CIRCULAR

PROMULGATING REGISTRATION FORMS OF COPYRIGHT AND RELATED RIGHTS

Pursuant to the Law on intellectual property dated November 29, 2005; the Law dated June 19, 2009 providing for amendments and supplements to a number of the Law on intellectual property;

Pursuant to the Government’s Decree No. 100/2006/ND-CP dated September 21, 2006 detailing and guiding the implementation of certain articles of the Civil Code, and the Law on intellectual property with respect to the copyright and related rights;

Pursuant to the Government’s Decree No. 85/2011/ND-CP dated September 20, 2011 providing for amendments and supplements to the Government’s Decree No. 100/2006/ND-CP dated September 21, 2006 detailing and guiding the implementation of certain articles of the Civil Code, and the Law on intellectual property with respect to the copyright and related rights;

Pursuant to the Government’s Decree No. 76/2013/ND-CP dated July 16, 2013 defining the functions, tasks, power and organizational structure of Ministry of Culture, Sports and Tourism;

At the request of Director of the Copyright Office of Vietnam,

Minister of Culture, Sports and Tourism promulgates a Circular to provide for registration forms of copyright and related rights.

Article 1. Scope

This Circular promulgates registration forms of copyright and related rights.

Article 2. Regulated entities

Agencies, organizations and individuals involved in the registration of copyright and related rights.

Article 3. Forms enclosed to this Circular

1. This Circular is enclosed with 04 forms with name and sign as below:

a) Declaration form for registration of copyright: Form No. 01;

b) Declaration form for registration of related rights: Form No. 02;

c) Copyright registration certificate: Form No. 03;

d) Related rights registration certificate: Form No. 04.

2. Forms mentioned in Points a, b, c and d Clause 1 of this Article must be printed in A4-size paper.

Article 4. Effect

This Circular takes effect as of August 15, 2016. Decision No. 88/2006/QD-BVHTT dated October 17, 2006 of Ministry of Culture and Information promulgating forms of declarations and certificates of copyright and related rights shall be annulled. Copyright registration certificates and related rights registration certificates which have been issued by using the forms promulgated under Decision No. 88/2006/QD-BVHTT are still in effect.

Article 5. Implementation

1. Agencies, organizations and individuals involved in the registration of copyright and related rights shall be responsible for the implementation of this Circular.

2. Difficulties that arise during the implementation of this Circular should be reported to the Ministry of Culture, Sports and Tourism for consideration./.
