorities shall be exempted from tuition fees from the 2022-2023 academic year (starting from September 1, 2022).

16. Learners subject to tuition fee exemption programs and schemes according to regulations of the Government of Vietnam.
17. Graduates of lower secondary education pursuing intermediate education.
18. Learners pursuing intermediate education and/or college-level education for majors that are difficult in terms of enrolment and admission but are demanded by society according to the list stipulated by the Ministry of Labor - War Invalids and Social Affairs of Vietnam.

Article 16. Eligibility for tuition fee reduction and tuition fee financing
1. Eligibility for a tuition fee reduction of 70% includes:
a) Students pursuing traditional arts and specific majors in public and/or private vocational education institutions and higher education institutions providing cultural-artistic training;
b) Students pursuing traditional art forms or arduous, hazardous, and dangerous occupations in vocational education under the list of arduous, hazardous, and dangerous occupations stipulated by the Ministry of Labor - War Invalids and Social Affairs of Vietnam;
c) Kindergarten children and students who are ethnic minorities (other than very minor ethnic minorities) in extremely disadvantaged hamlets or communes of category III areas in ethnic minority areas and mountainous areas or extremely disadvantaged communes in river islets, coastal regions, and islands according to regulations of competent authorities.
2. Eligibility for a tuition fee reduction of 50% includes:
a) Kindergarten children and students who are children of officials, public employees, or workers whose parent suffers from occupational accidents or diseases receiving regular allowances;
b) Preschool students, general education students, and learners of continuing education facilities pursuing general education programs whose parent, parents, or grandparents (in case of living with grandparents) are near-poor households according to regulations of the Prime Minister of Vietnam.
3. Eligibility for tuition fee financing: Primary education students in private education institutions in areas with insufficient number of public education institutions shall receive financing for tuition fees from the State.

In case of natural disasters, epidemics, and other force majeure events disclosed by competent authorities, depending on the level of impact and damage, People’s Committees of provinces shall request People’s Councils of provinces to consider deciding not to charge tuition fees in a specific period for kindergarten children, students in public general education institutions, and learners in continuing education facilities pursuing general education programs in areas suffering from natural disasters, epidemics, or other force majeure events.
Article 18. Eligibility for financing for studying costs
1. Kindergarten children, students in general education institutions, and students in continuing education facilities pursuing general education programs who are left without both parents.
2. Kindergarten children, students in general education institutions, and students in continuing education facilities pursuing general education programs suffer from disabilities.
3. Preschool students, general education students, and learners in continuing education facilities pursuing general education programs whose parents are poor households according to regulations of the Prime Minister of Vietnam.
4. Kindergarten children, students in general education institutions, and learners in continuing education facilities pursuing general education programs in extremely disadvantaged hamlets or communes in category III areas in ethnic minority areas and mountainous areas or extremely disadvantaged communes in river islets, coastal regions, and islands according to regulations of competent authorities.
Section 2. PROCEDURES FOR IMPLEMENTING TUITION FEE EXEMPTION, REDUCTION, AND PAYMENT METHODS

- Confirmation papers of disabilities issued by People’s Committees of communes or decisions on social benefits of Chairpersons of People’s Committees of districts for individuals under Clause 2 Article 15 hereof;
- Decisions on social benefits of Chairpersons of People’s Committees of districts for individuals under Clause 3 Article 15 hereof;
- Confirmation papers of poor households issued by People’s Committees of communes for individuals under Clause 4 Article 15 hereof;
- Confirmation papers of eligibility for tuition fee exemption according to Decree No. 27/2016/ND-CP dated April 6, 2016 of the Government and guiding documents of the Ministry of National Defense of Vietnam for individuals under Clause 7 Article 15 hereof;

- Birth certificate and citizen identity card or identification card, certificate of residence information or notice of personal identification number and citizen information in the National Population Database in case the agency or organization cannot access the residence information of citizens in the National Population Database[2] for individuals under Clause 5, Clause 8, Clause 15 Article 15 and Point c Clause 1 and Clause 3 Article 16 hereof. From the academic year of 2024 - 2025 (starting from September 1, 2024) individuals under Clause 5 and Clause 6 Article 15 hereof and from the academic year of 2025 - 2026 (starting from September 1, 2025) individuals under Clause 8 and Clause 9 Article 15 hereof, are only required to submit birth certificate;
- Lower secondary education degree or provisional confirmation of graduation for individuals under Clause 17 of Article 15 hereof;
- Monthly benefit number of either parent who suffers from occupational accidents or diseases granted by social security organizations for individuals under Point a Clause 2 Article 16 hereof;
- Confirmation papers of near-poor households issued by People’s Committees of communes for individuals under Clause 2 Article 16 hereof.
c) For preschool children, students in general education institutions, and learners in continuing education facilities pursuing formal education programs eligible for both tuition fee exemption, reduction and studying cost financing, only 1 set of application consisting of documents above together with the form prescribed in Appendix IV hereof are required.
d) Learners eligible for tuition fee reduction, exemption, and studying cost financing are only required to prepare 1 set of application for the whole studying period. For learners living in poor households or near-poor households, at the beginning of each semester, submit additional confirmation papers of poor households or near-poor households to serve as the basis for considering tuition fee reduction, exemption, and studying cost financing for the subsequent semester.
dd)[3] In case a student has a citizen identity card and is granted a personal identification number, information about permanent residence can be accessed from connecting and sharing population data with other educational institutions, the Committee Division of Education and Training, the Department of Education and Training, the Division of Labor - War Invalids and Social Affairs, the Committee Division of Finance, the Department of Finance, his/her parents (or guardian) are not required to submit birth certificate and proof of permanent residence.
2. Implementation procedures:
Within 45 working days from the starting date of an academic year, parents (or guardians) of preschool children, students in general education institutions, and students in continuing education institutions; students and learners in vocational education institutions and higher education institutions eligible for tuition fee reduction, exemption, tuition fee financing, or studying cost financing shall submit applications (using Form prescribed in Appendix II; Annex III; Appendix IV; Appendix V; Appendix VI, and Appendix VII hereof) and certified copies or copies with original copies for comparison or copies from the original copies of any documents specified under Clause 1 of this Article to prove eligibility for tuition fee reduction, exemption, and studying cost financing to education institutions via online methods, postal services, or the electronic trading system.

a) For preschools, primary education institutions, lower secondary education institutions, and continuing education facilities affiliated to Committee Divisions of Education and Training: Within 10 working days from the date on which applications for tuition fee reduction, exemption, studying cost financing, and tuition fee financing for students in private primary schools in areas with insufficient number of public schools are received, principals shall approve such applications and prepare lists of students eligible for tuition fee exemption, reduction, studying cost financing, and tuition fee financing for students in private primary schools and send them to Committee Divisions of Education and Training for appraisal;
b) For upper secondary education institutions, continuing education facilities, and other educational institutions affiliated to Departments of Education and Training: Within 10 working days from the date on which applications for tuition fee reduction, exemption, and studying cost financing are received, principals shall approve and prepare lists of students eligible for tuition fee reduction, exemption, and studying cost financing and send them to Departments of Education and Training for appraisal;
c) For public vocational education institutions and higher education institutions: Within 10 working days from the date on which applications for tuition fee reduction, exemption are received, heads of public vocational education institutions and higher education shall approve such applications and decide on the tuition fee reduction, exemption for students and learners while preparing lists of students eligible for tuition fee reduction, exemption using form prescribed in Appendix IX and submit them to direct superiors. Direct superiors shall appraise and prepare expenditure estimates using the form prescribed in Appendix X and send them to the Ministry of Finance of Vietnam for consolidation and present them to competent authorities for allocation of implementation funding within annual budget estimates;
d) For private preschools; private general education institutions; private continuing education institutions, private vocational education institutions, and private higher education institutions: Within 10 working days from the date on which applications for tuition fee reduction, reimbursement, and exemption, studying cost financing, tuition fee financing of learners are received, the mentioned entities shall issue written confirmation papers for learners according to Appendix VIII hereof.
dd) For private vocational education institutions and higher education institutions: within 10 working days from the date on which applications for tuition fee reduction, exemption are received, heads of private vocational education institutions and higher education institutions shall verify such applications for tuition fee reduction, exemption for leaners while preparing lists of learners eligible for tuition fee reduction, exemption using the form prescribed in Appendix IX and send them to Committee Divisions of Labor - War Invalids and Social Affairs where the learners register for permanent residence for implementation as per regulation.
Article 20. Policies on tuition fee reduction, exemption, studying cost financing, and tuition fee financing
1. Tuition fee reduction and exemption shall be implemented throughout studying periods at schools, except for cases where changes to eligibility for tuition fee reduction or exemption occur.
2. The state budget shall reimburse the reduced and exempted tuition fees for learners in public educational institutions, to be specific:
a) The State shall reimburse the reduced and exempted tuition fees for public preschools, general education institutions, and continuing education institutions to implement the tuition fee reduction, exemption for learners eligible for such reduction, exemption specified under this Decree following the tuition fees prescribed by People’s Councils of provinces for public education institutions that have not guaranteed recurrent expenditure entirely corresponding for each area and each education level;

The remainder of the tuition fees to be paid by the learners shall equal the difference between the top tuition fee limit prescribed under Point a Clause 1, Point a Clause 2 Article 10; Point a Clause 1, Point a Clause 2 Article 11, and the amount financed by the State, except for majors specified under Point a and Point b Clause 1 Article 16 where the learners must pay the difference between the tuition fees of educational institutions and the amount financed by the State.
3. The State shall, based on the tuition fees prescribed by competent authorities in public vocational education institutions and higher education institutions that have not guaranteed recurrent expenditure entirely for majors under Article 10 and Article 11 hereof, provide tuition fees in part or in whole for individuals eligible for tuition fee reduction, exemption studying in private preschools, general education institutions, vocational education institutions, and higher education institutions; provide financing for tuition fees for families of preschool students in private education institutions in areas with insufficient number of public educational institutions according to tuition prescribed by People’s Councils of provinces for public educational institutions that have not guaranteed recurrent expenditure entirely corresponding to each area and each education level.
4. In case an individual is eligible for tuition fee reduction, exemption, and studying cost financing according to this Decree and other effective legislative documents with higher benefits, he/she shall receive the higher benefits under other legislative documents.
5. Tuition fee reduction and exemption do not apply to cases where beneficiaries receive salaries and subsistence allowances when studying and cases of pursuing post-graduate education and researchers (except for individuals under Clause 14 and Clause 16 Article 15 hereof).
6. Learners who have received tuition fee reduction and/or exemption at certain vocational education institutions or higher education institutions and are now pursuing the same education level at other vocational education institutions or higher education institutions shall not be eligible for such benefits again. If learners are eligible for tuition reduction, exemption in multiple education institutions, or multiple majors/departments in the same education institutions, learners shall only receive the benefits once.
7. Tuition fee reduction and exemption shall not be applied to leaners who are pursuing short-term continuing education and training in continuing education institutions except for cases where learners pursue education levels under general education program in form of continuing education.
8. Tuition fee reduction, exemption, and studying cost financing shall not be applied to the period when learners are temporarily suspended, dismissed, repeating classes, or taking additional classes. In case learners must suspend their studying or repeat classes (no more than once) due to sickness or force majeure but not disciplinary actions or voluntary withdrawal from education, heads of educational institutions shall consider permitting the continuation of the education according to regulations and receipt of benefits under this Decree.
9. Reimbursement funding for tuition fee reduction, exemption, and tuition financing shall be granted depending on the actual learning period but no more than 9 months/academic year for preschool children, students pursuing general education, and students in continuing education institutions and 10 months/academic year for students learning in vocational education institutions and higher education institutions, and be made twice per year at the beginning of each semester.
10. The State shall finance studying costs directly for individuals under Article 18 hereof with the amount of VND 150,000/student/month for purchasing books, notebooks, and other learning equipment. Time of receiving benefits depends on actual learning period and does not exceed 9 months/school year; benefits shall be made twice per year at the beginning of each semester.

Article 21. Methods of reimbursing reduced, exempted tuition fees, and studying cost financing for public educational institutions
1. Methods of reimbursing reduced, exempted tuition fees for public educational institutions
a) The funding for reimbursing reduced, exempted tuition fees for public education institutions shall be granted on an annual basis in the form of assigning estimates. The allocation of estimates for the funding for tuition fee reimbursement for public educational institutions shall be implemented at the same time as the allocation of annual state budget estimates. When assigning estimates to educational institutions, presiding entities must clarify estimates for the funding for tuition fee reimbursement for learners eligible for tuition fee reduction, exemption, and studying in public educational institutions;
b) Public educational institutions shall send applications for estimate withdrawal to the State Treasury consisting of (i) Decision on estimate assignment of the competent authority for the funding for reimbursing reduced, exempted tuition fees; (ii) Decision on approving the list of individuals eligible for tuition fee reduction, exemption of public educational institutions together with lists and request for reimbursement of reduced, exempted tuition fees (consisting of: Full name, eligibility, the total number of students eligible for tuition fee reduction and exemption and pursuing education in educational institutions, tuition fees of education institutions, reduced and exempted tuition fees requested for reimbursement) and all documents approving eligibility for tuition fee reduction, exemption, and studying cost financing; (iii) Estimate withdrawal document to withdraw estimates for expenditure on reimbursing reduced, exempted tuition fees.
The State Treasury shall, based on the applications for estimate withdrawal, control and transfer money to bank accounts for tuition fee collection of educational institutions while adhering to estimates assigned by competent authorities and keeping within the estimate applied for withdrawal by education institutions.
The state budget for reimbursing reduced, exempted tuition fees for public educational institutions shall be transferred and recorded to bank accounts for tuition fee collection of the educational institutions and shall be used depending on the actual number of beneficiaries of reimbursement and applicable regulations on financial autonomy of public service providers; in case assigned estimates for reimbursing reduced, exempted tuition fees for public educational institutions are higher than actual number of beneficiaries and reimbursement amount according to regulations of the State, educational institutions shall report to presiding authorities for actions under current regulations.
2. Methods of paying for studying cost financing for individuals studying in public preschools and general education institutions.
a) Committee Divisions of Education and Training shall pay and settle the funding for financing studying costs for parents (or guardians) of preschool children, primary school students, and lower secondary school students; parents (or learners) in continuing education institutions or authorize educational institutions to pay and settle with Committee Divisions of Education and Training;
b) Departments of Education and Training shall pay and settle the funding for financing studying costs for parents of students (or students) in upper secondary education institutions, students in continuous education institutions of provinces, and students in other education institutions under the management of Departments of Education and Training or authorizing education institutions to pay and settle with Departments of Education and Training;

d) In case parents (or guardians) of preschool children and students have not received financing for studying costs within the prescribed deadline, they shall be paid the missing amount and the amount respective to the subsequent payment period in the subsequent payment period;
dd) The State Treasury shall, based on (i) the Decision on assigning estimates of competent authority (which specifies estimates for financing studying costs); (ii) wire receipt, pay Committee Divisions of Education and Training or Departments of Education and Training or educational institutions in advance (if authorized).
Committee Divisions of Education and Training or Departments of Education and Training or educational institutions (if authorized) shall pay the correct beneficiaries and settle advance with the State Treasury. The State Treasury shall, based on applications for advance and Schedule regarding documents on advance/payment, settle advance.
Article 22. Methods of paying reduced, exempted tuition fees, studying cost financing for learners in private educational institutions; vocational education institutions and higher education institutions affiliated to state enterprises and business entities; paying tuition fee financing for primary students in private educational institutions (in areas with an insufficient number of public schools)
1. Methods of paying reduced, exempted tuition fees, and financing for tuition costs
a) Committee Divisions of Education and Training shall pay and settle the funding for reducing, exempting tuition fees, and financing studying costs directly (or authorize educational institutions to pay) for parents (or guardians) of preschool children, students in primary education institutions, and students in lower secondary education institutions;
b) Departments of Education and Training shall pay and settle the funding for reducing, exempting tuition fees, and financing studying costs directly to parents of students in upper secondary education institutions or authorizing educational institutions to do so;
c) Committee Divisions of Labor – War Invalids and Social Affairs shall pay and settle the funding for reducing, exempting tuition fees for parents or guardians of students; students in local vocational education institutions and higher education institutions;
d) In case parents (or guardians) of preschool students, students pursuing general education, students in continuing education institutions, and students who have not received reimbursement for tuition fees and studying cost financing within the deadline, they shall receive the missing benefits in the subsequent payment period in addition to the benefits respective to the payment period.

2. Methods of paying tuition fee financing for students in private primary education institutions
a) Committee Divisions of Education and Training shall, based on documents and the actual number of students receiving benefits, and financing amount approved by People's Councils of provinces, withdraw estimates in treasury and transfer them to private primary education institutions. Private primary education institutions shall pay the correct beneficiaries. At the end of a budget year and the end of an academic year, private primary education institutions shall, based on the actual number of students receiving financing in each semester, verify the amount of money financing tuition and settle with Committee Divisions of Education and Training to settle the budget under regulations;
b) When withdrawing the funding for financing tuition fees, Committee Divisions of Education and Training shall send the following to the State Treasury where the Committee Divisions of Education and Training trade: Decision on assigning estimates of competent authorities (which specifies the funding for financing tuition fees), consolidated applications for financing tuition fees (consisting of Full name of primary school students eligible for tuition fee financing studying in private primary education institutions; financing amount approved by People’s Councils of provinces, and total funding requested for financing tuition fee) and wire receipt.
The State Treasury shall lend Committee Divisions of Education and Training in advance for transfer to private primary education institutions.
Committee Divisions of Education and Training shall, based on documents proving settlement sent by private primary education institutions, settle the advance with State Treasury. State Treasury shall, based on applications for advance and Schedule regarding documents on advance/payment, settle advance with Committee Divisions of Education and Training.
Section 3. PREPARATION AND ALLOCATION OF ESTIMATES, SETTLEMENT OF FUNDING FOR REDUCING, EXEMPTING TUITION FEES, FINANCING STUDYING COSTS, AND FINANCING TUITION FEES
Article 23. Preparation of estimates
Annually, according to Directives of the Prime Minister of Vietnam on the preparation of socio-economic development plans and state budget estimates for the year of planning, Circulars of the Ministry of Finance of Vietnam guiding the development of state budget estimates for the year of planning; on the basis of estimation of the number of individuals eligible for tuition fee reduction, exemption, studying costs financing, and tuition fee financing for students in private primary educational institutions in areas with an insufficient number of public education institutions; Ministries, central government authorities, and People’s Committees of provinces shall develop estimates for the funding for reducing, exempting tuition fees, financing studying costs, and financing tuition fees for students in private primary education institutions in areas with an insufficient number of public educational institutions to include in state budget expenditure estimates of Ministries and local governments sent to the Ministry of Finance of Vietnam at the same time with reports on state budget estimates for the year of planning.

a) Preschools, general education institutions, and continuing education institutions shall, based on the tuition fees prescribed by People's Councils of provinces for public education institutions that have not guaranteed recurrent expenditure entirely and the number of individuals eligible for tuition fee reduction, exemption, produce lists, develop funding estimates to apply for the reimbursement of reduced, exempted tuition fees (together with documents verifying eligibility according to this Decree) as follows: For preschools, primary education institutions, and lower secondary education institutions: Send to Committee Divisions of Education and Training for appraisal and submission to financial authorities of the same level for presentation to competent authorities; For upper secondary education institutions and other educational institutions affiliated to Departments of Education and Training: Send to Departments of Education and Training for appraisal and submission to financial authorities of the same level and presentation of competent authorities;
b) Vocational education institutions and higher education institutions shall, based on tuition fees corresponding to the majors of the educational institutions (without exceeding the top tuition fee limit under this Decree for vocational education institutions and higher education institutions that have not guaranteed recurrent expenditure entirely) and the number of individuals eligible for tuition fee reduction, exemption, develop lists and funding estimates to send to superior estimate entities for appraisal and submission to financial authorities of the same level for presentation to competent authorities.
2. Funding for financing studying costs
Committee Divisions of Education and Training or Departments of Education and Training shall, based on the financing rates for studying costs under this Decree and the number of beneficiaries, including the number of beneficiaries studying in public and private educational institutions (together with documents verifying eligibility according to this Decree), produce lists, consolidate, and develop funding estimates for submission to financial authorities of the same levels for presentation to competent authorities.
3. The funding for reducing and exempting tuition fees for learners in private educational institutions; vocational education institutions and higher education institutions affiliated to state enterprises and business entities; financing tuition fees for primary students in private educational institutions (in areas with an insufficient number of public schools)
a) Committee Divisions of Education and Training shall, based on the tuition fees of public preschools and lower secondary education institutions that have not guaranteed recurrent expenditure and financing for tuition fees for private primary school students prescribed by People’s Councils of provinces; the number of beneficiaries in private preschools, primary education institutions, and lower secondary education institutions, produce lists (including documents verifying eligibility according to this Decree), appraise, consolidate, and develop estimates for the funding for reducing, exempting, and financing tuition fees for learners in private educational institutions for submission to financial authorities of the same level for presentation to competent authorities;
b) Committee Divisions of Education and Training shall, based on the tuition fees of public upper secondary education institutions that have not guaranteed recurrent expenditure entirely prescribed by People’s Councils of provinces and the number of beneficiaries in private upper secondary education institutions, produce lists (including documents verifying eligibility according to this Decree), appraise, consolidate, and develop funding estimates for submission to financial authorities of the same level for presentation to competent authorities;
c) Committee Divisions of Labor – War Invalids and Social Affairs of districts shall, based on the top tuition fee limit of vocational education institutions that have not guaranteed recurrent expenditure entirely and higher education institutions that have not guaranteed recurrent expenditure entirely with majors under Article 10 and Article 11 hereof, the number of beneficiaries in private vocational education institutions and higher education institutions, vocational education institutions and higher education institutions affiliated to state enterprises, business entities, produce lists (attach documents verifying eligibility under this Decree), appraise, consolidate, and develop funding estimates for submission to financial authorities of the same level for presentation to competent authorities while sending them to Departments of Finance and Departments of Labor – War Invalids and Social Affairs for presentation to People’s Committees of provinces.
4. Departments of Labor – War Invalids and Social Affairs, and People’s Committees of districts, Departments of Finance shall, based on reports of Departments of Education and Training, cooperate with Departments of Education and Training, Departments of Labor – War Invalids and Social Affairs, and People’s Committees of districts in consolidating the number of beneficiaries, reporting to People’s Committees of provinces for approval and allocation of the funding while sending reports to the Ministry of Finance of Vietnam, the Ministry of Education and Training of Vietnam, and the Ministry of Labor – War Invalids and Social Affairs of Vietnam.

Based on decisions on assigning state budget estimates of the Prime Minister of Vietnam:
1. People’s Committees of provinces shall present decisions on allocation of implementation funding for reducing, exempting tuition fees, and financing studying costs for students in private primary education institutions within the local estimates for education and training to People’s Councils of the same level.
2. Ministries and central government authorities shall decide to allocate the funding for reducing, exempting tuition fees, and financing studying costs for public vocational education institutions and higher education institutions as per regulation.
Article 25. Management and statement of funding
1. Agencies and entities assigned with the funding for reducing, exempting tuition, financing studying costs, and financing tuition fees for students in private primary education institutions (in areas with an insufficient number of education institutions) shall manage and use such funding for the right purposes according to the Law on State Budget and send final accounts on the funding on implementation of these policies to superior agencies for consolidation and submission to financial authorities of the same levels before July 20 each year to serve as the basis for identifying and allocating funding estimates of the planning year.
2. Settlement figures of the funding for reducing, exempting tuition fees, financing studying costs, and financing tuition fees for students in private primary education institutions (in areas with an insufficient number of public educational institutions) shall be included in annual final accounts regarding state budget expenditure and conformable with the Law on State Budget, guiding documents, and applicable appendices of the state budget.
Article 26. Funding sources
Funding sources for reducing, exempting tuition fees, financing studying costs, and financing tuition fees for students in private primary education institutions (in areas with an insufficient number of public educational institutions) according to this Decree shall be allocated in annual estimates for education, training, and vocational training as per applicable state budget decentralization. Central government budget shall assist local governments with difficulties in implementing social security policies according to the Law on State Budget, guiding documents, and financing policies from central government budget to local government budget.

Article 27. General provisions on prices for services in education and training when assigning tasks, placing orders, and bidding
1. For services in education and training sectors where the State assigns tasks, places order, and organizes bidding, comply with Decree No. 32/2019/ND-CP dated April 14, 2019 of the Government of Vietnam.
2. The maximum unit price for placing orders of services in preschool education, general education, higher education, and vocational education shall equal the top service price limit under Clause 3 of this Article, Article 28, Article 29, and Article 30 hereof. For regulations on requirements, procedures, methods, and entitlement for assigning tasks, placing orders, or bidding, comply with Decree No. 32/2019/ND-CP and relevant laws.
3. The top limit of service prices in preschool education, general education, higher education, and vocational education whose orders are placed in areas with high private sector involvement or special requirements shall be presented to People’s Councils of provinces by Ministries or People’s Committees of provinces for approval of economic, technical, and costs norms issued by competent authorities in a manner that guarantees reasonable and valid cost offsetting corresponding to education and training services.
Article 28. Top limit of service prices for preschool education and general education
1. The top limit of service prices for preschool education and general education in the academic year of 2021 – 2022: Up to the tuition fees under Clause 1 Article 9 hereof.
2. The top limit of service prices for preschool education and general education from the academic year of 2022 – 2023 and onwards:
a) Preschools and general education institutions that have not guaranteed recurrent expenditure entirely: Up to the top tuition fee limit under Point a Clause 2 Article 9 hereof.
From the academic year of 2023 – 2024 and onwards, the top limit of service prices in preschool education and general education shall be revised according to the socio-economic conditions of local administrative divisions and solvency of the people without exceeding 7.5%/year;

c) Preschools and general education institutions that have guaranteed recurrent expenditure and investment expenditure entirely: Up to the top tuition fee limit under Point c Clause 2 Article 9 hereof;
d) Preschools and formal education institutions that have guaranteed recurrent expenditure entirely or recurrent expenditure and investment expenditure entirely in a manner satisfactory to quality accreditation standards of the Ministry of Education and Training of Vietnam are allowed to determine service prices on the basis of economic, technical, and cost norms issued by the education institutions and must present them to People’s Committees of provinces for presentation to People’s Councils of provinces for consideration and approval.
Article 29. Top service price limit for higher education
1. The top limit of service prices for higher education in the academic year of 2021 – 2022: Up to the tuition fees under Clause 1 Article 11 hereof.
2. The top limit of service prices for higher education from the academic year of 2022 – 2023 is as follows:
a) Higher education institutions that have not guaranteed recurrent expenditure entirely: Up to the top tuition fee limit under Point a Clause 2 Article 11 hereof;
b) For higher education institutions that have not guaranteed recurrent expenditure entirely: Up to the top tuition fee limit under Point b Clause 2 Article 11 corresponding to each major and academic year;
c) For higher education institutions that have guaranteed recurrent expenditure and investment expenditure entirely: Up to the top tuition fee limit under Point c Clause 2 Article 11 corresponding to each major and academic year;
d) For training programs of higher education institutions that satisfy quality accreditation standards of the Ministry of Education and Training of Vietnam or quality accreditation standards of foreign countries or equivalent, higher education institutions may determine service prices of the training programs on the basis of economic and technical norms issued by the higher education institutions while disclosing and providing explanations for learners and society;

e) The top limit of service prices for training for master's degree and doctorate degree: Equal the top limit of service prices for higher education multiplied by 1,5 for master's degree training and 2,5 for doctorate degree training in each major of each academic year and autonomy level of public higher education institutions.
Article 30. Top limit of service prices for vocational education
1. The top limit of service prices for vocational education in the academic year of 2021 – 2022: Up to the tuition under Clause 1 Article 10 hereof.
2. Top limit of service prices for vocational education from the academic year of 2022 – 2023:
a) The top limit service prices for vocational education shall be determined on the basis of economic and technical norms issued by competent authorities, ensuring transparency of price determinants;
b) In case the top limit of service prices for vocational education has not been prescribed:
- For vocational education institutions that have not guaranteed recurrent expenditure entirely: The top limit of service prices for vocational education shall not exceed the top tuition fee limit under Point a Clause 2 Article 10 hereof.
- For vocational education institutions that have guaranteed recurrent expenditure entirely: The top limit of service prices for vocational education shall not exceed the top tuition fee limit under Point b Clause 2 Article 10 hereof.
- For public vocational education institutions that have guaranteed recurrent expenditure and investment expenditure entirely: The top limit of service prices for vocational education shall not exceed 2,5 times the top tuition fee limit under Point a Clause 2 Article 10 hereof.

IMPLEMENTATION PROVISIONS[4]
Article 31. Implementation
1. The Minister of Education and Training of Vietnam and the Minister of Labor – War Invalids and Social Affairs of Vietnam shall, within their jurisdiction, cooperate with relevant Ministries in guiding the implementation of this Decree.
2. People's Committees of provinces shall develop and present criteria for identifying areas with insufficient numbers of public education institutions to People’s Councils of provinces.
3. People's Committees of provinces shall, based on national socio-economic conditions of the country, inflation index, and annual economic growth rate, decide on tuition range and annual tuition increase rate no more than 7,5%/year from the academic year of 2023 – 2024; public vocational education institutions and higher education institutions shall determine tuition fees corresponding to level of financial autonomy and quality accreditation according to Clause 2 Article 10 and Clause 2 Article 11 with tuition fee increase rate not exceeding 12,5%/year from the academic year of 2026 – 2027.
Collection and management of tuition fees of educational institutions affiliated to the national education system; policies on tuition fee exemption, reduction, and financing for studying costs; principles and methods of determining service prices in education and training sectors shall comply with this Decree.
4. In case agencies processing administrative procedures extract population database which contains sufficient information and documents required according to this Decree, students are not required to submit relevant documents to receive benefits.
Article 32. Transitional provision
1. For public preschools and general education institutions providing high-quality programs according to Clause 3 Article 3 of Decree No. 86/2015/ND-CP dated October 2, 2015 of the Government of Vietnam that satisfy education institution quality accreditation according to standards prescribed by the Ministry of Education and Training of Vietnam may determine tuition fees on the basis of economic, technical, and costs norm issued by educational institutions and present them to People’s Committees of provinces for presentation to People’s Councils of provinces.

2. For public service providers implementing pilot renovation of operations according to Resolution No. 77/NQ-CP dated October 24, 2014 of the Government of Vietnam, comply with regulations on tuition fees, tuition fee reduction and exemption, financing for studying costs according to this Decree from the 2021 – 2022 academic year.
3. For higher education institutions providing high-quality programs according to Clause 3 Article 3 of Decree No. 86/2015/ND-CP dated October 2, 2015 of the Government of Vietnam and satisfying training program quality accreditation according to the standards prescribed by the Ministry of Education and Training of Vietnam or training program quality accreditation according to standards prescribed by foreign countries or equivalent, may determine tuition fees for said programs on the basis of economic and technical norms issued by educational institutions while disclosing and providing explanations for the learners and society.
In case of not satisfying quality accreditation according to the regulations above, apply tuition fees following the approved high-quality program scheme within 2 years starting from the academic year of 2021 – 2022 to implement quality accreditation. In case of not satisfying quality accreditation requirements after 2 years, apply the top tuition fee limit corresponding to each major and level of financial autonomy according to this Decree.
4. Collection and management of tuition fees of educational institutions affiliated to the national education system; policies on tuition fee exemption, reduction, and financing for studying costs; service prices in education and training sectors under this Decree apply from the school year of 2021 - 2022.
Article 33. Entry into force
1. This Decree comes into force as of October 15, 2021 and replaces Decision No. 86/2015/ND-CP dated October 2, 2015 of the Government and Decree No. 145/2018/ND-CP dated October 16, 2018.
2. Ministers, heads of ministerial agencies, heads of governmental agencies, Chairpersons of People’s Committees of provinces and centrally affiliated cities, and relevant organizations and individuals shall implement this Decree./.
