PROMULGATING THE LIST OF 27 FOREIGN COMPANIES REGISTERED TRADING IN MEDICINES AND MEDICINE MATERIALS IN VIETNAM IN THE SECOND STAGE OF 2001

THE MINISTER OF HEALTH

Pursuant to the Law on People Health Protection of July 11, 1989;
Pursuant to the Statue on preventive and curative medicines issued together with Decree No. 23/HDBT of January 24, 1991 of the Council of Ministers (now called the Government);
Pursuant to Circular No. 07/BYT-TT of March 30, 1991 of the Minister of Health guiding the registration of the foreign companies allowed to export and import medicines and medicine materials with organizations and companies of the Socialist Republic of Vietnam.
Considering the official report of the meeting of the Ministry of Health’s council on checking businesses engaging in medicine trading
At the proposal of the director general of Vietnam’s Pharmaceutical Management Department,

DECIDES:

Article 1. Promulgating the list of 27 foreign companies registered trading in medicines and medicine materials in Vietnam (the list of 27 foreign countries is enclosed)

Article 2. Foreign countries regulated in Article 1 shall have the following responsibilities:

1. To strictly observe laws of the Socialist Republic of Vietnam and do business in accordance with the National Policy on medicines of Vietnam, assure to protect the health of Vietnamese people.

2. To strictly observe regulations on medicines and medicine materials management of the Vietnam’s Ministry of Health.

3. Carry out the report to the Vietnam’s Ministry of Health on trading activities annually or immediately as requested.

4. To announce and submit to the Vietnam’s Ministry of Health relevant documents in the following cases:

4.1. Change the company’s name and address in their countries.

4.2. Establish or change the address of representative office in Vietnam.

4.3. Change the director or person assuming the responsibility in producing and trading in medicine and medicine materials.

4.4. Divide, incorporate or stop the activities of the company.

5. To pay all fees in accordance with the current provisions.

Article 3. Foreign companies have to take responsibility before law for their legal violations in the process of their operation in Vietnam.

Article 4. The license has effective value of 02 years as from the date that this Decision takes effect.

Article 5. This Decision takes effect 15 days after the date of its signing.

Article 6. The chief clerks, chief-inspectors, chiefs of related departments under the Ministry of Health, general director of the Vietnam’s Pharmaceutical Management Department, directors of the Health Department of the provinces and centrally-run cities, directors of companies engaging in direct import and export of medicines and medicine materials and directors of foreign companies regulated in Article 1 shall have to implement this Decision.
