DECISION

ON OCCUPATIONAL TRAINING ASSISTANCE RATES FOR WORKERS PARTICIPATING IN UNEMPLOYMENT INSURANCE

Pursuant to the Law on Government Organization dated June 19, 2015 and Law on Amendments to the Law on Government Organization and Law on Local Government Organization dated November 22, 2019;

Pursuant to the Law on Employment dated November 16, 2013;

Pursuant to the Law on Vocational Education dated November 27, 2014;

Pursuant to the Government’s Decree No. 28/2015/ND-CP dated March 12, 2015 detailing the implementation of a number of Articles of the Law on Employment on unemployment insurance;

Pursuant to the Government’s Decree No. 61/2020/ND-CP dated May 29, 2020 amending some Articles of the Government’s Decree No. 28/2015/ND-CP dated March 12, 2015 detailing the implementation of a number of Articles of the Law on Employment on unemployment insurance;

At the request of the Minister of Labor - War Invalids and Social Affairs;

The Prime Minister hereby promulgates a Decision on occupational training assistance rates for workers participating in unemployment insurance.

Article 1. Scope

This Decision provides for occupational training assistance rates for workers participating in unemployment insurance.

Article 2. Regulated entities

1. Workers eligible for occupational training assistance according to regulations in Article 55 of the Law on Employment (hereinafter collectively referred to as “workers”).

2. Vocational education institutions and higher education institutions having registered for provision of vocational education at college level and enterprises, regulatory bodies and organizations permitted to provide vocational education and participating in occupational training for workers (hereinafter collectively referred to as “training institutions”).

3. Departments of Labor - War Invalids and Social Affairs; social insurance authorities; employment agencies established by employment authorities and regulatory bodies involved in occupational training assistance for workers.

Article 3. Occupational training assistance rates

1. Occupational training assistance rates

a) Workers taking an occupational training course lasting for up to 3 months are eligible for an amount that is calculated based on the tuition charged by the training institution and actual training time but shall not exceed VND 4.500.000/ person/ course.

b) Workers taking an occupational training course lasting for more than 3 months are eligible for a monthly amount that is calculated based on the tuition and actual training time but shall not exceed VND 1.500.000/ person/ month.

If workers take an occupational training course the duration of which does not make up full months according to regulations of the training institution, the odd days shall be calculated as follows: 14 odd days or fewer shall be regarded as half a month and 15 odd days or more shall be regarded as 01 month.

2. Applications for occupational training and provision of occupational training assistance are provided for in Articles 24 and 25 of the Government’s Decree No. 28/2015/ND-CP dated March 12, 2015 detailing the implementation of a number of Articles of the Law on Employment on unemployment insurance (amended by the Government’s Decree No. 61/2020/ND-CP dated May 29, 2020).

3. On a monthly basis, training institutions shall carry out procedures for provision of occupational training assistance according to regulations in Article 25 of the Government’s Decree No. 28/2015/ND-CP dated March 12, 2015 detailing the implementation of a number of Articles of the Law on Employment on unemployment insurance (amended by the Government’s Decree No. 61/2020/ND-CP dated May 29, 2020).

Article 4. Funding

Social insurance authorities shall cover occupational training assistance using funding from the unemployment insurance fund.

Article 5. Effect and implementing responsibility

1. This Decision takes effect from May 15, 2021.

Workers who apply for occupational training assistance prior to the entry into force of this Decision but are not yet granted an occupational training assistance decision are eligible for the assistance rates provided for by this Decision.

2. The Prime Minister’s Decision No. 77/2014/QD-TTg dated December 24, 2014 providing levels of vocational training support for employees covered by unemployment insurance is annulled from the entry into force of this Decision.

3. Ministers, heads of ministerial-level agencies, heads of Governmental agencies, and Chairpersons of People’s Committees of provinces and central-affiliated cities shall implement this Decision.
