On March 2, 2022, the General Department of Customs issued the Decision No. 247/QD-TCHQ, stipulating the method for connecting and exchanging surveillance camera system data between EPEs and customs authorities according to clause 10 of Article 1 in the Decree No. 18/2021/ND-CP and the customs supervision of EPEs through camera systems, and the Official Dispatch No. 697/TCHQ-GSQL on implementation of clause 10 of Article 1 in the Government’s Decree No. 18/2021/ND-CP. In order to carry out the inspection of conditions for customs supervision of EPEs according to the provisions of clause 10 of Article 1 in the Decree No. 18/2021/ND-CP before April 25, 2022, the General Department of Customs is requesting Customs Departments of provinces and cities shall follow the instructions hereunder:

1. Communicate and propagate the instructions provided in the Decision No. 247/QD-TCHQ and the Official Dispatch No. 697/TCHQ-GSQL above so that EPEs are informed and comply with them.

2. Where any EPE has not yet completed and sent the Notification Form No. 25 of Appendix VII to the Decree No. 18/2021/ND-CP, Customs Departments shall continue to urge and guide them to complete it as prescribed in regulations; closely find out the causes and problems making EPEs to delay the notification of satisfaction of the conditions for customs inspection and supervision as prescribed in clause 1 of Article 28a in the Decree No. 18/2021/ND-CP, and provide EPEs with support and counsels on tariff incentive law and policies applied to EPEs from April 25, 2022 onwards.

Finish the task of inspection and certification of EPEs meeting the conditions for customs inspection and supervision as prescribed before April 25, 2022.

3. Actively report to the People's Committees of the provinces or cities where EPEs run their investment projects on the state of fulfillment of the tasks prescribed in Article 28a of the Decree No. 18/2021/ND-CP, and at the same time request them to take measures to urge EPEs that have not yet notified customs authorities of the conditions for customs inspection and supervision using the sample Notice No. 25 of Appendix VII to the Decree No. 18/2021/ND-CP to comply with the instructions under law.

4. Make periodical data reports as required in point 5 of the Official Dispatch No. 6112/TCHQ-GSQL for submission to the General Department of Customs (via the Customs Management Supervision Department).

Upon receipt of this document, it is requested that Directors of Customs Departments of provinces and cities must strictly comply. If there is any difficulty arising from implementation, they must report to or send recommendations to the General Department of Customs (Customs Management Supervision Department) to seek their further instructions./.
