PROMULGATION OF POLICIES ON ENCOURAGEMENT OF INVESTMENT IN\r\nAGRICULTURE AND RURAL AREAS IN LAM DONG FUNDED BY LOCAL GOVERNMENT BUDGETS

THE PEOPLE’S COUNCIL OF LAM DONG PROVINCE

Pursuant to the Law on\r\nOrganization of Local Governments dated June 19, 2015;

Pursuant to Point a\r\nClause 1 Article 19 of the Government's Decree No. 57/2018/ND-CP dated April\r\n17, 2010 on incentives for enterprises investing in agriculture and rural\r\nareas.

In consideration of\r\ndocument No. 7582/TTr-UBND dated November 16, 2018 of the People’s Committee of\r\nLam Dong province requesting introduction of policies on encouragement of\r\ninvestment in agriculture and rural areas in Lam Dong province funded by local\r\ngovernment budgets; Report submitted by Economics – Budget Board of the\r\nPeople’s Council of Lam Dong province and comments of delegates of the People’s\r\nCouncil during the meeting.

RESOLVES THAT:

Article 1.\r\nPromulgation of policies on encouragement of investment in agriculture and\r\nrural areas in Lam Dong province funded by local government budgets

a) Assistance level:\r\nequal to the difference between commercial interest rate and preferential\r\ninterest rate imposed by the State multiplied by (x) the balance at the time of\r\napplication.

b) Loan limit: up to 50%\r\nof the total investment.

c) The People’s Committee\r\nof Lam Dong province shall specify the time and method for application of\r\npreferential interest rates.

2. Assistance for\r\nenterprises investing in research, transfer or application of high-tech\r\nagriculture, organic agriculture or smart agriculture:

a) An enterprise that\r\ncarries out scientific research, purchases copyright of technology or breeds to\r\nmake new products, improve technology, reduce pollution or save energy will\r\nreceive funding for 50% of the expense but not exceeding 100 million VND per\r\nresearch/copyright/technology.

b) Enterprises investing\r\nin projects for production of plant varieties, animal breeds, experimental\r\nproduction of new and highly profitable plants, if approved by the People’s\r\nCommittee of Lam Dong province, will receive a funding of 50% of the cost of\r\ndevelopment of infrastructure, equipment purchase, environmental remediation\r\nand seedlings but not exceeding 01 billion VND per project.

c) An enterprise\r\ninvesting in projects for high technology agriculture, organic agriculture or\r\nsmart agriculture will receive a funding of 100 million VND per hectare for\r\ndevelopment of infrastructure, equipment purchase and environmental remediation\r\nbut not exceeding 01 billion VND per project.

3. Assistance in\r\nprovision of vocational training for employees:

a) Enterprises whose\r\nagricultural projects are eligible for special investment incentives,\r\ninvestment incentives or investment promotions will receive a funding of\r\n700.000 VND per month per employee for provision of vocational training for\r\ntheir employees for 03 months.

b) The funding mentioned\r\nin Point a Clause 3 of this Article shall be provided for projects of\r\ninvestment. The total funding for a project shall not exceed 200 million VND.

4. Assistance in farm\r\nproduce storage and processing:

a) An enterprise that has\r\na project of investment in a farm produce processing facility will receive a\r\nfunding of 50% of the investment but not exceeding 02 billion VND per project.\r\nThe funding shall be used for development of waste treatment infrastructure,\r\nfactory construction and purchase of equipment within the project premises.

b) An enterprise that has\r\na project of investment in a farm produce storage facility (capable of drying,\r\nirradiation, sterilization, cold storage, biological storage) will receive a\r\nfunding of 50% of the investment but not exceeding 700 billion VND per project.\r\nThe funding shall be used for development of waste treatment infrastructure,\r\nfactory construction and purchase of equipment.

5. An enterprise that has\r\na project of investment in breeding of high-yield beef cattle will receive a\r\nfunding of 500 million VND per project for development of waste treatment\r\ninfrastructure, factory construction and purchase of equipment within the\r\nproject premises.

6. An enterprise has a\r\nproject of investment in collecting, treating domestic solid wastes in rural\r\nareas, pesticide packaging or agricultural wastes will receive a funding of 40%\r\nof the cost of purchase of equipment and construction of treatment systems but\r\nnot exceeding 01 billion VND per project.

7. Funding sources: 5% of\r\nthe agriculture funding in local government budget will be annually provided\r\nfor aforementioned assistance; funding sources from socio-economic development\r\nprojects and programs and other lawful funds may also be used in accordance\r\nwith this Resolution.

Article 2.

1. The People’s Committee\r\nof Lam Dong province shall organize the implementation of this Resolution.

3. Resolution No.\r\n150/2015/NQ-HDND dated December 11, 2015 of the People’s Council of Lam Dong\r\nprovince ceases to be effective from the effective date of this Resolution.

This Resolution is\r\nratified by the 9^th People’s Council of Lam Dong province during its\r\n6^th meeting on December 13, 2018 and comes into force from December\r\n23, 2018./.
