AMENDMENTS TO CIRCULAR NO. 238/2016/TT-BTC DATED NOVEMBER 11, 2016 OF THE MINISTRY OF FINANCE OF VIETNAM ON THE SERVICE PRICE FOR TECHNICAL SAFETY AND ENVIRONMENTAL PROTECTION INSPECTION OF CURRENTLY CIRCULATING MOTOR VEHICLES, EQUIPMENT, AND HEAVY-DUTY VEHICLES; ASSESSMENT AND CALIBRATION OF EQUIPMENT INSPECTING HEAVY-DUTY VEHICLES

Pursuant to the Law on Road Traffic 2008;

Pursuant to the Law on Prices 2012;

Pursuant to the Law on Fees and Charges 2015;

Pursuant to Decree No. 177/2013/ND-CP dated November 14, 2013 of the Government of Vietnam elaborating the Law on Prices of Vietnam and Decree No. 149/2016/ND-CP dated November 11, 2016 of the Government of Vietnam on Amendments to Decree No. 177/2013/ND-CP dated November 14, 2013;

Pursuant to Decree No.87/2017/ND-CP dated July 26, 2017 of the Government of Vietnam on functions, entitlements, and organizational structure of the Ministry of Finance of Vietnam;

Article 1. Amendments to Clause 1 Article 3 of Circular No. 238/2016/TT-BTC dated November 11, 2016 of the ministry of finance of Vietnam on the service price for technical safety and environmental protection inspection of currently circulating motor vehicles, equipment, and heavy-duty vehicles; assessment and calibration of equipment inspecting heavy-duty vehicles

“Article 3. Inspection service price

1. The service price prescribed in this Circular is the price that has already included VAT (10% tax rate) and the issuance cost of the Certificate of Technical Safety and Environmental Protection for motor vehicles and heavy-duty vehicles; not including expenses for accommodation, travel, and contact information for inspection work in places more than 100km away from the headquarters of the registration unit. Expenses for accommodation, travel, and contact information for inspection work in places more than 100km away from the headquarters of the registration unit (if any) shall comply with current regulations of the Ministry of Finance of Vietnam on regulations on work expenses for state agencies and public service providers.”

Article 2. Tariff on technical safety and environmental protection inspection service prices for currently circulating motor vehicles, equipment, and heavy-duty vehicles; assessment and calibration of equipment inspecting heavy-duty vehicles

The Tariff on service prices enclosed with Circular No. 238/2016/TT-BTC dated November 11, 2016 of the Ministry of Finance of Vietnam is replaced with the Tariff on service prices promulgated with this Circular.

Article 3. Implementation

1. This Circular comes into force as of October 8, 2022.

2. If competent agencies change the VAT rate, the Ministry of Transport (Vietnam Register) shall, based on the guidelines of competent agencies, provide guidelines on the adjustment for registration organizations corresponding to the service prices prescribed in the Tariff promulgated with this Circular.

3. Difficulties that arise during the implementation of this Circular shall be reported to the Ministry of Transport of Vietnam (Vietnam Register) for summary and cooperation with the Ministry of Finance of Vietnam in considering and settling.
