CIRCULAR

ABROGATION OF LEGISLATIVE DOCUMENTS PROMULGATED BY THE MINISTER OF SCIENCE AND TECHNOLOGY PRESCRIBING METHOD FOR DETERMINATION OF DOMESTIC CONTENT OF MOTOR VEHICLES

Pursuant to the Law on Promulgation of Legislative Documents dated June 22, 2015;

Pursuant to the Law dated June 18, 2020 on Amendments to the Law on Promulgation of Legislative Documents;

Pursuant to the Government’s Decree No. 116/2017/ND-CP dated October 17, 2017 on requirements for manufacturing, assembly and import of motor vehicles and provision of motor vehicle warranty and maintenance services;

Pursuant to the Government’s Decree No. 57/2020/ND-CP dated May 25, 2020 on amendments to several Articles of the Government’s Decree No. 122/2016/ND-CP dated September 1, 2016 on export and preferential import tariff schedules, lists of products, absolute, mixed and out-of-quota import duty rates, and to the Decree No. 125/2017/ND-CP dated November 16, 2017, amending several Articles of the Decree No. 122/2016/ND-CP;

Pursuant to the Government’s Decree No. 95/2017/ND-CP dated August 16, 2017 defining the functions, tasks, powers and organizational structure of the Ministry of Science and Technology;

At the request of Director General of Department of Technology Appraisal, Examination and Assessment and Director General of Department of Legislation;

Article 1. Abrogating legislative documents in their entirety

The following legislative documents are abrogated in their entirety:

1. Decision No. 28/2004/QD-BKHCN dated October 01, 2004 of the Minister of Science and Technology on method for determination of domestic content of motor vehicles.

2. Decision No. 05/2005/QD-BKHCN dated May 11, 2005 of the Minister of Science and Technology on amendments to Decision No. 28/2004/QD-BKHCN dated October 01, 2004 of the Minister of Science and Technology on method for determination of domestic content of motor vehicles;

3. Circular No. 05/2012/TT-BKHCN dated March 12, 2012 of the Minister of Science and Technology on amendments to Article 1 of the Decision No. 05/2005/QD-BKHCN dated May 11, 2005 of the Minister of Science and Technology on amendments to Decision No. 28/2004/QD-BKHCN dated October 01, 2004 of the Minister of Science and Technology on method for determination of domestic content of motor vehicles.

Article 2. Implementation clause

This Circular comes into force October 01, 2022./.
