MEMORANDUM

COOPERATION IN COPYRIGHTS AND RELEVANT RIGHTS BETWEEN THE COPYRIGHT OFFICE OF THE SOCIALIST REPUBLIC OF VIETNAM AND THE NATIONAL COPYRIGHT BUREAU OF THE PEOPLE’S REPUBLIC OF CHINA

The Copyright Office of the Socialist Republic of Vietnam and the National Copyright Bureau of the People’s Republic of China

- For the sake of cooperation, friendship and mutual understanding between the two countries;

- With the awareness of the importance of copyright and related rights in developing literature, arts and sciences;

- With the desire to lay the foundation for economic and cultural development and prosperity between the two countries through their cooperation in the field of copyright;

- With the awareness of the necessity to broaden the scope of cooperation in protecting copyrights and relevant rights;

Article 1. Targets and operation

1. To speed up the cooperation between the two countries in the field of copyright and relevant rights;

2. To promote the development of human resources in the field of copyright and relevant rights, including training and exchanging experts;

3. To enhance the exchange of information about copyright and relevant rights;

4. To boost the settlement of common issues relating to copyright and relevant rights between the two countries;

5. To strengthen mutual protection of copyright and relevant rights for the citizens of the two countries.

Article 2. Scope of cooperation

1. To exchange and popularize information and documents relating to copyright and relevant rights, including on the electronic information networks;

2. To develop human resources in the field of copyright and relevant rights, including the training of experts and specialists;

3. Through their visits, the two sides jointly study and exchange their experience;

4. To strengthen their mutual cooperation in copyright and relevant rights within the international scope;

5. To promote cooperation among non-government organizations of the two countries in the field of copyright and relevant rights.

Article 3. Interactions

1. Officials of the relevant government authorities of copyright and relevant rights of the two countries shall meet, interact and hold discussion during the cooperation between the two sides;

2. Every two years, the officials of the two sides shall visit each other.

Article 4. Implementation

1. This memorandum on cooperation shall not cause any dangers to the laws and interests of each side. Also, it shall not create any effect on the legal documents on copyright and relevant rights signed by the two sides or by several parties.

Article 5. Validity, amendment and completion

1. This memorandum shall come into effect when the two signatories inform each other about the implementation of the provisions in the Memorandum;

2. The two sides shall inform each other in writing in a prompt way as stipulated in Clause 1 of this Article in the Memorandum, no later than six (06) months after the day the two sides sign this Memorandum;

3. The two sides can amend this Memorandum through exchanging written documents.

This Memorandum is made in Ho Chi Minh City on 14 September 1998 in two copies of the same validity, one in Chinese and one in Vietnamese.
