PLANS, POLICIES AND SOLUTIONS FOR IMPLEMENTATION OF THE PLANNING FOR INFRASTRUCTURE OF INLAND WATERWAYS FOR THE 2021 – 2030 PERIOD, WITH A VISION TO 2050
THE PRIME MINISTER
Pursuant to the Law on Government Organization of Vietnam dated June 19, 2015; the Law on amendments to some Articles of the Law on Government Organization of Vietnam and Law on Local Government Organization of Vietnam dated November 22, 2019;
Pursuant to the Law on Inland Waterway Transport dated June 15, 2004; the Law on amendments to a number of Articles of Law on Inland Waterway Transport dated June 17, 2014;
Pursuant to the Law on Planning dated November 24, 2017; the Law on amendments to some Articles concerning planning of 37 Laws dated November 20, 2018;
Pursuant to Resolution No. 61/2022/QH15 dated June 16, 2022 of the National Assembly on enhancement of effectiveness and efficiency of the implementation of policies and laws on planning and a number of solutions for removal of difficulties and obstacles, acceleration in formulation and improvement of the quality of planning for the 2021 – 2030 period;

HEREBY DECIDES:
Article 1. The plans, policies and solutions for implementation of the Planning for infrastructure of inland waterways for the 2021 – 2030 period, with a vision to 2050 are promulgated together with this Decision
Article 2. This Decision takes effect from the date on which it is signed.
Article 3. The Ministers, Heads of the ministerial-level agencies, Heads of the governmental agencies, the Presidents of the People's Committees of provinces shall be responsible for the implementation of this Decision.

IMPLEMENTATION OF THE PLANNING FOR INFRASTRUCTURE OF INLAND WATERWAYS FOR THE 2021 – 2030 PERIOD, WITH A VISION TO 2050
(Issued together with Decision No. 1269/QD-TTg dated October 19, 2022 of the Prime Minister of Vietnam)
I. OBJECTIVES
- Raise awareness and carry out activities in implementation of Decision No. 1829/QD-TTg dated October 31, 2021 of the Prime Minister on approval for the Planning for infrastructure of inland waterways for the 2021 – 2030 period, with a vision to 2050 (hereinafter referred to as “the Planning”). Enhance the responsibility for cooperation with relevant ministries, central and local authorities in implementation of objectives, tasks and solutions in each period.
- Identify tasks, solutions, lists of specific projects subject to implementation in each period from present to 2030 in conformity with the conditions of ministries, central and local authorities; clearly identify methods, resources, mechanisms for cooperation among ministries, central and local authorities in implementation.
- Orientate ministries, central and local authorities to formulation of plans and cooperation with the Ministry of Transport and relevant ministries, central and local authorities in performance of tasks and solutions for the planning for infrastructure of inland waterways under management of local authorities.
II. TASKS AND PLANS FOR IMPLEMENTATION
1. Carry out procedures in accordance with regulations of planning laws.
- Organize declaration of the planning, disseminate the contents of the Planning, provide information about the Planning for organizations and individuals to participate in supervision of the implementation of the Planning and participate in the development of infrastructure of inland waterways according to the approved Planning.
- Provide data on the Planning for infrastructure of inland waterways to build information system and national database on planning.

- Closely cooperate with local authorities in the process of formulation of the provincial and regional planning for the content of infrastructure of inland waterways.
- Report and assess implementation of planning for infrastructure of inland waterways every year, every 05 years or on an ad hoc basic at the request of the competent authority.
2. Complete legal documents on inland waterways
- Review, amend regulations of Government’s Decree No. 08/2021/ND-CP dated January 28, 2021 on management of operation of inland waterways to conform to the practical conditions and meet the demands for development.
- Take charge and cooperate with the Ministry of Finance in issuing written agreements on transfer of some national inland waterway routes and sections to local authorities for management.
3. Develop infrastructure
- Focus on public investment projects on public inland waterway infrastructure (navigable channels, correctional works, signal works, locks, dams, etc.) for routes with high volume and density of transport; invest in construction of infrastructure to ensure inland waterway transport and state management of inland waterways at inland ports.
Ensure the progress and quality of inland waterway projects in the medium-term public investment plan for the 2021-2025 period of the Ministry of Transport, including: Southern waterway corridor and logistics development project; project on increase in clearance for road bridges across national inland waterway routes – phrase 1 (Southern area); Cho Gao Canal upgrade project - phrase 2; project on increase in clearance for Duong bridge; project on development of integrated management information system for digital transformation of Vietnam Inland Waterways Administration
- Prioritize and allocate plans for the implementation of medium-term public investment projects funded by the state budget for the 2021 – 2025 period, with a vision to the 2026 - 2030 period (Appendix I).

4. Update and adjust the planning
- Research, review and request competent authorities to update, adjust and supplement the planning on development of infrastructure of inland waterways in order to ensure consistency and uniformity with plannings in higher level and relevant plannings and effectiveness of implementation of the planning.
- Review the Planning every 5 years to make adjustment in conformity with the socio-economic development in each period.
5. Land-use plan
The land fund for implementation the planning shall follow the land-use plan of local authorities in conformity with the approved planning.
III. POLICIES AND SOLUTIONS FOR IMPLEMENTATION OF THE PLANNING
1. Attraction of the capital for development of infrastructure
- Balance the budget, allocate the capital for investment in construction of infrastructure of inland waterways according to the roadmap of the approved Planning, create influence and attract investment in infrastructure of inland waterway and relevant infrastructure in the area.
- Strengthen cooperation among ministries, central and local authorities to allocate resources for feasible and effective implementation of objectives of the planning.

- Continue to strengthen relationships with relevant organizations of strategic partners of Vietnam including Japan, Korea and other countries and international organizations including WB, JICA, ADB and other international organizations to attract the capital for investment in infrastructure of inland waterways, transport infrastructure in connection with inland waterways.
- Continue to research and complete policies on prices and fees at inland ports to improve the effectiveness of investment in inland ports, attract shipping enterprises and container cargo transported by inland waterways.
- Research the application of investment incentives to investment projects that use water surface and inland waterways (specified in the Law No. 61/2020/QH14 dated June 17, 2020 on Investment) to enhance attraction for investors to develop infrastructure of inland waterways.
- Research support policies and investment incentives for enterprises that invest in projects on inland ports.
- Use state budget expenditure intended for development investment for implementation of projects on application of information technology to inland waterways, including: database, software and hardware.
- Focus on allocation of the economic non-business capital for maintenance of inland waterways in order to ensure the maintenance of transport infrastructure and reduce inland waterway accidents.
2. Development of human resources
- Train and attract high-quality human resources, especially human resources in management and operation of infrastructure of inland ports; research implementation of mechanism for commissioning training and refresher training of human resources in management and operation of inland ports; strengthen cooperation and enlist support of partners and international organizations to develop human resources in inland waterways.
- Develop policies on attraction and training in order to provide high quality human resources; enhance training and refresher training of majors, foreign languages, information technology and other skills according to job positions for officials and public employees. Encourage officials and public employees to research scientific topics with practical contents relevant to specialized management of inland waterways.

- Continue to develop the highly qualified technical staff to participate in the development of regulations and standards and solve complex tech issues in the development of inland waterways and inland ports, construction, repair and operation of inland waterway vessels and relevant works.
3. Development and application of science and technology
- Promote application of achievements of the Fourth Industrial Revolution, science and technology, modern techniques, digital technology and digital transformation to the development of inland waterways.
- Prioritize effective investment, development and use of national single-window information technology system; accelerate implementation and completion of digitization of specialized database system.
- Strengthen cooperation with developed countries to gain experience, transfer science and technology to develop inland waterway transport at the advanced, efficient and safe level with standards in conformity with the region and world.
- Effectively operate management system of inland waterway vessels via identification system (AIS) to improve effectiveness in management and monitoring of the location of inland waterway vessels in order to serve management of inland waterways, search and rescue, defense - security and economic development.
- Implement declaration of procedures for inland waterway vessels via the portal.
4. Assurance about social security
- Inland waterway infrastructure is an important component of transport infrastructure and socio-economic infrastructure. Inland waterway infrastructure is one of the three strategic breakthroughs given priority for investment in order to ensure the harmony between economic development and social security.

5. Environmental protection
- Promote environmental protection and research in construction, management and operation of inland waterway infrastructure system and satisfaction of criteria for green building.
- Strengthen cooperation and enlist support of partners and international organizations in environmental protection, research, prevention and control of natural disasters and adaptation to climate change.
- The Ministry of Transport shall closely cooperate with the Ministry of Natural Resources and Environment, relevant ministries and local authorities in clearance of site, location for dumping and storage of dredged material in order to ensure regulations on environmental protection.
6. Assurance about financial resources
- Research and propose appropriate financial mechanisms and policies to meet the demands for investment in development of the inland waterway infrastructure system according to the planning.
- The Ministry of Transport shall closely cooperate with the Ministry of Finance and the Ministry of Planning and Investment in research and report to the competent authorities for consideration of allocation and use of the annual budget to implement contents of the planning.
7. Assurance about national defense and security
- Research and develop inland ports in island districts to serve socio-economic development in association with national defense - security and sovereignty over sea and islands.

8. Breakthrough mechanism
- Access to foreign preferential loans of the Government to invest in infrastructure of inland waterway to effectively connect inland waterway traffic with seaports in accordance with regulations of the Law on management and use of ODA capital, foreign preferential loans of the Government.
- Prioritize allocation of public investment capital to invest in renovation and upgradation of inland waterway channels on main inland waterway transport routes according to the planning for infrastructure of inland waterways for the 2021 - 2025 period and the 2026 – 2030 period.
- The People's Committees of provinces shall allocate funding from the local budget for investment, maintenance of river-crossing terminals in provinces with difficult socio-economic conditions and provinces without conditions for development and investment in other modes of transport.
- Allocate economic non-business capital for maintenance of inland waterways in conformity with the actual situation and the ability to mobilize resources to ensure maintenance of transport infrastructure and reduction in inland waterway accidents.
- Use funding for investment in the development of state budget capital to implement projects on application of information technology to inland waterways
- Use recurrent expenditures from the state budget capital to maintain information technology system that serves inland waterways after investment, including: database, software, hardware...
- Continue to distribute power in investment and maintenance of inland waterway infrastructure system at the request of the Government's Resolution No. 04/NQ-CP dated January 10, 2022 on promotion of distribution of power in state management.
V. IMPLEMENTATION

- Disseminate, provide information and keep documents on the Planning according to regulations.
- Take charge and cooperation with ministries, central and local authorities in management and organization of the implementation of the planning.
- Cooperate with the Ministry of Planning and Investment in research to report to the competent authorities for consideration and approval for addition of the detailed Planning for infrastructure of inland waterway to the list of the technical and specialized plannings in order to concretize and meet requirements for uniformity of the national planning in assessment of implementation of the Law on Planning dated November 24, 2017.
- Take charge of review of specialized laws and guiding documents to create favorable conditions for formulation of the planning, investment, management, maintenance and operation of infrastructure of inland waterways; complete the system of standards, regulations and economic - technical norms.
- Prioritize the balance and allocation of capital for the medium-term public investment plan of the central budget for the 2021-2026 period of the Ministry of Transport approved by competent authorities to implement the proposed projects in Appendix I.
- Cooperate with ministries and central authorities in implementation of relevant contents according to their assigned tasks and functions. Cooperate with local authorities in research and mobilization of resources to invest in development of infrastructure of inland waterways and land use planning in conformity with the planning.
- Take charge and cooperate with relevant agencies in report and assessment of implementation of the planning for infrastructure of inland waterways at the request of competent authorities on an annual, 05 years or ad hoc basis.
- Take charge and cooperate with the Ministry of Finance in transfer of some national inland waterway routes and sections assigned to local authorities for management according to regulations of the Government.

Take charge and allocate public service funding for maintenance of inland waterways within spending tasks of central budget according to within the annual budget.
4. Ministry of Natural Resources and Environment
Take charge and cooperate with the Ministry of Transport in completion of preferential policies on land use and use of rivers and lakes for construction of infrastructure inland waterways; develop regulations on management and use of land and use of border areas for infrastructure of inland waterways.
5. Ministry of Industry and Trade
Take charge and cooperate with the Ministry of Transport in completion of the Law on logistics services (in association with operation of deports); mechanisms and policies relevant to industrial development, supporting industries in association with transport.
6. Ministry of Science and Technology
Cooperate with the Ministry of Transport in organization of research and testing of new technology and new materials; promulgate the system of standards of transport

8. Ministry of Agriculture and Rural Development
Review regulations to facilitate investment in construction of loading and unloading works and cargo transport works of inland ports outside dykes without affecting drainage of flood and safety of dikes.
9. Ministry of Labor; War Invalids and Social Affairs
Review and cooperate with relevant ministries and central authorities in direction for vocational education institutions to carry out training of highly skilled human resources to meet the actual demands to develop inland waterway transport and coastal transport in inland waterways.
10. The People's Committees of provinces
- Organize implementation of state management of transport in accordance with regulations of the law within their provinces; strictly manage the land fund for implementation of the planning.
- Review the local plannings and projects to ensure consistency and uniformity with the plannings for transport.
- Update contents of the provincial planning in order to follow the orientation to development of local traffic according to the national planning. Actively build and integrate the detailed planning of infrastructure of inland waterways in the provincial planning.
- Take charge and allocate the local budget for the development of inland waterway transport of provinces under their management.

- The funding for the implementation of the Plan specified in Article 1 of this Decision shall be allocated within the annual state budget estimate of relevant ministries, central and local authorities according to the current state budget hierarchy in order to ensure the conformity with the ability to balance the state budget and other lawful sources of capital in accordance with the law in order to ensure thriftiness and efficiency.
- Relevant ministries, central and local authorities shall proactively allocate, integrate tasks and mobilize lawful sources of capital other than state budget capital to perform the tasks of the Plan in Article 1 of the Decision.
