CIRCULAR
PROVIDING FOR INSPECTION OF TECHNICAL SAFETY QUALITY AND ENVIRONMENTAL PROTECTION FOR RAILWAY VEHICLES
Pursuant to the Law on Railway Transport No. 06/2017/QH14 dated June 16, 2017;
Pursuant to the Law on Quality of Products and Goods No. 05/2007/QH12 dated November 21, 2007;

Chapter I
GENERAL
Article 1. Scope
1. This Circular provides for inspection and certification of technical safety quality and environmental protection for components of railway vehicles and railway vehicles during inspection of manufacture, assembly, import and modification and periodic inspection for operation on national railway, urban railways, specialized railways connected to the national railway and specialized railways not connected to the national railway passing through populated areas and intersecting with roads.
2. This Circular does not apply to components of railway vehicles fitted on completely built-up (CBU) railway vehicles
Article 2. Regulated entities
This Circular applies to organizations and individuals involved in import, manufacture, assembly, modification, periodic repair and operation of components of railway vehicles and railway vehicles operating on railway systems and organizations involved in management, testing and issuance of certificates of technical safety quality and environmental protection for components of railway vehicles and railway vehicles specified in Article 1 of this Circular.

2. “importer” refers to an enterprise having operations including the import of components of railway vehicles and railway vehicles as prescribed by law.
3. “repairing workshop” refers to an enterprise having operations including the modification and repair of components of railway vehicles and railway vehicles as prescribed by law.
4. “urban railway car” refers to a passenger vehicle operating on urban railways.
5. “special-purpose vehicle moving on rail tracks” (hereinafter referred to as “special-purpose vehicle”) refers to a vehicle used to transport persons, supplies and equipment to serve the purposes of relief; rescue in the event of railway accidents; inspection, construction, maintenance and repair of railway works.
6. “ components of railway vehicle” (hereinafter referred to as “components”) include bogies, locomotive distributing valves, car break valves, couplers, compressors, end of train devices and wheel-sets.
7. “certificate of technical safety quality and environmental protection” (hereinafter referred to as “the Certificate”) refers to a document certifying that a component or railway vehicle has undergone inspection in accordance with corresponding standards and technical regulations on technical safety quality and environmental protection.
8. “technical safety quality and environmental protection inspection stamp” (hereinafter referred to as “inspection stamp”) refers to a stamp issued to a railway vehicle for which technical safety quality and environmental protection have been certified.
9. “inspecting authority” is Vietnam Register affiliated to the Ministry of Transport, performing the tasks of inspecting and certifying technical safety quality and environmental protection for components of railway vehicles and railway vehicles.

Article 4. Types of inspection
Types of inspection of technical safety quality and environmental protection shall consist of:
1. Inspection of manufacture and assembly.
2. Inspection of import.
3. Inspection of modification.
4. Periodic inspection.
Article 5. Inspection of manufacture and assembly
1. The inspection of manufacture and assembly shall be intended for brand new manufactured and assembled components and vehicles.
2. Inspection conditions: the manufacturer shall prepare the component or vehicle and enable the inspecting authority to carry out inspection in accordance with corresponding national technical regulations.

4. Inspection methods:
a) Inspect each component or vehicle;
b) Regarding urban railway cars, inspect each car in its static state and its operation on rail tracks when assembled into a train according to the operation configuration;
c) Regarding wheel-sets, inspect representative sample of each lot of wheel-sets.
Article 6. Import inspection
1. The inspection of import shall be intended for brand new imported components and vehicles; used imported vehicles.
2. Inspection conditions: the manufacturing facility shall prepare the component or vehicle and enable the inspecting authority to carry out inspection in accordance with corresponding national technical regulations.
3. Inspected items are those covered by the inspecting authority and specified in corresponding national technical regulations applicable to each type of component or vehicle. Regarding end of train devices, the inspected items are provided in the Appendix I to this Circular.
4. Inspection methods:

b) Regarding urban railway cars, inspect each car in its static state and its operation on rail tracks when assembled into a train according to the operation configuration;
c) Regarding wheel-sets, inspect representative sample of each lot of wheel-sets.
Article 7. Modification inspection
1. The inspection of modification shall be intended for vehicles moving on the national railway and vehicles moving on specialized railways in case of change of one of the following details:
a) Braking leverage ratio, type of brake cylinder of the vehicle; main load-bearing parts of the vehicle’s body steel structure including end sills, draft sills, main cross bearers, center sills, cross sills, side sills (except for reinforcement aimed at increasing rigidity) which differ from their original design or from those in the latest modification inspection documentation;
b) Functions and uses of a vehicle resulting in the change of the layout and installation of other vehicle’s equipment which differ from those most recently registered;
c) Type of diesel engine (locomotive), traction motors, locomotive main generators, air compressors, hydraulic actuators, bogies, couplers, distributing valves, brake valves installed on vehicles which differ from those most recently registered.
2. Inspection conditions: the repairing workshop shall prepare the vehicle and enable the inspecting authority to carry out inspection in accordance with corresponding national technical regulations applicable to the modified items of each vehicle.
3. Inspected items: vehicle’s modified items shall be inspected under corresponding national technical regulations.

Article 8. Periodic inspection
1. The periodic inspection shall be intended for vehicles moving on the national railway, vehicles moving on specialized railways and vehicles moving on urban railways; end of train devices.
2. Inspection conditions: the manufacturer, owner or operator of the vehicles shall prepare the component or vehicle and enable the inspecting authority to carry out inspection in accordance with corresponding national technical regulations.
3. Inspected items are those covered by the inspecting authority and specified in corresponding national technical regulations applicable to each type of vehicle. Regarding end of train devices, the inspected items are provided in the Appendix I to this Circular.
4. Inspection methods:
a) Inspect each component or vehicle;
b) Regarding urban railway cars, inspect each car in its static state and its operation on rail tracks when assembled into a train according to the operation configuration.
5. Frequency of periodic inspection
a) The periodic inspection frequency is specified in the Appendix II to this Circular;

Chapter III
PROCEDURES FOR ISSUANCE, RE-ISSUANCE AND USE OF CERTIFICATES AND INSPECTION STAMPS
Article 9. Certificate
1. Regarding physical documents: The Certificate shall have 4 copies, one for retention (in case of import, manufacture, assembly, modification), one for circulation and one for following customs procedures (in case of import) and one for vehicle registration (in case of import, manufacture, assembly, modification).
2. Regarding electronic documents, the physical Certificate shall be issued in case the related authority has yet to connect electronic data to the inspecting authority.
Article 10. Application for inspection
An application for inspection consists of:
1. An application form, which is made using the form provided in the Appendix III to this Circular.
2. An inspection report or testing report in accordance with corresponding national technical regulations (original or legally valid copy or legally valid electronic copy) accompanied by a photo clearly showing vehicle number and overall appearance of the component or vehicle.

Article 11. Issuance of the Certificate and inspection stamp in case of inspection of manufacture and assembly
1. The manufacturer shall prepare 01 application for inspection as prescribed in Article 10 of this Circular and submit it to the inspecting authority, whether in person or by post or via public service portal.
2. The inspecting authority shall receive and inspect composition of the application for inspection and instruct the manufacturer to complete the application (if the application is inadequate) within one (01) working day or within ten (10) working days in the case of urban railway cars.
3. The inspecting authority shall verify the conformity of the application for inspection with the corresponding national technical regulation within five (05) working days or within thirty (30) working days in the case of urban railway cars.
a) If the application for inspection is valid, the inspecting authority shall send a notice of site inspection time according to the form specified in the Appendix V to this Circular;
b) If the application for inspection is invalid, the inspecting authority shall send a notice of application completion according to the form specified in the Appendix VI to this Circular; The processing time limit shall reset after the inspecting authority receives a sufficient application for inspection.
4. The inspecting authority shall carry out a site inspection of the component or vehicle in accordance with the corresponding national technical regulation.
a) In case the component or vehicle and the application for inspection conform to the corresponding national technical regulation, the inspecting authority shall initiate the procedures for issuing the Certificate as prescribed in point a clause 5 of this Article;
b) In case the component, vehicle or application for inspection fails to conform to the corresponding national technical regulation.

If the manufacturer fails to take corrective actions within ten (10) working days from the date on which the inspecting authority sends the corrective action notice, it will be assessed as failed.
5. Issuance of the Certificate/notice of failure and inspection stamp
a) Within three (03) working days from the end of the inspection and submission of a sufficient application as prescribed, the inspecting authority shall issue the Certificate (physical and/or electronic copy) to each component, lot of wheel-sets or vehicle according to the Appendix VII to this Circular, and at the same time issue the inspection stamp to the vehicle according to the form specified in the Appendix VIII to this Circular;
b) If the result is failed, within one (01) working day from the date of receiving the failed result, the inspecting authority shall issue a notice of failure to each component, lot of wheel-sets or vehicle according to the Appendix X to this Circular.
Article 12. Issuance of the Certificate and inspection stamp in case of inspection of import
1. The importer shall prepare 01 application for inspection as prescribed in Article 10 of this Circular and submit it to the inspecting authority, whether in person or by post or via public service portal.
2. The inspecting authority shall receive and inspect composition of the application for inspection and instruct the importer to complete the application (if the application is inadequate) within one (01) working day or within ten (10) working days in the case of urban railway cars.
3. The inspecting authority shall verify the conformity of the application for inspection with the corresponding national technical regulation within five (05) working days or within thirty (30) working days in the case of urban railway cars.
a) If the application for inspection is valid, the inspecting authority shall send a notice of site inspection time according to the form specified in the Appendix V to this Circular;

4. The inspecting authority shall carry out a site inspection of the component or vehicle in accordance with the corresponding national technical regulation.
a) In case the component or vehicle and the application for inspection conform to the corresponding national technical regulation, the inspecting authority shall initiate the procedures for issuing the Certificate as prescribed in point a clause 5 of this Article;
b) In case the component, vehicle or application for inspection fails to conform to the corresponding national technical regulation.
Within three (03) working days from the end of the inspection, the inspecting authority shall send a corrective action notice according to the form specified in the Appendix IX to this Circular. The importer is permitted to take corrective actions no more than once (except for urban railway cars).
If the importer fails to take corrective actions within ten (10) working days from the date on which the inspecting authority sends the corrective action notice, it will be assessed as failed.
Regarding urban railway cars, if, within sixty (60) days from the date on which the inspecting authority sends the corrective action report, the importer fails to complete its corrective actions without issuing a document stating the reason for its failure to complete corrective actions and the new time limit for taking corrective actions, it will be assessed as failed.
5. Issuance of the Certificate/notice of failure and inspection stamp
a) Within three (03) working days from the end of the inspection and submission of a sufficient application as prescribed, the inspecting authority shall issue the Certificate (physical and/or electronic copy) to each component, lot of wheel-sets or vehicle according to the Appendix VII to this Circular, and at the same time issue the inspection stamp to the vehicle according to the form specified in the Appendix VIII to this Circular;
b) If the result is failed, within one (01) working day from the date of receiving the failed result, the inspecting authority shall issue a notice of failure to each component, lot of wheel-sets or vehicle according to the Appendix X to this Circular and to the customs authority as prescribed.

1. The repairing workshop shall prepare 01 application for inspection as prescribed in Article 10 of this Circular and submit it to the inspecting authority, whether in person or by post or via public service portal.
2. The inspecting authority shall receive and inspect composition of the application for inspection and instruct the repairing workshop to complete the application (if the application is inadequate) within one (01) working day.
3. The inspecting authority shall carry out a site inspection of the vehicle according to their modified items compared to those specified under the corresponding national technical regulation.
a) If the vehicle and the application for inspection conform to the corresponding national technical regulation, the inspecting authority shall initiate the procedures for issuing the Certificate as prescribed in point a clause 4 of this Article;
b) In case the vehicle or application for inspection fails to conform to the corresponding national technical regulation.
The repairing workshop is permitted to take corrective actions no more than once.
If the repairing workshop fails to take corrective actions within ten (10) working days from the end of the inspection, it will be assessed as failed.
4. Issuance of the Certificate/notice of failure
a) Within three (03) working days from the end of the inspection, the inspecting authority shall issue the Certificate (physical and/or electronic copy) to each vehicle according to the Appendix VII to this Circular;

Article 14. Issuance of the Certificate and inspection stamp in case of periodic inspection
1. The repairing workshop, owner or operator of the vehicle shall prepare 01 application for inspection as prescribed in Article 10 of this Circular and submit it to the inspecting authority, whether in person or by post or via public service portal.
2. The inspecting authority shall receive and inspect composition of the application for inspection and instruct the repairing workshop, owner or operator of the vehicle to complete the application (if the application is inadequate) within one (01) working day.
3. The inspecting authority shall carry out a site inspection of the component or vehicle in accordance with the corresponding national technical regulation.
a) If the component or vehicle and the application for inspection conform to the corresponding national technical regulation, the inspecting authority shall initiate the procedures for issuing the Certificate as prescribed in point a clause 4 of this Article;
b) In case the component, vehicle or application for inspection fails to conform to the corresponding national technical regulation.
The repairing workshop, owner or operator of the vehicle is permitted to take corrective actions no more than once.
If the repairing workshop, owner or operator of the vehicle fails to take corrective actions within ten (01) working day from the end of the inspection, it will be assessed as failed.
4. Issuance of the Certificate/notice of failure and inspection stamp

b) If the result is failed, within one (01) working day from the date of receiving the failed result, the inspecting authority shall issue a notice of failure to each component or vehicle according to the Appendix X to this Circular.
Article 15. Re-issuance of the Certificate
1. An unexpired Certificate will be re-issued if it is lost or damaged or has errors or the enterprise’s address or name is changed.
2. Application for re-issuance
An application form for re-issuance of the Certificate, which is made by the manufacturer, importer, repairing workshop, owner or operator of the vehicle using the form in the Appendix XI to this Circular.
3. Procedures
a) The manufacturer, importer, repairing workshop, owner or operator of the vehicle shall prepare 01 application for inspection as prescribed in clause 2 of this Article and submit it to the inspecting authority, whether in person or by post or via public service portal;
b) The inspecting authority shall inspect the application, receive it and return the result within one (01) working day. In case the application is invalid, the inspecting authority shall instruct the applicant to complete within the working day;
c) The inspecting authority shall re-issue the Certificate (physical and/or electronic copy) to each vehicle according to the Appendix VII to this Circular or issue a notice of its failure to re-issue the Certificate in case the application is still unsatisfactory.

Article 16. Revocation of the Certificate
1. The Certificate shall be revoked in the following cases:
a) The inspecting authority has issued a notice of expiry of the Certificate as prescribed in point b clause 2 Article 17 of this Circular (except for the case where the vehicle has been issued with a new Certificate or new inspection stamp);
b) The owner or operator of the vehicle, manufacturer, importer or repairing workshop is found forging the application for inspection.
2. The inspecting authority shall issue a notice of expiry of the Certificate, send it to related authorities as prescribed and revoke the Certificate in case the physical Certificate still exists.
Article 17. Use and effective period of the Certificate and inspection stamp
1. Use of the certificate and inspection stamp
a) The Certificate issued to a component shall be used as the basis for assembly on a vehicle;
b) The Certificate (physical or electronic copy) issued to a competent or vehicle shall be only used to follow customs procedures, register the vehicle or circulation;

2. Effective period of the Certificate and inspection stamp
a) The effective period of the Certificate and inspection stamp issued with the inspection frequency is provided in the Appendix II to this Circular;
b) The Certificate shall cease to have effect in any of following cases:
The vehicle has been issued with a new Certificate or new inspection stamp;
Actual specifications of the vehicle are different from those on the issued Certificate;
The vehicle is out of order due to an accident, natural disaster or act of damage or its bogie or its body's load-bearing steel structure is deformed during the vehicle storage or transport to the extent that technical safety and environmental protection requirements are not satisfied as prescribed.
Chapter IV
RESPONSIBILITIES OF ORGANIZATIONS AND INDIVIDUALS
Article 18. Responsibilities of Vietnam Register

a) Actual specifications of the vehicle are different from those on the issued Certificate;
b) The vehicle is out of order due to an accident, natural disaster or act of damage or its bogie or its body's load-bearing steel structure is deformed during the vehicle storage or transport to the extent that technical safety and environmental protection requirements are not satisfied as prescribed.
2. Carry out an irregular inspection:
a) When the competent authority finds that the vehicle is suspected of not conforming to the corresponding applied standard or national technical regulation;
b) At the request of a competent authority.
If any violation is found during the irregular inspection as prescribed in this clause, the inspecting authority shall make a minutes of the case and report it to the competent authority.
3. Collect charges and fees for registration and inspection services in accordance with applicable regulations and return the Certificate or issue a notice of failure as a manufacturer, importer, repairing workshop, vehicle owner or operator has completely discharged their financial obligations as prescribed.
Article 19. Responsibilities of manufacturers, importers, repairing workshops, vehicle owners and operators
1. Every manufacturer shall:

b) Take responsibility for quality of components and vehicles it manufactures and assembles; provide warranty on manufactured and assembled components and vehicles;
c) Maintain essential equipment serving the manufacture and ensure that it works in good condition in accordance with the manufacturer’s regulations;
d) Comply with applicable regulations, standards and national technical regulations when manufacturing and assembling components and vehicles; make preparations necessary for the inspection of components and vehicles as per applicable national technical regulations;
dd) Cooperate with the inspecting authority and provide information upon request in the course of irregular inspection;
e) Surrender the physical Certificate and inspection stamp when receiving the revocation notice of the inspection authority (except the case of loss).
2. Every importer shall:
a) Take legal responsibility for origin and quality of imported components and vehicles;
b) Comply with applicable regulations, standards and national technical regulations when importing components and vehicles; cooperate with relevant parties to make preparations necessary for the inspection of components and vehicles as per applicable national technical regulations;
c) Issue a written notice and surrender the Certificate and inspection stamp to the inspecting authority when exporting temporarily imported and re-exported vehicles or receiving the revocation notice of the inspection authority (except the case of loss).

a) Inspect operating status of the vehicle so as for it to ensure technical safety quality and environmental safety inspection before moving on rail tracks;
b) Take responsibility for repairing and maintaining vehicles in accordance with national technical regulation on technical safety quality and environmental safety inspection between two inspections by the inspecting authority;
c) Monitor and inspect components and vehicles brand new manufactured, assembled and imported for the first time that are undergoing a running test;
d) Provide internal standard and vehicle repair process to the inspecting authority prior to the initial periodic inspection and upon change of internal standard or vehicle repair process;
dd) Take responsibility for quality of manufactured and assembled components and vehicles; monitor the compliance with standards and vehicle repair process at all levels for periodically repaired vehicles;
e) Store technical documentation, quality certificates, Certificates and inspection stamps, and produce them at the request of competent authorities;’
b) Report to the inspecting authority when actual specifications of the vehicle are different from those on the issued Certificate; when the vehicle is out of order due to an accident, natural disaster or act of damage or its bogie or its body's load-bearing steel structure is deformed during the vehicle storage or transport to the extent that technical safety and environmental protection requirements are not satisfied as prescribed; when the vehicle’s structure, shape, and functions is changed in addition to the changes specified in clause 1 Article 7 of this Circular;
h) Cooperate with the inspecting authority and provide information upon request in the course of irregular inspection; share and provide data on the operating vehicle in annual use to the inspecting authority;
i) Surrender the physical Certificate and inspection stamp when receiving the revocation notice of the inspection authority (except the case of loss).

a) Build a quality management system to maintain quality of modified and repaired vehicles; build a vehicle quality inspection process;
b) Take responsibility for quality of vehicles it modifies and repairs; provide warranty on vehicles it modifies and repairs;
c) Maintain essential equipment serving the manufacture and ensure that it works in accordance with the manufacturer’s regulations;
d) Comply with standards and processes for vehicle modification and repair at all levels promulgated by the vehicle owner; comply with applicable regulations and national technical regulations in the course of vehicle repair; make preparations necessary for the inspection of vehicles as per applicable national technical regulations;
dd) Be subject to the supervision by the vehicle owner and/or vehicle operator in terms of quality and compliance with standards and vehicle repair processes at all levels;
e) Cooperate with the inspecting authority and provide information upon request in the course of irregular inspection;
g) Surrender the physical Certificate and inspection stamp when receiving the revocation notice of the inspection authority (except the case of loss).
5. Manufacturers, importers, repairing workshops, vehicle owners and operators shall take responsibility for the legality and accuracy of the documents in applications for inspection and provide adequate relevant information; pay charges and fees for registration and inspection services and other costs in accordance with prevailing regulations.

Article 20. Effect
1. This Circular comes into force from March 15, 2024.
2. The following Circulars are repealed:
a) Circular No. 29/2018/TT-BGTVT dated May 14, 2018 of the Minister of Transport.
b) Circular No. 10/2022/TT-BGTVT dated June 23, 2022 of the Minister of Transport.
3. Articles, clauses and points in the following Circulars are repealed:
a) Article 1 and clauses 1, 2 and 3 Article 3 of the Circular No. 32/2020/TT-BGTVT dated December 14, 2020 of the Minister of Transport.
b) Article 1 of the Circular No. 01/2022/TT-BGTVT dated January 12, 2022 of the Minister of Transport.
Article 21. Transition clause

2. As any of the regulations referred to in this Circular is amended or replaced, the newest one shall prevail.
Article 22. Implementation
Chief of the Ministry Office, Chief Inspector of the Ministry, Directors General of Departments, Director General of Vietnam Railway Authority, Director General of Vietnam Register, Directors of Departments of Transport and Directors of Departments of Transport and Construction of provinces and central-affiliated cities, heads of agencies, units and individuals concerned are responsible for the implementation of this Circular./.

APPENDIX I
INSPECTED ITEMS OF END OF TRAIN DEVICES

An end of train device must:
1. control brake pipe pressure at the rear car of the train.
2. control the car coupling during train operation.
3. record brake pipe pressure at the rear car of the train during its operation.
4. control the brake pipe air release at the rear car of the train to initiate an emergency brake application.
5. give rear signals.
II. Inspected items
1. The end of train device should be compact, have a hard cover and designed in a manner that allows easy installation, use, repair and maintenance. It must operate normally in such extreme weather events as rain, sun or storm wind and withstand shaking if installed on the locomotive or cars.
2. The end of train device should clearly display information and such information should be read with the naked-eye in daylight or light at night.

4. The end of train device should warn (by sound and light) the train driver if the brake pipe pressure at the rear car of the train is less than:
a) 4.6 bar in case the train supplies air with a 5-bar brake pipe pressure;
b) 5.6 bar in case the train supplies air with a 6-bar brake pipe pressure.
5. The end of train device should control the brake pipe air release at the rear car of the train to initiate an emergency brake application. An emergency brake application command from the front unit of the device shall activate the emergency air valve at the rear of the train within 5 seconds. The rear unit, upon receipt of the command, shall open the emergency air valve and hold it open for from 15 to 70 seconds.
6. The end of train device must transmit information, data and emergency brake application command of the train driver between the rear unit and the cab unit using radio waves continuously during normal operation of the train. The radio frequencies must be licensed by a competent authority.
7. The radio waves shall be transmitted from the rear unit to the cab unit at a distance recommended by the manufacturer and such distance shall not be less than 1,000m.
8. The battery voltage shall comply with manufacturer’s regulations. The battery capacity shall satisfy the following requirements:
a) The power shall be supplied to a brand new imported or assembled end of train device in such a manner as to ensure that it operates continuously for at least 36 hours;
b) The power shall be supplied to the end of train device that is being operated and used in such a manner as to ensure that it operates continuously for at least 20 hours.

10. Regarding the end of train device that has a motion sensor, the cab unit shall display signals on the screen to warn the train driver of the status of the last car during train operation.
11. Regarding the end of train device connected to GPS and axle counter on railways, the cab unit shall display data to assist the train driver in monitoring the integrity, length and change of length of the train during its operation.
12. The end of train device shall accurately record and store the brake pipe pressure at the rear car of the train during its operation. The recorded data shall ensure the continuity. The device memory capacity must be enough to record data for at least 55 hours. Data stored in the end of train device database must be exported and loaded to a computer.
