CIRCULAR

LIST OF POTENTIALLY UNSAFE PRODUCTS AND GOODS UNDER THE MANAGEMENT OF MINISTRY OF LABOUR, WAR INVALIDS AND SOCIAL AFFAIRS

Pursuant to the Law on quality of goods and products dated November 21, 2007;

The Government’s Decree No. 132/2008/ND-CP dated December 31, 2008 on detailing the implementation of a number of articles of the Law on products and goods quality;

Pursuant to the Government’s Decree No. 74/2018/ND-CP dated May 15, 2018 providing amendments and supplements to a number of articles of Decree No.&fA132/2008/ND-CP; dated December 31, 2008, detailing the implementation of a number of articles of the Law on products and goods quality;

Pursuant to the Government’s Decree No. 14/2017/ND-CP dated February 17, 2017 defining the functions, tasks, powers and organizational structure of the Ministry of Labour, War Invalids and Social Affairs;

At the Request of the Director of the Department of Work Safety;

The Minister of Labour, War Invalids and Social Affairs promulgates a Circular providing the List of potentially unsafe products and goods under the management of the Ministry of Labour, War Invalids and Social Affairs;

This Circular provides the List of potentially unsafe products and goods under the management of the Ministry of Labour, War Invalids and Social Affairs (hereinafter referred to as the “List of group-2 products and goods”), enclosed with their HS codes.

Article 2. Regulated entities    

This Circular applies to:

1. Domestic and foreign organizations and individuals that produce, import, export, trade and/or use group-2 products and goods under the management of the Ministry of Labour, War Invalids and Social Affairs;

2. Organizations and individuals involved in the management, assessment and certification of quality of group-2 products and goods under the management of the Ministry of Labour, War Invalids and Social Affairs.

Article 3. List of group-2 products and goods under the management of the Ministry of Labour, War Invalids and Social Affairs

1. The list of group-2 products and goods under the management of the Ministry of Labour, War Invalids and Social Affairs and HS codes thereof are provided in the Appendix enclosed herewith.

2. Rules for application of HS codes of the listed group-2 products and goods:

a) In case where only 4-digit HS code is specified, the regulations herein also apply to all products and goods with 8-digit HS codes in the same 4-digit heading;

c) In case where 8-digit HS code is specified, the regulations herein apply to listed products and goods with 8-digit HS codes.

Article 4. Effect

1. This Circular comes into force from February 01, 2019.

2. The list of group-2 products and goods provided in this Circular supersedes the one provided in the Appendix I enclosed with the Circular No. 03/2010/TT-BLDTBXH dated January 19, 2010 by the Minister of Labour, War Invalids and Social Affairs.

Article 5. Implementation organization

1. The Department of Work Safety and Provincial Departments of Labour, War Invalids and Social Affairs shall organize and instruct the implementation of this Circular;

2. The Department of Work Safety shall play the leading role and cooperate with relevant authorities in reviewing and proposing amendments to the List of group-2 products and goods to the Ministry of Labour, War Invalids and Social Affairs to serve management purposes;

3. If legislative documents, technical regulations and/or standards referred to in this Circular are amended or replaced, the new ones shall apply;

4. Difficulties that arise during the implementation of this Circular should be reported to the Ministry of Labour, War Invalids and Social Affairs for consideration.
