CIRCULAR

FEES FOR PROCESSING OF APPLICATIONS FOR LICENSE FOR ESTABLISHMENT AND OPERATION OF BANKS AND NON-BANK CREDIT INSTITUTIONS

Pursuant to the Law on Fees and Charges dated November 25, 2015;

Pursuant to the Government’s Decree No. 87/2017/ND-CP dated July 26, 2017 defining functions, tasks, powers and organizational structure of the Ministry of Finance;

At the request of the Director General of the Department of Tax Policy;

The Minister of Finance promulgates a Circular prescribing fees for processing of applications for license for establishment and operation of banks and non-bank credit institutions.

Article 1. Fees for processing of applications for license for establishment and operation of banks and non-bank credit institutions

Holders of license for establishment and operation of banks and non-bank credit institutions issued by competent authorities shall pay fees as follows:

1. From May 05, 2020 to December 31, 2020 inclusively, fees payable shall be equal to 50% of the fees prescribed in Point a and Point b Section 1 of the Fees Schedule provided in Clause 1 Article 4 of the Circular No. 150/2016/TT-BTC dated October 14, 2016 of Minister of Finance prescribing fees for processing of applications for license for establishment and operation of credit institutions, license for establishment of foreign bank branches, representative offices of foreign credit institutions or other foreign organizations performing banking activities, license for provision of intermediary payment services by non-bank institutions, and the collection and transfer thereof (hereinafter referred to as “Circular No. 150/2016/TT-BTC”).

During the validity period of this Circular, no collection of fees for processing of applications for license for establishment and operation of banks and non-bank credit institutions prescribed in Clause 1 Article 4 of Circular No. 150/2016/TT-BTC shall be made.

2. From January 01, 2021 onwards, fees for processing of applications for license for establishment and operation of banks and non-bank credit institutions shall be paid according to the fees prescribed in Clause 1 Article 4 of Circular No. 150/2016/TT-BTC.

Article 2. Effect

1. This Circular comes into force from May 05, 2020 to December 31, 2020 inclusively.

2. Scope of application, payers, collectors, declaration, payment, and other relevant contents, which are not provided for in this Circular, shall comply with the provisions in Circular No. 150/2016/TT-BTC.

3. Difficulties that arise during the implementation of this Circular should be promptly reported to the Ministry of Finance for consideration./.
