CIRCULAR
AMENDMENT TO CIRCULAR NO. 25/2021/TT-BTC DATED APRIL 7, 2021 OF THE MINISTER OF FINANCE ON FEES AND CHARGES IN IMMIGRATION, TRANSIT AND RESIDENCE IN VIETNAM AND COLLECTION, SUBMISSION, MANAGEMENT AND USE THEREOF
pursuant to the Law on Fees and Charges dated November 25, 2015;
Pursuant to the Law on State Budget dated June 25, 2015;
Pursuant to the Law on Entry, Exit, Transit, and Residence of Foreigners in Vietnam dated June 16, 2014; the Law on amendment to the Law on Entry, Exit, Transit, and Residence of Foreigners in Vietnam dated November 25, 2019; the Law on amendment to the Law on Entry, Exit of Vietnamese Citizens and the Law on Law on Entry, Exit, Transit, and Residence of Foreigners in Vietnam dated June 24, 2023;
Pursuant to Decree No. 120/2016/ND-CP dated August 23, 2016 of the Government elaborating the Law on Fees and Charges;
Pursuant to Decree No. 117/2017/ND-CP dated July 19, 2017 of the Government on management and use of state budget in diplomatic activities;
Pursuant to Decree No. 14/2023/ND-CP dated April 20, 2023 of the Government on functions, tasks, powers, and organizational structures of Ministry of Finance;

The Minister of Finance promulgates Circular on amendment to Circular No. 25/2021/TT-BTC dated April 7, 2021 of the Minister of Finance on fees and charges in immigration, transit and residence in Vietnam and collection, submission, management and use thereof.
Article 1. Amendment to Circular No. 25/2021/TT-BTC dated April 7, 2021 of the Minister of Finance on fees and charges in immigration, transit and residence in Vietnam and collection, submission, management and use thereof
1. Amend Clause 1 Article 7:
“Article 7. Fee and charge management
1. Fee collectors that are Immigration Department; police authority, Border Guard Command of provinces and central-affiliated cities; police authority of districts, communes, town-level cities; police authority of communes, wards, towns:
a) Fee collectors are allowed to retain 25% of collected fees to cover expenses according to Article 5 of Decree No. 120/2016/ND-CP dated August 23, 2016 of the Government. In which, other expenses relating to task execution, service provision, and fee collection include expenditure on:
- Traveling, meal, hiring interpreters, guarding detained foreigners; medical examination and treatment for ill foreigners; extraditing foreigners illegally residing or violating the law to their countries. Only use the retained amount to cover these expenses if representative missions of the foreigners’ home countries refuse to cover these expenses or the foreigners’ home countries do not establish representative missions in Vietnam.
If competent authority declares epidemic, fee collectors are allowed to decide on covering the expenses above and expenses serving epidemic management for the purpose of dealing with foreigners violating the law.
- Providing training and advanced training for officials and soldiers working in immigration management.

- Negotiating, cooperating with foreign partners in issuing visas and documents relating to Vietnam entry and exit for foreigners.
- Improving income and livelihood of officials and soldiers working in immigration management according to regulations of the Ministry of Public Security, Ministry of National Defense, and applicable regulations and law (if any).
b) Fee collectors shall submit 75% of collected fees to state budget under chapter, sub-chapter of applicable content of state budget”.

Article 2. Entry into force
1. Clause 1 Article 1 hereof enters into force from November 18, 2023. Clause 2 Article 1 hereof enters into force from October 3, 2023.
2. If legislative documents referred to under this Circular are amended or replaced, the new versions shall prevail.
3. Difficulties that arise during the implementation of this Circular should be reported to the Ministry for consideration./.
