DECISION
APPROVAL OF PLAN FOR SUSTAINABLE DEVELOPMENT OF PRIVATE-SECTOR ENTERPRISES TO BE IMPLEMENTED BY 2025 WITH VISION TOWARDS 2030
THE PRIME MINISTER
Pursuant to the Law on Government Organization dated June 19, 2015;
Pursuant to the Resolution No. 142/2016/QH13 dated April 12, 2016 of the XIIIth National Assembly regarding the 5-year socio-economic development plan during the 2016 – 2020 period;
Pursuant to the Resolution No. 24/2016/QH14 dated November 8, 2016 of the National Assembly regarding the Plan for restructuring of the national economy during the 2016 – 2020 period;
Pursuant to the Resolution No. 10-NQ/TW dated June 3, 2017 of the 5th Meeting of the Party’s XIIth Central Committee regarding development of the private sector economy into an important driving force for the socialist-oriented market economy;
Pursuant to the Government’s Meeting Decision No. 98/NQ-CP dated October 3, 2017 issuing the Program of Action for implementation of the Resolution No. 10-NQ/TW dated June 3, 2017 of the 5th Meeting of the Party’s XIIth Central Committee regarding development of the private sector economy into an important driving force for the socialist-oriented market economy;
Pursuant to the Prime Minister’s Decision No. 622/QD-TTg dated May 10, 2017 dated May 10, 2017 issuing the national Plan of Action for implementation of the 2030 conference agenda for sustainable development;
Upon the request of the Minister of Planning and Investing,
HEREBY DECIDES
Article 1. To grant approval for the plan for sustainable development of private-sector enterprises to be implemented by 2025 with vision towards 2030, including the following main subject matters:
I. VIEWPOINTS ON SUSTAINABLE DEVELOPMENT OF PRIVATE-SECTOR ENTERPRISES
1. Eliminate all socio-psychological barriers and business environment for the sake of development of private sector enterprises without any restriction on the scale and freedom of doing business in industries not prohibited by law.
2. Develop private sector enterprises in an effective and sustainable manner, ensuring a close, reasonable and harmonious combination between economic efficiency and social corporate responsibility, protection of natural resources and environment.
3. Prefer to support the development of private sector enterprises doing business on a small and medium scale; encourage building major brands of Vietnamese enterprises on both domestic and foreign markets.
II. OBJECTIVES OF SUSTAINABLE DEVELOPMENT OF PRIVATE SECTOR ENTERPRISES
1. General objectives:
Promote private sector enterprises’ authentic and effective growth which provides a solid foundation and an important driving force for rapid and sustainable socio-economic development.
2. Specific objectives:
a) Improve the quality and performance of private sector enterprises, striving to increase the number of private sector enterprises to at least 1.5 and 2 million by 2025 and 2030, respectively.
b) Promote innovative creativity and strengthen linkages between private sector enterprises. By 2030, narrow the gap in the technology level, the quality of human resources and competitiveness of enterprises, and raise the rate of enterprises participating in regional and global production networks and value chains on a par with other leading ASEAN countries (ASEAN-4).
c) In the period of 2021-2030, private sector enterprises is expected to achieve an average growth of about 6-8% per year; make an average increase in employees' income by about 25-30% per annum; increase an average rate of contribution to the state budget by about 23-25% per year.
III. GROUPS OF MAJOR DUTIES AND SOLUTIONS
1. 1st Solution Group: Continuing to improve the business environment in order to maintain private-sector enterprise’s trust and increase the sustainable business of these enterprises
a) Ministries, ministerial-level agencies, Governmental bodies, People's Committees of provinces and centrally-run cities and concerned entities shall focus on drastically, seriously and effectively implementing tasks and solutions prescribed in:
- Government’s Resolution No. 35/NQ-CP dated May 16, 2016 on supporting and developing enterprises by 2020;
- Resolution No. 27/NQ-CP dated February 21, 2017 issuing the Government’s Program of Action for implementation of the Resolution No. 05-NQ/TW dated November 1, 2016 of the Fourth Meeting of the Party’s Central Committee on several major strategies and policies for continuation in reform of growth models and increase in the quality of growth, labor productivity and competitiveness of the economy, and Resolution No. 24/2016/QH14 dated November 8, 2016 of the National Assembly on the Plan for restructuring of the economy for the period of 2016-2020;
- Resolution No. 98/NQ-CP dated October 3, 2017 issuing the Program of Action for implementation of the Resolution No. 10-NQ/TW dated June 3, 2017 of the 5th Meeting of the Party’s XIIth Central Committee regarding development of the private sector economy into an important drive force for the socialist-oriented market economy;
- Resolution No. 139/NQ-CP dated November 9, 2018 issuing the Program of Action for reduction in corporate costs.
- Resolution No. 02/NQ-CP dated January 1, 2019 on ongoing implementation of major duties and measures to improve business environment and enhance national competitive capacity in 2019 with vision towards 2021.
b) Ministry of Planning and Investment shall conduct assessment of the implementation of the Government's Resolution No. 35/NQ-CP dated May 16, 2016 on supporting and developing enterprises by 2020, proposing and recommending solutions to supporting and developing enterprises by 2025 with a vision towards 2030.
c) The Ministry of Finance continues to improve the quality of tax and customs administration, and promptly solve issues and problems that enterprises may face;
d) The Ministry of Industry and Trade shall be proactive and has a strategy to negotiate appropriate bilateral and multilateral agreements, enabling Vietnamese private sector enterprises to develop; assess and push the implementation of the Plan for the Implementation of the Comprehensive and Progressive Agreement for Trans-Pacific Partnership (CPTPP) under the Prime Minister's Decision No. 121/QD-TTg dated January 24, 2019.
dd) The Ministry of Natural Resources and Environment shall continue to study and finalize the draft Law on Amending and Supplementing the 2013 Land Law and submit it to the National Assembly in 2020; review and evaluate the implementation of regulations on standards regulations, standards and regulations on compliance with environmental protection regulations in the corporate sector, and propose amendments to regulations on the environmental law, provide favorable conditions for enterprises, propose measures to improve the efficiency of state management of the environment to seek the approval from the Prime Minister in 2019.
e) Vietnam Chamber of Commerce and Industry shall continue to carry out the Provincial Competitiveness Index (PCI) and implement the Action Program to promote business integrity practices.
2. 2nd Solution Group: Encouraging private-sector enterprises to make best use of sustainable business models, cleaner production technologies and effectively exploit natural resources and protect environment.
a) The Ministry of Planning and Investment shall conduct study into and development of programs to support and encourage private sector enterprises to use sustainable business models, cleaner production technologies, efficiently exploit resources and protect the environment in the 2021-2025 period with a vision to 2030, and submit them to the Prime Minister in 2020.
b) The Ministry of Finance shall take charge of perfecting policies and regulations that require listed enterprises to make non-financial reports which contain environmental and social factors and disclose the rate of corporate compliance on an annual basis.
c) The Ministry of Natural Resources and Environment shall complete regulations on environmental protection, make annual public disclosure of the percentage of industrial parks and export processing zones which are equipped with centralized wastewater treatment system that is automatically monitored and connected online with the environmental management agency to ensure their operation meets environmental requirements; the rate of industrial clusters with centralized wastewater treatment systems.
d) Vietnam Chamber of Commerce and Industry shall develop the Program for multiplied application of a set of indicators for sustainable enterprises according to the principle of avoidance of any increase in administrative procedures and costs in the best interests of enterprises, and shall be held responsible for submitting it to the Prime Minister in 2020.
3. 3rd Solution Group: Promoting innovative startups and strengthening effective implementation of support policies granted to small and medium-sized enterprises.
a) Ministries, ministerial-level agencies, Governmental bodies, People's Committees of provinces and centrally-run cities and concerned entities shall focus on drastically, seriously and effectively performing tasks assigned in the Prime Minister’s Directive No. 15/CT-TTg dated June 15, 2018 on effective implementation of the Law on Support for Small and Medium-sized Enterprises.
b) The Ministry of Planning and Investment shall play its leading role in:
- In 2019, imperatively formulating and proposing the Decree amending and supplementing the Government's Decree No. 118/2015/ND-CP dated November 12, 2015 to seek the Government’s consent to adding 04 trades and industries receiving investment incentives, including investment in product distribution chains of small and medium-sized enterprises, investment in small and medium-sized enterprise incubation facilities, investment in a co-working spaces for small and medium-sized creative startups and investment in technical infrastructure necessary for small and medium-sized enterprises.
- Taking charge of cooperating with other Ministries, sectoral administrations and localities in reviewing implementation of the Decree No. 39/2018/ND-CP regulating details of several articles of the Law on Support for Small and Medium-sized Enterprises, and proposing plans for formulation of the Decree on Amendments, Supplements to or Replacement of the Decree No. 39/2018/ND-CP, with the aim of increasing the effective implementation of the Law on Support for Small and Medium-sized Enterprises.
- In 2019, presiding over and collaborating with ministries, sectors, localities and business associations in studying and petitioning the Prime Minister to approve the Small and Medium Enterprise Support Program for the period 2021-2025, concentrating on supporting small and medium-sized creative startups and small and medium-sized enterprises to join clusters and value chains.
- Taking charge of collaborating with the Ministry of Science and Technology and other entities concerned in studying and formulating the Program for establishment of the National Innovation Center and submitting it to the Prime Minister in 2019.
c) Ministry of Finance shall be responsible for:
- Petitioning the Government to seek the National Assembly’s approval of addition of formulation of the draft Law on amendments and supplements to the Law on Corporate Income Tax to the National Assembly’s 2020 Program for formulation of Laws and Ordinances to actualize corporate income tax support policies granted to small and medium enterprises specified in the Law on Support for Small and Medium Enterprises.
- Studying the formulation of the Program for experimenting on crowdfunding models and submitting such Program to the Government in 2019.
d) The Ministry of Science and Technology shall preside over and coordinate with the concerned agencies in continuing to accelerate the implementation of the Program No.844 on perfecting the creative startup ecosystem; focusing on the in-depth cooperation with domestic and foreign start-up communities with a view to promoting connection between Vietnamese business start-ups and other business start-ups in the globe.
dd) The Ministry of Education and Training shall continue to accelerate the effective implementation of the Program for “Support for students’ startup by 2025”.
e) People’s Committees of provinces and centrally-run cities shall, depending on actual local conditions, propose the establishment of the Creative Startup Centers to promote, connect and mobilize social resources necessary for creative startup activities falling within their remit.
4. 4th Solution Group: Assisting in improvement of labor productivity of enterprises; promoting high-quality human resources and enhancing corporate management and governance capabilities.
a) The Ministry of Planning and Investment shall take charge of developing the Vietnam Creative Innovation Network, strengthening the team of experts to offer enterprises support through overseas volunteer groups and connection with Vietnamese expatriates and students studying abroad; sending Vietnamese engineers and experts to work and study abroad.
b) The Ministry of Science and Technology shall take charge of researching, building and operating the database system of good practices in labor productivity which serves as a basis for enterprises to measure, assess and improve their business.
c) The Ministry of Labor, War Invalids and Social Affairs shall play its leading role in:
- Continuing to pilot high-quality human resource training programs by using curricula and syllabi from advanced countries in the world and then multiplying such use as well as ensuring effectiveness; promoting ties between enterprises and vocational training institutions in the vocational education sector;
- Preparing the complete Program for renewal and improvement of vocational education quality for submission to the Prime Minister in 2019; continuing to promote training and education activities to provide staff meeting high technical and professional needs.
d) The Ministry of Education and Training shall preside over:
- Encouraging the development of forms of training links amongst schools, other establishments and businesses; promoting the higher education and close connection to social needs through receiving and meeting orders from existing businesses and ensuring the balance between trades or industries; providing career counseling and orientation services for students taking universal education and higher education programs.
- Promoting training in soft skills for workers to enhance their ability to adapt to new working environment and collaborate with others to gain the highest efficiency.
- Formulating the Program of attracting domestic, foreign experts and overseas Vietnamese to participate in training, scientific and technological research activities, projects and programs at Vietnamese higher education institutions, and submitting it to the Prime Minister in 2019.
5. 5th Solution Group: Providing incentives for private enterprises so that they can apply scientific achievements and technological advances as well as make the most of the 4th industrial revolution.
c) The Ministry of Science and Technology shall preside over:
- Strengthening the integration and sharing of sources of information about intellectual property rights (IP), enhancing the capacity of public intellectual property information services, and providing accurate and timely intellectual property information, as well as building public infrastructure necessary to render intellectual property services.
- Conducting researches into building and perfection of the system of conformity assessment services to create a network of testing, certification, assessment and inspection bodies that ensure quantitative adequacy and good quality to meet the demands of all enterprises; strengthening the implementation of State management in the field of product and commodity conformity assessment in Vietnam; report on this to the Prime Minister in 2020;
- Developing policies to encourage business establishments, research institutes and universities to strengthen links in terms of scientific and technological research and application of scientific findings and technological advances to production and business processes; proposing solutions to encouraging and reducing costs related to technology transfers between domestic businesses, and reporting on this to the Prime Minister in 2019.
- Identifying the needs of small and medium-sized enterprises to apply scientific achievements and technological advances to production and business activities; proposing solutions to promoting small and medium-sized enterprises certified as science and technology enterprises in a number of prioritized technology sectors; reporting on this to the Prime Minister in 2019.
b) The Ministry of Planning and Investment shall take charge of preparing the complete National Fourth Industrial Revolution Strategy for submission to the Government in 2019.
c) The State Bank of Vietnam shall preside over:
- Continuing to improve the legal framework for provision of banking products and services, especially banking products and services developed on digital platforms.
- Studying and developing a legal framework for Fintech's activities in the banking sector which is tested in a control trial in hope of expanding access to financial services and cutting down on the costs of using financial services for small and medium enterprises, and reporting on this to the Prime Minister in 2019.
6. 6th Solution Group: Enhancing roles of business associations in supporting private-sector enterprises in their efficient and sustainable development.
a) Ministries, sectors and localities shall take the initiative in reviewing and proposing pilot plans to transfer a number of public services within their ambit to business associations for the 2021-2025 period, and sending such plans to the Ministry of Home Affairs for compiling purposes, and shall report on this to the Prime Minister in 2020.
b) The Ministry of Home Affairs shall take charge of reviewing and giving recommendations on formulation of the complete legal and policy framework for the formation and operation of socio-political organizations, professional social organizations and trade associations in order to enable these organizations and associations to promote their roles and improve the effectiveness in supporting the development of their member enterprises.
c) Vietnam Chamber of Commerce and Industry shall preside over preparing a review report on markets of business development services in Vietnam, proposing measures that the Government may take to promote growth in business development service markets for the period of 2020-2030, and shall submit it to the Prime Minister in 2019.
d) Vietnam Chamber of Commerce and Industry, Vietnam Association of Medium and Small Enterprises and other entities shall assume their responsibilities for:
- Giving more support by providing training courses to enhance the capacity of their member enterprises and to raise awareness of social corporate responsibility among private sector enterprise communities.
- Actively coordinating with state regulatory authorities to recommend policies encouraging private enterprises to contribute to attaining national sustainable development goals; scaling up effective and sustainable business management and governance models to address sustainable development challenges.
- Take active actions to raise public awareness of private sector enterprise’s roles and pay tributes to private sector enterprises that make significant contributions to environmental protection and social corporate responsibility activities.
The chart of specific programs and projects shall be annexed hereto.
IV. FUNDING SOURCES
1. Funding for the Plan shall be composed of state expenditures and other legal financial sources.
2. Central government budget: This budget shall fund general activities specified in the Plan at the central level, programs or projects falling within the central government's remit.
3. Local government budget: This budget shall be used for carrying out general activities specified in the respective local Plans.
V. IMPLEMENTATION RESPONSIBILITIES
In order to implement the Plan for sustainable development of private-sector enterprises by 2030, Ministries, sectors and localities should integrate the requirements and solutions concerning the sustainable development of private sector enterprises with national target programs, projects and other target programs of related ministries, sectors and localities in order to make effective use of various resources.
1. The Ministry of Planning and Investment:
- Preside over monitoring, surveying, evaluating and compiling an annual report to the Prime Minister on the implementation of the Plan's objectives, tasks and solutions to ensure the effective implementation of the Plan.
- Consolidate, consider, balance and report to the Prime Minister on allocation of state capital expenditures used for supporting the implementation of solutions specified in the Plan for sustainable development of private-sector enterprises as prescribed in regulations in force.
- Collaborate with the Ministry of Finance, Vietnam Social Security in 2019 in setting up a cooperative mechanism to identify and classify small and medium-sized enterprises in accordance with the Law on Support for Small and Medium-sized Enterprises, formulating instructional documents on these legal instruments, and step by step building an interconnection system for categorization of small and medium-sized enterprises.
2. The Ministry of Finance shall consider, balance and petition the Prime Minister in allocate state current expenditures to Ministries and other Ministry-level bodies for the implementation of solutions specified in the Plan for sustainable development of private-sector enterprises as prescribed in regulations in force.
3. Ministries and sectors shall be responsible for effectively carrying out requirements and solutions specified in the Plan within their scope of assigned functions and duties.
4. People’s Committees of centrally-affiliated cities and provinces shall be responsible for:
- Proactively formulating tasks and solutions for sustainable development of private sector enterprises, integrating them with other programs, plans and schemes for support for development of local enterprises, delivering a roadmap for implementation thereof, and annually providing manpower and budget to implement these tasks and solutions.
- Collaborating with other Ministries and sectors in executing the Plan for sustainable development of private-sector enterprises to be implemented by 2025 with vision towards 2030.
- Assigning responsibilities to Departments of Planning and Investment to act as liaison agents to collaborate with relevant departments and agencies in implementing the Plan for sustainable development of private-sector enterprises by 2025 with vision towards 2030 within their remit, promptly sending reports to the Ministry of Planning and Investment on any issue or problem arising in the course of implementing the Plan to seek its solutions.
5. Related associations shall be responsible for proactively finding resources, formulating and implementing plans, programs and projects for support for development of private-sector enterprises.
6. Other Ministries, sectors, localities and business associations shall be responsible for sending review reports on implementation of the Plan for sustainable development of private-sector enterprises within their remit and jurisdiction to the Ministry of Planning and Investment by December 15 each year for compiling and reporting purposes as prescribed in regulations in force.
Article 2. This Decision shall enter into force from the signature date.
Article 3. Ministers, Heads of Ministry-level agencies, Heads of Governmental bodies, and Presidents of People’s Committees of centrally-affiliated cities and provinces, shall be responsible for implementing this Decision./
