DECISION
MECHANISMS AND POLICIES TO ENCOURAGE DEVELOPMENT OF INLAND WATERWAY TRANSPORT
Pursuant to the Law on Government Organization dated June 19, 2015; Law dated November 22, 2019 on Amendments to some Articles of the Law on Government Organization and Law on Local Government Organization;
Pursuant to the Law on Inland Waterway Transport dated June 15, 2004; Law dated June 17, 2014 on Amendments to some Articles of the Law on Inland Waterway Transport;
Pursuant to the Law on Investment dated June 17, 2020;
Pursuant to the Law on Public Investment dated June 13, 2029;
Pursuant to the Law on State Budget dated June 25, 2015;

This Decision provides for mechanisms and policies to encourage development of inland waterway transport in Vietnam.
This Decision applies to authorities, organizations and individuals related to inland waterway transport nationwide.
Article 3. Mechanisms and policies to encourage development of inland waterway transport
1. Development of inland waterway transport
a) Be entitled to access government’s ODA and foreign concessional loans to develop inland waterway infrastructure with the aim of establishing a convenient and effective connection with other modes of transport, especially with the seaport system;
b) Prioritize the provision of capital for development of inland waterway infrastructure so as to renovate and upgrade inland waterway channels on major transport routes under the inland waterway infrastructure planning in the period 2021 - 2030 with a vision toward 2050;
c) People’s Committees of provinces and central-affiliated cities shall review and include river-crossing passenger landing stages in extremely disadvantaged areas incapable of development of and investment in other modes of transport in their local planning, ensuring that the investment in such river-crossing passenger landing stages is made in compliance with clause 2 Article 12 of the Law on Public Investment 2020 in case of using local government budget for making investment.

Provide state budget-derived funding for economic development for maintenance of inland waterway infrastructure according to the plan approved by the competent authority and within the capacity for mobilizing resources, ensuring the capital allocated in the following year is higher than that allocated previously and meeting the capital requirement by 2030 according to the plan approved by the competent authority.
3. Application of information technology
a) Prioritize the allocation of state budget-derived funding for investment and development to execute information technology application projects in service of inland waterway-related activities;
b) Use state budget-derived funding for recurrent expenditures for covering costs of management, operation and maintenance of information technology systems in service of inland waterway-related activities, including database, software and hardware.
Article 4. Implementation
1. The Minister of Transport shall:
a) Preside over implementing and assessing the implementation of this Decision every year and carry out a 5-year review;
b) Cooperate with the Ministry of Finance and Ministry of Planning and Investment in allocating budget for implementation of the mechanisms and policies for development of inland waterway transport specified in this Decision;
c) Cooperate with the Ministry of Finance in providing guidelines for implementation of the mechanisms and policies for development of inland waterway transport specified in this Decision.

2. The Ministry of Finance shall:
Preside over and provide funding for maintenance of inland waterways covered by the state budget on an annual basis under this Decision.
3. The Ministry of Planning and Investment shall:
a) Preside over and cooperate with the Ministry of Transport and Ministry of Finance in implementation of the mechanisms and policies for development of inland waterway transport specified in this Decision;
b) Preside over and provide capital for investment in inland waterway infrastructure under the Law on Public Investment and Law on State Budget.
4. The Ministry of Natural Resources and Environment shall:
Provide guidelines for allocating land and water surface to projects on construction of inland waterway ports in the land use plans and planning.
5. The Ministry of Agriculture and Rural Development shall:
Consider instructing local governments to elaborate on conditions for investment in and construction of inland waterway transport infrastructure, facilities building, modifying, repairing and restoring inland waterway vehicles on dykes for effective operation during flood season.

Cooperate with the Ministry of Transport in disseminating information to encourage investment in inland waterway infrastructure, building of inland waterway vehicles and provision of goods handling equipment, contributing to enhancing the development of inland waterway.
7. People's Committees of provinces and central-affiliated cities shall:
a) Cooperate with the Ministry of Transport and Ministry of Natural Resources and Environment in allocating land and water surface to projects on construction of inland waterway vehicle building and repair facilities and inland waterway ports in their local land use plans and planning;
b) Preside over and allocate local government budget to develop inland waterway transport under their management;
c) Prioritize the allocation of land for construction of inland waterway ports for container handling in the North and the Mekong Delta.
Article 5. Effect
1. This Decision comes into force from December 25, 2022.
2. The Decision No. 47/2015/QD-TTg dated October 05, 2015 on mechanisms and policies to encourage development of inland waterway transport is annulled.
