ISSUING PROVISION ON DOSSIER HANDLING PROCESS REGARD TO REGISTRATIONFOROPENINGUNIVERSITY, COLLEGE LEVEL TRAINING DISCIPLINES AT THE MINISTRY OF EDUCATION AND TRAINING

Pursuant to the Government’s Decree No.178/2007/ND-CP December 03,2007 on providing for functions, duties, authorities and organizational structure of ministries and ministerial agencies;
Pursuant to the Government’s Decree No.32/2008/ND-CP of March 19,2008 on providing for functions, duties, authorities and organizational structure of the Ministry of Education and Training;
Pursuant to the Ministry of Education and Training’s Circular No. 08/2011/TT-BGDDT of February 17, 2011 on providing for conditions, dossier, registration process of opening training disciplines, suspending enrolment, revoking decision of opening university, college level training disciplines;
At proposal of the Head of Department of Education and Training,
DECIDES:
Article 1. Issuing together this Decision is provisions on dossier handling process regard to registration for opening university, college level training disciplinesat the Ministry of Education and Training.
Article 2. This Decision takes effect from the signing date.
This Decision replaces the regulation on process, conditions and dossier of registration for opening university, college level training disciplines in the May 09, 2007 Decision No.2368/QD-BGDDT of Minister of Education and Training.
Article 3. Chief of Office, Director General of Department of university education, Heads of relative agencies under the Ministry of Education and Training, Heads of university education centers shall be responsible for the implementation of this Decision.

PROVISION
ON DOSSIER HANDLING PROCESS REGARD TO REGISTRATION FOR OPENING UNIVERSITY, COLLEGE LEVEL TRAINING DISCIPLINES AT MINISTRY OF EDUCATION AND TRAINING
(Issuing together the March 23, 2011 Decision No. 1146 /QD-BGDDT of the Minister of Education and Training)
I. Dossier receiving
1. After having opinion certifying real conditions of team of tenuredlecturers, equipments for training, library from Department of Education and Training, opinion on training program of the evaluation council of training program, training centers, who register for opening training disciplines, sends 03 sets of registeration dossiers of opening university, college level training disciplines,having attached files of documents in CD disk to one-door section of the Office of Ministry of Education and Training.
2. The one-door section of the Ministrial Office is responsible for receiving dossiers, examining the regular and writing 02 dossier receipts (Annex I), 01 receipt shall be transferred to the training center, 01 shall be included in dossier sending to Departmentof Education and Training. And concurrent sendding documents files in CD disk to the Department of Information Technology for uploading to the website of Ministry of Education and Training for collecting opinions.
II. Considering dossier and making decision for opening university, college level training disciplines
1. Units taking part in dossier consideration
a) The presiding unit: Department of University Education
b) Coordinating Units: Department of Financial Planning and The Education Quality Verifying and Examination Department.
2. Contents be considered in dossier
Units taking part in appraising are responsible for comparision data in dossier with data of training center public proclaiming in website and evidences reported by training center; actual examination result of Departments of Education and Training of centrally-affiliated cities and provinces; training program appraising result of the training program appraising council and compare to conditions for opening university, college level training disciplines provided in Article 2, Article 3 of the February 17, 2011 Circular No. 08/2011/TT- BGDDT of Minister of Education and Training providing for conditions, dossier and process of opening training disciplines, enrolment suspension, withdrawal of decision of opening university, college level training disciplines in order to consider conditions of opening training disciplines.
3. Process of considering dossier and making decision to open training discipline
3.1. Dossier consideration
a) Time for dossier consideration of requesting for opening university, college level training disciplines is conducted in March, June, September and December annually.
b) From the first to the fifth of the above mentioned months, Department of University Education forwards dossiers of training centers to the units taking part in dossier consideration. Within 30 working days, the units taking part in dossier appraising are responsible for dossiers investigation, comparision with current regulations, sending evaluation opinion in writing (Annex II) to Department of University Education for synthesizing.
c) Department of University Education synthesizes opinions of the evaluation units and opinions of organizations, individuals who contributed on website:
- If dossier of requesting for training permission of the training centers ensures conditions and fully meets requirements under provisions, Departments of University Education submit to Minister of Education and Training for issuing decision of opening university, college level training disciplines.
- If dossier of requesting for training permission of the training centers ensures conditions as provided but still having a number of issues need to be completed, Department of University Education informs in writing to training center about the appraising result and issues need to be completed.
- If dossier of requesting for training permission of the training centers fails to meet conditions, Department of University Education informs in writing about dossier’s status and suggests the training center to continue preparing conditions.
If necessary, Ministry of Education and Training shall organize to reappraise at the training center.
d) Decision of training permission, information official dispatch is transferred to one-door section, MinistrialOffice for sending to the training center.
3.2. Reappraising at the training centers
Time for finishing acts of reappraising at the training center is 15 working days since the date of Ministry of Education and Training sending information official dispatch to the training center for reappraising conditions at the training centers, specifically:
a) After 07 working days, Ministry of Education and Training organizes to reappraise at the training center. Appraising crew comprises: leader representative of Department of University Education (Head of delegation), 01 expert of Department of University Education(secretary), representative of Department of Financial Planning, representative of The Education Quality Verifying and Examination Department, representative of examination delegation of Department of University Education, representative of the agency owning training center (if any);
b) Reappraising crew at the training center examines conditions of opening training disciplines presented in dossier and writes comments in actual appraising Minute. The appraising Minute is necessary to specify opinions of members regard to actual status, ability meeting conditions of training permission (Annex III) and conclusion of appraising crew. The appraising minute is made in 03 original copies, 02 copies are hand to the training center, 01 copy is kept by the appraising crew.
3.3. For the training center informed dossier need to be completed or reappraised at the training center
a) After completing dossier (at the request of Ministry of Education and Training’s official letter suggesting to complete dossier or at conclusion of the appraising crew of Ministry of Education and Training), the training center send 01 set of completed dossier to one-door section, Ministrial Office, the one-door section is responsible for receiving regular dossier and writing 02 completed dossier receipts (Annex IV), 01 receipt is transferred to the training center, 01 receipt is included in dossier sending to Department of University Education.
b) Within 15 working days, since the date of completed dossier receiving, Department of University Education exams dossier, if dossier fully meets conditions as provided, Department of University Education submits to the leader of Ministry for issuing decision of opening university, college level training disciplines; if the training center still fails to meet conditions, Department of University Education reports to the leader of Ministry and sends notification official letter to the training center.
c) Decision of training permission or official letter sending to the training center is transferred to one-door section, Ministrial Office for sending to the training center.
