To: Departments of Health of provinces and centrally-affiliated cities (specified in the enclosed List)

Pursuant to the Official Dispatch No.6188/BYT-KH-TC dated August 12, 2016 that has been sent to the Departments of Health and Social Insurance Service of 16 provinces in respect of application of covered service price which is inclusive of direct costs, specified allowances and salary stipulated in the Joint Circular No.37/2015/TTLT-BYT-BTC dated October 29, 2015 by the Ministry of Health and Ministry of Finance, the Ministry of health hereby requests:

1. Entities that fail to input the covered service price which is inclusive of direct costs, specific allowances and salary expenses (stipulated in Annex of prices applied as of July 01, 2016 enclosed with the Joint Circular No.37/2015/TTLT-BYT-BTC (hereinafter referred to as “new price”) into the electronic medical billing software by August 12, 2016 to input the new price into the software (do not retrospect to August 12, 2016)

2. Medical facilities to:

a) Make the new price publicly available under the Directives of the Ministry of Health, disseminate the new price to residents, address arising issue (if any)and consult with supervisory authorities if the issue is beyond the competence;

b) Promptly notify the Social Insurance Services of the application of the new price.

c) In case of outpatients and inpatients whose treatment series starts and ends after the application of new price shall be charged at the existing price until the treatment is ended or the patient is discharged.

3.  The Departments of Health of provinces with the absence of healthcare funds for the poor to immediately request the People’s Committee of the province to set up healthcare fund/mobilize funding /allocate the remaining health fund (if any) under the regulations of laws on health insurances to support entities prescribed in the Decision No.139/2002/QD-TTg dated October 15, 2002 by the Prime Minister on medical examination and treatment for the poor, Decision No.14/2012/QD-TTg dated March 01, 2012 by the Prime Minister of amendments to a number of articles of the Decision No.139/2002/QD-TTg and Joint Circular No.33/2013/TTLT-BYT-BTC dated October 18, 2013 by the Ministry of Finance and Ministry of Health providing guidance on the implementation of the Decision No.14/2012/QD-TTg  dated March 01, 2012 by the Prime Minister.

4. The Departments of Health of provinces to direct medical facilities within the province allocate part of surplus to the healthcare fund under the Government's Decree No.85/2012/ND-CP dated October 15, 2012 on financial and operational regulations of public service providers and prices of medical services administered by public medical facilities; establish the internal regulations on assistance in healthcare funds in case patients are unable to the medical service expenses.

5. The Department of Health of the province to request the People’s Committee of the province to consider having the medical expenses of patients who are injured due to Acts of Gods prescribed in point c, clause 2, Article 20 of the Government's Decree No.85/2012/ND-CP dated October 15, 2012 on operational and financial regulations applicable to public service providers and medical service prices of public medical facilities covered.

Any issue arising in connection to the implementation should be promptly reported to the Ministry of Health.
