DECISION
PROMULGATING THE INTERIM GUIDANCE ON ORGANIZATION OF TRANSPORT ACTIVITIES IN 3 SECTORS (ROADWAY, INLAND WATERWAY, MARITIME) TO ENSURE THE SAFETY, FLEXIBILITY, AND EFFECTIVE CONTROL OF THE COVID-19 EPIDEMIC
MINISTER OF TRANSPORT
Pursuant to Decree No. 12/2017/ND-CP dated February 10, 2017 of the Government on functions, tasks, entitlements, and organizational structure of the Ministry of Transport;
Resolution No. 128/NQ-CP dated October 11, 2021 of the Prime Minister on “Thích ứng an toàn, linh hoạt, kiểm soát hiệu quả dịch COVID-19” (Safety, flexibility, and effective control of COVID-19 epidemic) provisional regulations.
Pursuant to the Government’s Resolution No. 38/NQ-CP dated March 17, 2022 on promulgation of the COVID-19 Prevention and Control Program;
Pursuant to Directive No. 01/CT-TTg dated February 8, 2022 of the Prime Minister on the urge and effective implementation of tasks after the Lunar New Year holiday of the Tiger 2022;
Pursuant to Decision No. 218/QD-BYT dated January 27, 2022 of the Ministry of Health on medical expertise to implement Resolution No. 128/NQ-CP dated October 11, 2021 of the Government on provision regulations on “Safety, flexibility, and effective control of COVID-19 epidemic”;

HEREBY DECIDES:
Article 1. Promulgating the Interim Guidance on organization of transport activities in 3 sectors (roadway, inland waterway, and maritime) to ensure the safety, flexibility, and effective control of the COVID-19 epidemic with the following content:
1. Regulated scope
This Interim Guidance applies to transport activities of 3 sectors (roadway, inland waterway, and maritime) nationwide, ensuring the safety, flexibility, and effective control of the COVID-19 epidemic while ensuring inter-provincial transportation of goods and organization of inter-provincial public passenger transport in accordance with the COVID-19 epidemic situation.
2. Regulated entities
a) State management agencies, epidemic control forces, transport business units of 3 sectors; internal transport units; bus stations, roadside stations on the roadway; seaports; ports; inland harbors; other focal points for cargo loading and unloading;
b) Vehicle drivers, service staff on vehicles, attendants (regarding transporting goods, internal passengers, workers, specialists), and passengers participating in traffic by vehicles of 3 sectors;
c) Organizations and individuals involved in transport activities.
3. Classification of COVID-19 risks and scope of risk classification

- Level 1: Low risks (new normal) equivalent to green;
- Level 2: Medium risks equivalent to yellow;
- Level 3: High risks equivalent to orange;
- Level 4: Very high risks equivalent to red.
3.2. Scope of risk classification
From commune level. Scope of risk classification is recommended for a level as smallest as possible (under commune level) to ensure the flexibility and effectiveness.
4. Areas within levels 1 to 4 of the COVID-19 risk classification are eligible for roadway transport activities (including internal transport activities), inland waterway, and maritime transport activities but shall fully implement COVID-19 prevention and control measures at the request and guidance of the Ministry of Health and local health authorities.
5. Vehicle drivers (drivers, co-drivers, stevedoring staff accompanying the vehicle; ship drivers, sailors, stevedoring staff accompanying the ship), and passengers participating in traffic in 3 sectors (roadway, inland waterway, and maritime) shall:
5.1. Comply with the "5K Rule"; make medical declaration in accordance with regulations of the Ministry of Health;

5.3. Regarding medical test and isolation: comply with requests and guidance of the Ministry of Health and local health authorities.
6. Transport business units, enterprises, bus stations, roadside stations on the roadway; seaports; ports, inland harbors; other focal points for cargo loading and unloading in areas within levels 1 to 4 of the COVID-19 risk classification are eligible for operations but shall fully implement COVID-19 prevention and control measures at the request and guidance of the Ministry of Health and local health authorities.
7. In case the Government, National Steering Committee for COVID-19 Prevention and Control, or Ministry of Health promulgates new regulations on COVID-19 prevention and control regarding regulated entities of this Interim Guidance, comply with new regulations.
Article 2. Entry into force
1. This Decision comes into force as of its date of signing.
2. Annul Decision No. 1812/QD-BGTVT dated October 16, 2021 of the Minister of Transport on promulgation of the interim guidance on organization of transport activities of 5 sectors (roadway, inland waterway, maritime, railway, and airway) to ensure the safety, flexibility, and effective control of the COVID-19 epidemic, Document No. 10137/BGTVT-VT dated October 20, 2021 on cooperation, directive, and implementation of the Interim Guidance on organization of transport activities to ensure the safety, flexibility, and effective control of the COVID-19 epidemic, and Document No. 1026/BGTVT-VT dated January 28, 2022 of the Ministry of Transport on adjustment of a number of contents on frequency and seat distancing on vehicles of Decision No. 1812/QD-BGTVT dated October 16, 2021.
Article 3. Chief of Office of the Ministry, Chief Inspector of the Ministry, Directors of Departments, General Director of the Directorate for Roads of Vietnam, Directors of Departments, Directors of Departments of Transport, Departments of Transport and Construction of provinces, centrally-affiliated cities, Vietnam Automobile Transportation Association, local automobile transportation associations, Vietnam Inland Water Transport Association, Vietnam Ship Owners Association; transport business units, enterprises; bus stations, roadside stations on the roadway; seaports; ports, inland harbors; other focal points for cargo loading and unloading; directors of agencies, units, and related organizations, individuals shall implement this Decision.
