THE LAW

MODIFICATIONS AND SUPPLEMENTS OF THE LAW OF MILITARY OBLIGATIONS

At the proposal of the Government Council, the following amendments and supplements are now provided to the Law on Military Service of April 15, 1960, which was amended and supplemented for the first time by the Law of October 26, 1960. 1962.

Article 1: To amend articles 8 and 10 of the Law on Military Service and replace them with the following (new) articles :

1. Article 8 (new) - Soldiers who are serving under the voluntary regime will gradually be enlisted and transferred to the reserve, or discharged from military service. However, in order to meet special requirements on army building and combat, the Ministry of Defense is allowed to implement a volunteering regime for some non-commissioned officers and soldiers.

2. Article 10 (new) - The term of active service of non-commissioned officers and soldiers in the army is 4 years.

Term of active service of non-commissioned officers and soldiers in the air defense - air force, non-commissioned officers and soldiers in the navy, technical non-commissioned officers and technical soldiers in the land army army is 5 years.

The duration of active service of non-commissioned officers and soldiers of the technical services in the People's Armed Police is the same as the duration of active service of the armed services and branches in the People's Army.

In case of necessity, the Minister of National Defense and the Minister of Public Security may extend the active service period of soldiers under their authority; each extension of the service life must not exceed 1 year.

Article 2: Now supplemented with Article 34b of the Law on Military Service and Article 34c as follows:

Article 34c - In peacetime, when there is an urgent situation but no mobilization order is required, in order to promptly strengthen the armed forces and ensure the armed forces are ready to fight, according to the decision of the Association. Council of the Government, the Minister of National Defense has the right to call a number of discharged servicemen, a number of cadres, male and female workers, and technical staff to serve in the army.

This Law was passed by the 3rd National Assembly of the Democratic Republic of Vietnam, 2nd session, on April 10, 1965.
