EXAMINATION FEE FOR ISSUING CONSTRUCTION PRACTICE CERTIFICATES

Pursuant to the Law on Construction No. 50/2014/QH13 dated June 18, 2014; Law on amendments to the Law on Construction dated June 17, 2020;

Pursuant to Government's Decree No. 52/2022/ND-CP dated August 8, 2022 on functions, tasks, powers, and organizational structure of the Ministry of Construction;

Pursuant to Decree No. 15/2021/ND-CP dated March 3, 2021 of the Government on elaboration of construction project management;

Pursuant to Decree No. 35/2023/ND-CP dated June 20, 2023 of the Government on amendments to Decrees under management of the Ministry of Construction;

Article 1. Issue the Regulation on the Examination Fee for Issuing Construction Practice Certificates, attached to this Decision.

Article 2. This Decision comes into force as of the date of signing and supersedes Decision No. 970/QD-BXD dated September 21, 2017 of the Ministry of Construction on examination fee for issuing construction practice certificates.

Article 3. The Chief of the Ministry Office, Director of the Department of Construction Management and agencies and organizations related to examination for issuance of construction practice certificates shall implement this Decision./.

REGULATION

ON EXAMINATION FEE FOR ISSUING CONSTRUCTION PRACTICE CERTIFICATES

1. This Regulation applies to the issuing  authorities of construction practice certificates in accordance with the regulations and affiliated public sector entities of these issuing authorities (hereinafter referred to as issuing authorities); individuals taking the examination for issuing construction practice certificates (hereinafter referred to as examinees).

2. The regulations on the examination fee for issuing construction practice certificates (hereinafter referred to as the examination fee) in this document are the basis for issuing authorities of construction practice certificates and examinees to perform the collection, payment, and management and use of examination fees.

3. The state budget is not used to hold the examination for issuing construction practice certificates.

Article 2. Examination fee for issuing construction practice certificates

1. The examination fee is a fixed amount that an examinee must pay when taking an examination for a construction practice certificate, to compensate for the cost of holding the examination.

2. The examinee shall pay the examination fee once before taking the examination. The examination fee is not refundable in any case.

3. The examination fee is collected and used to pay for the following activities of the issuing authorities, including:

a) Travel, accommodation, and accommodation costs for individuals who hold the examination;

b) Examination costs, including:  costs for renting halls, computer rooms, tea break and other costs directly related to the organization of exams;

d) The cost of managing and operating the software system;

e) The cost of developing, updating, and supplementing the question bank for the examination for construction practice certificates;

Article 3. Amount of examination fee for issuing construction practice certificates

1. The examination fee is calculated per examination of an examinee as follows: VND 350,000/examination.

2. In addition to the examination fee mentioned in Clause 1 of this Article, socio-professional organizations recognized as eligible for granting practice certificates may set their own fee rates to serve the assessment of applications for construction practice certificates of examinees but not exceeding the fee amount in accordance with the regulations of the Ministry of Finance and publicly listed according to the regulations.

Article 4. Management and use of examination fees

1. Agencies/organizations that hold the examination shall be responsible for developing and issuing regulations on collection and expenditures to manage and use examination fees efficiently, ensuring the efficiency of the examination activities, in accordance with the law.

2. After each examination session (no more than 10 days from the date of the examination), the agency/organization collecting the examination fee shall transfer the portion to cover the cost of managing and operating the software system and the cost of developing, updating, and supplementing the question bank for the examination for construction practice certificates to the Construction Activities Management Department, affiliated to Ministry of Construction, in specific:

a) The cost of managing and operating the software system: VND 60,000/examination;

3. Agencies/organizations collecting and using examination fees shall perform the declaration and settlement of examination fees in accordance with the law./.
