To: Employers in Ho Chi Minh City
Pursuant to The Law on Employment (Law No. 38/2013/QH13 dated 16/11/2014), from 01/01/2015, any employee that has been worked for any organization under an employment contract for at least 03 months (regardless of the number of workers employed) has to obtain compulsory unemployment insurance.
Social insurance of Ho Chi Minh City promulgated the Official Dispatch No. 4064/BHXH-THU on December 17, 2014 requesting the employers to review and promptly provide additional information about unemployment insurance policyholders from January 2015.
However, until now, a number of organizations have not followed procedures for changes of unemployment insurance policyholders according to the regulation and affect benefits of employees.
So as to ensure benefits of employees when they stop working, not later than 31/03/2015, employers shall submit the applications for unemployment insurance for the employees who have been worked under employment contracts for at least 3 months as prescribed in the regulations. Employers shall be responsible for any negative effect to benefits from social insurance, health insurance, unemployment insurance of employees that is due to the tardiness in the implementation of such regulation.
After the aforementioned deadline, the social insurance agency will carry out a review and raise the benefits of unemployment insurance purchased from January 2015 according to the regulation.
