CIRCULAR
ON REQUIREMENTS PERTAINING TO WORKSHOPS AND EQUIPMENT APPLYING TO SHIPYARDS SPECIALIZED IN BUILDING AND UPGRADING OF FISHING BOATS
Pursuant to Decree No. 199/2013/NĐ-CP dated November 26, 2013 of the Government defining functions, tasks, entitlements and structure of the Ministry of Agriculture and Rural Development;
Pursuant to Decree No. 59/2005/NĐ-CP dated May 4, 2005 of the Government on business conditions applying to fisheries (hereinafter referred to as Decree No. 59/2005/NĐ-CP); Decree No. 14/2009/NĐ-CP dated February 13, 2009 on amendments to Decree No. 59/2005/NĐ-CP;
Pursuant to Decree No. 67/2014/NĐ-CP dated July 7, 2014 of the Government on fishery policies;
At the request of Director of Department of Fisheries Resources,
The Minister of Agriculture and Rural development issues a Circular on requirements pertaining to workshops and equipment applying to shipyards specialized in building and upgrading of fishing boats.
Article 1. Scope
This Circular promulgates requirements pertaining to workshops and equipment applying to shipyards specialized in building and upgrading of fishing boats (hereinafter referred to as shipyards for fishing boats) having at least 90 CV of main engines.
Article 2. Regulated entities
This Circular applies to organizations or individuals involved in building and upgrading of fishing boats having at least 90 CV of main engines.
Article 3. Requirements pertaining to workshops and equipment applying to shipyards for wooden fishing boats
Any shipyard of wooden fishing boats is required to meet minimum requirements pertaining to workshops and equipment prescribed in Appendix I issued together herewith.
Article 4. Requirements pertaining to workshops and equipment applying to shipyards for composite fishing boats
Any shipyard of composite fishing boats is required to meet minimum requirements pertaining to workshops and equipment prescribed in Appendix II issued together herewith.
Article 5. Requirements pertaining to workshops and equipment applying to shipyards for steel fishing boats
Any shipyard of steel fishing boats is required to meet minimum requirements pertaining to workshops and equipment prescribed in Appendix III issued together herewith.
Article 6. Implementation
1. The People’s Committees of provinces or central-affiliated cities must:
a) Raise public awareness of organizations or individual involved in building or upgrading of fishing boats in the administrative divisions of provinces;
b) Direct Services of Agriculture and Rural development to check and access requirements applying to shipyards specialized in building or upgrading of fishing boats in the administrative divisions of the provinces; every year, act as a counselor to the People’s Committee of the province to announce shipyards meeting requirements as prescribed and send reports to the Ministry of Agriculture and Rural Development (through Department of Fisheries Resources).
2. Department of Fisheries Resources must:
a) Raise public awareness of organizations or individual involved in building or upgrading of fishing boats;
b) Provide local governments with instructions in inspection and assessment of shipyards specialized in building and upgrading of fishing boats as prescribed.
c) Submit list of shipyards specialized in building or upgrading of fishing boats meeting requirements as prescribed for the Ministry of Agriculture and Rural Development’s approval.
Article 7. Implementation
1. This Circular comes into effect from August 25, 2014.
2. Units affiliated to the Ministry of Agriculture and Rural Development, Services of Agriculture and Rural development of provinces or relevant organizations or individuals shall take responsibility for implementation of this Circular.
3. Difficulties that arise from implementation should be reported to the Ministry of Agriculture and Rural Development (through Department of Fisheries Resources) for consideration./.

In case the shipyard of fishing boats has no band saw or crane as prescribed in this Appendix, it is required to conclude a rental agreement on those equipment pieces.
