DECISION
APPROVING SCHEME FOR IMPLEMENTING REGULATIONS OF THE INTERNATIONAL CONVENTION ON STANDARDS OF TRAINING, CERTIFICATION AND WATCHKEEPING FOR SEAFARERS 1978, AS AMENDED IN 2010
THE PRIME MINISTER
Pursuant to the Law on government organization dated December 25, 2001;
Pursuant to the International Convention on Standards of Training, Certification and Watchkeeping for Seafarers in 1978, as amended in 2010;
Pursuant to the Maritime Code of Vietnam dated June 14, 2005;
At the request of the Minister of Transport;
HEREBY DECIDES:
Article 1. The Scheme for implementing regulations of the International convention on standards of training, certification and watchkeeping for seafarers 1978, as amended in 2010 (hereinafter referred to as “STCW 78/2010 Convention”), which includes the following contents, is hereby given approval.
I. OBJECTIVES
1. General objectives:
a) Fully and comprehensively implement regulations of the STCW 78/2010 Convention to which Vietnam is a signatory; keep the name of Vietnam on the White List of International Maritime Organization (IMO);
b) Establish the network of maritime education and training institutions that meet mandatory standards set forth in the STCW 78/2010 Convention; develop maritime personnel competencies and skills so as to achieve objectives of the Resolution on Vietnam's marine strategy by 2020;
c) Implement contents and orientations towards maritime human resource development by 2020 according to the approved plan for development of Vietnam’s sea transport by 2020 with orientations by 2030.
2. Specific objectives:
a) In 2013 – 2015 period:
- Improve and perfect the system of domestic legislative documents in order to adequately and comprehensively implement regulations and standards of the STCW 78/2010 Convention;
- Make investments in construction and upgrade of material and technical facilities which must meet relevant standards set forth in the STCW 78/2010 Convention so as to improve the capacity for providing maritime training programs of training institutions, including the provision of training models and the acquisition of equipment, tools and instruments to provide training programs that satisfy mandatory standards set forth in the STCW 78/2010 Convention;
- Reform the mechanism for management, training, testing and evaluation adopted by training institutions with the aims of improving competencies and skills of Vietnamese seafarers serving on domestic or foreign ships;
- Establish framework programs and training programs in both Vietnamese and English; compile syllabuses and prepare teaching materials which need to meet STCW 78/2010 standards for application nationwide;
- Provide training courses to improve knowledge and capacity of lecturers and instructors in conformity with STCW 78/2010 standards;
- Ensure that seafarers, upon their completion of training programs, shall meet regional and international standards for seafarers as well as satisfy quality requirements set forth in the STCW 78/2010 Convention; prioritize the training in highly skilled officers and seafarers for export.
b) Organize the application of amended regulations of the STCW 78/2010 Convention to seafarers attending training courses in Vietnam from July 01, 2013;
c) Ensure the adequate and proper compliance with regulations of the STCW 78/2010 Convention by 2016.
II. TASKS AND SOLUTIONS
1. Review, amend and supplement Vietnam’s laws on training, certification and watchkeeping for seafarers on the basis of STCW 78/2010 regulations, including:
a) Perfect regulations on training, watchkeeping, standards for medical health and certification for seafarers; policies on hours of work and rest of seafarers; regulations on ranks and rank-based duties of seafarers, and registration of seafarers working on board Vietnamese seagoing ships in conformity with requirements set in the STCW 78/2010 Convention;
b) Perfect ISO quality management system for managing seafarers training quality by regulatory authorities and training institutions;
c) Perfect regulations on licensing seafarers training activities so as to process applications for license to provide training programs for seafarers.
2. Perfect training programs and courses in conformity with standards of the STCW 78/2010 Convention, including:
a) Formulate new training programs for seafarers or amend the current ones to meet standards of the STCW 78/2010 Convention for uniform application nationwide;
b) Perfect sets of exam questions and answers in both professional knowledge and English to test competency of maritime officers nationwide;
c) Organize translation of IMO Model courses into Vietnamese for using as the basis for compiling teaching materials; translation of training programs and teaching materials from Vietnamese into English.
3. Provide training courses to improve knowledge, skills and capacity of senior lecturers and instructors in conformity with STCW 78/2010 standards in the following forms:
a) Appoint them to attend domestic and overseas training courses;
b) Invite experts working for IMO and experienced lecturers of foreign seafarers training institutions to teach certain training courses in Vietnam.
4. Invest in construction and upgrade of material facilities of seafarers training institutions to meet standards of the STCW 78/2010 Convention, including:
a) Invest in acquisition of syllabuses, reference materials and model courses of IMO;
b) Invest in acquisition and upgrade of equipment serving training for seafarers.
III. PROGRAMS AND PROJECTS
The list of programs and projects is available in the Appendix enclosed herewith.
IV. FUNDING FOR IMPLEMENTATION
1. Funding for implementing the Scheme shall be determined and allocated to each specific program or project in accordance with applicable law regulations.
2. Sources of funding: Funds derived from state budget, revenues of training institutions and other legal funding sources as prescribed by law.
V. RESPONSIBILITY FOR IMPLEMENTATION
1. The Ministry of Transport shall:
a) take charge and cooperate with relevant Ministries and authorities to organize the implementation of the Scheme within its competence;
b) prepare and submit reports to the International Maritime Organization (IMO) on compliance and application of regulations of the STCW 78/2010 Convention in Vietnam;
c) instruct and inspect the application of regulations of the STCW 78/2010 Convention in Vietnam, and report on issues beyond its capacity to the Prime Minister for consideration.
2. The Ministry of Finance shall:
- Take charge and cooperate with the Ministry of Transport, and relevant Ministries and authorities to formulate and organize the implementation of financial mechanism and regulations on collection, management and use of legitimate fees and charges relating seafarers training;
- Take charge and cooperate with the Ministry of Planning and Investment, the Ministry of Transport and relevant authorities to prioritize allocation of funds for implementing the Scheme.
3. The Ministry of Health shall:
Take charge and cooperate with the Ministry of Transport, and relevant authorities to perfect regulations on standards of medical health of seafarers working on board ships.
4. Seafarers training institutions shall:
Proactively formulate detailed plans for implementing the Scheme according to assignment by the Minister of Transport in conformity with the Scheme's contents; prepare and provide necessary conditions and facilities for seafarers training courses in accordance with regulations of the STCW 78/2010 Convention.
5. Owners of Vietnamese-flagged ships shall:
a) Cooperate with the Ministry of Transport to disseminate regulations of the STCW 78/2010 Convention to Vietnamese seafarers working on board ships:
b) Formulate plans for appointing seafarers to attend training courses or programs in accordance with regulations of the STCW 78/2010 Convention;
c) Formulate training programs which are conducted on board ships under their management and operation in accordance with regulations of the STCW 78/2010 Convention.
6. Seafarers shall attend and complete training courses provided by seafarers training institutions as regulated.
Article 2. This Decision comes into force as from the date on which it is signed.
Article 3. Ministers, Heads of ministerial-level agencies, Heads of Government’s agencies, Chairpersons of People’s Committees of central-affiliated provinces and cities, seafarers training institutions in Vietnam, and relevant organizations and individuals shall implement this Decision.
