CIRCULAR
CRITERIA FOR CLASSIFICATION OF INLAND PORTS AND ANNOUNCEMENT OF LIST OF INLAND PORTS
Pursuant to the Law on Inland Waterway Navigation dated June 15, 2004 and the Law on the amendments to the Law on Inland Waterway Navigation dated June 17, 2014;
Pursuant to Decree No. 107/2012/ND-CP dated December 20, 2012 of the Government defining the functions, tasks, entitlements and organizational structure of the Ministry of Transport;
At the request of the Director of Department of Transport Infrastructure and the Director of Vietnam Inland Waterway Administration,
The Minister of Transport promulgates a Circular on criteria for classification of inland ports and announcement of inland ports.
Article 1. Scope
This Circular deals with criteria for classification of inland ports and announcement of list of inland ports.
Article 2. Regulated entities
This Circular applies to agencies, organizations and individuals related to classification of inland ports and announcement of list of inland ports.
Article 3. Criteria for classification of inland ports
1. Criteria for classification of an inland port include:
a) The importance of the inland port to socio-economic development of the region, the province or the area of the province.
b) Size of the inland port, including: port infrastructure, capacity of receiving the largest watercraft and quantity of cargo and passengers through the port per one year.
2. The classification of inland ports shall comply with Appendix 1 issued herewith.
Article 4. Announcement of list of inland ports
1. The power to announce the list of inland ports
a) The Ministry of Transport shall announce the list of inland ports on national inland waterways, specialized inland waterways in conjunction with national inland waterways, specialized inland waterways through at least two central-affiliated cities or provinces.
b) The People’s Committees of central-affiliated cities or provinces shall announce the list of inland ports on local inland waterways, specialized inland waterways in conjunction with local inland waterways in the provinces or cities.
2. Procedures for announcement of list of inland ports
a) Vietnam Inland Waterway Administration shall prepare a list of inland ports on national inland waterways, specialized inland waterways in conjunction with national inland waterways, specialized inland waterways through at least two central-affiliated cities or provinces, and then submit it to the Ministry of Transport before every December 20;
b) Each Service of Transport shall announce a list of inland ports on local inland waterways, specialized inland waterways in conjunction with local inland waterways in the provinces or cities, and then submit it to the People’s Committee of central-affiliated city or province before every December 20;
c) The agency competent to announce the list of inland ports prescribed in Point a and Point b Clause 1 of this Article shall announce the list of inland ports before every December 31 using the form of Appendix 2 issued herewith;
d) After the People’s Committee of central-affiliated city or province announces the list of inland ports, the Service of Transport shall send the announced list to Vietnam Inland Waterway Administration before every January 15; Vietnam Inland Waterway Administration shall send reports to the Ministry of Transport before every January 25.
3. The agency competent to announce the list of inland ports prescribed in Point a and Point b Clause 1 of this Article must post the announced list of inland ports on their website(s).
Article 5. Implementation
1. This Circular comes into effect from January 1, 2015.
2. The Chief of the Ministry Office, the Chief Inspector of Ministry, Directors of Departments, Director of Vietnam Inland Waterway Administration, Directors of the Services of Transport of central-affiliated cities and provinces, Heads of relevant agencies or organizations, and individuals shall implement this Circular.
3. Difficulties that arise during the implementation of this Circular should be reported to the Ministry of Transport for consideration./.
