DECISION
APPROVING ANTI-HUMAN TRAFFICKING PROGRAM FOR THE PERIOD OF 2021 - 2025 AND ORIENTATION UNTIL 2030

Pursuant to Law on Governmental Organization dated June 19, 2015; Law on amendments to Law on Government Organization and Law on Local Governmental Organization dated November 22, 2019;
Pursuant to the Law on Anti-Human Trafficking dated March 29, 2011;
Pursuant to Decision No. 623/QD-TTg dated April 14, 2016 of the Prime Minister approving the National Strategy for Fighting and Preventing Crime for the period of 2016 - 2025 and orientation until 2030;
Pursuant to Decision No. 634/QD-TTg dated May 13, 2020 of the Prime Minister approving the Program for implementing Resolution No. 96/2019/QH14 dated November 27, 2019 of the 14th National Assembly on fighting and preventing crime and violations of the law, operations of the People’s Procuracy, People’s Court, and judgment enforcement;

Article 1. Approve the Anti-human trafficking program for the period of 2021 - 2025 and orientation until 2030 (hereinafter referred to as the “Anti-human trafficking program”).
Article 2. This Decision comes into effect from the day of signing.
Article 3. Ministers, heads of ministerial agencies, heads of Governmental agencies, Chairpersons of People’s Committees of provinces and central-affiliated cities are responsible for implementing this Decision./.

1. General objectives and requirements
a) Exercise the combined force of the entire political system and the general public; identify tasks and responsibilities; improve cooperation effectiveness between ministries and local governments in preventing and fighting human trafficking; mobilize domestic resources, support and assistance of other countries, international organizations, and relevant organizations. Effectively implement Scheme assigned under the National strategy for fighting and preventing crime for the period of 2016 - 2025 and orientation to 2030, integrate anti-human trafficking measures in the Scheme.
b) Create the important shift in awareness and responsibilities of all levels, disciplines, and classes of the general public; promptly clarify and rectify causes, conditions that give way to crimes, and reduce risks of human trafficking; develop policies and regulations on anti-human trafficking; effectively receive, verify, identify, rescue, protect, and support victims of human trafficking.
2. Specific objectives and requirements
a) Promote communications to raise awareness of individuals, families, and community regarding anti-human trafficking measures, prioritizing high risk groups, especially those in rural, remote, border areas and ethnic minority areas. Central and local press authorities and radio station systems in districts and communes deliver articles, sections, publications regarding anti-human trafficking for different target audiences and different districts, communes on a monthly basis. Regularly update forms, schemes, and goals of human traffickers on popular websites and social network sites in Vietnam.
b) Ensure that 100% of crime reports and petitions for prosecution relating to human trafficking are received and classified with more than 90% of which are processed and resolved. Cases suggesting signs of human trafficking must be investigated and verified and, after all bases are present, prosecuted as per the law. Investigation, prosecution, and trial of human traffickers are proper, legitimate, and without errors. More than 90% of prosecuted cases are investigated and resolved. 95% of annual human trafficking cases are resolved and prosecuted. 90% of annual human trafficking cases are resolved and adjudicated.
c) Victims are verified, identified, rescued, protected, and supported in a timely and effective manner as per the law. Develop, reinforce, upgrade, and invest in amenities and equipment of facilities providing support for human trafficking victims. Provide training, improve knowledge and skills for officials who receive, verify, identify, and support human trafficking victims.
d) Policies and regulations relating to anti-human trafficking operations, verification, identification, rescue, protection, and support for human trafficking victims are regularly amended to stay consistent with regulations of regions, international laws, and implementation of anti-human trafficking operations.
dd) Improve effectiveness of interdisciplinary cooperation and international cooperation in receiving, verifying, identifying, rescuing, protecting, assisting victims, investigating, prosecuting, and adjudicating human trafficking cases. International treaties, bilateral agreements, unilateral agreements, agreements on anti-human trafficking to which Vietnam is a signatory are effectively implemented and concluded.

II. TASKS AND SOLUTIONS
1. Communications regarding anti-human trafficking
a) Central and local press authorities develop and maintain articles, sections, programs on radio and television regarding anti-human trafficking which focus on new schemes, methods, and key locations of such crimes, potential victims, benefits of victims, and hotline for receiving information on human trafficking victims and cases.
b) Prioritize communications on mass media, websites and social network sites, information systems for different target audiences and locations; integrate information on rights of victims, assistance, support, counseling, and information receipt in messages, articles, sections, and communication materials regarding anti-human trafficking.
c) Mobilize participation of telecommunication, information technology service enterprises and internet service providers in communicating anti-human trafficking.
d) Organize effective implementation of behavior change communication in community, change forms of communication to best fit different groups of victims and potential victims. Organize activities celebrating “Ngày toàn dân phòng, chống mua bán người 30/7” (Date of general public’s participation in anti-human trafficking of July 30) consistent with messages of UN and local implementation.
dd) Integrate and communicate anti-human trafficking messages in character education and extracurricular programs.
c) Develop and duplicate communication models in communities; collect, gather information and signs relating to human trafficking in local communities.
2. Fighting human trafficking

b) Receive, verify, and promptly resolve accusations, information, and petitions for prosecution of human trafficking crimes; investigate and unveil cases, series of human trafficking crimes, hunt subjects; adopt solutions for rescuing, receiving, protecting, assisting victims as per the law; initiate series of intensive offending and suppressing of human trafficking crimes and relevant crimes on a nationwide scale, especially key routes and areas.
c) Enhance border and checkpoint management, effectively prevent illegal entry and exit; enhance state management regarding adoption, marriage with foreign element, Vietnamese guest worker service provision and brokerage, studying, tourism, and other conditional lines of business in order to promptly discover human trafficking in these sectors.
3. Prosecution and adjudication of human traffickers
a) Exercise prosecutor’s rights and control resolution of human trafficking cases and ensure legitimacy thereof.
b) Promptly and strictly adjudicate human trafficking cases; research and develop precedents regarding human trafficking.
c) Choose and identify key cases, organize experience-learning trials to improve adjudication quality, publicize law education to the general public.
4. Victim receipt, verification, identification, rescue, and protection
a) Receive, verify, identify, and rescue human trafficking victims in a manner revolving around the victims; provide initial essential support as per the law.
b) Implement solutions for ensuring information security and safety for victims and their relatives.

a) Develop and implement standard procedures for assisting human trafficking victims to rehabilitate; research and carry out pilot implementation of procedures for referring human trafficking victims and suspected victims; develop regulations on interdisciplinary cooperation in receiving and supporting victims, providing connection and services for receiving, assisting victims and suspected victims.
b) Reinforce, develop, and improve quality of public services utilizing state budget in supporting human trafficking victims and ensure availability and accessibility thereof; invest, upgrade equipment, develop criteria for assessing quality of victim support services and carry out pilot implementation of rehabilitation assistance models.
c) Integrate anti-human trafficking information in programs for preventing crimes, social evils, reducing poverty, providing vocational education and training, creating jobs, ensuring gender equality, protecting children, and other socio-economic development programs.
6. Policy and regulation development, and monitoring of policy and regulation implementation relating to anti-human trafficking
a) Organize preliminary conclusion and final conclusion of implementation of the Law on Anti-Human Trafficking of 2011; on the basis of final conclusion results, request competent authorities to improve effectiveness of anti-human trafficking operation.
b) Research to amend and complete regulations on anti-human trafficking and guiding documents, ensure consistency and conformity with international treaties to which Vietnam is a signatory and anti-human trafficking situation.
c) Develop plans for implementing and monitoring compliance with regulations and law on anti-human trafficking and relevant guiding documents.
7. Enhancement of interdisciplinary and international cooperation in anti-human trafficking
a) Develop, sign, and effectively implement regulations on cooperation, maintain periodic reports and information sharing between relevant authorities in central and local level relating to receiving, verifying, identifying, rescuing, protecting, and supporting victims; investigate, prosecute, and adjudicate human trafficking cases.

c) Develop and reach an agreement with neighboring countries regarding criteria for identifying victims, regulations on cooperation in exchanging information and repatriating victims. Effectively utilize the Border Liaison Office in border provinces.
d) Organize effective implementation of international treaties regarding anti-human trafficking and relevant international treaties to which Vietnam is a signatory; organize preliminary and final conclusion of the implementation. Research, propose amendments, sign, participate in international treaties, agreements, and commitments.
dd) Organize and participate in domestic and international conventions, conferences, multilateral and bilateral forums regarding anti-human trafficking; exchange information regarding principles, policies, efforts, and experience of Vietnam in preventing and fighting human trafficking.
e) Mobilize resources of social agencies, organizations, enterprises, international organizations, NGOs, and individuals for preventing and fighting human trafficking and assisting human trafficking victims.
8. Development of statistical data on anti-human trafficking
a) Statistical data must regularly update information and data on implementation, results of anti-human trafficking and other relevant data, be regularly and closely connected between ministries and disciplines.
b) Carry out assessment, analyze statistical data to serve reports and plans for implementing relevant activities in anti-human trafficking every year and every stage.
9. Improve capacity of officials engaging in activities relating to anti-human trafficking
a) Research, develop documents, disseminate, provide training, education, improve skills of officials directly engaging in activities relating to anti-human trafficking and assisting human trafficking victims.

III. RESPONSIBILITIES
Ministries, ministerial agencies, Governmental agencies, and People’s Committees of provinces and central-affiliated cities, within their responsibilities and powers, shall advise, develop, issue plans, implement tasks and solutions of the Anti-human trafficking program; while implement the following specific tasks:
1. Ministry of Public Security shall
a) Assisting Prime Minister, National Steering Committee for Anti-crime of the Government in inspecting, encouraging, organizing preliminary conclusions and final conclusions of implementation of tasks and objectives of the Anti-human trafficking program.
b) Take charge and cooperate with forces, synchronously implement professional measures, acknowledge the situation, implement plans, solutions for fighting, preventing human trafficking and relevant crimes.
c) Take charge receiving, verifying, identifying, rescuing, and protecting victims; organizing preliminary conclusion and final conclusion of implementation of the Law on Anti-Human Trafficking of 2011 and request competent authorities to develop solutions for improving effectiveness of anti-human trafficking operation, including development of regulations and law on anti-human trafficking.
d) Take charge and cooperate with relevant authorities in promoting international cooperation in preventing and fighting human trafficking crimes, especially with neighboring countries and countries with large Vietnamese population.
dd) Develop statistical data criteria regarding human trafficking while ensuring consistency with international practice; develop and manage statistical data regarding human trafficking.
e) Take charge and cooperate with ministries, press and communication authorities in implementing social deterrence activities; effectively implement general public’s participation in national defense, security, crime and social evil prevention; develop contents for periodic communications regarding anti-human trafficking results on mass media and website of the Ministry of Public Security.

2. Ministry of National Defense shall
a) Take charge fighting and preventing human trafficking crimes in borders, checkpoints, sea, islands, and other areas under their management.
b) Rescue, protect, receive, and assist victims; oversee security and order in border areas, checkpoints, sea, islands, and other areas of their responsibility; implement international cooperation on anti-human trafficking.
c) Provide information based on statistical data criteria to serve management of statistical data on anti-human trafficking.
3. Ministry of Labor - War Invalids and Social Affairs shall
a) Carry out preliminary conclusion and final conclusion of implementation of regulations and law on victim support and request competent authorities to develop regulations on victim support.
b) Take charge assisting victims; reinforcing, developing, and improving quality of public services utilizing state budget in assisting human trafficking victims; carry out pilot implementation of assisted rehabilitation; disseminating, organizing conferences, training, improving capacity of personnel assisting victims; inspecting and supervising implementation of victim support.
c) Receive information, notice regarding human trafficking via hotline 111; process information, counsel, and refer cases of human trafficking victims or suspected victims.
d) Increase supervision, inspection, and examination regarding organizations and individuals engaging in Vietnamese guest worker service provision or brokerage; take strict actions against violations; disclose organizations and enterprises allowed to provide Vietnamese guest workers and fees payable by employees.

e) Provide information based on statistical data criteria to serve management of statistical data on anti-human trafficking.
4. Ministry of Information and Communications shall
a) Take charge communicating anti-human trafficking on mass media, websites, social network sites, and information systems; integrate anti-human trafficking contents in other information programs; improve skills in disseminating anti-human trafficking of persons engaging in communication work, journalists, and editors of press authorities.
b) Direct enterprises, telecommunication services, information technology, and internet service providers to communicate anti-human trafficking.
5. Ministry of Foreign Affairs shall
a) Direct and guide Vietnamese representative missions in foreign countries to offer protection to Vietnamese citizens, assist victims of human trafficking, and persons awaiting verification; cooperate with authorities of Vietnam and foreign countries in verifying and adopting other necessary procedures for bringing the victims back.
b) Take charge and advice Government, Prime Minister to develop principles, policies regarding international migration issues in order to improve management effectiveness of international migration and prevent the risks of human trafficking.
c) Take charge and cooperate with foreign affair information regarding policies and efforts of Vietnam in anti-human trafficking and other relevant information.
d) Provide information based on statistical data criteria to serve management of statistical data on anti-human trafficking.

a) Cooperate with Ministry of Public Security and relevant authorities in reviewing and developing law system; monitor enforcement of regulations and policies relating to anti-human trafficking, ensure effective implementation and consistency with international treaties to which Vietnam is a signatory.
b) Manage, guide, inspect, and investigate activities assisting marriage, adoption, giving up for adoption in order to prevent exploitation of these activities for the purpose of human trafficking.
c) Guide state legal aid centers and organizations to provide legal aid for human trafficking victims as per the law.
d) Cooperate with ministries and local governments in publicizing and educating laws regarding anti-human trafficking.
7. Ministry of Culture, Sports and Tourism shall
a) Integrate law education and dissemination regarding anti-human trafficking in cultural, artistic, sports, and tourism activities together with developing agreements in local communities, developing cultural lives in agencies, organizations, schools, and residential areas.
b) Enhance management, inspection, and investigation of tourism, cultural, sports service provision in order to prevent exploitation of these activities for the purpose of human trafficking.
c) Publicize, educate moral and lifestyles to prevent, fight, denounce human trafficking crimes.
8. Ministry of Education and Training shall

b) Direct schools and other education institutions in the national education systems to closely monitor studying and activities of students; enable student who are victims of human trafficking to attend education, vocational training and education, and rehabilitate; cooperate with families, agencies, organizations in implementing anti-human trafficking measures.
c) Manage, supervise, inspect, and investigate organizations, individuals providing study abroad counseling services, study abroad services, promptly rectify and take actions against violations.
9. Ministry of Health shall
Direct, instruct medical establishments to cooperate with social protection facilities and victim support facilities in prioritizing medical examination and treatment for human trafficking victims; research, propose policies financing insurance of human trafficking victims.
10. Ministry of Agriculture and Rural Development shall
Implement tasks and solutions for fighting and preventing human trafficking in aquaculture; cooperate with relevant authorities in preventing labor abuse.
11. Ministry of Finance shall
Take charge and consolidate recurrent expenses for implementing tasks of the Anti-human trafficking program in annual state budget of ministries and central authorities and request competent authorities to approve as per the Law on State Budget and guiding documents.
12. Ministry of Planning and Investment shall

13. People’s Committees of provinces and central-affiliated cities shall
a) Organize effective implementation of the Anti-human trafficking program, prioritizing communication aiming at prevention; prevent, promptly and strictly deal with violations of the law regarding anti-human trafficking; receive and assist human trafficking victims in rehabilitating; organize effective implementation of state management regarding security and order serving anti-human trafficking purposes.
b) Specify contents and tasks serving anti-human trafficking in socio-economic development plans of each year and each stage, programs, resources, and projects under local governments’ management.
c) Request People’s Councils of the same levels to allocate expenses for implementing Anti-human trafficking program for local agencies and entities in accordance with the Law on State Budget and guiding documents.
14. Central Committee of Vietnamese Fatherland Front and member organizations shall
a) Mobilize the general public, public officials, members, union members, and reputable figures in ethnic minority communities, religious officials to participate in fighting and preventing human trafficking crimes; disseminate and encourage the general public to protect national security.
b) Advise Communist Party committees and cooperate with the government in coordinating anti-human trafficking operations. Enable human trafficking victims to participate in loan support, vocational training and education, rehabilitation support programs and policies.
c) Supervise the implementation of regulations on anti-human trafficking; mobilize members, union members, and the general public to denounce and criticize human traffickers; cooperate in organizing effective implementation of the “Public denunciation of crimes” forum in key areas.
d) Organize frequent preliminary conclusion, final conclusion, commendation, experience learning, and duplication of advanced models in fighting and preventing human trafficking crimes.

a) Take charge disseminating anti-human trafficking contents, prioritizing behavior change communication and innovation of communication forms.
b) Develop and duplicate communication models; victim support models; provide information and connect victims with rehabilitation support services; enable human trafficking victims to participate in loan support programs of Women’s Unions of all levels.
c) Improve communication skills regarding anti-human trafficking for speakers and personnel.
16. Supreme People’s Procuracy and Supreme People’s Court shall
a) Effectively implement Regulations on cooperation with the Government; closely cooperate with ministries and Governmental agencies in fighting and preventing crimes; guiding legal authorities to jointly apply regulations on fighting and preventing human trafficking, promote timely and strict investigation, prosecution, and adjudication of human traffickers and relevant criminals; list and provide information in accordance with statistical data criteria.
b) The Supreme People’s Court shall research and develop precedents, organize experience-learning trials to improve adjudication quality of human trafficking cases; cooperate with communication authorities in disseminating and publicizing the law by adjudicating human trafficking cases.
IV. EXPENDITURE ON IMPLEMENTATION
Expenditure on Anti-human trafficking program implementation shall be guaranteed by the state budget and allocated in annual state budget of ministries and local governments in accordance with the Law on State budget and guiding documents; mobilized by sponsorships and donations of domestic and foreign organizations, individuals, other legal sources as per the law.

2. Assign the Ministry of Public Security to assist Prime Minister in monitoring, supervising, inspecting, and mobilizing officials of departments and local governments to strictly implement the Anti-human trafficking program. Periodically submit reports on the situation to the Prime Minister./.
