DECISION

ON PARTIAL SUSPENSION OF THE DECISION NO.23/2018/QD-UBND DATED JULY 19, 2018 OF THE PEOPLE’S COMMITTEE OF HO CHI MINH CITY ON RESTRICTION OF CARGO VEHICLES AND TRUCKS AND GRANT OF LICENSES FOR OPERATION THEREOF IN URBAN AREAS OF THE CITY

PEOPLE’S COMMITTEE OF HO CHI MINH CITY

Pursuant to the Law on Organization of the Local Government dated June 19, 2015;

Pursuant to the Law on Promulgation of Legislative Documents dated June 22, 2015;

Pursuant to the Government’s Decree No. 34/2016/ND-CP dated May 14, 2016 on detailing certain articles of and providing measures for implementing the Law on Promulgation of Legislative Documents;

At the request of the Department of Justice and Department of Transport in the statement No. 11960/TTr-STP-SGTVT dated November 16, 2018 on partial suspension of the Decision No. 23/2018/QD-UBND dated July 19, 2018 of the People’s Committee of Ho Chi Minh City on restriction of cargo vehicles and trucks and grant of licenses for operation thereof in urban areas of the City.

DECISION

Article 1. Articles 6, 7, 8, 9 and 11 of the Regulation enclosed with the Decision No. 23/2018/QD-UBND dated July 19, 2018 are suspended.

Article 2. The suspension begins from the effective date of this Decision and ends when Articles 6, 7, 8, 9 and 11 of the Regulation enclosed with the Decision No. 23/2018/QD-UBND dated July 19, 2018 are amended or annulled.

Article 3. Department of Transport shall take charge, cooperate with the Department of Justice and People’s Committee Secretariat of the City (Administrative Procedures Control Agency) and submit a report to the People's Committee of the City in order for this Committee to consider amending and annulling certain contents of the Regulation enclosed with the Decision No. 23/2018/QD-UBND as regulated; such amendment or annulment shall be carried out before December 14, 2018.

Article 4. This Decision shall come into effect from the date on which it is signed.

Article 5. Chief of the People's Committee Secretariat, Director of the Department of Justice, Director of the Department of Transport, Chairpersons of the People’s Committees of 24 districts and other related organizations and individuals shall implement this Decision./.
