ON THE ISSUANCE OF THE RULE ON THE REGISTRATION OF SHORT-TERM VALUABLE PAPER

THE GOVERNOR OF THE STATE BANK

Pursuant to the Law on the State Bank of Vietnam No. 01/1997/QH10 dated 12 December, 1997 and the Law on the Credit Institutions No. 02/1997/QD10 dated 12 December 1997;
Pursuant to the Decree No. 15/CP dated 2 March 1993 of the Government providing for the assignment, authority and responsibility for State management of the ministries and ministry-level agencies;
Upon the proposal of the Director of the Banking Operation Department,

DECIDES

Article 1. To issue in conjunction with this Decision " the rule on the registration of short-term valuable paper"

Article 2.This Decision shall be effective after 15 days from the date of signing.

Article 3. The Director of the Administration Department, the Director of the Banking Operation Department, Heads of the relevant units in the State Bank, General Managers (Managers) of the State Bank branches in provinces and cities under Center Management, General Directors (Directors) of the Credit Institutions participating to open market operation shall be responsible for the implementation of this Decision.

RULE

 ON THE REGISTRATION OF SHORT-TERM VALUABLE PAPER
(issued in conjunction with the Decision No. 171/2000/QD-NHNN13 dated 25th may, 2000 of the Governor of the State Bank)

Chapter I

GENERAL PROVISIONS

Article 1. Governing scope

This Regulation shall provide for the registration, depository of short-term valuable paper under the ownership of Credit Institutions participating to the open market operation at the State Bank to implement the open market operation.

1. Treasury Bills;

2. State Bank bills;

3. Other short-term valuable paper provided for by the Governor of the State Bank from time to time.

Article 3. The registration, depository of short-term valuable paper to participate in the open market operation shall be carried out at the Banking Operation Department or the State Bank branches in provinces, cities designated by the Governor of the State Bank of Vietnam (abbreviated as the registration, depository unit)

Chapter II

DETAILED PROVISIONS

Article 4. At 10a.m of the open market operation day at the latest, members participating to the auction must register and surrender short-term valuable paper at the registration, depository unit.

Article 5. Short-term valuable paper mentioned in Article 2 shall have to satisfy following conditions:

1. Being tradable;

3. The remaining period is 90 days at the most for valuable paper to be traded in an outright purchase, sale;

4. The remaining period for valuable paper to be traded in a sale and repurchase agreement must be longer than the term of the respective sale and repurchase agreement with the State Bank.

Article 6. Surrender of short-term valuable paper

Upon the registration of short-term valuable paper, Credit Institutions shall make and send 02 copies of a list of short-term valuable paper to the registration, depository unit (Form No. 01/DK attached to this Regulation) with the following contents:

1. Name and code of the credit institution which surrenders the short-term valuable paper;

2. Type of short-term valuable paper;

3. Form of short-term valuable paper;

4. Term of short-term valuable paper;

5. Face value of short-term valuable paper;

7. Date of issuance;

8. Payment date of short-term valuable paper.

Article 7. Receipt of short-term valuable paper

1. Upon the receipt of short-term valuable paper of Credit Institutions, the registration, depository unit shall proceed:

a. to verify the authenticity of short-term valuable paper

b. to verify the elements written on the list of short-term valuable paper.

c. to complete the procedures for the receipt, depository and maintenance of short-term valuable paper (in case of valuable paper in certificate form);

d. to complete the procedures to freeze the value of short-term valuable paper (in case of valuable paper in book entry form);

e. to confirm by signing on the list of short-term valuable paper, of which 01 copy shall be returned to the registering Credit institution and 01 shall be kept in file.

Article 8. Withdrawal of short-term valuable paper

1. Credit Institutions shall be entitled to withdraw the registered short-term valuable paper in following cases:

a. The short-term valuable paper have become due for payment;.

b. At request of the credit institution which has registered short-term valuable papers (in the event that Credit institution fails to win in the auction);

2. Credit Institution shall not be entitled to withdraw the short-term valuable paper during the term of the sale and repurchase agreement.

3. Upon the withdrawal of registered short-term valuable paper, credit institutions shall make and send 02 copies of the request for withdrawal of registered short-term valuable paper to the registration, depository unit (Form No. 02/DK attached to this Regulation) with the following contents:

a. Name and code of the credit institution requesting the withdrawal of short-term valuable paper;

b. Type of short-term valuable paper;

c. Form of short-term valuable paper;

e. Face value of short-term valuable paper;

f. Interest rate of short-term valuable paper;

g. Date of issuance;

h. Payment date of short-term valuable paper;

i. Reasons for the withdrawal of short-term valuable paper.

4. Upon the receipt of the request for the withdrawal of short-term valuable paper by the credit institution, the registration and depository unit shall proceed:

a. to verify whether the elements on the written request for the withdrawal of registered short-term valuable paper are in compliance with the registered short-term valuable paper;

b. to complete the procedures for the withdrawal of short-term valuable paper;

c. to confirm by signing on the written request for the withdrawal of short-term valuable paper, of which 01 copy shall be returned to the credit institution requesting the withdrawal of short-term valuable paper, 01 copy shall be kept in file.

IMPLEMENTING PROVISIONS

Article 9. Any amendment, supplement of this Regulation shall be decided upon by the Governor of the State Bank.
