DECISION
PROMULGATING REGULATION ON ORGANIZATION AND OPERATION OF THE NATIONAL TUBERCULOSIS ELIMINATION COMMITTEE
CHAIRMAN OF THE NATIONAL TUBERCULOSIS ELIMINATION COMMITTEE
Pursuant to the Law on organization of Government dated June 19, 2015;
Pursuant to the Decision No. 34/2007/QD-TTg dated March 12, 2007 of the Prime Minister on promulgation of Regulation on establishment, organization and operation of interdisciplinary cooperation organizations;
Pursuant to the Decision No. 1745/QD-TTg dated December 04, 2019 of the Prime Minister on establishment of the National Tuberculosis Elimination Committee;
At the request of the Minister of Health;
HEREBY DECIDES:
Article 1. Regulation on organization and operation of the National Tuberculosis Elimination Committee (hereinafter referred to as the “National Committee 45”) is issued together with this Decision.
Article 2. This Decision comes into force from the day on which it is signed.
Article 3. Deputy Chairmen and members of the National Tuberculosis Elimination Committee, Ministers, heads of ministerial agencies, heads of Governmental agencies, and Chairpersons of people’s committees of central-affiliated cities and provinces are responsible for the implementation of this Decision./.

REGULATION
ON ORGANIZATION AND OPERATION OF THE NATIONAL TUBERCULOSIS ELIMINATION COMMITTEE
(Enclosed with the Decision No. 294/QD-UBQG45 dated December 25, 2019 of the Chairman of the National Tuberculosis Elimination Committee)
Chapter I
GENERAL PROVISIONS
Article 1. The National Committee 45 is an interdisciplinary cooperation organization in charge of assisting the Prime Minister in directing, expediting, coordinating and instructing relevant ministries and regulatory authorities to prevent and control tuberculosis with the aim of eliminating tuberculosis in 2030, and contributing to protection, caring and improvement of human health.
The National Committee 45 and its members shall perform their duties according to this Regulation and relevant laws.
Article 2. The National Committee 45 operates and works according to democracy principles. Members of the National Committee 45 shall work under the dual office-holding regime, engage in all operations of the National Committee 45 and assume responsibility before the Chairman of the National Committee 45 for their assigned duties.
Article 3. Chairman of the National Committee 45 shall use the seal of the Government; Deputy Chairmen and Members of the National Committee 45 shall use the seals of authorities/organizations where they are working during their performance of assigned duties.
Chapter II
RESPONSIBILITIES AND POWERS OF MEMBERS OF THE NATIONAL COMMITTEE 45
Article 4. Chairman of the National Committee 45
1. Lead and manage operations of the National Committee 45; assign specific duties to each member of the National Committee 45.
2. Take charge and draw conclusions at the meetings of the National Committee 45 in order to effectively implement tuberculosis (TB) prevention and control policies and projects/schemes of the National Action Program for TB Prevention and Control in each period.
3. Make decisions on matters within the scope of functions, duties and powers of the National Committee 45.
Article 5. Standing Deputy Chairman of National Committee 45
1. Act on behalf of the Chairman of the National Committee 45 to take charge of and coordinate joint activities of the National Committee 45 upon authorization of the Chairman of the National Committee 45.
2. Assist the Chairman of the National Committee 45 to directly coordinate activities of the National Committee 45 for implementing policies, schemes and/or plans of the National Action Program for TB Prevention and Control in each period.
3. Provide advice for the Chairman of the National Committee 45 about directing ministries, regulatory authorities and organizations to suggest policies/mechanisms on TB prevention and control to the Government and the Prime Minister.
4. Inspect and report the cooperation between ministries, regulatory authorities, local governments and relevant organizations in performing TB prevention and control duties to the Chairman of the National Committee 45.
5. Handle regular activities of the National Committee 45 according to the authorization of the Chairman of the National Committee 45.
6. Actively cooperate in handling any matters within the managing scope of other Deputy Chairmen. Any unsolved matters must be reported to the Chairman of the National Committee 45.
Article 6. Deputy Chairwoman of the National Committee 45
1. Cooperate with Members of the National Committee 45, ministries, regulatory authorities and members of Vietnamese Fatherland Front to formulate interdisciplinary programs/plans for performing activities/methods for disseminating information on TB prevention and control from central to local government, especially grassroots authorities and residential areas.
2. Combine activities between sectors/fields, socioeconomic programs and movements/campaigns launched by the Central Committee of Vietnamese Fatherland Front and its members.
3. Prepare thematic/consolidated reports on TB prevention and control campaigns launched by Vietnamese Fatherland Front and its members.
Article 7. Members of the National Committee 45
1. Provide advice to the Chairman of the National Committee 45 about formulating work programs and activities for performing TB prevention and control duties within the management scope of the National Committee 45.
2. Direct and organize TB prevention and control activities within the ambit of their assigned functions and duties.
3. Participate in all activities of the National Committee 45 and report on their assigned duties. On the basis of every 6 months (by June 30) and annual basis (by December 31), submit reports to the Chairman of the National Committee 45 on progress and results of activities under the management of ministries and regulatory authorities.
Article 8. Secretarial member of the National Committee 45
1. Take charge of the assisting apparatus shared with the National Committee for AIDS, Drugs and Prostitution Prevention and Control.
2. Assist the Chairman of the National Committee 45 to formulate and organize the implementation of work programs/plans and annual inspection plans of the National Committee 45; make preliminary report and assessment of performance/implementation of TB elimination duties/solutions. Monitor, expedite and submit reports to the Chairman of the National Committee 45 on the implementation of programs/plans of the National Committee 45 and conclusions/directives given by the Chairman.
3. Assist the Chairman of the National Committee 45 to act as the contact point in preparing for meetings and activities of the National Committee 45; coordinate, expedite and organize the implementation of as well as inspect the performance of advisory duties on TB elimination policies, strategies and/or mechanisms.
4. Perform other duties as assigned by the Chairman of the National Committee 45.
Chapter III
WORKING REGIME AND RELATIONSHIP
Article 9. Working regime
1. The working regime of the National Committee 45 emphasizes the role of its head through regular and extraordinary meetings chaired by its Chairman or its Standing Deputy Chairman when authorized.
2. Members of the National Committee 45 work under the dual office-holding regime and receive benefits decided by its Chairman in accordance with relevant laws.
3. In case a member of the National Committee 45 goes on a business trip or attends a training course for 06 months or longer or there is any changes in personnel, his/her supervisory authority shall submit a report thereof to the Chairman of the National Committee 45 and appoint a substitute for that member.
4. The National Committee 45 shares the same assisting apparatus with the National Committee for AIDS, Drugs and Prostitution Prevention and Control in formulating its work programs/plans and regulating/cooperating in inspecting and expediting the performance of duties by ministries, regulatory authorities and local governments; preparing consolidated reports on TB prevention and control duties.
5. The Ministry of Health shall act as the standing body of the National Committee 45 – Standing Deputy Chairman of the National Committee 45 shall ensure working conditions for the National Committee 45, decide the use of the assisting office of the National TB Control Program located at the Central Lung Hospital affiliated to the Ministry of Health and other existing affiliated units of the Ministry of Health for performing duties assigned by the Chairman of the National Committee 45.
6. Member of the National Committee 45 - Manager of National Tuberculosis Control Program - Director of National Lung Hospital - Chief of Office of the National Committee 45 shall closely cooperate with other members and assisting apparatus of the National Committee 45 in proposing action programs/plans, submitting periodical or ad hoc reports on TB prevention and control status, doing research on professional/ technical solutions for effectively eliminating TB in 2030 and reporting results thereof to the Chairman of the National Committee 45.
Article 10. Meeting regime
1. The National Committee 45 shall meet every 06 months. The Chairman of the National Committee 45 may convene extraordinary meetings when necessary.
2. The Chairman of the National Committee 45 decides to invite other relevant organizations and individuals to its meetings.
3. Contents, time and location of a meeting of the National Committee 45 must be notified in writing (enclosed with relevant documents) at least 05 days in advance. Members of the National Committee 45 and individuals invited to the meeting shall examine provided documents, prepare ideas to be contributed at the meeting and arrange time for attending all meetings of the National Committee 45.
In case members of the National Committee 45 need to ask for opinions but cannot convene a meeting, they shall send written request for opinions to the Office of the National Committee 45.
4. Conclusions of the Chairman or Deputy Chairman (if authorized at meetings) of the National Committee 45 shall be drawn as written notifications of the Office of the Government.
Article 11. Funding for covering operational expenses of the National Committee 45 is included in funding for operational recurrent expenditures of the Ministry of Health and other lawful funding sources (if any).
Chapter IV
IMPLEMENTATION PROVISIONS
Article 12. Members of the National Committee 45 shall closely cooperate with relevant ministries, regulatory authorities, local governments and relevant organizations during the performance of TB prevention and control duties.
Ministers, heads of ministerial agencies, heads of Governmental agencies, and Chairpersons of people’s committees of central-affiliated cities and provinces are responsible for facilitating the instruction, inspection and performance of TB prevention and control duties by the National Committee 45.
