AMENDMENTS TO CIRCULAR NO. 08/2021/TT-NHNN DATED JULY 6, 2021 OF THE GOVERNOR OF THE STATE BANK OF VIETNAM PRESCRIBING THE GRANT OF SPECIAL LOANS TO CREDIT INSTITUTIONS UNDER SPECIAL CONTROL

Pursuant to the Law on Credit Institutions dated June 16, 2010;

Pursuant to the Law on Amendments to the Law on Credit Institutions dated November 20, 2017;

Pursuant to Decree No. 16/2017/ND-CP dated February 17, 2017 of the Government on functions, duties, entitlements and organizational structure of the State Bank of Vietnam;

At the request of the Director of the Financial Policy Department;

The Governor of the State Bank of Vietnam hereby promulgates the Circular on amendments to Circular No. 08/2021/TT-NHNN dated July 6, 2021 of the Governor of the State Bank of Vietnam prescribing the grant of special loans to credit institutions under special control.

Article 1. Amendments to Circular No. 08/2021/TT-NHNN dated July 6, 2021 of the Governor of the State Bank of Vietnam prescribing the grant of special loans to credit institutions under special control

“d) A special loan with a preferential interest rate as low as 0% shall be granted to a commercial bank that is acquired before the effective date of the Law No. 17/2017/QH14 in accordance with regulations prescribed in Clause 2 Article 3 of the Law No. 17/2017/QH14;”.

2. Amendments to Clause 1 Article 5:

“1. With regard to the special loans specified in Points b, c, d, dd Clause 1, Point c Clause 2, Point c Clause 3, Point b Clause 4 Article 4 of this Circular, the loan amount, loan purposes, collateral, lending interest rate, loan term, debt repayment, interest exemption or reduction, settlement of special loans granted (including extension of special loan, interest rate on overdue principal amount) shall comply with the approved restructuring plan or transfer plan. With regard to the special loans specified in Point d Clause 1 Article 4 of this Circular, comply with regulations prescribed in Clause 2 Article 3 of the Law No. 17/2017/QH14.”.

Article 2. Replace and annul a number of phrases of Circular No. 08/2021/TT-NHNN dated July 6, 2021 of the Governor of the State Bank of Vietnam prescribing the grant of special loans to credit institutions under special control

1. Replace the phrase “Khi có nhu cầu vay đặc biệt theo quy định tại điểm b, c, d, đ khoản 1 Điều 4 Thông tư này” (When the credit institution under special control wishes to apply for special loan as prescribed in Points b, c, d, dd Clause 1 Article 4 of this Circular” with the phrase “Khi có nhu cầu vay đặc biệt theo quy định tại điểm b, c, đ khoản 1 Điều 4 Thông tư này” (When the credit institution under special control wishes to apply for special loan as prescribed in Points b, c, dd Clause 1 Article 4 of this Circular) in Clause 1 Article 17.

2. Replace the phrase “Đối với khoản vay đặc biệt quy định tại điểm b, c, d, đ khoản 1 Điều 4 Thông tư này” (With regard to the special loans specified in Points b, c, d, dd Clause 1 Article 4 of this Circular) with the phrase “Đối với khoản vay đặc biệt quy định tại điểm b, c, đ khoản 1 Điều 4 Thông tư này” (With regard to the special loans specified in Points b, c, dd Clause 1 Article 4 of this Circular) in Clause 1 Article 19.

3. Annul the phrase “quyết định của Thủ tướng Chính phủ,” (decision of the Prime Minister) in Clause 3 Article 5, Point dd Clause 1 Article 16, Article 17, Article 19, Clauses 2, 3 Article 23, and Clause 3 Article 24.

4. Annul the phrase “đã được Thủ tướng Chính phủ quyết định hoặc” (decided by the Prime Minister or) in Clause 3 Article 5, Point c Clause 2, Points c, d Clause 5 Article 16.
