DECISION
PAYMENT OF FINANCIAL SUPPORT TO UNIONISTS OR EMPLOYEES STRICKEN BY THE COVID-19 EPIDEMIC AND NATURAL DISASTERS IN 2020 ON 2021 VIETNAMESE TET HOLIDAY.
PRESIDIUM OF VIETNAM GENERAL FEDERATION OF LABOUR
- Pursuant to the 2012 Law on Trade Unions;
- Pursuant to the 2015 Law on State Budget;
- Pursuant to the 2018 Regulations of Vietnam Trade Union;
- Pursuant to the Decision No. 1610/QD-TLD dated October 22, 2019 of the Presidium of the General Confederation on adopting Regulations for principles of setting and allocating the 2020 trade union budget;
- Pursuant to the Decision No. 1636/QD-TLD dated November 26, 2020 of the Presidium of the Vietnam General Confederation of Labor, regarding Approval of the 2020 trade union budget;
- Pursuant to the Decision No. 1739/QD-TLD dated December 25, 2020 of the Presidium of the Vietnam General Confederation of Labor, regarding Approval of modification of the 2020 trade union budget;
- Pursuant to the Plan No.75/KH-TLD dated October 30, 2020 of the Presidium of the Vietnam General Confederation of Labor, regarding the implementation of welfare measures for unionists and employees on 2021 Vietnamese Tet holidays;
- Pursuant to the Notice No. 190/TB-TLD dated October 20, 2020 of the Presidium of the Vietnam General Federation of Labour regarding Conclusions relating to concerns discussed in the 16th Conference of the XIIth-tenure Presidium of the Vietnam General Confederation of Labour about the support package for unionists and employees on 2021 Vietnamese Tet holidays;
- Pursuant to the Notice No. 256/TB-TLD dated December 21, 2020 of the Vietnam General Federation of Labour regarding Conclusions relating to the proposal for the support package for unionists and employees on 2021 Vietnamese Tet holidays in the cross-functional update meeting of the standing Presidium of the Vietnam General Confederation of Labour;
- In the light of the request from the Department of Socio-economic, Emulation and Rewarding Policies, and the Department of Financial Affairs of the Vietnam General Federation of Labour;
HEREBY DECIDES
Article 1. Payment of the financial support package to unionists and employees stricken by the Covid-19 epidemic and natural disasters in 2020 on 2021 Vietnamese Tet holidays.
1. Funding sources
1.1. The support package is funded by accumulated amounts available at the Confederations of Labor of provinces and cities; Trade Unions of central authorities and equivalents; Trade Unions of Corporations or General Companies directly controlled by the Vietnam General Confederation of Labor and grassroots-level directly superior trade unions. The maximum payment of these amounts shall not exceed 50% of provisional or contingency funds according to the decision on allocation of the 2020 budget of the Presidium of the Vietnam General Confederation of Labor (i.e. the remaining amount of funds as part of the support package prescribed in the Decision No. 643/QD-TLD dated May 22, 2020 of the Presidium of the Vietnam General Confederation of Labour, regarding support for unionists and employees afflicted with the Covid-19 disease).
1.2. Vietnam General Confederation of Labor shall consider providing financial support for Confederations of Labor in provinces and cities; Trade Unions of central authorities and equivalents; Trade Unions of Corporations or General Companies directly controlled by the Vietnam General Confederation of Labour if any of them has no fund in hand and needs more funds to compensate for last year’s budget deficits.
2. Qualified beneficiaries:
Unionists and employees working for enterprises, agencies and units severely afflicted with the Covid-19 epidemic and natural disasters occurring in 2020.
3. Support criteria
- If unionists or employees work for enterprises, agencies or units for at least 01 year (till December 31, 2020), in order to be entitled to the support package, they must follow the guidelines about eligibility criteria mentioned hereunder:
3.1. They themselves or their spouses, children or parents (whom beneficiaries are living with and directly looking after) have fatal diseases; They themselves are the disabled or suffer from accidents at workplace or occupational diseases, and are receiving monthly benefits.
3.2. They work for enterprises facing difficulties due to the Covid-19 epidemic to the extent that these enterprises have to close their business, they are out of work, take turns to get days-off or work at wide intervals, and earn an unstable amount of income in 2020 which equals not more than 03 million dong/month on average.
3.3. They have had to stop working at educational institutions for at least 1.5 month due to the Covid-19 disease and natural disasters in 2020 to the extent that living standards and income of theirs and their families are adversely affected.
3.4. They are in difficult situation, work at agencies, units or localities that are badly affected by natural disasters occurring in 2020.
3.5. They face difficulties while being pregnant or taking care of their infants aged under 24 months, and earning an average amount of monthly income less than the region-specific statutory minimum pay.
- After taking into consideration the aforesaid criteria, based on the number of unionists, public servants, employees and workers; support from local authorities; and accumulated funds of their subordinate units, Confederations of Labor of cities and provinces, Trade Unions of central authorities and equivalents, and Trade Unions of Corporations or General Companies directly controlled by the Vietnam General Confederation of Labor, may supplement or concretize criteria according to the motto in which priority is given to those facing the most severe hardship or directly hit by the Covid-19 disease and natural disasters in 2020.
Unionists, employees already receiving support under the Decision No. 643/QD-TLD dated May 22, 2020 of the Presidium of the Vietnam General Confederation of Labor, regarding support for unionist, employees stricken by the Covid-19 disease shall not be entitled to the support package as per this Decision. In case where they remain in extremely difficult situation after having already received support under the Decision No. 643/QD-TLD dated May 22, 2020 of the Presidium of the Vietnam General Confederation of Labor, trade unions at all levels must conduct careful examination and continue to give the support sum stated in paragraph 4.2 herein.
4. Support sums:
4.1. Monetary support: The sum of financial support is VND 1,000,000 (one million Vietnamese dong)/person.
4.2. If any unionist or employee is in extremely difficult situation, severely affected by the Covid-19, natural disasters, the maximum support sum shall be VND 2,000,000 (two million Vietnamese dong)/person.
The number of persons given a special treat stated in paragraph 4.2 must not exceed 20% of total number of unionists and employees eligible for the support package.
4.3. Each beneficiary may receive the support package from only one trade union.
Article 2. Implementation
1. The Standing Committees of the Labor Confederations of provinces and cities; Trade Unions of central authorities and equivalents; Trade Unions of Corporations or General Companies directly controlled by the Vietnam General Confederation of Labor:
1.1. Based on the above-stated guidelines about support criteria, conducting surveys and examinations of the local or sectoral situations to supplement and concretize the criteria where appropriate; selecting qualified persons, compiling, reviewing and approving the list of qualified persons according to the principles of right beneficiaries and conformance to the prescribed criteria.
1.2. Implementing the simple and warm procedures for payment of the support package to unionists and employees, ensuring for the convenience of qualified unionists and employees. At each local authority, a solemn gathering place may be arranged for public propaganda and communication purposes.
1.3. Regularly sending communication, progress and review reports on the implementation of the support package to the Vietnam General Confederation of Labor (via the Department of Socio-economic, Emulation and Rewarding Policies, concerning criteria and qualified beneficiaries; via the Department of Financial Affairs, concerning payment sources and procedures). Being held accountable to the Vietnam General Confederation of Labor for recommending and implementing criteria; duly paying the support package to correct beneficiaries without causing any loss or extravagance. Ensuring that all unionists and employees have access to the support package by February 5, 2021.
2. Departments controlled by the Vietnam General Confederation of Labor shall, within their duties and powers, perform the following tasks:
2.1. The Department of Socio-economic, Emulation and Rewarding Policies shall cooperate with the Department of Financial Affairs under the control of the Vietnam General Confederation of Labor in supervising, urging and guiding the provincial Confederations of Labor; Trade Unions of central authorities and equivalents; Trade Unions of Corporations or General Companies directly controlled by the Vietnam General Confederation of Labor, in implementing this Decision.
2.2. The Department of Financial Affairs must guide, supervise and urge the Labor Confederations of provinces and cities; Trade Unions of central authorities and equivalents; Trade Unions of Corporations or General Companies directly controlled by the Vietnam General Confederation of Labor so that they follow the budget and pay the support package in accordance with regulations. The payment of the support package must occur within the fiscal period of 2021 and must be recorded into the social activity entry (31.11).
Cooperating with the Department of Socio-economic, Emulation and Rewarding Policies in giving counsels on providing financial support for units that have no fund in hand and need more funds to compensate for last year’s budget deficits.
2.3. The Propaganda Department of the Vietnam General Confederation of Labor: Directing communication agencies of trade unions at all levels and cooperating with central and local media agencies to strengthen propaganda and communication about welfare measures applied to unionists and employees during 2021 Vietnamese Tet holidays, especially implementing the support for unionists and employees during Vietnamese Tet holidays as per this Decision.
The Inspection Committee of the Vietnam General Confederation of Labor shall guide the Inspection Committees at all levels to inspect and supervise the implementation of this Decision and send inspection and supervision reports to the Vietnam General Confederation of Labor within the 1st quarter of 2021.
3. Organizations and individuals shall be strictly forbidden from committing acts of abusing the support policy prescribed herein to gain personal benefits. In case where there is any violation, based on the nature and extent of violation, violating entities and persons shall be disciplined or subject to administrative penalties or the criminal prosecution process under law.
Article 3. This Decision shall enter into force as of the signature date.
The Department of Financial Affairs; the Department of Socio-economic, Emulation and Rewarding Policies; the Department of Labor Relations; the Propaganda Department; the Inspection Committee; the Office of the Vietnam General Confederation of Labor; Labor Confederations of provinces and cities; Trade Unions of central authorities and equivalents; Trade Unions of Corporations or General Companies directly controlled by the Vietnam General Confederation of Labor; and other units concerned, shall be responsible for implementing this Decision./.
