The Ministry of Planning and Investment has received feedback regarding guidance on registration for early resumption of business activity before the end of the suspension period of cooperative unions and cooperatives (hereinafter referred to as “cooperatives”). Regarding the matter, the Ministry of Planning and Investment remarks as follows:

1. Regarding registration of early resumption of business activity of cooperatives.

The Law on Cooperative in 2012 and guiding documents do not prescribe application and procedures for early resumption of business activity of cooperatives.

In order to rectify drawbacks and difficulties in applying regulations and law on cooperatives, Ministry of Planning and Investment is now concluding 10 years of implementation of the Law on Cooperatives and developing amendments to the Law on Cooperatives. The Ministry of Planning and Investment acknowledges difficulties raised by cooperatives while developing the legal framework regarding cooperatives.

2. Regarding registering changes of cooperative registration during suspension period

The Law on Cooperatives does not prohibit cooperatives from registering changes to cooperative registration during their suspension period. The procedures for exchanging information to register changes to cooperative registration between the National information portal for cooperative registration and the Application system for tax registration are specified under Article 9 of Regulation No. 01/2022/QCLT-BTC-BKHDT dated January 13, 2022 of the Ministry of Finance and Ministry of Planning and Investment.
