DECISION
APPROVAL FOR DETAILED PLANNING FOR SEAPORTS IN THE SOUTHEAST (GROUP 5) BY 2020 AND ORIENTATION TOWARDS 2030
THE MINISTER OF TRANSPORT
Pursuant to the Maritime Code of Vietnam dated November 25, 2015;
Pursuant to the Law on Construction dated June 18, 2014;
Pursuant to the Government’s Decree No. 12/2017/ND-CP dated February 10, 2017 defining the functions, tasks, powers and organizational structure of the Ministry of Transport;
Pursuant to the Government's Decree No. 92/2006/ND-CP dated September 07, 2006 on formulation, assessment, ratification and management of socio-economic development master plans and the Government's Decree No. 04/2008/ND-CP dated January 11, 2008 on amendments to Decree No. 92/2006/ND-CP;
Pursuant to the Prime Minister’s Decision No. 1037/QD-TTg dated June 24, 2014 on amendments to the Master Plan for development of Vietnam’s seaport system by 2020 and the orientation towards 2030;
Pursuant to document No. 1178/TTg-KTN dated August 06, 2013 of the Prime Minister on improvement of management of Group 5 seaports and ports in Cai Mep – Thi Vai area;
In consideration of the report No. 1990/TTr-CHHVN dated May 24, 2017; the document No. 5218/CHHVN-KHDT dated December 22, 2017 of Vietnam Maritime Administration and updates to the Planning; the written record dated November 21, 2017 given by the Assessment Council at the meeting on amendments to the detailed planning for seaports in the Southeast (Group 5) by 2020, and the orientation towards 2030;
At the request of the Standing Member of the Assessment Council and Director of Planning and Investment Department,
HEREBY DECIDES:
Article 1. Grant of approval for detailed planning for seaports in the Southeast (Group 5) by 2020 and the orientation towards 2030 with the following contents:
I. Planning scope
Group 5 includes seaports in provinces/cities in the Southeast region, including: Ho Chi Minh City, Dong Nai, Ba Ria – Vung Tau, Binh Duong, and terminals along Soai Rap river in Long An province.
II. Viewpoint and development objectives
1. Viewpoint
- Make the best use of natural and socio-economic conditions of the southeast region for seaport development; effectively use available land for construction of seaports to improve the ability to receive large ships and develop the potential for international transshipment of Group 5 seaports.
- Make the best use of favorable natural conditions for suitable development of floating terminals and cargo transshipment hubs on the way so as not to cause adverse impacts on other socio-economic development plans and to strictly comply with regulations on environmental protection, maritime safety and security for the purposes of reducing investment costs and maritime shipping costs, and relieving burden of road transport and vehicular weight inspection.
- Planning-based sizes of ships (deadweight tonnages) are used as the basis for making investment in public infrastructure of seaports but are not used as the basis for prohibiting ships with larger sizes from making ocean voyages on shipping lanes, and entering/leaving seaports. A ship which has a larger size but has technical specifications conformable with a wharf’s capacity and technical standards and regulations for the shipping lane (in terms of width, depth and clearance height, etc.), and meets all of safety conditions may enter/leave seaports in this group.
- Make in-depth investment to improve capacity and effectively use existing infrastructure of wharfs and terminals; enhance application of advanced, modern and energy-saving technologies in management and operation of seaports; encourage old terminals that have low loading capacity to upgrade and adopt new technologies to improve their loading capacity and meet the need for movement of goods carriage by sea in the Southeast region in particular and in the entire Southern region in general.
- Develop Group 5 seaports in association with connection of road, rail and inland waterway infrastructure to boost development of coastal economic zones, urban areas and major industrial parks in Ho Chi Minh City, Dong Nai, Ba Ria – Vung Tau, Binh Duong, Binh Duong and adjacent provinces.
- Combine harmonious development of dedicated ports for bulk cargo, liquid cargo, farm produce, etc. to serve movement of goods in the entire region.
- Utilize every social resource, especially from the private sector and foreign direct investment for development of seaports and public infrastructure of seaports.
- Development of seaports must be sustainable and in association with protection of ecology of Ganh Rai bay, mangrove forests in Can Gio and along Thi Vai river; ensure that there are no negative impacts on tourism potential of provinces/cities in the region; meet climate change adaptation and sea level rise requirements.
- Development of seaports shall be in association with national defense and security.
2. Development objectives and orientation
a) General objectives
- Reasonably arrange Group 5 seaports to develop potential, facilitate a balanced and uniform development of seaports and relevant infrastructure, combine development of industry and services as the motive for economic development and assurance of national defense and security.
- Reasonably arrange and regulate the movement of goods in order to relieve the burden of traffic volume and congestion on the center of Ho Chi Minh City.
- Support the development of industrial parks and export-processing zones and facilitate the urban development to boost the industrialization and modernization process of the Southeast region by 2020 with an orientation towards 2030.
- Establish and develop modern international ports and central ports to facilitate the sea transport development of Vietnam and the world; attract a part of transshipped goods in the region.
b) Specific objectives
Ensure the estimated quantity of goods/passengers by the following planning phases:
- 228,2 - 238,5 million tonnes/year by 2020, in which the quantity of container cargo accounts for 10,58 - 11,08 million TEU/year; 291,8 - 317,7 million tonnes/year by……, in which the quantity of container cargo accounts for 14,40 - 15,75 million TEU/year; 358,5 - 411,5 million tonnes/year by 2030, in which the quantity of container cargo accounts for 18,95 - 21,48 million TEU/year.
- 281,9 - 343,9 thousand arrivals/year by 2020; 294,4 - 478,4 thousand arrivals/year by 2025; 307,5 - 705,8 thousand arrivals/year by 2030.
- Capacity of ships: general ships and bulk cargo ships with a deadweight tonnage of up to 10.000 tonnes or over, container ships with a deadweight tonnage of from 10.000 tonnes to 200.000 tonnes, crude oil ships with a deadweight tonnage of up to 300.000 tonnes, oil product ships with a deadweight tonnage of from 10.000 tonnes to over 50.000 tonnes, and passengers ships capable of carrying up to 6.000 persons.
III. Planning contents
1. Detailed planning for Group 5 ports
The group of seaports in the Southeast (Group 5) has 04 seaports: Ho Chi Minh City seaport, Dong Nai seaport, Vung Tau seaport (including Con Dao port) and Binh Duong seaport.
a) Ho Chi Minh City seaport: a national central multipurpose terminal (Class I) which comprises the following primary terminals: terminals along Sai Gon river, Cat Lai terminals along Dong Nai river, terminals along Nha Be river, and Hiep Phuoc terminals along Soai Rap river.
Estimated capacity of goods movement: 112,67 - 116,94 million tonnes/year by 2020, in which the quantity of container cargo accounts for 6,56 - 6,82 million TEU/year; 133,03 - 141,48 million tonnes/year by 2025, in which the quantity of container cargo accounts for 7,72 - 8,18 million TEU/year; 145,47 - 159,98 million tonnes/year by 2030, in which the quantity of container cargo accounts for 8,44 - 9,07 million TEU/year.
Expected movement of passengers: 26,49 - 48,67 thousand arrivals/year by 2020; 27,67 - 108,76 thousand arrivals/year by 2025; 28,9 - 243,0 thousand arrivals/year by 2030.
Detailed planning for primary terminals:
+ Terminals along Sai Gon river: Terminals/wharves for ships with a deadweight tonnage of up to 30.000 tonnes. These terminals shall be relocated and repurposed in accordance with the Prime Minister’s Decision No. 791/QD-TTg dated August 12, 2005; a part of Khanh Hoi terminal shall be converted into an inland passenger terminal and maritime service center. Tan Thuan terminal (in Sai Gon Terminal) shall be relocated to Hiep Phuoc in conformity with the construction progress of Thu Thiem 4 bridge. Unrelocated terminals shall continue their operation according to existing conditions and shall not be upgraded and expanded. They shall be relocated after 2020 or have their operation terminated upon the end of land lease duration.
+ Cat Lai terminals (Dong Nai river): Terminals/wharves for ships with a deadweight tonnage of up to 30.000 tonnes. New investments in terminals are restricted; operation methods shall be adopted to relieve burden on existing road transport routes; new investments in terminals shall be taken into consideration when the investment in the port infrastructure connected with the regional transport infrastructure is fully completed to ensure the transport capacity and meet the needs for goods movement.
+ Nha Be terminals (Nha Be river): Terminals for ships with a deadweight tonnage of up to 30.000 tonnes. Terminals along Nha Be river shall be upgraded (not expanded). A new passenger terminal for ships with a capacity of 60.000 GT shall be built in Phu Thuan (in the downstream of Phu My bridge).
+ Hiep Phuoc terminals (Soai Rap river): primary terminals of Ho Chi Minh City seaport in the future for general cargo ships with a deadweight tonnage of up to 50.000 tonnes and container ships with a capacity of up to 4.000 TEU; some dedicated terminals directly serving adjacent industrial facilities.
+ Can Giuoc – Long An terminals (on Soai Rap river): multipurpose and dedicated terminals (including terminals serving Long An Power Center) for ships with a deadweight tonnage of 20.000 – 50.000 tonnes going through Soai Rap sanctuary.
b) Dong Nai seaport: National and central multipurpose terminal (Class I ) which comprises: Long Binh Tan terminals (Dong Nai river); Phu Huu terminals (segments of Dong Nai river and Long Tau – Nha Be river), Ong Keo terminals (Long Tau and Dong Tranh rivers); Go Dau terminals and Phuoc An terminals (Thi Vai river).
Estimated capacity of goods movement: 17,72 - 18,79 million tonnes/year by 2020, in which the quantity of container cargo accounts for 0,66 - 0,71 million TEU/year; 29,20 - 32,96 million tonnes/year by 2025, in which the quantity of container cargo accounts for 1,30 - 1,51 million TEU/year; 44,48 - 51,69 million tonnes/year by 2030, in which the quantity of container cargo accounts for 2,27 - 2,65 million TEU/year.
Detailed planning for primary terminals:
+ Phuoc An, Go Dau terminals (on Thi Vai river): Primary terminals of Dong Nai seaport for general ships and container ships with a deadweight tonnage of up to 60.000 tonnes (Phuoc An) and 30.000 tonnes (Go Dau); some dedicated terminals directly serving adjacent industrial facilities.
+ Phu Huu, Nhon Trach, Ong Keo terminals (on Dong Nai, Nha Be, Long Tau rivers): Dedicated terminals for ships with a deadweight tonnage of 10.000 – 30.000 tonnes and multipurpose terminals for ships with a deadweight tonnage of up to 30.000 tonnes.
+ Terminals along Dong Nai river: Terminals for general ships, container ships and dedicated terminals for ships with a deadweight tonnage of up to 5.000 tonnes in Long Binh Tan area (Dong Nai).
c) Binh Duong seaport: A local multipurpose terminal (Class II) along Dong Nai river which comprises 01 terminal for ships with a deadweight tonnage of up to 5.000 tonnes, loading of general cargo and container handling.
Estimated capacity of goods movement: 1,8 - 2,0 million tonnes/year by 2020 and remains unchanged during 2025 – 2030.
d) Vung Tau seaport: A national multipurpose terminal, international gateway (Class IA) which plays a role as an international transshipment port, comprising the following primary terminals: Go Dau, Tac Ca Trung terminals; Phu My, My Xuan terminals; Cai Mep, Sao Mai – Ben Dinh terminals; Long Son terminals; Ding river terminals and Con Dao terminals.
Estimated capacity of goods movement: 96,06 - 100,85 million tonnes/year by 2020, in which the quantity of container cargo accounts for 3,14 - 3,30 million TEU/year; 127,88 - 141,28 million tonnes/year by 2025, in which the quantity of container cargo accounts for 5,16 - 5,82 million TEU/year; 166,81 - 197,93 million tonnes/year by 2030, in which the quantity of container cargo accounts for 8,02 - 9,51 million TEU/year.
Expected movement of passengers: 255,39 - 295,25 thousand arrivals/year by 2020; 266,75 - 369,65 thousand arrivals/year by 2025; 278,60 - 462,80 thousand arrivals/year by 2030.
Detailed planning for primary terminals:
+ Go Dau, Tac Ca Trung terminals: Terminals for general ships and container ships with dedicated terminals for bulk cargo and liquid cargo, capable of receiving ships with a deadweight tonnage of up to 30.000 tonnes.
+ Phu My, My Xuan terminals (Thi Vai river): for general ships with a deadweight tonnage of 50.000 – 80.000 tonnes; container ships with a capacity of 4.000 – 6.000 TEU; some terminals are dedicated to serve industrial and services facilities.
+ Cai Mep, Sao Mai – Ben Dinh terminals: Primary terminals of the port which handle containers exported and imported of long shipping routes and international container transshipment; Cai Mep terminals are capable of receiving ships with a deadweight tonnage of 80.000 – 200.000 tonnes (6.000 – 18.000 TEU); Sao Mai – Ben Dinh terminals are capable of receiving container ships with a deadweight tonnage of from 80.000 tonnes (6.000 TEU) to over 100.000 tonnes, and terminals for international passenger ships with a capacity of up to 225.000 GT.
+ Long Son terminals: Dedicated to the oil refinery complex with terminals for receiving crude oil ships with a deadweight tonnage of up to 300.000 tonnes, ships with a deadweight tonnage of 30.000 – 100.000 tonnes carrying other materials and exports; the Southeast coast is meant to build a multipurpose terminal serving long-term development of the region.
+ Vung Tau – Song Dinh terminals are capable of receiving general ships with a deadweight tonnage of up to 10.000 tonnes (Dong Xuyen Industrial Park).
+ Con Dao terminals are general terminals and passenger terminals of Con Dao, capable of receiving ships with a deadweight tonnage of 2.000 - 5.000 tonnes; there are also maritime service terminals and oil terminals for ships with a deadweight tonnage of up to 10.000 tonnes.
2. Relocation plan in next periods
- Terminals along Sai Gon river: Tan Thuan terminal (in Sai Gon Terminal) shall be relocated to Hiep Phuoc area in conformity with the construction progress of Thu Thiem 4 bridge; unrelocated terminals shall continue their operation according to existing conditions and shall not be upgraded and expanded, and shall be relocated after 2020 or have their operation terminated upon the end of land lease duration.
- Floating terminals on Sai Gon, Dong Nai and Nha Be rivers are relocated in conformity with investment progress of river-crossing structures and permanent terminals in the region.
(A list of capacity and functions of each port in the Group is provided in the Appendix enclosed with this Decision).
3. Planning for upgrade and improvement of shipping lanes
- Sai Gon – Vung Tau lane: Do research on upgrade some sharp turns, maintain depth and maritime signaling system for Long Tau lane for ships with a deadweight tonnage of 30.000 tonnes maintaining 24/7 operation.
- Soai Rap lane: Dredge shallow water areas and implement methods of river improvement (dyke, embankment, etc.) in order to ensure the land depth of -9,5 m (nautical chart system) and the capacity to receive ships with a deadweight tonnage of up to 30.000 tonnes fully loaded and 50.000 tonnes partially loaded.
- Dong Nai river lane: Maintain conditions for operation of ships with a deadweight tonnage of 30.000 tonnes arriving Cat Lai terminals, and ships with a deadweight tonnage of 5.000 tonnes arriving the downstream area of Dong Nai bridge.
- Cai Mep – Thi Vai lane: Arrange shipping lanes in Ganh Rai Bay area in order to ensure maritime safety in that area; do research on investment in dredging of the lane section from the buoy “0” to the CMIT terminal with a depth of -15,5 m to serve large ships and improve the transshipment in Cai Mep area. Gradually improve and upgrade the lane routes to ensure the capacity for receiving ships with a deadweight tonnage of up to 200.000 tonnes, container ships with a deadweight tonnage of 18.000 TEU entering/leaving terminals in Cai Mep area; receiving ships with a deadweight tonnage of up to 100.000 tonnes, container ships with a deadweight tonnage of 8.000 TEU entering/leaving Phu My area (Thi Vai); receiving ships with a deadweight tonnage of up to 60.000 tonnes entering/leaving Phuoc An, My Xuan areas, and ships with a deadweight tonnage of up to 30.000 tonnes entering/leaving Go Dau area.
- Dong Tranh lane: Maintain operation for ships with a deadweight tonnage of 3.000 tonnes fully loaded and 5.000 tonnes partially loaded.
- Dinh river lane: Maintain conditions for operation of ships with a deadweight tonnage of 10.000 tonnes.
4. Planning for infrastructure serving management and operation of seaports
a) Development of barge terminals serving operation of seaports
Make the best use of natural river/canal system for developing terminals for receiving small ships and barges serving the connection of inland waterway to other regions. To be specific:
- Ho Chi Minh City seaport: Barge terminals in Cat Lai, terminals on Rop, Muong Lon, Soc Vam canals, etc. in Hiep Phuoc.
- Ba Ria – Vung Tau seaport: Barge terminals around Cai Mep Ha Logistics Center, on Vam Treo Gui, Nga Tu canal, Ban Thach canal, etc.
- Dong Nai seaport: Barge terminals on Tac Hong, Quan Chim rivers, etc.
b) Anchoring, pilot boarding and landing areas
- Build new anchoring sites in Ganh Rai bay area to serve the expansion and division of shipping lanes of Cai Mep - Thi Vai lane; build new anchoring sites serving the storm sheltering for drilling platforms and large ships in areas adjacent–to anchoring area outside the buoy “0” of Sai Gon – Vung Tau lane; build a new lay-up area for barges entering/leaving terminals in Cai Mep – Thi Vai area; build new anchoring and storm sheltering sites in Dong Nai river area to meet the lay-up demand of ships entering/leaving terminals in the area.
- Adjust the pilot boarding and landing area in Ganh Rai bay area and along two sides of Cai Mep – Thi Vai lane for division of shipping lanes.
c) Development of inland ports and auxiliary works serving operation of seaports
- Develop inland ports combined with logistics service provision according to the detailed planning for development of Vietnam’s inland port system by 2020 with an orientation towards 2030.
- Develop the system of auxiliary works (warehouses, parking areas, etc.) in industrial parks and logistics centers in conformity with the planning for traffic development in provinces/cities having Group 5 seaports.
5. Investment projects given priority by 2020
a) Navigational channels: Request the Government to give approval for determination that the investment project on Cai Mep – Thi Vai channel is an important and urgent project needs to be executed immediately, especially the channel section from the buoy “0” to CMIT terminal with a width of B = 350 m, bottom elevation of -15,5 m to serve operation of ships with a deadweight tonnage of 80.000 - 160.000 tonnes.
b) Roads:
- Expedite the investment in transport routes from Cat Lai terminals to the belt road No. 2, My Thuy intersection and other traffic intersections connected to Cat Lai terminals.
- Bien Hoa – Vung Tau expressway: Make investment in construction of Bien Hoa – Cai Mep section to improve the connection to Cai Mep - Thi Vai terminals.
- Inter-port transport routes and other routes connected to Cai Mep - Thi Vai terminals.
- Roads to Hiep Phuoc terminals: Finish North – South roads to Hiep Phuoc terminals and main roads to terminals of the industrial park.
c) Railway: Make feasibility study on connection of railway to Cai Mep terminals.
d) Inland waterway: Report on guidelines for investment in development projects of waterway corridor and logistics in the Southern region with ODA funding.
IV. Policies and solutions for implementation
1. General development of seaports
- Enhance private sector involvement in development of seaport infrastructure. Enhance promotion of investment in seaport development. State budget shall focus on investment in public infrastructure works (shipping lanes, common breakwaters, etc.) attached to important seaports/ terminals.
- Keep boosting administrative procedure reform in management of investment and operation of seaports/terminals towards simplification and international integration; facilitate arrangement of offices of port authorities and regulatory bodies at new terminals; improve state management of planning for development of seaports in the Group; ensure cooperation and harmonious association with planning for development of local traffic network, construction planning, and socio-economic development master plans of the provinces/cities where the seaports are located.
- Encourage construction of terminals for shared use at economic zones and industrial parks to improve effectiveness of investment in terminals and use of coastlines. Ensure at least 500 – 700 m in width of land for port development along big rivers with potential for port development (Cai Mep - Thi Vai, Soai Rap, Long Tau, Nha Be, Dong Nai, etc.); provide land area behind the ports to build goods distribution centers which plan the role as logistics centers; intensify inland waterway connection and reduce logistics expenses.
2. Policies and organization of port relocation
- Policies on and organization of relocation of ports along Sai Gon river and Ba Son shipyard are specified in the Prime Minister’s Decision No. 791/QD-TTg dated August 12, 2005 and other directive documents.
- Funding derived from repurposing, transfer of land use rights, liquidation of factories and other works shall be used in accordance with the Prime Minister’s Decision No. 46/2010/QD-TTg dated June 24, 2010 promulgating Financial regulations on relocation of ports along Sai Gon river and Ba Son shipyard and relevant legislative documents.
- Other policies on relocation (land lease funding, tax, preferential loans, etc.) are implemented in accordance with current regulations, and may be reported to the Steering Committee for consideration of relocation of ports along Sai Gon river and Ba Son shipyard; ultra vires issues may be reported to the Prime Minister.
3. Policies on monitoring of goods movement
- Distribute the quantity of goods movement between Cat Lai terminal and other terminals in areas such as Cai Mep – Thi Vai, Hiep Phuoc, Long An, etc. according to guidelines for distribution of quantity of imports/exports containers between Cai Mep – Thi Vai and Dong Nai, Hiep Phuoc, Long An terminals instead of gathering a large amount of goods in Cat Lai terminal.
- Do research on solutions for restricted transport of goods by road through Cat Lai terminal; intensify inland waterway transport to seaports.
- Establish regulatory authorities and other agencies/units related to maritime operation and operation of seaports in Cai Mep and Hiep Phuoc terminals; improve capacity of Cai Mep – Thi Vai, Hiep Phuoc terminals; intensify e-customs and gradually eliminate submission of physical documents in order to reform administrative procedures and facilitate movement of goods.
4. Mechanism for encouragement of international transit of goods
- Enhance application of policies encouraging development of international transit of goods and establishment of basic infrastructure, organize the management, operation, provision of financial and banking services and other services necessary for improvement of competitiveness, attraction and movement of internationally transited goods in the region.
- Provinces/cities where Group 5 seaports are located shall plan land areas for and promote investment in inland ports and logistics centers serving operation of terminals; promote investment in industrial facilities at terminals where the quantity of goods movement is still low.
5. Solutions for floating terminals and transport hubs
- The planning for floating terminals and transshipment hubs shall be formulated and managed properly. Stable and long-term investment in and operation of these floating terminals and transshipment hubs are encouraged in conformity with the port master planning and in the same manner as wharves/terminals. Construction and operation of floating terminals (including transshipment floating terminals serving thermoelectric centers when transshipment ports are established) must be taken into careful consideration and ensure the satisfaction of environmental protection requirements.
- Temporary floating terminals and transshipment hubs shall not be included in the planning but shall be licensed to operate for a fixed period of not exceeding 5 years when wharves, terminals, floating terminals and/or transshipment hubs under the planning in the region are unable to meet the actual demands for goods movement. Investors must stop operation and dismantle floating terminals upon expiration of operation license.
- Floating terminals on Sai Gon river will be relocated by 2020. Floating terminals on Dong Nai and Nha Be rivers will be gradually relocated in conformity with the progress of investment in permanent terminals. Floating terminals/transshipment hubs on Go Gia, Thieng Lieng, Soai Rap rivers and Ganh Rai bay should be developed to serve ships of suitable sizes and movement of goods in the region, and reduce transport costs.
6. Solutions for oil terminals
- Formulate the planning for oil terminals at appropriate locations to meet fire prevention and oil spill response requirements.
- Inspect, review and implement technical measures for improving fire safety of oil terminals in the Group, if necessary, and ensuring fire safety, maritime safety and prevention of environmental pollution.
Article 2. Management and organization of planning implementation
1. Vietnam Maritime Administration
- Play the leading role and cooperate with local departments, regulatory authorities and relevant agencies in publishing and managing the implementation of approved planning.
- Play the leading role and cooperate with local departments, regulatory authorities and relevant agencies in counseling the Ministry of Transport to consider approving new investment, improvement, expansion or upgradation of wharves/terminals.
- Take charge of appraising and requesting the Ministry of Transport to consider and decide the updates or adjustments to the scale, functions or construction progress of wharves/ terminals.
- Based on actual demand and at the request of investors and provincial people’s committees, Vietnam Maritime Administration shall submit a consolidated report on potential ports/terminals to Ministry of Transport for consideration.
- Regularly cooperate with local governments and relevant authorities in carrying out inspection of the implementation of planning for seaport development, proposing actions against projects that fail to comply with the planning; submit annual consolidated report on the planning implementation to Ministry of Transport.
- Organize the implementation of seaport development planning in association with the implementation of solutions for improving effectiveness of seaports and terminals specified in Decision No. 3304/QD-BGTVT dated October 25, 2013 of the Minister of Transport; make investment in multipurpose and container terminals at terminals in a manner that ensures there are no negative impacts on the movement of goods through terminals in the region, and convenient transport conditions without causing traffic congestion in order to reduce transport costs.
2. Provincial People’s Committees
- Direct the formulation of local planning in conformity with the approved detailed planning for the Group of seaports; strictly manage land area dedicated to port construction; provide land area according to the planning for harmonious development of ports and infrastructure connected thereto, logistics centers and maritime service centers in order to ensure convenient operation of seaports.
- Before allocating land/ waters within the planning area for construction of seaports/terminals or issuing a certificate of investment to a seaport construction project, people’s committees of provinces/ cities must send written request to the Ministry of Transport for its opinions about contents related to the port planning (the purpose, scale, time and investment progress) as regulated, and cooperate with local governments in managing the planning implementation.
- Instruct provincial competent authorities to strictly cooperate with Vietnam Maritime Administration in preparing, appraising and applying for approval for detailed planning for terminals; propose updates, supplements or adjustments to the detailed planning for seaports/ terminals to Ministry of Transport in accordance with regulations.
Article 3. This Decision comes into force from the day on which it is signed and supersedes the Decision No. 3327/QD-BGTVT dated August 29, 2014 of the Minister of Transport.
Article 4. Chief of Office and Chief Inspector of the Ministry of Transport, Directors of Departments, Director of Vietnam Maritime Administration, heads of relevant agencies, organizations and individuals are responsible for the implementation of this Decision./.
