PROVISIONAL GUIDELINES REGARDING REGULAR DOMESTIC PASSENGER FLIGHTS FULFILLING SAFE, FLEXIBLE ADAPTATION, AND EFFECTIVE CONTROL OF COVID-19

MINISTER OF TRANSPORT

Pursuant to Decree No. 12/2017/ND-CP dated February 10, 2017 of Government on functions, tasks, powers, and organizational structure of Ministry of Transport;

Pursuant to Resolution No. 128/NQ-CP dated October 11, 2021 of the Government on Provisional guidelines on “Safe, flexible adaptation, and effective control of COVID-19”;

Pursuant to Resolution No. 38/NQ-CP dated March 17, 2022 of the Government on COVID-19 Control Program;

Pursuant to Resolution No. 01/CT-TTg dated February 8, 2022 of the Prime Minister on effectively expediting and implementing tasks following the Chinese New Year of 2022;

Pursuant to Decision No. 218/QD-BYT dated January 27, 2022 of Ministry of Health on Provisional guidelines on medical specialty in implementation of Resolution No. 128/NQ-CP dated October 11, 2021 of the Government;

HEREBY DECIDES:

Article 1. The Provisional guidelines on organization of regular domestic passenger flights fulfilling safe, flexible adaptation and effective control of COVID-19 are attached hereto as follows:

1. Scope

These Provisional guidelines apply to organization of regular domestic passenger flights fulfilling safe, flexible adaptation, and effective control of COVID-19.

2. Regulated entities

a) Authorities, epidemic control forces, airlines, airports, and aerodromes of Vietnam;

b) Organizations and individuals engaging in domestic passenger air transport.

3. Frequency of domestic passenger air transport and COVID-19 control measures

a) Frequency of operation of regular domestic passenger airway: Vietnamese airlines are allowed to operate flights with frequency depending on market demand, airlines’ capacity, airport's infrastructures, and air navigation infrastructure.

Provisional guidelines on medical specialty in implementation of Resolution No. 128/NQ-CP dated October 11, 2021 of the Government; requirements and guidelines of the National Steering Committee for COVID-19 Control, Ministry of Health, and local health authorities.

4. Flight crews (aircrew and stewardess) and passengers engaging in domestic air transport must:

a) comply with “5K Rule”; perform medical declaration in accordance with regulations of Ministry of Health;

b) strictly implement COVID-19 control measures in accordance with guidelines of the National Steering Committee for COVID-19 Control and Ministry of Health;

c) perform medical test and quarantine: conform to requirements and guidelines of Ministry of Health and local health authorities.

5. Enterprises operating airports and aerodromes must adequately implement COVID-19 control measures in accordance with request and guidelines of the National Steering Committee for COVID-19 Control, Ministry of Health, and local authorities.

6. If new regulations on COVID-19 control applicable to regulated entities hereof are promulgated by the Government, the National Steering Committee for COVID-19 Control, or Ministry of Health, the new regulations shall prevail.

Article 2. Entry into force

1. This Decision comes into effect from the day of signing.

Article 3. Organization for implementation

Chief of Ministry Office, Chief of Ministry Inspectorate, Directors of Departments, General Director of Directorate for Roads of Vietnam, Director of Information Technology Center, entities, enterprises providing aviation transport services; enterprises operating airports; air traffic service providers; heads of agencies, entities, and relevant organizations, individuals are responsible for implementation of this Decision./.
