DECISION

ON ESTABLISHMENT OF DA NANG HI-TECH ZONE MANAGEMENT BOARD

THE PRIME MINISTER

Pursuant to the December 25, 2001 Law on Organization of the Government;
Pursuant to the November 13, 2008 High Technology Law;
Pursuant to the Prime Minister's Decision No. 1979/QD-TTg of October 28, 2010, establishing, and promulgating the operation regulation of, the Da Nang Hi-Tech Zone;
At the proposal of the Minister of Science and Technology and the chairperson of the People's Committee of Da Nang city,

DECIDES:

Article 1. To establish the Da Nang Hi-Tech Zone Management Board under the People's Committee of Da Nang city.

Article 2. The Da Nang Hi-Tech Zone Management Board is a state management agency of general-department level which has seal bearing the national emblem, is a tier-1 state budget-funded unit, acts as a focal point for allocation of annually planned targets, receives state budget funds for its operation and is headquartered in Da Nang city.

3. The Accounting and Finance Department;

4. The Department of Investment Support and Promotion:

5. The Department of Planning, Construction and Environment;

6. The Department of Enterprise and Labor Management;

7. The Department of Research and Development for Technology Application and Technology and Business Incubation;

8. The Inspectorate;

9. The Center for Technology Research and Development;

The Training Center:

12. The Center of Hi-Tech Business Incubation;

13. The Da Nang Hi-Tcch Zone Development One-Member Limited Liability Company;

The units specified in Clauses 1 thru 8 of this Article are administrative units assisting the Head of the Da Nang Hi-Tech Zone Management Board in performing the state management function. The units specified in Clauses 9 thru 12 are non-business units serving the state management.

The chairperson of the People's Committee of Da Nang city may set up. dissolve, arrange and reorganize non-business units of the Da Nang Hi-Tech Zone Management Board under law.

Article 4. Leadership of the Da Nang Hi-Tech Zone Management Board

1. The Da Nang Hi-Tech Zone Management Board has its head and no more than 3 deputy heads.

2. The head and deputy heads of the Da Nang Hi-Tech Zone Management Board are appointed, relieved from duty or dismissed by the chairperson of the People's Committee of Da Nang city under law.

3. The head of the Da Nang Hi-Tech Zone Management Board shall define the functions, tasks, powers and organizational structure of units of the Management Board under law and power decentralization of the chairperson of the People's Committee of Da Nang city.

4. The head of the Da Nang Hi-Tcch Zone Management Board shall be accountable to the chairperson of the People's Conunittee of Da Nang city and law for all activities of the Management Board. Deputy heads shall be accountable to the head and law for their assigned tasks.

Ministers, heads of ministerial-level agencies, heads of government-attached agencies, the chairperson of the People's Committee of Da Nang city and the head of the Da Nang Hi-Tech Zone Management Board shall implement this Decision.-
