AMENDMENTS TO THE CIRCULAR NO. 25/2017/TT-BGTVT DATED JULY 28, 2017 OF THE MINISTER OF TRANSPORT PRESCRIBING FORMS OF CERTIFICATES AND RECORDS OF SATISFACTION OF TECHNICAL SAFETY AND ENVIRONMENTAL PROTECTION REQUIREMENTS ISSUED TO SHIPS, INLAND WATERWAY VEHICLES AND INDUSTRIAL PRODUCTS USED FOR INLAND WATERWAY VEHICLES

Pursuant to the Maritime Code of Vietnam dated November 25, 2015;

Pursuant to the Law on Inland Waterway Transport dated June 15, 2004, and the Law dated June 17, 2014 on amendments to the Law on Inland Waterway Transport;

Pursuant to the Government’s Decree No. 12/2017/ND-CP dated February 10, 2017 defining the functions, tasks, powers and organizational structure of the Ministry of Transport;

At the request of the Director of the Legal Department and the Director of Vietnam Register;

The Minister of Transport promulgates a Circular providing amendments to the Circular No. 25/2017/TT-BGTVT dated July 28, 2017 of the Minister of Transport prescribing forms of certificates and records of satisfaction of technical safety and environmental protection requirements issued to ships, inland waterway vehicles and industrial products used for inland waterway vehicles.

Article 1. Amendments to the Circular No. 25/2017/TT-BGTVT dated July 28, 2017

1. Clauses 25, 26, 27 and 28 are added to Article 4 as follows:

 “25. Safety certificate for towing operation issued under the provisions of the National Technical Regulation QCVN 73:2019/BGTVT is provided in Form No. 44 in Appendix 1 enclosed herewith.”

 “26. Certificate of bollard pull testing issued under the provisions of the National Technical Regulation QCVN 73:2019/BGTVT is provided in Form No. 45 in Appendix 1 enclosed herewith.”

 “27. Safety compliance certificate for submersible craft issued under the provisions of the National Technical Regulation QCVN 21:2015/BGTVT and MSC/Circular. 981 of IMO is provided in Form No. 46 in Appendix 1 enclosed herewith.”

 “28. Certificate of satisfaction of technical safety and environmental protection requirements for pleasure yacht issued under the provisions of the National Technical Regulation QCVN 81:2014/BGTVT and Amending 1-2017 QCVN 81:2014/BGTVT is provided in Form No. 47 in Appendix 1 enclosed herewith.”

2. Point dd is added to Clause 2 Article 5 as follows:

“dd) Declaration of MARPOL electronic record book for ships equipped with electronic record book issued under the Resolutions MEPC.312(74) and  MEPC.314(74) of IMO is provided in Form No. 48 in Appendix 1 enclosed herewith.”

3. The Appendix is amended as follows:

a) Form No. 29 in the Appendix enclosed with the Circular No. 25/2017/TT-BGTVT dated July 28, 2017 shall be replaced by Form No. 29 in Appendix 2 enclosed herewith.

b) Form No. 31 in the Appendix enclosed with the Circular No. 25/2017/TT-BGTVT dated July 28, 2017 shall be replaced by Form No. 31 in Appendix 2 enclosed herewith.

c) Form No. 33 in the Appendix enclosed with the Circular No. 25/2017/TT-BGTVT dated July 28, 2017 shall be replaced by Form No. 33 in Appendix 2 enclosed herewith.

d) Form No. 37 in the Appendix enclosed with the Circular No. 25/2017/TT-BGTVT dated July 28, 2017 shall be replaced by Form No. 37 in Appendix 2 enclosed herewith.

dd) Form No. 38 in the Appendix enclosed with the Circular No. 25/2017/TT-BGTVT dated July 28, 2017 shall be replaced by Form No. 38 in Appendix 2 enclosed herewith.

e) Form No. 39 in the Appendix enclosed with the Circular No. 25/2017/TT-BGTVT dated July 28, 2017 shall be replaced by Form No. 39 in Appendix 2 enclosed herewith.

Article 2. Effect

1. This Circular comes into force as from July 01, 2020.

2. If certificates and records of satisfaction of technical safety and environmental protection requirements issued for ships, inland waterway vehicles and industrial products used for inland waterway vehicles, which are amended in this Circular, are issued before July 01, 2020, they will remain valid until their expiry date.

Article 3. Implementation organization

Chief of the Ministry's Office, Chief Inspector of the Ministry, Directors of Departments affiliated to the Ministry, Director of Vietnam Register, Directors of provincial Departments of Transport, heads of relevant agencies/ organizations and relevant individuals shall be responsible for implementing this Circular./.
